This guide is not all encompassing; it merely summarizes the major provisions related to candidates running for office in Sacramento County. Candidates, district staff, political committees, and anyone else interested in elective office should not, therefore, rely solely on this booklet; but, should contact Voter Registration and Elections for more detailed information, or seek legal counsel. Member (Elected by area) San Joaquin Delta Community College District and Sierra Community College District are also scheduled for election in November, 1985. Sacramento County residents who are voters of these districts will have an opportunity to vote for candidates, since although trustees qualify by area, they are elected at large. Residents of Sacramento County, however, are eligible to be candidates only in those trustee areas which extend into Sacramento County and which are scheduled for election. 4 CANDIDATE'S CHECKLIST OF DOCUMENTS REgUIRED TO BE FILED Listed below is an informal checklist indicating the various forms required to be filed for candidacy for the different offices. It is the obligation of the candidate to insure that (s)he meets all filing requirements and deadlines. All candidates are urged to file the necessary papers as early as possible in order to avoid last minute rush and confusion, or any misunderstandings. Ad- ditionally, it is recommended that the candidate file all papers involved with his/her candidacy personally. If an aide or assistant is delegated this responsibility, a specific letter of authorization, signed by the candidate, will be required of any person obtaining or submitting nomination documents on behalf of a candidate. NOMINATION PROCEDURE FOR SPECIAL DISTRICT CANDIDATES FIRE PROTECTION DISTRICTS, IRRIGATION DISTRICTS, RECREATION AND PARK DISTRICTS, ATER DISTRICTS, and OMMUNITY SWICESRATS DATE ACTIVITY SCHEDULE July 15 Issuance of Nomination Papers Not more than 113 days prior to the election, upon request, the Registrar of Voters shall issue nomination papers and all other forms required. Some special district offices may also have a limited number of nomination packets available on and after July 15. See page(s) 49 - 50 of this guide for the addresses and telephone numbers of district offices. July 15 Circulation of Nomination Papers through Circulators may obtain signatures to the nomination papers August 9 of any candidate at any time not more than 113 nor less than 88 days prior to the election. Circulators shall be voters in the district, or division, in which the candidate is to be voted on, and may obtain signatures only from registered voters residing within that district, or division. A can- didate may circulate his/her own nomination papers, or (s)he may appoint a circulator. Signatures Required Nomination papers shall be signed by not less than 10 or more than 20 registered voters of the district. July 15 Filing of Nomination Papers through All completed nomination papers must be filed with the Reg - August 9 istrar of Voters, 3700 Branch Center Road, Sacramento, at 5:00 p.m. California 95827, not later than 5:00 p.m. on August 9, 1985. Candidate's Statement A candidate may also file with his/her nomination papers a candidate's statement not exceeding 200 words in length (unless a maximum of 400 words has been specifically author- ized by the governing board of the district). See pages 18 - 20 for further information and cost estimate. Withdrawal of Candidate No candidate shall withdraw his/her nomination paper after 5:00 p.m. on August 9, 1985. 6 NOMINATION PROCEDURE FOR SPECIAL DISTRICT CANDIDATES (Continued) August 14 Extension, if Incumbent Does Not File at 5:00 p.m. If nomination papers for an incumbent director are not filed by 5:00 p.m. on the 88th day before the election, the voters shall have until 5:00 p.m. on the 83rd day before the elec- tion, to nominate candidates other than the incumbent for such office. Refer to Submittal of Campaign Disclosure Statements schedule All candidates for public office are required to file cam - on page 23 paign disclosure statements. See pages 23 - 25 of this guide for reporting dates. TIE VOTE PROCEDURE If a tie vote makes it impossible to determine which of two or more candidates have been elected, the Registrar of Voters shall notify the governing body of the district thereof and such governing body shall forthwith notify the candi- dates who have received the tie votes to appear before it either personally or by representative at a time and place designated by the governing body. The governing body shall at that time and place determine the tie by lot and the results thereof shall be declared by the governing body. The candidate so chosen shall take office and serve as though elected at the preceding general district election. PROCEDURE IF NO ELECTION If only one person has been nominated for any elective office to be filled at the election, or no person has been nominated for any such position, and if a petition signed by 10% or 50 voters of the district (or division, if appli- cable), whichever is the smaller number, has not been presented to the Regis- trar of Voters by 5:00 p.m. on August 14, 1985, requesting that a general dis- trict election be held for the office(s), an election shall not be held. If there is no election for a position due to insufficient or no nominees, the Registrar of Voters shall submit a certificate of the facts to the super- vising authority and request that the supervising authority at a regular or special meeting held prior to the last Monday before the last Friday in November in which the election is held, appoint to such office or offices the person or persons, if any, who have been nominated. If no person has been nominated for any office, the supervising authority shall appoint any person to the office who is qualified on the date when the election would have been held. The person(s) appointed shall qualify and take office and serve exactly as if elected at a general district election for such office. (EC 23520) 7 NOMINATION PROCEDURE FOR SPECIAL DISTRICT CANDIDATES (Continued) ASSUMPTION OF OFFICE Elected and appointed officials shall take office at noon on the last Friday in November, following the general district election (November 29, 1985). EXCEPTION: Officials elected or appointed to the district board of an Irriga- tion District (district governed by Water Code Section 21101) take office on the last Friday in December (December 27, 1985). Prior to taking office, each elective officer shall take the official oath and execute such bond as may be required by the principal act. A NOMINATION PROCEDURE FOR LANDOWNER DISTRICT CANDIDATES App 7 ca bl e toa�r_7Ts rT c , ar=6eMa W ate r gency, and Omochumne-Hartnell Water District only Except as otherwise provided in the principal act of the district, the election process for landowner districts remains the same as for resident voting districts. The primary differences as pertains to candidacy are: 1. Candidates qualifying for the ballot in landowner election are required to obtain 10-20 signatures of owners of land within the district, or division, if any. 2. Only landowners are eligible to vote in a landowner district election. The principal act of a landowner voting district provides for the manner in which the votes are to be distribu- ted; i.e., assessed value of land, or acreage of land owned. 3. Landowner voting districts cannot be consolidated with a resident voter election. 9 NOMINATION PROCEDURE FOR SCHOOL GOVERNING BOARD CANDIDATES DATE ACTIVITY SCHEDULE July 15 Obtaining Nomination Papers On and after July 15, 1985, nomination papers for the office of governing board member, or trustee of a community college district, will be available at Voter Registration and Elections, 3700 Branch Center Road, Sacramento, California 95827, between the hours of 8:00 a.m. to 5:00 p.m., Monday through Friday. July 15 Filing of Nomination Papers through Nomination papers must be filed at Voter Registration and August 9, Elections, 3700 Branch Center Road, not later than 5:00 p.m. on at 5:00 p.m. August 9, 1985. Candidates for school district offices file a "Declaration of Candidacy" and the signatures of voters are not required. Candidate's Statement A candidate may also file with his/her nomination papers a candidate's statement not exceeding 200 words in length (un- less a maximum of 400 words has been specifically authorized by the governing board of the district) . See pages 18 - 20 for further information and cost estimate. Withdrawal of Candidate No candidate may withdraw his/her "Declaration of Candidacy" after the close of the nomination period. August 14 Extension if Incumbent Does Not File 5:00 p.m. If nomination papers for an incumbent governing board member or trustee are not filed by 5:00 p.m. on August 9, 1985, the filing period is extended until 5:00 p.m. on August 14, 1985, to nominate candidates other than the incumbent for such office. Refer to Submittal of Campaign Disclosure Statements schedule All candidates for public office are required to file campaign on page 23 disclosure statements. See pages 23 - 25 of this guide for re- porting dates. 