DETAILS: On 3/14/03, at approximately 0128 hours, Officer SALAZAR and I responded, in full police uniform, to 190 Crandall for the report of a vandalism. Upon arrival we were told that lemons had been thrown over the back fence from 1312 Foothill. The lemons had broken a window at 190 Crandall, refer to case #030314011 for details. After contacting the victims at the Crandall location Officer SALAZAR and I went to the complex at 1310 Foothill to attempt contact. ARREST DISPOSITION Misd. Box 1328 · San Luis Obispo, CA 93406 * (805) 781-7317 CA0400600 ADDITIONAL CASE NO, 030314008 Supplement No 0 When we arrived we heard loud talking coming from 1316 Foothill witch is across the driveway from 1312 Foothill. Officer SALAZAR knocked on the front door of 1316 to attempt contact with those residence. While she was knocking, the door from 1312 opened and S/Matthew SODERSTROM yelled, "What the fuck are you doing, get off of my property" and started running at me. SODERSTROM was standing approximately twenty feet from me when I first heard and saw him advance towards me. After SODERSTROM yelled this I announced myself as a police officer, by yelling, "Police, stop". While I yelled I shined my flashlight onto my chest so SODERSTROM could see my uniform. I also heard Officer SALAZAR yell, "Police". SODERSTROM continued out of his residence and ran towards me raising both of his fists to a boxing type stance. SODERSTROM approached at a full run and struck me in the forehead with his right, closed fist causing no injury. After hitting me in the forehead, SODERSTROM wrapped his right arm around my neck and his left arm around my chest. Because of the momentum SODERSTROM hit me with and because he had both arms wrapped around my chest and neck, I felt that he was attempting to tackle me and I was afraid for my own safety. I yelled at him to "Stop fighting, stop fighting" with no result. As SODERSTROM wrapped his left arm around me I had my arms raised to chest level in an attempt to block him. Because of this SODERSTROM'S left arm was under my arm and I was able to reach around my back and brake his grip. In order to avoid injury to myself, Officer SALAZAR or the suspect, I used a wrist/elbow control technique to take SODERSTROM to the ground. As he fell to the ground SODERSTROM put his right arm down in order to break his fall. Once SODERSTROM was detained on the ground Officer SALAZAR placed handcuff's on him. SODERSTROM was taken into custody for 243(b) PC without further incident. During my contact with SODERSTROM I could smell a strong odor of an alcoholic beverage coming from his breath when he slurred his words. SODERSTROM told me he did not realize he had hit a police officer but rather a friend. SODERSTROM told me that he and his friends often fight in the court yard when they are drunk as a form of entertainment. During a search of his person I found a CallD card in the name of "with a DOB of 1/2/79. The photo of 10 card resembled SODERSTROM. He told me that he was holding the 10 card for his friend for when they go to the bar's. SODERSTROM also said that he did not know it was illegal to have a friends 10 card. Once SODERSTROM was in custody he complained of pain in his right elbow. SODERSTROM told me he "Felt something" when he hit the ground. Sgt. STALEY responded to the scene and viewed SODERSTROM. There were no visible injuries to SODERSTROM and he was transported to General Hospital's E.R. for treatment. Once at the hospital SODERSTROM was treated by Dr. MALCOLM. I issued SODERSTROM a citation at the hospital and released him on his written promise to appear. DISPOSITION: Cleared by arrest. The suspects had fled to the Sigma Chi Fraternity complex located at 1310-1318 Foothill and had been reported to have been drinking. Officer Pfarr and myself arrived at the complex and found remnants of glass bottles and oranges strewn over the entirety of the driveway. The driveway is approximately 150 ft long with duplexes on either side. I attempted to make contact at the residence across the driveway from 1312 Foothill, as there were voices clearly audible, coming from the duplex. While Officer Pfarr and I waited for the door to be opened we heard a door open behind us. A male (later identified as S/Soderstrom) opened the front door to 1312 Foothill and yelled, "What the fuck do you want?" As Soderstrom yelled and us, we both identified ourselves as police officers. Soderstrom ran off of his porch towards Officer Pfarr with his fists clenched. I turned my attention back to the door in front of me because it began to open. My attention was now divided between watching Soderstrom and the two men standing in the doorway in front of me. I looked over my left shoulder at Officer Pfarr in time to see Soderstrom raise his right fist in the air as in to strike Officer Pfarr. I looked back at the two men in front of me to make sure they were not going to intercede in the contact between Officer Pfarr and Soderstrom. I advised both men to stay inside the house. I then turned to assist Officer Pfarr with Soderstrom. Officer Pfarr had taken Soderstrom's left arm and attempted to detain him on the ground. As Officer Pfarr took Soderstrom to the ground, Soderstrom outstretched his right arm towards the concrete driveway in an attempt to break his fall. I handcuffed Soderstrom and advised dispatch we had one subject detained. While Soderstrom was detained on the ground he repeatedly said, "I'm sorry. I didn't know you were the police. I thought you were