Business Operations Plan Business Plan:A plan describing how the commercial cannabis business will operate in accordance with City code,state law,and other applicable regulations.The business plan must include plans for handling cash and transporting cannabis and cannabis products to and from the site. Community Relations Plan:A plan describing who is designated as being responsible for outreach and communication with the surrounding community,including the neighborhood and businesses,and how the designee can be contacted. State Licenses:Copies of the state licenses relating to the commercial cannabis business licenses,the applicant holds (when available). Tax Compliance:A current copy of the applicant’s city business operations tax certificate,state sales tax seller’s permit,and the applicant’s most recent year’s financial statement and tax returns (for first time applicants,the business operations tax account will be set up in-house after the application has been submitted). Insurance:The applicant’s certificate of commercial general liability insurance and endorsements and certificates of all other insurance related to the operation of the cannabis business. Community Benefit:The applicant shall demonstrate to the satisfaction of the City of its intent to local hiring and community support. Education Plan:A plan describing the type of cannabis education and prevention efforts that will be provided by the business to the community. Security Plan:A detailed security plan outlining the measures that will be taken to ensure the safety of persons and property on the business site. The security plan must be prepared by a qualified professional. Lighting Plan:A detailed lighting plan showing existing and proposed exterior and interior lights that will provide adequate security lighting for the business site. 5 Site and Floor Plans:A dimensioned site plan of the business site,including all buildings,structures,driveways, parking lots,landscape areas and boundaries.Also provide dimensioned floor plans for each level of each building that makes up the business site,including the entrances,exits,walls and cultivation areas,if applicable.The plans shall also include the following information about the site:current zoning,parking requirements,consistency with development standards for the zone,if new development planned for the site,and any other site development information. Water Efficiency Plan:The applicant shall demonstrate to the satisfaction of the City that sufficient water supply exists for the use. Odor Control Plan:A detailed plan describing how the applicant will prevent all odors generated from the cultivation,manufacturing and storage of cannabis from escaping from the buildings on the business site,such that the odor cannot be detected by a reasonable person of normal sensitivity outside the buildings. Hazardous Materials Plan:To the extent that the applicant intends to use any hazardous materials in its operations,the applicant shall provide a hazardous materials management plan that complies with all federal,state and local requirements for management of such substances. Energy Efficiency Plan:Documentation that the applicant has identified the best way,including carbon free power sources to provide reliable and efficient energy solutions for their business. H.City Authorization I, the applicant, provide authorization and consent for the City Manager or his/her designee to seek verification of the information contained on this application. I.Indemnification I,the applicant,agree to the fullest extent permitted by law,any actions taken by a public officer or employee under the City of San Luis Obispo regulations for Commercial Cannabis Businesses,shall not become a personal liability of any public officer or employee of the City.To the maximum extent permitted by law,the permittee shall defend (with counsel acceptable to the City),indemnify and hold harmless the City of San Luis Obispo,the San Luis Obispo City Council,and its respective officials,officers,employees,representatives,agents and volunteers from any liability,damages,actions,claims,demands,litigations,loss (direct or indirect),causes of action,proceedings,or judgments (including legal costs,attorneys’fees,expert witness or consultant fees,City Attorney or staff time, expenses or costs)against the City to attach,set aside,void or annul,any cannabis-related approvals and actions and strictly comply with the conditions under which such permit is granted,in any.The City may elect,in its sole discretion,to participate in the defense of said action and the permittee shall reimburse the City for its reasonable legal costs and attorneys’ fees. Focusing on Retail None storefront(mobile delivery), Processing, and Distribution. With the objective of providing high quality lab tested products to San Luis Obispo County at a cost effect price while supporting and educating the community. In order to stay in compliance with all local and state regulations Lab Tested SLO LLC will act in accordance with all local and state regulations. The Mobile Delivery will be providing third party lab tested cannabis and CBD products to members over the age of 21 with a valid government issued ID or to members with a state issued medical card and matching government issued ID in San Luis Obispo County. The products provided through the delivery service will include flower, concentrates, and edibles all of which will be labeled and packaged in compliance with regulations. All products will come from licenced facilities with a focus on supporting local. With the use of Metrc (California Cannabis Track and Trace) integrated programs Lab Tested Slo will be able to ensure all products distributed and processed are coming from state licensed sources. Cash Handling Product Transportation As Lab Tested Slo is a mobile delivery, distribution and processing company the movement of any and all cannabis products will be tracked in accordance with local and state regulations. All products to be distributed, delivered, or processed will be tracked via QR code connected to a system integrated with Metrc to ensure the highest level of tracking. All product being distributed to Lab Tested Slo will be done in accordance with local and state regulations ensuring all product is tracked and tested. To ensure the proper tracking of product all distribution, transport, and delivery vehicles will require GPS tracking to the extent required by local and state regulations and all product in vehicles must be properly checked out of the safe room prior to loading. The Delivery area will be used to pull vehicles into building so as to load and unload product inside building behind closed garage entry. 