10 TIE VOTE PROCEDURE If a tie vote makes it impossible to determine which of two or more candi- dates has been elected, the Superintendent of Schools having jurisdiction shall so certify to the governing board. The governing board may either call a runoff election or determine the winner or winners by lot. Prior to the conduct of any school board election, the governing board of each school district shall establish which of such procedures is to be employed by the district in the event of a tie vote. PROCEDURE IF NO ELECTION If only one person has been nominated for each position of governing board member to be filled at that election, or no person has been nominated for any such position, and if a petition signed by 10% or 50 voters of the district (or division, if applicable), whichever is the smaller number, has not been presented to the Registrar of Voters by 5:00 p.m. on August 14, 1985, requesting that a school district election be held for the office(s), an election shall not be held. If, pursuant to Education Code Section 5326, an election is not held, the qualified person nominated shall be seated at the organizational meeting of the board. If there is no nominee for an office, the governing board of the district shall appoint a qualified person at a meeting held prior to the day fixed for the election. Prior to making any such appointment to office, the governing board of the district shall publish a notice, once in a newspaper of general circulation in the district, stating that the board intends to make an appointment and informing persons of the procedure available for applying for the office. The person(s) so appointed shall be seated at the organizational meeting of the board as if elected at a dis- trict election. ASSUMPTION OF OFFICE Elected and appointed school officials will take office on November 29, 1985. 11 BALLOT DESIGNATION The ballot designation is the word, or group of not more than three (3) words, which will appear on the ballot under the candidate's name, designating the principal profession, vocation, or occupation of the candidate. The ballot designation that a candidate may use is governed by Elections Code Section 10211 which, in part, states the following. At the option of the candidate, immediately under the name of each candidate and not separated from the name by any line, may appear only one of the fol- lowing designations: 1. Words designating the elective city, county, district, state, or federal office which the candidate holds at the time of filing the nomination papers to which (s)he was elected by vote of the people. 2. The word "incumbent" if the candidate is a candidate for the same office which (s)he holds at the time of filing the papers, and was elected to that office by a vote of the people. 3. No more than three words designating the principal professions, vocations, or occupations of the candidate. For purposes of this section, all Cali- fornia geographical names shall be considered to be one word. 4. The phrase "appointed incumbent" if the candidate holds an office by vir- tue of appointment and the candidate is a candidate for election to the same office; or, if the candidate is a candidate for election to the same office or to some other office, the word "appointed" and the title of the office. In either instance, the candidate may not use the unmodified word "incumbent" or any words designating the office unmodified by the "appointed." However, the phrase "appointed incumbent" shall not be re- quired of a candidate who seeks reelection to an office which (s)he holds and to which (s)he was appointed, as a nominated candidate, in lieu of an election, pursuant to Elections Code Section 23520 or Education Code Sec- tions 5326-28. The Registrar of Voters, pursuant to Elections Code Section 10211(b) shall NOT accept a ballot designation which: 1. Would mislead the voter. 2. Would suggest an evaluation of a candidate, such as outstanding, leading, expert, virtuous, or eminent. 3. Abbreviates the word "retired" or places it following any word or words which it modifies. 4. Uses a word or prefix, such as "former" or "ex," which means a prior status. The only exception is the use of the word "retired." 5. Uses the name of any political party, whether or not it has qualified for the ballot. 12 BALLOT DESIGNATION (Continued) 6. Uses a word or words referring to a racial, religious, or ethnic group. 7. Refers to any activity, which activity is prohibited by law. Additionally, no title or degree shall appear on the same line on a ballot as a candidate's name, either before or after the candidate's name, in the case of any election to any office. The ballot designation will be checked and verified by Voter Registration and Elections prior to the printing of voters pamphlets and sample ballots. Each candidate will be sent a letter indicating his/her ballot designation, and requesting the Registrar of Voters be notified immediately, in writing, of any omissions or errors. If, upon checking the nomination papers, the Registrar of Voters finds the des- ignation to be in violation of any of the restrictions, the Registrar of Voters shall notify the candidate by certified mail, return receipt requested. The candidate shall, within three days from the date of receipt of the notice, ap- pear before the Registrar of Voters and provide an alternate designation. In the event the candidate fails to provide an alternate designation, no designa- tion shall appear after the candidate's name. No designation given by a candidate shall be changed by the candidate after the final date for filing nomination papers, except as specifically requested by the Registrar of Voters. Ballot designations will be printed in 8 -point roman uppercase and lowercase type except that if the designation selected is so long that it would conflict with the space requirements of Elections Code Sections 10207 and 10221, the Registrar of Voters shall use a type size for the designation for each candidate for that office sufficiently smaller to meet these requirements. 13 CANDIDATE'S STATEMENT (Elections Code Section 0012) Each candidate for nonpartisan elective office may prepare a candidate's state- ment on an appropriate form provided by the Registrar of Voters. The candi- date's statement is designed to acquaint voters with a candidate's qualifica- tions for the office (s)he is seeking. This statement is incorporated into the sample ballot, generally at the candidate's expense, and will be mailed to all registered voters in the district eligible to vote for that particular candi- date. Time period for The filing period for the candidate's statement is filing: July 15, 1985, to August 9, 1985, at 5:00 p.m. The filing period will be extended (for candidates other than the incumbent) to August 14, 1985, at 5:00 p.m., if the incumbent does not file. THE CANDIDATE'S STATEMENT MUST BE FILED WITH THE NOMINATION PAPERS. Where: Voter Registration and Elections 3700 Branch Center Road Sacramento, California 95827 Contents: The statement may contain the name, age, and occupation of the candidate and a brief description of no more than 200 words (unless a maximum of 400 words is specifically authorized by the district governing board) of the candidate's education and qualifications expressed by the candidate himself/hers;lf. The spacing is to be uniform and conform to the guidelines shown in the "Candidate's Statement Guidelines." Restrictions: The candidate's statement shall not include the party af- filiation of the candidate, nor membership or activity in partisan political organizations. Withdrawal: The statement may be withdrawn, but not change during the period for filing nomination papers ana tjntT1 5:00 p.m. of the next working day after the close of the nomination period. Confidentiality Notwithstanding any other provisions of law, candidate's of Statements: statements filed pursuant to Section 10012 of the Elec- tions Code shall remain confidential until the expiration of the filing deadline. (EC 10012.7) Challenge of Candidate's statements are available for viewing after the Contents: deadline for filing has passed. There is then a ten-day public examination period whereby the documents may be 14 CANDIDATE'S