the guys next door." Soderstrom was referring to the Sigma Nu Fraternity located at 190 Crandall. Soderstrom began to complain of right arm pain and Sgt. Staley was called to the scene. Per Sgt. Staley, Officer Pfarr transported Soderstrom to General Hospital for a medical clearance prior to booking. SEX HT ADDRESS, CITY, STATE, ZIP I PHONE OTHER PHONE WORI</SCHOOL PHONE : OTHER INFO/55;; SlO 8REW AKAs SCARS, r,lARKs, TATTOOS NARRATIVE: Follow Up Investigation I reviewed the original arrest report and reported vandalism detailing the incidents that occurred between the two fraternities at 190 Crandall Way and 1310-1318 Foothill Blvd on 3-13/14-03. Based upon that information I conducted follow up investigation to try and determine who was responsible for the breaking of a window at 190 Crandall Way and to locate witnesses to the assault on Officer Pfarr. Summary I was able to recover the actual item that was thrown through the window at 190 Crandall Way. In addition, I located witnesses who heard and saw the confrontation occur between Officer Pfarr and S/ Matt Soderstrom. These witnesses confirmed the details as reported by Officers Pfarr and Salazar. I have received information that W/and stated to others that they witnessed what they reported to be as an unprovoked attack on S/Soderstrom by the police officers that resulted in his suffering a broken arm. and are believed to be fraternity brothers of S/Soderstrom. refused to be interviewed when contacted and I have not yet located although he may be living in Truckee now. I also located witnesses that reported that and did not arrive at the location until after S/Soderstrom had attacked Officer Pfarr and had been arrested. Interview with Witness 3/28/03 at 1600 hrs related the following information: His roommate's bedroom window was broken by someone from the ex-fraternity that is located behind them. is a member of the Sigma Nu fraternity. The neighboring fraternity is or was Sigma Chi. Sigma Chi has been kicked off of campus for various problems. Late on the night of March 13 or morning of the 14th the guys who live at the neighboring fraternity were out of control. They had been making lots of noise, including sounds of things being broken and thrown. Suddenly he heard something break a window and it turned out to be part of a chair leg thrown through his roommate's bedroom window. didn't have much of a view from his bedroom window as he is located in the northern most bedroom (far left) of the two upstairs apartments. (His view allows him to see only the corner of the garage at the 1316 Foothill address.) He had no idea who threw the wood but knew it came from the guys behind them. said that his roommates were on spring break and that the item thrown through the window was locked up in his roommates bedroom. He had heard that the S/ charged across the driveway from his apartment when he saw someone standing on the opposite porch, thinking that it was another member of the fraternity with a flashlight. He heard that a fraternity member is known to try to control the more rowdy fraternity brothers. He did not know who the responsible fraternity member might be. I photographed the view from his bedroom window towards the area where the assault occurred. Later I booked the digital photos as evidence. Interview with 3/31/03 at 1530 hrs related the following information: He was not home when the window was broken. He lives in the same apartment as He said that he was across the street when the incident occurred. He came home and found police there. The assault had already occurred. gave me the broken chair leg that was thrown through the bedroom window. I noticed that the piece of wood looked like a wooden trim piece that might cover a metal base leg for a rolling office type chair. I photographed the wooden chair leg as well as the broken window and view towards the area where the assault occurred from inside his bedroom. The chair leg was retained as evidence and the digital photos booked in as evidence. Interview with 3/31/03 at 1540 hrs related the following information: He had been asleep that evening in the upper right apartment in the left side bedroom.. He awoke when he heard a lot of commotion, things getting broken, and general noise coming from the fraternity that lives behind them. He got up although he didn't continue to look out of his window constantly. He heard the window break but didn't know who had been responsible for it. Later, he heard someone shout, "What do you want? Get out of here" or words that were very similar. He then heard the same guy saying, "my arm, my arm, get off of me. I'm sorry." He looked outside knowing that the lights had been on next door. He noticed that the lights had been turned off when the police arrived. It was his belief from what he heard that guy had confronted the police officers. I photographed the view from his bedroom towards the other fraternity and noticed that there was a view of the front door of the apartment at 1316 Foothill from his bedroom window although it did not extend very far to the left of the door as you looked at it. The digital photos were later booked into evidence at this department. identified his roommates as and Interview with 3/31/03 at 1550 hrs related the following information: He had been in his bedroom when he saw the officers with flashlights walk up the driveway. He saw everyone that had been out there scatter. He heard the officers knock on the door of the apartment across the driveway and that faced