Although the Commission will not take action on any item presented during the Public Comment Period, the Chair may direct staff to place an item on a future agenda for formal discussion. CONSIDERATION OF MINUTES 1. Minutes of the Architectural Review Commission meeting of October 15, 2018. PUBLIC HEARINGS Note: Any court challenge to the actions taken on public hearing items on this agenda may be limited to considering only those issues raised at the public hearing, or in written correspondence delivered to the City of San Luis Obispo at, or prior to, the public hearing. Rescission of the July 16, 2018, ARC action on modification to approved building design, and consideration of the application for modified design ap proval, pursuant to City Council final action and direction upholding in part and denying in part an appeal of the decision of the Architectural Review Commission denying changes to approved colors and building design for a remodeled commercial building, with a categorical exemption from environmental review; Case #: APPL 1070 2017, C-D Zone; 33 Tons, LLC, applicant. Architectural review of the single-family portion of the South Morro’s development within the Orcutt Area Specific Plan, including an exception for the rear yard setback. Plans include minor exceptions to driveway standards, the rear yard setback (10 -feet where 20-feet is normally required) and includes a temporary sales office during construction, in accordance with the Mitigated Negative Declaration ER-137-11 adopted by City Council Resolution No. 10462 (2013 Series); Case #: ARCH-1019-2017, R-2-SP Zone; SLO Orcutt, LLC, applicant. (Kyle Bell) 4. 40 Buena Vista Ave. Architectural review of a design modification to a previously approved single - family residence on a sensitive site. Plans include a new façade design, removal of the roof deck, and revisions to the previously approved exceptions including a building height increase of 7-feet, and a side yard setback exception of 10-feet where 13.5-feet is normally required, with a categorical exemption from environmental review; Case #: MOD-1734-2018, R-1-S Zone; Gary & Sonja Withey, LLC, applicant. Agenda Forecast ADJOURNMENT The next Regular Meeting of the Architectural Review Commission is scheduled for Monday, December 3, 2018 at 5:00 p.m., in the Council Hearing Room, 990 Palm Street, San Luis Obispo, California. APPEALS Any decision of the Architectural Review Commission is final unless appealed to the City Council within 10 days of the action. Any person aggrieved by a decision of the Commission may file an appeal with the City Clerk. Appeal forms are available in the Community Development Department, City Clerk’s office, or on the City’s website (www.slocity.org). The appropriate appeal fee must accompany the appeal documentation.