STATEMENT (Continued) Challenge of reviewed and copies obtained for $0.50 per page. Also, Contents: during this 10 -calendar day examination period, any voter (Continued) of the affected jurisdiction may take legal action to challenge the contents of the candidate's statement pur- suant to Election Code Section 10013.5. Cost: Because of the many unknown factors involved in printing, handling, and mailing, and the number of,candidates fil- ing the statement, it is difficult to determine, prior to the election, the exact cost to each candidate who avails himself/herself of this service. The cost estimates pro- vided on pages 18 - 20 of this guide are based upon his- torical data and a projection of statistics available approximately six months prior to the election. Payment of Advance Payment Candidate's Statement The governing body of a district or jurisdiction may re - Charges: quire each candidate filing a candidate's statement to pay in advance his or her pro rata share as a condition of having his or her statement included in the voters' pamphlet. If such determination is made, each candidate will be required to deposit with the district in advance the estimated pro rata cost of the candidate's statement. When advance payment is required by a district, the Reg- istrar of Voters will require presentation of a receipt for payment prior to or at the time of acceptance of nomination papers and candidate's statement. Overpayment/Underpayment In the event of overpayment of actual costs, any ex- cess shall be refunded to the candidate within thirty days from the date the district receives a billing for election charges. In the event of underpayment, the candidate shall be billed and required to pay the additional costs upon receipt of the billing. Char es to be Billed After Election Advance Payment Not Required) If a district or jurisdiction does not require advance payment for submission of a candidate's statement, each candidate will be billed, after actual election costs have been determined, the pro -rated share of printing, handling, postage, and translation incurred. Voter Registration and Elections will pay costs for the candidate's statement and will, in turn, bill the district. The district, in turn, will bill the candidates who submitted a statement. The candidate is to make payment directly to the district. 15 CANDIDATE'S STATEMENT (Continued) Preparation of In order to insure uniformity of candidate's statements, Candidate's the candidate must prepare the statement as follows: Statement: 1. Type statement exactly as you want it to appear. When prepared in accordance with these standards, statements are printed exactly as submitted. 2. Submit typed, double-spaced copy only. Use upper and lower case type. 3. Do not use any unusual spacing or underscoring on the statement. 4. Check statement for errors in spelling, punctuation, and grammar. 5. Confine the statement to the number of words limita- tion. The limit is usually 200 words, but may be 400, depending upon authorization from the governing body. 6. Do not include any party affiliation. 7. Do not include membership or activity in partisan political organizations. The Registrar of Voters shall reject any statement which contains any obscene, vulgar, profane, scandalous, libelous or defamatory matter, or any language which in any way incites, counsels, promotes or advocates hatred, abuse, vio- lence or hostility toward, or which tends to cast ridicule or shame upon any per- son or group of persons by reason of sex, race, color, religion, or manner of worship, or any language or matter the circulation of which through the mail is prohibited by Congress. In the case where a candidate submits a statement which is not in conformance with the guidelines provided (i.e., typed in all caps, underscoring, unusual spacing, or capitalization of some words for emphasis purposes), the Registrar of Voters will instruct the printer to ignore any special emphasis placed on words or phrases, and type -set the statements utilizing a uniform format. Notwithstanding the above guidelines, nothing shall be deemed to make any state- ment or author thereof free or exempt from any civil or criminal action or penal- ty because of any false, slanderous, or libelous statements offered for printing. GUIDELINES FOR DETERMINING NUMBER OF WORDS IN CANDIDATE'S STATEMENT Listed below are the guidelines utilized by Voter Registration and Elections in determining the number of words submitted on any document (such as the candi- date's statement) whose contents is limited by statute: 16 CANDIDATE'S STATEMENT (Continued) 1. Signs and symbols are not counted. 17 CANDIDATE'S STATEMENT COST ESTIMATE FOR PRINTING IN SAMPLE BALLOT The Elections Code specifies that candidates may submit a statement to be included in the sample ballot not to exceed 200 words, unless the govern- ing body of the district specifically authorizes an increase to 400 words. Costs will vary depending upon the number of ballot types in the district, the number of pages in the various sample ballots, the number of registered voters in the ballot types, and the number of candidates who have state- ments. Actual costs may deviate significantly from the estimate because of these variables. Candidates are responsible for actual costs, not estimated costs. The estimated costs shown below are for the Sacramento County portion of districts only. The districts marked with an asterisk extend into one or more counties, in addition to Sacramento County. When a district overlaps into another county, the candidate's statement will be printed in each and every county in which the district lies. This dec- laration shall be signed under penalty of perjury and shall be filed in the same manner and in the same places as a campaign statement." 23 THRESHOLD STATEMENTS (Continued) Therefore, if a candidate for a position scheduled to appear on the November 5, 1985, ballot does not anticipate spending $500 or more on his/her campaign, files FPPC Form 470 on or before September 12, 1985, and marks the statement "Final," the candidate will not be required to file the 3rd or 4th threshold, or the semi-annual statement due not later than January 31, 1986, UNLESS the $500 threshold requirements are reached. Candidate's statement fees are exempt in computing the $500 threshold level IF THE MONIES WERE PAID FROM PERSONAL FUNDS, as opposed to campaign contri- bution funds. If a candidate spends $500 (excluding candidate's statement fee), then the candidate's statement charges are to be included in expenses on FPPC Form 430 or Form 490, whichever is applicable. SEMI-ANNUAL CAMPAIGN DISCLOSURE STATEMENTS All candidates and committees are required to file semi-annual campaign dis- closure statements IF THEY MADE ANY expenditures or contributions in the six- month semi-annual period. (Note: Candidates for the November 5, 1985, elec- tion who file final statements prior to the 3rd threshold period, will not be required to file a semi-annual statement covering the period July 1, 1985, through December 31, 1985, unless expenditures/contributions reach the $500 threshold.) Elected officeholders who receive $100 a month or more in compensation must file a semi-annual statement REGARDLESS OF ANY ACTIVITY they had. Except: Judicial officers, UNLESS they received/made ANY contribu- tions/expenditures. Except: If a candidate in a six-month period filed an exemption at the time (s)he filed nomination papers, and stays under the $500 threshold level, the candidate will not have to file semi-annual statement for THAT period. FILING IS THE RESPONSIBILITY OF CANDIDATE AND/OR COMMITTEE It is the responsiblity of candidates and/or committees to be aware of and to file the required campaign disclosure statements in a timely manner. As a courtesy, Voter Registration and Elections mails a reminder notice to can- didates who, based on nomination documents, appear to have a campaign disclo- sure filing requirement. This notice is mailed approximately ten days prior to a campaign disclosure filing deadline. With the inception of threshold filing periods/requirements, however, only the candidate or committee can ascertain whether they do or do not have a threshoTU77ing requirement. Forms and assistance in completing the forms are available by telephoning Voter Registration and Elections, Campaign Reporting Unit, at 366-2051. 