the rear of his apt. He then heard someone yell in an aggressive tone, "What are you doing here." He then heard, "My arm". Page 4 of 8 San Luis Obispo Police Department P.O. He said it sounded like the suspect was crying as he was saying, "I'm sorry - I can't get arrested". said that he thought that there had been as many as 15-20 individuals on the driveway prior to the police showing up. After the police members of the other fraternity came over and stood in the parking lot of 190 Crandall next to the fence and were trying to stand up for their buddy and were confrontational. They were there for about 5 minutes before the police showed up and they ran off. I photographed the view from his bedroom window out towards 1316 Foothill which appeared to be a distance of no more than about 75 feet. The digital photos were returned to this department were returned to this department where they were entered into evidence. Interview with 31/03 1605 hrs I left apt and went next door to interview the occupants of 1316 Foothill based upon a statement from Officer Salazar that the unknown residents had opened up the door while Officer Pfarr was trying to deal with S/Soderstrom. Officer Salazar had told me that she had told the occupants of 1316 Foothill to stay back. related the following information: He had been in his bedroom studying with his stereo headphones on. He said that he was trying to not pay attention to what was going on. He said that he heard something but he didn't know what. He said he didn't know who had opened the door. And he didn't know who was in his apartment. Interview with 3/31/03 at 1610 hrs Newton arrived while I was interviewing in front of their apartment. said that he was home that evening inside the apartment but he didn't see anything and he didn't know who had opened the door. He added that he didn't remember anyone answering the door. and added that their other roommate, was not currently home but that he was present the night of the incident. They could not state who else was present on the evening in question. While speaking with and I had a conversation with other members of the fraternity that appeared to live in the apts at 1312 and 1314 Foothill. None of the people I spoke with had any information concerning the vandalism that had occurred to their neighbors window nor did they witness the confrontation that had occurred in the yard that night. Interview with Witness 4/10/03 at 1330 hrs. related the following information: He lives in the downstairs apt #2 but had been upstairs for about an hour listening to a lot of disturbing noise coming from the fraternity to the rear of their apartments. Something was thrown through the bedroom window of apt #4 and called the PD. spoke with the officers when they arrived. He watched as the officers approached the far side bungalow and knocked on the door (1316 Foothill). He saw someone peak their head out and converse with the officers as someone said loud enough for him to hear, "What are you doing hear?" or words similar to that. He also heard the comment, "We didn't do anything" or similar. He saw the individual cross the driveway and confront the officers. He said that the guy had gone across the driveway from the right side of the parking area separating 1310 from 1312 Foothill. He said that the guy had appeared drunk by the way that he walked with an unbalanced, stumbling stride. The guy got right in the face of the male officer (6 inches). The officer was in-between the guy and his view so he could not see what the guy did with his hands. He said that he was focused on the officers. He couldn't tell if the guy's hands were on the officer because of the position but that he was right in the officer's face when he saw the officer spin as he took the guy to the ground, out of sight further to the left of the apartment as he viewed the scene. The officer was kneeling and trying to gain control of the guy but he could only see the boots of the officer. He saw nothing that was improper or unusual. I,.CASE NO. 030314008 Supplement No 2 believed that the officer had tried to put the guy's arm behind his back and that it had been broken during the attempt. He remembered that other individuals arrived by vehicle as the officers were gaining control of the suspect. These other individuals arrived possible in a vehicle like a Chevy Suburban or maybe a pick up with a shell. He thought the vehicle was a dark color. He did remember that the occupants had questioned what was happening and that they seemed to be pissed at the cops although they didn't know what had happened. He believed that only one of the vehicle's occupants did the talking. He remembered that the female officer spoke with these people telling them to stay back. remembered that he did hear the suspect complain about his arm and it was after he was complaining that the vehicle occupants arrived and got out of their vehicle. also said that he saw the female officer deal with the occupants of the apt at 1316 Foothill after they got control of the suspect. He also recalled that he had heard the officers say, "SLOPO" when first knocking on the door. I asked if he knew as I was led to believe that had been one of the people who had arrived just during or after S/Soderstrom had been taken into custody. doesn't know but reported that other brothers know and it was believed that was talking when he exited the vehicle and that later was trying to mediate the confrontation that took place when members of the fraternity