Recommendation
▪Recommend that the City Council adopt an
Ordinance amending the newly adopted Update
to the Zoning Regulations
▪Recommend that the City Council adopt the
Addendum to the Negative Declaration of
Environmental Impact
▪Council hearing to introduce the Zoning
Regulations amendments November 27, 2018

Council Direction
▪On August 21, 2018, the Council voted 5-0 to introduce
an ordinance updating the City’s Zoning Regulations
and directed staff to revise and review five items to be
brought back to Council after the Planning Commission
has provided a recommendation
▪On September 18, 2018, the City Council voted 5-0 to
approve the updates to the City’s Zoning Regulations,
Title 17 of the City’s Municipal Code.

Council Direction
▪Tiny Homes –Reduce the maximum size from 450 sq. ft. to
possibly 300 sq. ft. (without counting the loft) and require a
Director’s Action (appealable decision).
▪ADU Owner Occupancy –Consider excluding the owner
occupancy requirement for ADUs in the R-3 and R-4 zones
▪ADU Lot Coverage –Consider reducing the lot coverage
exemption for an ADU from 450 sq. ft. to 300 sq. ft.
(consistent with the size of a Tiny Home).
▪EV Parking –Further implement the CAP by requiring
installation of EV capable parking spaces in new
developments or significant remodels/additions.
▪Downtown Overlay Zone –Revise to require a DA for any
project proposing to take advantage of increased height
(above 45 feet).

Item #1 Tiny Homes
1)The maximum size has been reduced from 450 sq. ft.
to 300 sq. ft. (without counting the loft) and requires a
Director’s action application.
2)Regulations also include;
•Time Limit: set to expire after a 12-month period.
•Maintenance: the tiny home shall be consistent with
Property Maintenance Standards.
•Location: the tiny home shall be located toward the
rear of the lot screened from view of the public
street.
•Findings: Required for Director’s Action

Recreational Vehicles
Recreational Vehicles (RVs)are defined in HSC Section 18010.RVs may
include a motor home,travel trailer,truck camper or camping trailer,with or
without motive power,designed for human habitation for recreational,
emergency or other occupancy.RVs are not intended for occupancy as a
permanent dwelling.An RV meets all of the following criteria:
•It contains less than 320 square feet of internal living room area,excluding
built-in equipment,such as wardrobe,closets,cabinets,kitchen units or
fixtures,and bath or toilet rooms.
•It contains 400 square feet or less of gross area measured at maximum
horizontal projections.
•It is self-propelled,truck-mounted,or permanently towable on the highways
without a permit and is built on a single chassis.

Tiny homes on wheels are
considered Recreational
Vehicles (RV’s).

Item #2 -ADU Owner Occupancy
1)Staff has received a suggestion from public testimony
to exclude the R-3 and R-4 zones from the owner
occupancy requirement while maintaining it in the R-1
and R-2 zones.
2)Owner occupancy would continue to help the
preservation of the lower density residential
neighborhoods, while not being required in the R-3 and
R-4 zones which are designated for higher density
residential developments

Item #3 –ADU Lot Coverage
1)The Planning Commission had recommended that the
lot coverage exemption for an ADU be 450 sq. ft.
2)The Council provided direction to reduce the lot
coverage exemption to 300 sq. ft. (to be consistent with
the size of a Tiny Home).
3)The lot coverage exemption has been reduced from
450 sq. ft. to 300 sq. ft. per Council direction.

Item #4 –EV Parking
1)Staff identified additional opportunities to further implement
the CAP upon receiving additional public comments after
the Planning Commission review.
2)As introduced to the Council on August 21st, the following
additional standards include:
•Expand the parking requirements to include EV capable
(conduit installed ready for hook up) in addition to the
already required EV ready (charging station installed)
•Provide more definitions for terms such as “equipped
with charging equipment.”
•The EV parking requirements for substantial
redevelopments and reconfigured parking lots in
addition to new developments.

Item #5 –Downtown Overlay Zone
1)The Council directed staff to address the Overlay zone
with the PC for further review and specifically include a
requirement for approval of a Development Agreement
for any project requesting an increased height (>45’).
2)Staff has determined additional review is necessary to
evaluate the changes. These revisions are best paired
with the subsequent amendments on flexible density
downtown planned for spring 2019.

A.Revise Section 17.10.020A to provide consistency for the M/A
abbreviation with Table 2-1
B.Revise Table 2-1 to allow Single-Unit Dwellings in the R-1 Zone
C.Revise Table 2-6, Table 2-8, & Table 2-10 to include the word density
when referring to density minimum allowances
D.Revise Section 17.32.030E.2b(2) SLO Green Build reference to Green
Point Rated New Home Multi-family Checklist
E.Restructure Section 17.70.170C.5 to provide clarity to projections into the
required setbacks
F.Revise Table 3-4 Parking Requirements by Use for Single-Unit Dwellings
to require a minimum of two parking spaces for the first four bedrooms
and 0.75 spaces for each additional bedroom beyond the first four
G.Revise Table 3-4 Parking Requirements by Use for Multi-Unit Residential
to relocate and clarify the parking requirement for elderly housing to
Subsection B after Table 3-4

H.Revise Table 3-4 Parking Requirements by Use for Medical-Doctor’s Office to

J.Revise Section 17.86.100B.2 to eliminate the term ministerial, as Director

L.Revise Section 17.138.130 to remove the word “except” from the last
sentence
M.Revise Section 17.140.040K to include a new subsection addressing parking
requirements for housing occupied exclusively by very low or low-income
households
N.Revise Section 17.140.070 to include the changes to State Housing Law to
provide for child care facilities as part of affordable housing projects, as well
as address the appropriate review authority for alternative incentives