24 LATE CONTRIBUTION REPORTS "Late contribution" means any contribution, including a loan, which totals in the aggregate one thousand dollars ($1,000) or more from a single source that is made to or received by a candidate, controlled committee, or committee formed or existing primarily to support or oppose a candidate or measure before the date of the election at which the candidate or measure is to be voted on but after the closing date of the last campaign statement required to be filed by the recipient before the election. (In other words, for the November elec- tion, a contribution made or received between October 20, and November 4, 1985). Contributions made to officeholders or candidates not currently running for election and to general purpose committees are not "late contributions." Every candidate or committee that makes or receives a late contribution shall report the late contribution to each office with which the candidate is re- quired to file its next campaign statement. a. The donor (candidate, committee, or individual that makes the late con- tribution) shall report his or her full name and street address and the full name and street address of the person to whom the late contribution has been made, and the date and amount of the late contribution. b. The recipient of the late contribution shall report his or her full name and street address, and the date and amount of the late contribution. The recipient shall also report the full name of the contributor, his or her street address, occupation, and the name of his or her employer or, if self-employed, the name of the business. c. A late contribution shall be reported by mailgram, telegram, any over- night guarantee delivery service, or personal delivery within 48 hours of the time it is made in the case of the candidate or committee that makes the contribution, and within 48 hours of the time it is received in the case of the recipient of the contribution. d. A late campaign contribution shall be reported on subsequent campaign statements without regard to reports filed pursuant to this section. e. A late contribution need not be reported nor shall it be deemed accepted if it is not cashed, negotiated, or deposited, and is returned to the con- tributor within 48 hours of receipt. f. A late contribution report filed pursuant to this section shall be done in addition to any other campaign statement required to be filed. 25 PENALTIES INVOLVED IN FAILURE TO COMPLY WITH CAMPAIGN DISCLOSURE REQUIREMENTS Government Code Section 91013, provides as follows: "(a) If a person files an original statement or report, after any deadline imposed by this act he shall, in addition to any other penalties or remedies established by this act, be liable i n the amount of ten dollars ($10) per day after the deadline until the statement or report is filed. Liability need not be enforced by the filing officer if on an impartial basis he determines that the late filing was not willful and that enforcement of the liability will not further the purposes of the act, except that no liability shall be waived if a statement or report is not filed within 10 days, or after the filing officer has sent specific written notice of the filing requirement. (b) If any person files a copy of a statement or report after any deadline imposed by this act, he shall, in addition to any other penalties or remedies established by this chapter, be liable in the amount of ten dollars ($10) per day, starting 10 days, or five days in the case of the second pre-election campaign statement, after the officer has sent specific written notice of the filing requirement and until the statement is filed. (c) The officer shall deposit any funds received under this section into the general fund of the jurisdiction of which he is an officer. No liability under this section shall exceed the cumulative amount stated in the late statement or report, or one hundred dollars ($100), whichever is greater." W CODE OF FAIR CAMPAIGN PRACTICES Chapter 855, Statutes of 1982, established a "Code of Fair Campaign Prac- tices" in California which could be voluntarily subscribed to by candidates for public office. The Registrar of Voters is required, at the time the individual filed nomi- nation papers or other papers evidencing intentions to become a candidate for public office, to provide each candidate with a copy of the provisions of the Chapter, and a form on which to subscribe to the Code. Subscription to the Code is voluntary. Completed forms are to be filed with the Registrar of Voters, and shall be retained for public inspection until 30 days after the election. For your information, pages 28 and 29 of this guide contain a sample copy of the form and the provisions of Code. Reference: Elections Code Sections 12500 - 12526 27 PROVISIONS OF THE CODE OF FAIR CAMPAIGN PRACTICES as found in Chapter 6 of Division 9 of the California Elections Code Chapter 6. Fair Campaign Practices Article 1. General Intent 12500. The Legislature hereby declares that the purpose of this chapter is to encourage every candidate for public office in this state to subscribe to the Code of Fair Campaign Practices. It is the ultimate intent of the Legislature that every candidate for public office in this state who subscribes to the Code of Fair Campaign Practices will follow the basic principles of decency, honesty, and fair play in order that. after vigorously contested, but fairly conducted campaigns, the citizens of this state may exercise their constitutional right to vote, free from dishonest and unethical practices which tend to prevent the full and free expression of the will of the voters. The purpose in creating the Code of Fair Campaign Practices is to give voters guidelines in determining fair play and to encourage candidates to discuss issues instead of untruths or distortions. Article 2. Definitions 12510. Unless otherwise indicated, the definitions set forth in this article shall govern the inter- pretation of this chapter. Article 3. Code of Fair Campaign Practices 12520. At the time an individual files his or her d lazation of candidacy, nomination papers, or any other paper evidencing an intention to be a ate for public office, the county clerk, shall give the individual a blank form of the Cod paign Practices and a copy of the provisions of this chapter. The county clerk shall_ h' didate for public office that subscription to the code is voluntary. In the case of a co a independent expenditure within the meaning of Section 12511, the Secretary o ate pr e a blank form and a copy of the provisions of this chapter to the individual film "_ 0cordance with Title 9 (commencing with Section 81000) of the Government Code, an initial c p9ign statement on behalf of the committee. The text of the code shall read, as follows: (see reverse) 12522. The Secretary of State shall print, or cause to be printed, blank forms of the code. The Secretary of State shall supply the forms to the county clerks in quantities and at times requested by the clerks. 12523. The county clerk shall accept, at all times prior to the election, all completed forms which are properly subscribed to by a candidate for public office and shall retain them for public inspection until 30 days after the election. 12524. Every code subscribed to by a candidate for public office pursuant to this chapter is a public record open for public inspection. 12525. In no event shall a candidate for public office be required to subscribe to or endorse the code. 12526. This chapter shall be operative only until January 1, 1989, and as of that date is repealed. 28 CODE OF FAIR CAMPAIGN PRACTICES There are basic principles of decency, honesty, and fair play which every candidate for public office in the State of California has a moral obligation to observe and uphold, in order that, after vigorously contested, but fairly conducted campaigns, our citizens may exercise their constitutional right to a free and untrammeled choice and the will of the people may be fully and clearly expressed on the issues. THEREFORE: (1) I SHALL CONDUCT my campaign openly and publicly, discussing the issues as I see them, presenting my record and policies with sincerity and frankness, and criticizing without fear or favor the record and policies of my opponents or political parties which merit such criticism. (2) I SHALL NOT USE OR PERMIT the use of character defamation, whispering campaigns, libel, slander, or scurrilous attacks on any candidate or his or her personal or family life. (3) I SHALL NOT USE OR PERMIT any appeal to negative prejudice based on race, sex, religion, national origin, physical health status, or age. (4) I SHALL NOT USE OR PERMIT any dishonest or unethical practice which tends to corrupt or undermine our American system of free elections, or which hampers or prevents the full and free expression of the will of the voters incl g acts intended to hinder or prevent any eligible person from registering to vote, enrolling voting. r '.. I, the undersigned, candidate for election to public office in the State of California or treasurer or chairman of a committee making any independent expenditures, hereby voluntarily endorse, subscribe to, and solemnly pledge myself to conduct my campaign in accordance with the above principles and practices. DATE SIGNATURE PLEASE PRINT NAME, OFFICE SOUGHT, AND DATE OF ELECTION 29 WRITE-IN CANDIDACY 14 Days Every person who desires to be a write-in candidate and have his/her name as written on the ballot of an election October 22, counted for a particular office shall file: at 5:00 p.m. 1. A statement of write-in candidacy which shall contain the candidate's name, residence address, a declaration stating that (s)he is a write-in candidate, the title of the office for which (s)he is running, and the date of the election. 