The following section appears to indicate that the developer can designate the occupants of the inclusionary units. I
believe this is contrary to what is intended and may be rectified by eliminating the word “except” or changing
“affordable “ to “market rate”.
17.138.130 – Eligibility Screening
The Housing Authority or other housing provider designated by the City shall screen prospective renters or buyers of
affordable units. Renters or buyers of affordable units shall enter into an agreement with the City. Occupants must be
selected by means of an open, public process which ensures that individuals of a group of interested participants have
equal probability of selection. Private selection of individuals by project owners is not permitted except for any
affordable units.

The benefit to the developer to provide lower income units should be greater than for providing moderate income units.
Here lower and moderate receive the same number incentives throughout this section. This makes it is hard to
understand why any lower income units would be identified as inclusionary. Many Cities require higher percentages of
inclusionary housing than we are and the percentage of moderate income units should be adjusted to 15 - 20% for one
incentive with adjustments for additional incentives.
17.140.070 – Alternative or Additional Incentives
When a developer agrees to construct housing for households of very-low, lower, or moderate income households, or
for qualifying senior households, or for qualifying transitional foster youth, disabled veterans, or homeless persons, and
desires an incentive other than a density bonus as provided in Section 17.140.040 (Standard Incentives for Housing
Projects), or when an applicant for approval to convert apartments to a condominium project agrees to provide housing
for households of very-low, lower, or moderate income, or for qualifying senior households, the developer shall receive
the following number of incentives or concessions:
1. One incentive or concession for housing developments that include at least 10 percent of the total units for lower
income households, at least five percent for very-low income households, at least 10 percent for persons and families of
moderate income in a common interest development, or at least 10 percent for qualifying transitional foster youth,
disabled veterans, or homeless persons,

The proposed limitations on the Advisory Bodies with the shifting of more and more discretion to the Community
Development Director or staff that may be assigned both restricts public input and eliminates our elected officials
rendering determinations. As Mayor and City Council you run the City on behalf of its residents. It is understandable that
staff would prefer to eliminate public hearings with all the related staff reports and time involved, but that is the nature
of an open, transparent and robust government with citizen participation. Please consider the purpose and goals of
democracy and the effects of streamlining not only upon staff and developers, but the vibrancy and health of our City
institutions and trust of its residents.
