Senate Concurrent Resolution No. 5—Approving an amend-
ment to the Charter of the City of San Luis Obispo, County
of San Luis Obispo, State of California, ratified by the
qualified electors of the cite at a special election held therein
on the seventh day of June, 1966.
WHEREAS, Proceedings have been had for the proposal, adop-
tion and ratification of an amendment to the Charter of the
City of San Luis Obispo, a municipal corporation in the
County of San Luis Obispo, State of California, as hereinafter
set forth in the certificate of the mayor and city clerk of the
city as follows:
CERTIFICATE OF RATIFICATION BY ELECTORS OF THE CITY OF SAN
LUIS OBISPO OF A CERTAIN CHARTER AMENDMENT

We, the undersigned, Clell W. Whelchel, Mayor of the City
of San Luis Obispo, County of San Luis Obispo, State of Cali-
fornia, and J. H. Fitzpatrick, City Clerk of the City of San
Luis Obispo, do hereby certify and declare as follows:
That the City of San Luis Obispo, a Municipal Corporation
of the County of San Luis Obispo, State of California, now is
and at all times herein mentioned was, a City having a popu-
lation of more than thirty-five hundred (3,500) inhabitants
and less than fifty thousand (50,000) inhabitants, and -has
been, since May 18, 1955, and is now organized and acting
under a Charter adopted under and by virtue of Section 8,
Article XI of the Constitution of the State of California, which
Charter was duly ratified by a majority of the qualified elec-
tors of such City at a special election held for that purpose
on the 4th day of April, 1955, and approved by the Legisla-
ture of the State of California by concurrent resolution filed
with the Secretary of State on the 18th day of May, 1955 (Vol.
2, Statutes 1955, Page 4110).
That in accordance with the provisions of Section 8, Article
XI of the Constitution of the State of California, on its own
motion the Council of the City of San Luis Obispo, being the
legislative body thereof, duly and regularly submitted to the

qualified electors of the said City of San Luis Obispo a certain
proposal for the amendment of the Charter of said City, to
be voted upon by said qualified electors at a Special Municipal
Election held as provided for by law, in said City on the
7th day of June, 1966, which said proposal was designated as
Proposed Charter Amendment.
That said proposed amendment was published and advertised
in accordance with Section 8 of Article XI of the Constitution
of the State of California, in the "Telegram -Tribune," a daily
newspaper of general circulation published, printed and cir-
culated in said City, and being the official newspaper of said
City for said purpose, and in each edition thereof during the
day of publication.
That said proposed charter amendment was submitted to
the electors of said City for adoption and ratification at a
special municipal election duly and regularly held in said
City of San Luis Obispo on the seventh day of June, 1966,
which said date was not less than forty, nor more than sixty,
days after the completion of the advertising in the above men-
tioned official paper of the proposed charter amendment afore-
said. That, in accordance with the provisions of the Elections
Code of the State of California, the Council of the City of
San Luis Obispo had adopted, on March 28, 1966•, Resolution
Number 1537 (1966 Series) wherein it requested the Board
of Supervisors of San Luis Obispo County, California, to order
the consolidation of said Special Municipal Election with the
state-wide primary election held in said County on June 7,
1966; that said consolidation had been so ordered by said
Board of Supervisors and that said special municipal election
was so consolidated with said state-wide primary election held
in said County on said date.
That at said special municipal election a majority of the
qualified electors voting upon said proposed charter amend-
ment voted in favor of the amendment and adopted and rati-
fied the same.
That said Amendment to the Charter so ratified by the elec-
tors of the City of San Luis Obispo is in words and figures as
follows:
"San Inks Obispo Municipal Election Date. Shall Section
300 of the Charter of the City of San Luis Obispo, California,
be amended to read as follows:
Section 300. General Municipal Elections. General Munic-
ipal Elections to fill elective offices shall be held in said City
on the third Tuesday in April in each odd nuinbered year.,,
That the Charter shall be worded as follows:
"Section 300. General Dlnnicipal l',lections• General IIIu-
nicipal Elections to fill elective of{iees s11111 be held in said

That we have compared the foregoing amendment with the
original proposal submitting the same to the electors of said
City and find that the foregoing is a full, true, correct and
exact copy thereof; we further certify that the facts set forth
in the preamble preceding such amendment to the said Charter
are, and each of them is, true.
In witness whereof, we have hereunto set our hands and
caused the corporate seal of said City of San Luis Obispo to
be affixed hereto this 21st day of November, 1966.