2. The requisite number of signatures on the nomi- nation papers, if any, for that office. The statement and nomination papers shall be filed with the Registrar of Voters not later than the 14th day prior to the election. Signers of nomination papers for write-in candidates shall be voters in the district or political subdivision in which the candidate is to be voted on. No fee or charge shall be required of a write-in candidate. If there are two or more persons to be elected to an elective office, those candidates equal in number to the number to be elected who receive the highest number of votes for that office shall be declared elected. (Reference: Elec- tions Code Section 23554) County or Local Measures If a majority of the voters voting on a proposed ordinance vote in its favor, the ordinance shall become a valid and binding ordinance. The ordinance shall be considered as adopted upon the date the vote is declared by the governing body, and shall go into effect 10 days after that date. (Reference: Elections Code Sections 3716 and 5159) State Measures If a measure receives affirmative votes on a majority of all ballots cast for that measure, it is deemed approved by the voters. An initiative measure approved by a majority vote takes effect the day after the election unless the measure provides otherwise. If provisions of two or more measures approved at the same election conflict, those of the measure receiving the highest affirm- ative vote prevail. The legislature may amend or repeal initiative statutes by another statute that becomes effective only when approved by the electors unless the initiative stat- ute permits amendment or repeal without their approval. (Reference: California Constitution Article II, Section 10) Bond Measures or Imposition of Special_ Taxes Cities, counties, and special districts, by a two-thirds vote of the qualified electors of such district may impose special taxes on such district, except ad valorem taxes on real property or a transaction tax or sales tax on the sale of real property within such city, county, or special district. (Reference: California Constitution, Article X111A, Section 4) 31 CAMPAIGN LITERATURE MASS MAILING Definition of Mass Maijiny "Mass mailing" means two hundred (200) or more identical or nearly iden- tical pieces of mail, but does not include a form letter or other mail which is sent in response to a request, letter, or other inquiry. (Reference: Government Code Section 82041.5) Mass Mailing Requirements Section 84305 of the Government Code provides as follows: "(a) Except as provided in subdivision (b), no candidate or committee shall send a mass mailing unless the name, street address, and city of the candidate or committee are shown on the outside of each piece of mail in the mass mailing and on at least one of the inserts included within each piece of mail of such mailing in no less than 6 -point type. A post office box may be stated in lieu of a street address if the organization's address is a matter of public record with the Secretary of State. (b) If the sender of the mass mailing is a single candidate or commit- tee, the name, street address, and city of the candidate or commit- tee need only be shown on the outside of each piece of mail. (c) If the sender of a mass mailing is a controlled committee, the name of the person controlling the committee shall be included in addi- tion to the information required by subdivision (a)." OTHER Political Advertising Requirements --Newspapers Any paid political advertisement which refers to an election or to any candidate for state or local elective office and which is contained in or distributed with a newspaper, shall bear on each surface or page thereof, in type or lettering at least half as large as the type or lettering of the advertisement or in 10 -point roman type (whichever is larger), the words "Paid Political Advertisement." Such words shall be set apart from any other printed matter. As used in this section, "paid political advertisement" shall mean and shall be limited to published statements paid for by advertisers for purposes of supporting or defeating any per- son who has filed for an elective state or local office. (Reference: Elections Code Section 11708) 32 OTHER (Continued) Printing of Simulated Sam le Ballot Elections Code Section 11709 provides, in part, as follows: "Every simulated ballot or simulated sample ballot shall bear on each surface or page thereof, in type or lettering at least half as large as the type or lettering of such statement or words or in 10 -point type, whichever is larger, in a printed or drawn box and set apart from any other printed matter, the following statement: NOTICE TO VOTERS (Required by Law) This is an unofficial, marked ballot prepared by (insert name and address of the person or organization responsible for prepara- tion thereof)." No such simulated ballot or simulated sample ballot shall bear any offi- cial seal or the insignia of any public entity, nor shall any such seal or insignia appear upon the envelope in which it is mailed or otherwise delivered. Campaign Literature Containing Pol� ling Place of Voter_ Candidates are requested not to distribute or mail campaign literature telling a voter where his or her polling place is located. It is not only confusing to voters, but invariably some polling place changes occur in the last few days before an election. In the past, candidates have mailed or had distributed campaign literature telling voters to go to the wrong polling place. I am sure you can understand the problems this causes for voters and my staff, as well as for the candidate. OUTDOOR POLITICAL ADVERTISING POLITICAL SIGNS --STATE REQUIREMENTS/GUIDELINES Reference: i3usi ness and Prrotessi ons�ode `section 5405.3 Nothing in this chapter, including but not limited to Section 5405, shall prohibit the placing of temporary political signs, unless a federal agency determines that such placement would violate federal regulations. However, no sign shall be placed within the right-of-way of any public road or highway or within 600 feet of the edge of a landscaped freeway. 33 POLITICAL SIGNS --STATE REQUIREMENTS/GUIDELINES (Continued) A temporary political sign is a sign which: a. Encourages a particular vote in a scheduled election; b. Is placed not sooner than 90 days prior to the scheduled elec- tion and is removed within 10 days after the election; c. Is no larger than 32 square feet; and d. Has had a statement of responsibility filed with the Department of Transportation certifying a person who will be responsible for removing the temporary political sign and who will reimburse the department for any cost incurred to remove it. Before placing any signs or sign structures within view of a county or state highway, a statement by a responsible party, requiring a notarized signature, must be filed with the Chief of the Highway Outdoor Advertis- ing Program, Department of Transportation, 1120 "N" Street (5th floor), Sacramento, California 95814. Voter Registration and Elections has a supply of "Statement of Responsi- bility" forms available, and will provide to interested candidates and committees on request. The forms must be filed, however, with the De- partment of Transportation at the aforementioned address. Because the law directs the Department of Transportation to remove signs that do not comply with the regulations and to bill the responsible party for removal costs, it is recommended that candidates and committees, prior to the placement of any political signs on property adjacent to roadways, contact Stan Lancaster, Chief of Highway Outdoor Advertising Program, at (916) 445-3331 for more detailed information. POLITICAL SIGNS --SACRAMENTO COUNTY REQUIREMENTS/GUIDELINES e erence:-75cramento ounty Code, Title 18 Violations and Enforcement (Chapter 18.02.010) "It is unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use or maintain any sign or sign structure in the county, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this title. Any person, firm or corporation violating any of the provisions of this title is guilty of a misdemeanor, and each such person is guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this title is committed, con- tinued or permitted, and upon conviction of such violation such person is punishable by a fine of not more than five hundred dollars or by im- prisonment for not more than six months, or by both such fine and im- prisonment." 