SUBJECT: ACQUISITION OF EASEMENTS FOR THE RAMONA DRIVE TO
FOOTHILL BOULEVARD CLASS 1 PATH
RECOMMENDATION
Authorize the Mayor to execute easement and deed agreements in a total amount not to exceed
$423,700 including title and escrow charges in a fo rm subject to the approval of the City
Attorney.
DISCUSSION
Policy Context
In August of 2017, the Council adopted a Safe Routes to School Plan for Bishop’s Peak and
Pacheco Elementary Schools (Attachment A) and included all of its projects as an amendment to
the Bicycle Transportation Plan. In February of 2017, the Council adopted the Anholm Bikeway
Plan (Attachment B). Both adopted plans identify the construction of a bicycle and pedestrian
crossing signal at Foothill Blvd. and a Class I path crossing the Latter-Day Saints (LDS) Church
property. The proposed acquisition of these easements is necessary to implement these projects
and plans.
The project supports the Circulation Element goals to increase bicycle and pedestrian
transportation.
Background
As part of the 2017-19 financial planning process, Council gave strategic budget direction for
staff to pursue acquisition of easements on the LDS Church property (APN 052 -162-024 and
APN 052-162-025) for purposes of both the Class I Path as well as for a ne w park. Following
staff discussions with LDS Church officials, the Church responded that it was interested in
negotiating easements for purposes of the Class I Path, but not for a park.
The proposed Class I path would be located on the eastern edge of the LDS Church property,
providing a convenient connection to the proposed Ferrini crossing of Foothill Blvd. The
permanent easement area would include a 20’ wide easement located along the 168.79’ northern
portion of the property along Foothill Blvd and a 41 1.20’ portion of the eastern boundary
adjacent to the Foothill Plaza. The total permanent easement area is 11,360 sq. ft. Once
completed, the pathway will provide a connection for elementary school students to cross

Foothill Blvd with lower vehicular volumes and speeds than at Broad Street and Foothill, which
is where many elementary school students typically cross.
In order to independently determine the property’s value, t he City hired Dennis E. Greene, MAI,
SRA, a licensed real estate appraiser through a government real estate services firm, Hamner,
Jewell & Associates. Using accepted appraisal principles and procedures, the appraisal
determined the market value of the proposed permanent easement area as well as the market
value for a 6-month temporar y construction easement of 10’ wide adjoining the entire length of
the proposed bike and pedestrian path. The appraisal evaluated recent sales of comparable
properties and depreciated replacements costs and gave consideration for zoning, development
potent ial, and the income that the subject property can produce. The market value for both the
permanent easement and temporary construction easement was valued at $373,900.
However, the LDS Church disagreed with the evaluation given that the appraisal was base d on a
90% loss in utility to the owner as opposed to 100% loss in utility, a difference of $38,960. Staff
agrees with the 100% loss in utility given that City policy does not allow for a setback credit on
the remaining portion of the parcel should the owner decide to develop it.
Another aspect of the property negotiation involved future vehicular access to the undeveloped
property via Foothill Blvd in conjunction with a future development application on the LDS
Church property. Currently, access to the undeveloped property is via the existing driveway to
the Church. While the Church is supportive of the Safe Routes to School project, they are
concerned about cutting off access to the undeveloped property. Therefore, the Agreement
authorizes vehicular access from the LDS Church property to Foothill Blvd across the easement
area in conjunction with a future development application provided that the design and location
of said access is subject to the City’s engineering standards and must undergo the City’s re view
process.

Public Engagement
This project was identified as a result of the community outreach for the Safe Routes to School
Plan for Bishop’s Peak and Pacheco Elementary Schools which was adopted by the City Council
at a public hearing in August of 2017. The planning process for t he Plan included two
community meetings, and meetings with parents, residents, and the San Luis Coastal School
District. Other outreach efforts included an invitation to leave feedback on the project’s website

ENVIRONMENTAL REVIEW
This project was adopted as an amendment to the Bicycle Transportation Plan in August 2017
and included as an amendment to the Initial Study / Negative Declaration for the 2013 Bicycle
Transportation Plan.

In February 2017 the City Council adopted the Anholm Bikeway Plan which includes this right -
of-way acquisition and construction of the Foothill Ped/Bike Signal & Class I Path as the first
phases of plan implementation. Staff requests authorization to complete the easement acquisition
with the LDS Church for the temporary construction easement and permanent easement not to
exceed $423,700. The 2017-19 Financial Plan allocated $633,000 total funds for Phase 1 of the
Anholm Bikeway Plan, including the Foothill / Ferrini crossing in two CIP projects: Safe Routes

to School Implementation (Spec # 91376) and Broad Street Bicycle Boulevard (Spec # 91619).
A balance of $603,667 remains in these CIP project accounts including funding from SB1,
General Fund, and a SLOCOG Safe Routes to School grant. For the easements purchase,
$289,106 will come from SB1 and $134,594 from Measure G.
NEXT STEPS
This easement purchase is a component of the Anholm Bikeway Plan Phase I. Design is
currently underway of phase I improvements which include the path to be constructed on this
easement, the Bicycle/Pedestrian Signal at Foothill Boulevard, and the protected bike lanes on
Ramona. Const ruction is currently anticipated in the second quarter of 2019.
ALTERNATIVE
The City Council may decide not to authorize the completion of the easement agreements. Staff
does not recommend this option as it will not further the project, which is recommended in the
Anholm Bikeway Plan and the Safe Routes to School Plan for Pacheco and Bishop’s Peak
Elementary Schools.