the Legislature of the State of California for approval or re-
jection, as a whole without power of alteration or amendment,
in accordance with Section S of Article XI of the Constitution
of the State of California; now, therefore, be it

bly thereof concurring, a majority of all the members elected to
each house voting therefor and concurring therein, That the
amendment to the Charter of the City of San Luis Obispo, as
proposed to and adopted and ratified by the electors of the city,
as hereinbefore fully set forth, is hereby approved as a whole,
without alteration or amendment, as an amendment to and as
part of the Charter of the City of San Luis Obispo.

'lis for your help on Senate Concurrent Resolution No. 5, approv-
ing the recent Curter amendment for the City of San Buis Obispo.
According to the article which appeared in the Telegram Tribune,
your colleagues apparently gave you quite a time when you introduced
the legislation.
I hope that the next time we call upon you for assistance you won't bre
given such a rough time. Anyway, the publicity in our local paper
and on the television station should have convinced even the loyal
opposition that you are on the job for San Luis Obispo.
Of course, it was a source of particular pleasure to me that the first
bill you introduced was for the City of San Luis Obispo. I have placed
Senator Grunsky's letter of january 16, 1967, transmitting two enrolled
copies of the approved legislation, on the Agenda for the next meeft
Of the City Council and I plan to publicly acknowledge your fine assist-
ance on the matter when the item comes up for discussion.
I wish to take this opportunity also to thank you for the copy of Governor
Reagan's recent.stratements on crime which you recently forwarded to
me. Time has not yet permitted me to give it the careful consideration
It deserves, but I will be in touch with you about my thoughts on the
matter. I attended a conference yesterday at the Golden Tee Motel in
Morro Bay which reviewed the progress of the California Department of
Justice and other concerned State and Federal agencies in coordinating
the California Auto Statis system with the newly established Natioml
Crime Information Center, When ilslly implemented, the effectiveness
of law enforcement - local, state and Federal - will be increased sub-
stantially.

Hawever, until adequate legislation is adopted to insure that criminals
who are finally apprehended do not escape the punishment they deserve
either through unrealistic court decisions or inadequate .terms of sen-
tences, the tide in the battle against crime is far from turned.

I would like to take this opportunity to express my personal congratu -
lations to you on being re -elected to the California Senate; San Luis
Obispo is fortunate to be represented by one who has served so long
in the Senate and who will, therefore, .be in a position to assume
greater responsibilities in the coming legislative session.
From time to time the City of San Luis Obispo has occasion to amend
its Charter, the current version of which was first adopted on May
18, 1955. The most recent revision was adopted at a Special Munici-
pal Election held in the City on the 7th day of June, 1966. We are en-
closing a "Certificate of Ratification by Electors of the City of San
Luis Obispo of a Certain Charter Amendment" which amends Section
300 of the Charter, and a proposed Concurrent Resolution approving
the amendment.
We are taking the liberty of furnishing copies of this letter and the
enclosed documents to Nir. Winfield Shoemaker and Mr. William M.
Ketchum, recently elected to represent portions of the City of San
Luis Obispo in the California Assembly.
Your cooperation in introducing the enclosed Resolution for approval
by the legislature, at your earliest convenience, will be appreciated.

SAN LUIS OBISPO, CALIFORNIA, ORDERING, CALLING,
PROVIDING FOR AND GIVING NOTICE OF, A SPECIAL
MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON
TUESDAY, JUNE 7, 1966 FOR THE PURPOSE OF SUB-
MITTING TO THE QUALIFIED VOTERS OF SAID CITY
A PROPOSITION FOR INCREASING THE SALARIES OF
THE MAYOR AND COUNCILMEN, AND A PROPOSITION
FOR CHANGING THE MUNICIPAL ELECTION DATE AND
CONSOLIDATING INITH THE STATE-WIDE DIRECT PRI-
MARY ELECTION TO BE HELD ON THE SAME DATE.
The Council of the City of San Luis Obispo, California, does hereby RESOLVE.
DETERMINE AND ORDER AS FOLLOWS:
1. That a special election be held and the same is hereby called to be held in the
City of San Luis Obispo, California, on Tuesday, the 7th day of June, 1966, for the pur-
pose of submitting to the qualified voters of said City a proposition for increasing the Mayor
and City Councilmen's salaries as hereinafter set forth, and a proposition for amending
the City Charter to provide that the City's general municipal elections will be held on the
third Tuesday in April in each odd numbered year.
2. That the proposition to be voted on to authorize an increase in the Mayor .and
City Councilmen's salaries shall be substantially as follows:
SAN LUIS OBISPO CITY MAYOR AND COUNCIL SALARIES.
Shall the Councilmen of the City of San Luis Obispo, for
their duties as such, receive monthly salaries in accord-
ance with the salary schedules presently or hereinafter