34 POLITICAL SIGNS --SACRAMENTO COUNTY REQUIREMENTS/GUIDELINES (Continued) Reference: Sacramento punt o e , it e18 Signs on County Property (Chapter 18.03.010) "No person shall paint, post, attach or affix any sign upon or to any bridge, fence, traffic sign, building or other property of the county or to any tree or public utility pole with the right-of-way of any public highway of the county." Signs on Adjacent Improvements to County property (Chapter 18.03.015) "No person shall erect, construct, place or maintain any sign within the right-of-way of any public highway of the county, or on any sidewalk, curb or gutter or pavement constructed adjacent to the highway where these improvements have been placed at a location prescribed by county ordinances in compliance with the county master plan of streets and high- ways and the land it is placed on is not dedicated to the county." Sacramento County Zoning Regulations Pertaining to Political Signs Sacramento County Zoning Code, Title III, Chapter 35, provides as follows: Political campaign signs are authorized in any zone for a period not to exceed 90 days provided: a. Such signs are removed within ten (10) days following the conclu- sion of the campaign; and b. Said sign shall not be displayed in the Scenic Corridors. Other- wise, signs shall not be within five (5) feet of the side property lines and shall be set back from the street right-of-way lines at least ten (10) feet. Violations of the above provisions of code for failure to comply with any of the requirements constitute a misdemeanor. Any person, firm, or corp- oration whether as principal, agent, employee or otherwise, shall upon conviction thereof be fined not more than $500 or imprisoned for not more than six months in the county jail or both. Enforcement of Violations in the Unincorporated Area of Sacramento County Sign enforcement in the County of Sacramento is under the jurisdiction of the Planning and Community Development Department. Any complaints or in- quiries pertaining to the erection/removal of political signs in the un- incorporated area of Sacramento County should be referred to the Sacra- mento County Zoning Enforcement Program, at 440-6444. POLITICAL SIGNS --CITY OF SACRAMENTO REQUIREMENTS/GUIDELINES Reference: '�acramen 6—M y code Chapter—f, Section 1.7 General Penalty; Continuing Violations "Whenever in this Code or in any other ordinance of the city, any act is prohibited or is made or declared to be unlawful or an offense, or the 35 POLITICAL SIGNS --CITY OF SACRAMENTO REQUIREMENTS/GUIDELINES (Continued) doing of any act is required or the failure to do any act is declared to be unlawful or a misdemeanor, where no specific penalty is provided therefore, the violation of any such provision of this Code or any other ordinance of the city shall be punished by a fine not exceeding five hundred dollars or imprisonment in the city jail for a term not exceeding six months, or by both such fine and imprisonment. Every day any violation of this Code or any other ordinance of the city shall continue shall constitute a separate offense." Exempt Signs Reference: Sacramento City Code Chapter 3, Section 3.140k, Division 6 Political or campaign signs on behalf of candidates for public office or measures on election ballots are subject to the following regulations: a. Such signs may be erected not earlier than ninety days prior to the election and shall be removed within fifteen days following such election. b. In any "R," "A," or "OB" Zone, only one stationary sign is permitted on any one parcel of land. Such sign shall not exceed ten square feet in area and, if detached, shall not exceed six feet in height. Such sign shall not be erected in such a manner as to constitute a roof sign. c. In any "SC," NC," "C," OR "M" Zone, one or more temporary signs are permitted on a parcel of land provided all such signs do not, in the aggregate, exceed a sign area of fifty square feet. Such signs shall not be erected in such a manner as to constitute a roof sign. Notwithstanding the provisions of this subparagraph, a sign may be placed upon any legally existing sign structure. d. No sign shall be located within or over the public right-of-way. Permits May Be RMuired All political and campaign signs not covered by the aforementioned reg- ulations require sign permits issued by the Planning Department, 1027 Tenth Street, 3rd floor, Sacramento, California, Phone: 449-5604. Posted Properties Notwithstanding the fact that a candidate may have received permission from a landowner to place a political sign on that landowner's private property, if the property in question has been "POSTED" by the City Police, an individual who violates the warning is subject to citation. 36 POLITICAL SIGNS --CITY OF SACRAMENTO REQUIREMENTS/GUIDELINES (Continued) Enforcement of Violations within Sacramento City Limits Sign enforcement in the City of Sacramento is under the jurisdiction of the Sacramento City Clerk. Any complaints or inquiries pertaining to the erection/removal of political signs within the city limits of Sacramento should be referred to Lorraine Magana, Sacramento City Clerk, at 449-5426. POLITICAL SIGNS --SACRAMENTO MUNICIPAL UTILITY DISTRICT RE UIREMENTS/GUIDLINES State of California Public Utilities Commission General Order 95, Rule 34, states as follows: "Nothing in these rules shall be construed as permitting the unauthor- ized attachment, to supply or communication poles, of radio antennas, ropes, lec si ns and any such equipment foreign to the purposes of over- head ertc line construction." Persons placing signs on any Sacramento Municipal Utility District power poles are in violation of the aforementioned Public Utilities Commission General Order. Any such signs become the property of SMUD, and will be removed and destroyed. Enforcement of Violations (Signs on Power Poles) Sign enforcement for SMUD is under the jurisdiction of the Field Services Division. Any complaints or inquiries pertaining to the erection/removal of political signs within the District should be referred to the Supervisor of the Field Services Division at 732-5046. 37 ELECTION NIGHT ACTIVITIES The polls are officially closed at 8:00 p.m. Election activity then changes from what was primarily voter participation at the polls to precinct officials completing necessary procedures and forms, and delivering voted ballots and supplies to a ballot receiving center. Certain check-in and processing proce- dures then take place. Next, the voted ballots are delivered to the Counting Center, located in the County Administration Building, where the votes are tallied by computer and the cumulative election results are available to can- didates, the media, and the public. Information/media headquarters for election night returns will be located in the cafeteria on the ground floor of the County Administration Building lo- cated at 700 "H" Street, Sacramento. The entrance to the building on elec- tion night is on the 8th Street side of the building. The absentee vote will be reported first, at approximately 8:30 p.m. Election results will be provided by telephone to candidates who wish to mon- itor the results, with information from the first precinct(s) available start- ing at approximately 9:30 p.m. The number to call for Sacramento County election results is 366-2051; operators (who will be obtaining the information directly from the down own computer center via terminals) will be standing by to provide up -to -the minute results. Also, semi-final election results will be available by phone at 366-2051 be- tween 8:00 a.m. and 5:00 p.m. at Voter Registration and Elections on the day after the election. Copies of the last returns will also be available. The official election results will be certified after the canvass of the returns, which must be completed not later than November 25, 1985. afl QUESTIONS FREQUENTLY ASKED BY CANDIDATES 1. Is there a filing fee involved in my candidacy? Election law currently provides that there is no filing fee for special dis- trict offices and for school district offices. 