at 1310-1318 Foothill went to 190 Crandall Way. Interview with Witness 4/10/03 at 1515 hrs I telephoned the original RP/at his residence. related the following information: He had telephoned the PO because the other fraternity was throwing bottles at their own houses and then he thought that a lemon had been thrown through one of their windows at 190 Crandall. Later, the members of the other fraternity came around to the parking lot of 190 Crandall, threatening and looking for a fight. His fraternity brothers backed off and called the PO again. While they waited for the offices to arrive one of the members form the other fraternity tried to calm things down and said, "Come on, let's leave." Interview with Witness 4/10/03 1600 hrs I telephoned who related the following information: He didn't answer the door on the night when the conflict occurred on his front porch. He didn't know who did. He couldn't tell me how many people were in his apartment that night nor would he even estimate 5 or 20. He said that he knew people saw it but he didn't want to say anymore that just that he thought that had seen it. When asked, he thought that might have seen it as well. Interview with 4/14/03 1500 hrs I telephoned SLO Brew promotions manager at his cell phone number. He said that does work for him as a OJ two nights per week. He said that the OJ's play until 0140 hrs as a rule although sometimes they might go until 0145 hrs. He said that is pretty good about ending at 0140 hrs. It then takes him time to pack up and leave the business. He believes that drives a white pick up. He also said that works every Wednesday and Thursday evening and has done so for about the last 8 months. Interview with 4/14/03 1630 hrs I telephoned on his cell phone since I had no address or other way to get in touch with him. He said that he lives at 1318 Foothill. was reluctant to speak with me. He said he didn't have time right now. He said he was concerned that he didn't want anything that he said to be twisted around. I told him that he could bring a tape recorder or that I would tape the interview to insure that it was accurately documented. We agreed that I would call him back on Tuesday, 4/15, to arrange for an interview date and time. I asked about and learned that he was now living in Truckee. He did not provide a phone number for On Tuesday, 4/15, I telephoned to set up an interview. He refused to be interviewed. He said that he had been interviewed by a private investigator and had nothing to say to me. Physical Evidence The physical evidence collected consists of the wooden chair leg, digital photographs, and cassette tape recording of the conversation I had with the individuals at the complex at 1310-1318 Foothill although there was nothing of a truly evidentiary value obtained). The quality of the tape recording is poor due to radio wave interference associated with my cell phone. In addition, I have reviewed the in-car video tapes of the officers and supervisor who responded to 1316 Foothill. While there was no video of the actual location because the original responding officers left their vehicles parked on Crandall facing south, video tape number 3886 shows a white pick up driving east into the 1300 block of Foothill. There was also an audio conversation between the officers and some comments from S/Soderstrom on this same video tape #3886 as he was placed into the rear of the patrol vehicle and later at General Hospital. This video tape was assigned to Officer Pfarr and has been returned to the video tape evidence locker per dept procedures. I have also obtained copies of the radio logs and telephone calls from the original RIP's. It is my opinion that the time displayed on Officer Pfarr's in-car video tape recording is off by about 4 1/2 minutes when compared to the radio log time entries. Crocker and I responded to 1312 Foothill after Officers Pfarr and Salazar advised of an arrest at that location. Upon our arrival we contacted Officers Pfarr and Salazar along with Sf Soderstrom on the sidewalk area in front of 1312 Foothill. Sf Soderstrom was handcuffed and standing next to both Officers Pfarr and Salazar on the sidewalk. I asked the officers what had occurred and Officer Pfarr began to explain the circumstances which led to the arrest of SI Soderstrom. Upon hearing Officers Pfarr and Salazar's explanation of the event SI Soderstrom spontaneously stated that he did not realize that they were the police and he had believed that they were friends of his. SI Soderstrom repeated several times that he was not aware that Officers Pfarr and Salazar were the police when the incident had occurred. Officer Pfarr informed me that SI Soderstrom had a complaint of pain in his right arm. Officer Pfarr confirmed with SI Soderstrom where his arm hurt and SI Soderstrom indicated the area by his right elbow. I watched as Officer Pfarr examined the area of SI Soderstrom's elbow. I instructed Officer Pfarr to take SI Soderstrom to the hospital for medical clearance. I walked with Officer Pfarr and SI Soderstrom to Officer Pfarr's vehicle which was parked on Crandall. Officer Pfarr placed SI Soderstrom in the back of his unit and transported him to General Hospital. STALEY, I heard SODERSTROM explain that he "didn't know that they were police officers when he ran into them." SODERSTROM explained that he "thought the officers were some friends" of his that were playing a prank. He admitted running into the officers and, again, said he didn't know they were the police.