General Law cities, and shall the Mayor, for his duties
as such, receive $150.00 a month more than the salary
paid to a Councilman; such salaries to be subject to
the same rights of the electors to increase or decrease

California, be amended to read as follows:

held in said City on the third Tuesday in April in

5. That the ballot label for the proposition to amend the City Charter to change
the date of the City's general municipal elections shall be substantially as follows:

6. That the Council hereby determines that there will be a substantial savings in
the cost of the elections if the City's general municipal elections, which are now held on
the second Tuesday in April of each odd numbered year, and the School District's elections,
which are now held on the third Tuesday in April of each odd numbered year, are held on
the same date and can be consolidated.
7. That said special election hereby called to be held in the City of San Luis Obispo
on the 7th day of June, 1966 shall be and is hereby ordered consolidated with the State-wide
direct primary election to be held on said date, and within the City of San Luis Obispo the
precincts, polling places and officers of election for the special election hereby called
shall be the same as those provided for said general election.
8. That the Board of Supervisors of the County of San Luis Obispo is hereby re-
quested to order the consolidation of the special election hereby called with said State-wide
direct primary election, and said Board of Supervisors is authorized hereby to canvass the
returns of the special election hereby called, and the elections shall be held in all respects

as if there were only one election, and only one form of ballot, namely the ballots used at
such general election, shall be used. Said Board of Supervisors shall certify the result of
the canvass of the returns of such special election to the Council of the City of San Luis
Obispo, who shall thereupon declare the result thereof.
9. Said propositions shall be designated on the ballot by a letter printed on the left
margin of the square containing the description of the measure, as provided in Section
10231 of the Elections Code of the State of California.
10. That only qualified voters of the City of San Luis Obispo shall be permitted to
vote on the measures at the election hereby called.
11. That said Board of Supervisors is hereby requested to issue instructions to the
County Clerk and Registrar of Voters to take any and all steps necessary for the holding of
said consolidated election.
12. That the City Clerk of the City of San Luis Obispo is hereby directed to file a
certified copy of this Resolution with the Board of Supervisors, the County Clerk and the
Registrar of Voters of the County of San Luis Obispo.
13. That the City Clerk shall certify to the passage and adoption of this Resolution
and shall cause this Resolution to be published once in the San Luis Obispo County Telegram-.L-
Tribune,
elegram=Tribune, a newspaper of general circulation printed, published and circulated in the City
of San Luis Obispo, within fifteen days of the date hereof and not more than sixty days prior
to the 7th day of June, 1966.
14. This Resolution shall take effect upon its adoption.

Gentlemen:
Re: Charter amendments
March 18. 1966
The State Constitution requires that a proposed Charter amendment
(change of election date) must be published within fifteen (15) days
after filing with the City Clerk.
The Elections Code governing consolidation of elections requires
advertising not more than sixty (60) days prior nor less than forty
(40) days prior to the election date.
In order to comply with these two separate advertising requirements,
the Resolution calling the election and consolidating the same will
have to be adopted at an Adjourned regular meeting of the Council
on March 28, 1966..
The City Charter provisions governing Mayor and City Councilmen
compensation (Sections 604 and 702) set the salaries at the existing
amounts and each contain a provision "except to the extent heretofore
or hereafter approved by the electorate, ... " This permits the change
of the Mayor and Councilmen's salaries without amendment of the
Charter, only approval by the electorate. Therefore, the ballot
proposition contains a clause that the changes in salary shall be
effective May 1, 1967, which will be the time that the new term of
office will commence for the elected Mayor and two Councilmen.
Therefore, only the change in the election date, if approved by the
voters, will have to be ratified by the State Legislature before it
goes into effect.