2. Is your office open during the lunch hour? Yes. Office hours are 8:00 a.m. to 5:00 p.m., Monday through Friday, exclud- ing holidays, and we do remain open between the hours of noon to 1:00 p.m. 3. What happens if I am the only candidate to file for an office? If you are the only candidate to file and qualify for a special district office, you will be appointed to the office by the Board of Supervisors. You shall qualify and take office and serve exactly as if elected at the general district election. If only one person has been nominated for a school district office, that person, if qualified, shall take office without the necessity of being ap- pointed by the governing board. If there are no nominees, the school govern- ing board will appoint a qualified person. 4. What if I change my mind about being a candidate after filing nomination papers? You may withdraw as a candidate at any time prior to the close of the nomina- tion period, which is August 9, 1985- You are not permitted to officially withdraw after that date, and your name will appear on the ballot. 5. What happens if some of the signatures I obtain on my nomination papers for a special district office are not registered voters, or do not live within the district I seek to represent? File your nomination papers early to avoid the consequences of a problem of this type. The Registrar of Voters must certify the signatures on nomination papers. If you wait until the last day to file and your sponsors' signatures, for any reason, are insufficient, you will not have qualified to be a can- didate. If you file early, there will be time to check the signatures and notify you of any insufficiencies and you may have an opportunity to submit supplemental signatures on your nomination papers. 6. How soon will a list of qualified candidates be available after the close of the nomination period? The nomination period ends August 9, however, if an incumbent does not file, the nomination period is extended until August 14, 1985. A list of candidates will be prepared the next day, and should be available for distribution by noon on August 15. You may come in to the office and pick up a copy of the list of candidates, or you may request a list be mailed to you by telephoning 366-2051 after August 16. 39 QUESTIONS FREQUENTLY ASKED BY CANDIDATES (Continued) 7e May I change or correct the wording/spelling on my candidate's statement after submission? No, ,you may not. Check your candidate's statement carefully before sub- mitting. 8. If I submit a voluntary candidate's statement and I change my mind, may I withdraw the statement? The candidate's statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 p.m. of the next working day after the close of the nomination period. (EC 10012) 9. May my wife, friend, or campaign manager pick up my nomination documents for me? All forms must be either picked up in person by the candidate or a letter of specific authorization, signed by the candidate, must be presented by the candidate's representative. 10. May my wife, friend, or campaign manager file my nomination documents, or can I mail them to you? Election law does not specifically prohibit another person filing nomina- tion papers for a candidate, however, candidatco arc urged to file in per- son. The reasons are twofold: a. The oath or affirmation must be administered by a member of my staff, an authorized public official, or a notary public. It is much easier for a candidate to file the nomination papers in person and have the oath administered at the time (s)he files; and b. The signature of the candidate, as well as other data, is required on many documents involved in the nomination process. If through an over- sight the nomination papers are incomplete, the problem can easily be rectified when a candidate files in person. 11. Why is there so much paperwork involved in being a candidate, particularly when there is no salary for being a director and the compensation for attending meetings is minimal? Election law specifies documents required, as well as format, filing dates, etc.; the filing requirements are not discretionary. 40 REGISTRATION AND ELECTION DATA The California Administrative Code, Title 2, Division 7, Article 1, Section 19003, specifies permissible uses for any data obtained from voter registra- tion files. Permissible usage includes direct election campaigning, surveys in conjunction with an election campaign and distribution of information of a political nature. Data obtained from voter registration or election files may not be sold, leased, loaned, reproduced, or possession thereof relin- quished without receiving written authorization to do so from the Secretary of State or Registrar of Voters. Prohibited usage includes commercial pur- poses and solicitation of contributions or services for any purpose other than on behalf of a candidate or political party, or in support or opposition of a ballot measure. DATA AVAILABLE FROM VOTER REGISTRATION AND ELECTIONS Voter Registration and Elections has a "Specialized Services" booklet available which contains complete information on services and materials available from the department. Copies of this booklet are available at the department's reception counter. Listed below is a brief description of some of those items: 1. Walking Lists Lists of registered voters, by general election precinct, are available. The fee is $0.50 per thousand names. There is a limit of two copies per candidate and/or committee. Lists based on the 60 -day close of registration for the November 5, 1985, consolidated election will be available on and after September 23. Lists obtained prior to September 23, will be based either on: a. Records for the November, 1984, general election; or b. Records for the 60 -day close of registration for the Sacramento City Primary Election, with the data available on or after August 15. The Sacramento City Primary listing will contain updated information only in those precincts involved in the September 24, 1985, Sacramento City Primary Election. 2. District Maps Maps of special districts and school districts are on file at Voter Registration and Elections. These maps may be reviewed from 8:00 a.m. to 4:00 p.m., Monday through Friday, excluding holidays. 3. Voter File Tapes Tape copies of the Voter Master File may be purchased from Voter Registration and Elections for $68.00, and contain the names of all registered voters in Sacramento County. These tapes are available for election purposes only. 41 REGISTRATION AND ELECTION DATA (Continued) 3. Voter File Tapes (Continued) To purchase tape copies of the Voter Master File, you will be required to do the following: a. Pay the $68.00 fee in advance; b. Provide three (3) reels (for writing 1600 BPI) or two (2) reels (for writing 6250 BPI) of either OS or standard 360 label tapes with inter- nal volume number and name. Each reel must have a label on the out- side containing its internal volume number and name (tapes may be purchased from Voter Registration and Elections for $15.50 each); and c. Sign a declaration that the data on the tapes will be used for election purposes only. It will take approximately one week to produce the requested tapes. Al charges are subject to postage, packaging, and handling fees, if mailed. Voter Registration and Elections does not provide data processing services for producing labels or lists. A candidate or committee must make arrangements with a private data processing service bureau for these services. Candidates and committees should consult with a private data processing service bureau about prices and the use for which the tape is being purchased prior to purchase from this department. DATA AVAILABLE ELSEWHERE to Secretary of State Voter File Tapes The Secretary of State has voter file tapes available containing the names and addresses of all registered voters in the State of California. These tapes are available for election purposes only. District Maps Copies of general election precinct maps are available for purchase from Atlas Blueprint in Sacramento. The maps are 30" X 46" each, and there are 53 maps for Sacramento County. Atlas Blueprint has an index which lists the precincts and maps for any given district. Individual maps, which con- tain anywhere from a portion of a precinct to several precincts, cost $2.00 each. District maps are also available for viewing purposes only at Voter Registration and Elections. 