On a motion by Barlow and seconded by Wright, the minutes from the August 23, 1984 meeting were approved unanimously. ITEM #3. Some discussion and clarification regarding the calculating of the CPI. Two members of the public testified that the figures are avail- able monthly and many mobilehome parks increase rental spaces via the CPI figures of August previous to implementing a rent increase in January. Board members heard testimony regarding the Master Lease dilemma (i.e., Mr. Anderson/Ranch San Luis situation). Mr. Zolkowski submitted a handout for board review especially recom- mendation #3; more verification and justification of rent increases. Mr. Bennett spoke against "passing through" the master lease increases. Mr. Kirchner commented in favor of the "pass through" provision. Mr. Feliciottl spoke regarding many areas of improvement that needed attention in the ordinance. Mr. Zolkowski said rent increases should not be determined by "fair market value". Should landowner be allowed to "pass through" in- creases of leases? City Attorney Roger Picquet addressed board members in response to questions regarding Master Lease holder and fair market value. Landowners should be held accountable for rent increases as com- pared to Manager/Operator. Public comment by Mr. Long regarding fair market value and the $300 application fee. Mr. Walter Fell wanted to know about government mandated costs being "passed through". The pool at his park was shut down by the Health RENT REVIEW BOARD MINUTES AUGUST 27, 1984 Department. Each increase in rent is investigated individually by the Rent Review Board. Chairman Burke found Board consensus: The property owner is in the same shoes as Manager/Operator and responsible for justification of rent increases. Chairman Burke asked staff to come back to next meeting with research and infor- mation. Some further discussion concern 90 day cooling -off period" of Mr. Zolkowski's handout. Member Barlow wanted specifics on rent increase justifications (i.e., Schedule E of tax forms, a financial officer available). Chairman Burke wanted to know if this was necessary for all applications. These actions were seen as administrative rule and policy rather than changes to the existing ordinance. Next meeting was scheduled for September 10, 1984 in the Council Chambers. Meeting was adjourned at 11:30am.