42 INFORMATION REGARDING SUBMISSION OF ARGUMENTS ON MEASURES County measure means any proposed county charter, any proposed amendment to a county charter, any proposition for the issuance of funding or refunding of bonds of the county, and other questions or propositions submitted to the voters of the county at any election held throughout an entire single county; and any advisory questions or any bond or other proposals submitted to the voters of any public district although the boundaries of the district may be coterminous with those of the county. The following are deadlines, established by Sacramento County Voter Registra- tion and Elections, relating to any measure to appear on the November 5, 1985, ballot. They are not due dates, however, and it is recommended that all mea- sures be submitted as early as possible, but in no event later than the sug- gested date. Each measure is treated as a separate election, and the dead- lines and dates will be determined by the Registrar of Voters based on date of submission and qualification. A bona fide association is a recognized authentic or genuine group of citizens bound together, without intent of fraud or deceit, by a common interest or cause. Arguments may not exceed 300 words in length. Selection of Argument to Appear in Sample Ballot if More Than One Argument u mitte 7n avor or 7n Opp os7t7on If more than one argument for or more than one argument against any measure is submitted within the time prescribed, the Registrar of Voters shall select one of the arguments in favor and one of the arguments against for printing and distribution to the voters. In selecting the argument, the Registrar of Voters shall give preference and priority in the following order: 1. Board of Supervisors, or member(s) of the Board authorized by the Board; or in the case of a district measure, the district board or member(s) of the board authorized by the directors. 43 INFORMATION REGARDING SUBMISSION OF ARGUMENTS ON MEASURES (Continued) 20 The individual voter or bona fide association of citizens, or combina- tion of voter associations, who are the bona fide sponsors or propo- nents of the measure. 3. Bona fide associations of citizens. 4. Individual voters who are eligible to vote on the measure. Rebuttals When the Registrar of Voters has selected the arguments for and against a mea- sure, he shall send copies of the argument in favor of the measure to the authors of the argument against, and copies of the argument against the measure to the authors of the argument in favor. The authors may prepare and submit rebuttal arguments not exceeding 250 words in length. GUIDELINES --FORM OF SUBMISSION The following statement shall be printed on the heading of the front page of the argument: "Argument in Favor to Measure or "Argument Against Measure ,'r or "Rebuttal to Argument in Favor oMeasure ," or "Rebuttal to Argument Against Measure whichever is applicable. Election law also requires that all arguments and rebuttals be accompanied by the following form statement, or a facsimile thereof, to be signed by each author of the argument: "The undersigned author(s) of the argument (primary/rebuttal) in favor o /_ ballot proposition at the against name or number) title of election election for the to be held on hereby state that such (jurisdiction) (date) argument is true and correct to the best of knowledge and s ier ei r belief." Signed 44 Date GUIDELINES --FORM OF SUBMISSION (Continued) A ballot argument shall not be accepted unless accompanied by the name or names of the person or persons submitting it, or, if submitted on behalf of an organization, the name of the organization and the name of at least one of its principal officers. No more than five signatures shall appear with any argu- ment. A ballot argument or rebuttal argument which includes in its text the name of a person, other than the author of the argument, who is represented as being for or against a measure, shall not be accepted unless the argument is accom- panied by a signed consent of such person. The consent of a person other than an individual (such as an organization, committee, etc.) shall be signed by an officer or other duly authorized representative. Withdrawal of Arguments Whenever any ballot argument for or against for approval are authorized, such arguments nents at any time prior to and including the ments. (EC 5351) Challenge of Argument/Rebuttal Contents any measure submitted to the voters may be withdrawn by their propo- final date fixed for filing argu- Arguments/rebuttals submitted for and/or against a measure are available for public viewing only after the deadline for the specific filing has passed. There is then a ten-day public examination period whereby the documents may be reviewed and copies obtained for $0.50 per page. Also, during this 10 -calendar day examination period, any voter of the affected jurisdiction may take legal action to challenge the contents of the arguments/rebuttals pursuant to Elec- tions Code Sections 3795, 5025, 5215, and 5330. 45 OTHER DATA PERTAINING TO THE NOVEMEBR 5, 1985, ELECTION Sample Ballots Between September 26, 1985, and October 26, 1985, the Registrar of Voters shall mail a sample ballot to each voter entitled to vote at the November 5, 1985, election. (EC 10010) Registration Deadline October 7, 1985, is the last day to register to vote at the November 5, 1985, election. (EC 305) Absent Voter Information Application for an absent voter's ballot shall be made in writing to the Regis- trar of Voters between October 7, 1985, and October 29, 1985. The application shall be signed by the applicant and shall show his/her place of residence. Any applications received by the Registrar of Voters prior to October 7, 1985, shall be kept and processed during the application period. Any applications received by mail after October 29, 1985, will not be processed. A letter of explanation will be sent to the applicant, however. advising that the absent voter application was received after the deadline. (EC 1002) Late Absentee Voting --Request for Absentee Ballot After Period for Requesting '6y7a71 — Between October 30, 1985, and November 5, 1985, election day, absent voters' ballots will be issued, upon written request, in the office of the Registrar of Voters. The elector may either request the absentee ballot personally; or, upon presentation of authorization in writing, signed under penalty of perjury, the ballot shall be delivered by the Registrar of Voters to any authorized representative of the voter who presents the required written statement and authorization. Before delivering the ballot, the Registrar of Voters shall compare the signature on the request with the signature on the voter's affida- vit of registration. (EC 1017) Absentee Vote Processing Any county having the necessary computer capability may start to process absent voter ballots on the fifth day prior to the election, which is October 31, 1985. The processing is open to the public to view, and takes place at 3700 Branch Center Road, Suite C, Sacramento, California. This process may be completed to the point of putting the information on computer tape, but under no circumstances is a vote count to be made until 8:00 p.m. on the day of the election. (EC 1400) 46 OTHER DATA PERTAINING TO THE NOVEMBER 5, 1985, ELECTION (Continued) Election Day On November 5, 1985, election day, the polls will be open from 7:00 a.m. to 8:00 p.m. November 5, 1985, at 8:00 p.m., is also the deadline for the Regis- trar of Voters to receive ballots cast by absent voters by mail or in person. Absent voter ballots may also be received at any polling place in the county by the close of the polls on election day. Those absent voter ballots received at the polls are counted during the official canvass inasmuch as the voters' signatures have to be verified before counting. (EC 1013) Official Canvass of the Returns The Registrar of Voters shall conduct the official canvass of the returns com- mencing not later than the first Thursday following each election, which in this case is November 7, 1985. If there are two or more persons to be elected to an elective office, those candidates equal in number to the number to be elected who receive the highest number of votes for the office shall be de- clared elected. (EC 23554) Tie Vote Procedures Seeci-al Districts --If a tie vote makes it impossible to determine which of two or more candidates has been elected, the Registrar of Voters shall notify the governing body of the district thereof and such governing body shall forthwith notify the candidates who have received the tie votes to appear before it either personally or by representative at a time and place designated by the governing body. The governing body shall at that time and place determine the tie by lot and the results thereof shall be declared by the governing body. The candidate so chosen shall qualify, take office, and serve as though elected at the preceding general dis- trict election.