13 Community Relations Lab Tested Slo is committed to being a model community member and as such will outreach to the surrounding community and businesses to educate and inform of the new business, as well as to establish goals within the community of which Lab Tested Slo may donate volunteer hours and/or finances to achieve the desired outcomes of the communities goals. Through the designation of a primary partner of Lab Tested Slo all community relations will be done in a timely manner ensuring all community correspondence take place in a timely manner. Designated community relations director can be reached through email, social media, and phone. Upon local approval, state approval and receiving occupancy Lab Tested Slo’s community relations director will directly reach out to the local community and business supplying them with multiple methods of contact. The most basic of such information being a contact form. (Appendix A) State Licenses All state licences to be supplied upon receipt Tax Compliance Lab Tested Slo LLC was created January 2019 as such has not received tax documentation. All documentation will be supplied upon issuance. Lab Tested Slo LLC will follow all state and local tax regulations and will hire an outside CPA service to ensure compliance. Insurance Lab Tested Slo LLC will act in accordance with all state and local insurance requirements by obtaining all insurance requirements from local and state regulators. Lab Tested Slo LLC has already been working with California Meridian Insurance services, Inc. out of Paso Robles to obtain all necessary insurances. One of such applications which was provided by California Meridian Insurance and has been submitted is available in the appendices. (Appendix B) Budget Lab Tested Slo is a new company which makes it so there are no recent annual budgets available. As such an estimated first years budget page is included. (Appendix C) Financial Capacity The initial capital requirements for the company will be the initial city application fee, the yearly city license, as well as all state licensing fees. Other initial associated costs will include permits to operate a business, permits for site improvements, updating the site to meet local and state security requirements. The owners will fund a minimum of 50% and a maximum of 100% of all costs associated with licensing, building improvements, inventory procurement, and business expenses through personal funds. Should the company require more capital than the owners are able to provide through personal finance owners will either obtain a private loan, or bring on investors. Owners plan on implementing marketing strategies prior to opening to push merchandise sales, educate the public, and ensure market awareness so that upon opening there is brand recognition. 14 All initial capital needs will be covered by partners who have a bank balance of should these balances not prove to be sufficient funding owners will either obtain a private loan, or bring on investors. Owners have spoken with outside parties willing to loan the necessary monetary needs for the business to succeed as well as taken steps to find individuals in the local community who would purchase ownership in the company should it be necessary. Products and Services Lab Tested LLC will provide a variety of products and services to San Luis Obispo County including but not limited to cannabis and medical cannabis products (flower, concentrates, edibles, tinctures, topicals, vape cartridges), distribution services(transportation and storage), and processing(packaging and post production needs). Other products and services include CBD(flower, topicals, consumables), merchandise, as well as educational materials, resources, and programs for the community. The product being distributed and sold through Lab Tested SLO will vary in potency. Potency will be listed on packaging along with state warning logos. Community Benefit Staffing Lab Tested Slo is committed to the San Luis Obispo community with plans on hiring 90% or more of its employees from the local San Luis Obispo Community. In an effort to support the local communities Lab Tested Slo plans on compensating employees at or 40% above the average median entry level positions ensuring compensation is competitive. Community Support Lab Tested Slo will implementing methods to support the local community. With sourcing a minimum of 80% of all product and equipment from local businesses, donating a minimum of 20h per month to the local community through volunteering, and supplying educational resources. The owners of Lab Tested Slo have already participated in community support through supporting the integrity and safety of our coastlines and beaches by joining and assisting organizations with the removal of over 600lbs of waste. The owners of Lab Tested Slo plan on committing a minimum of $1000 per month to support community programs, local non profit organizations and youth programs. Lab Tested Slo plans on supporting its direct industrial community through multiple avenues most notably committing to significantly improve facilities including but not limited to upgrading and rebuild gated areas around trash, supplying of receptacle for recycling as well as landscaping and maintenance needs. Educational Plan Cannabis Education With the legalization of cannabis many people are seeking answers to many questions regarding the cannabis and CBD industry as such Lab Tested Slo will provide multiple resources for the community to ensure all community members seeking information are provided with ample information and resources of the effects, research that's been done, potential side effects, negative and beneficial outcome of its 15 use. All resources will be available on Lab Tested Slo’s webpage with connecting the community to local educational programs as well as indicating dates that Lab Tested Slo will be holding informational programs, options to view the latest research and development in cannabis. Other education programs will be implemented in the direct industrial community through the Community Relations Director to educate, inform, and supply resources so that all questions may be answered. Prevention Efforts With the goal of supporting the community Lab Tested Slo will strictly follow all state and local regulations ensuring no person under the age of 21 will be able to obtain cannabis with resources available to educate and inform parents of preventive and educational methods. Other methods of prevention will include following local and state regulations regarding packaging ensuring all products are not labeled or marketed in a manner that would be considered appealing to those under 21 and ensuring all product is sold in state compliant child proof packaging. The described location is connected to city water which will allow for ample water for the business use as the business has limited water needs. Odor Control Plan Odor Control This facility will use industry best practices and leading edge technology as well as any equipment or technology mandated by the City of San Luis Obispo and state regulators to prevent odor issues at the business facility including: Exhaust air filtration system with carbon filters/scrubbers will be used to prevents internal odors from being emitted externally. The carbon air filters will “scrub” the odor from the air which neutralizes the odor before it is exhausted out. Equipment specs: 12" High Velocity Blower fan with a 48” Carbon Filter Inline fans are perfect for carbon filters. Controls odors and keeps rooms cool with this compact metal fan. 295-watt, 12-inch fan pushes 1,050 cubic feet per minute. 16 In less than 2 minutes all of the air in the business will circulate through the Fan & filter combo completely removing all of the odor. Great for large spaces. Carbon filter is Packed with highly porous charcoal. Carbon Filter eliminates all odors as the air is forced by the millions of open fissures in the packed charcoal. In addition Ona Gel Blocks which were originally developed to control the smell of sewage facilities will be used. Ona Gel Blocks are remarkably effective at neutralizing odors and leaving a pleasant fresh scent which will be circulated through the business. Hazardous Materials Plan Hazardous Materials Lab Tested Slo plans on using little to no hazardous materials in operation, any and all hazardous materials will be stored in a locked cabinet with signs indicating hazardous materials storage area. Personal Protective Equipment such as safety goggles, rubber gloves, emergency eye wash kit, and tyvek suits will be kept on site. Waste Management All general waste generated through business will be disposed of through onsite dumpster bins which are maintained weekley by local waste management company. Any and all waste that might include cannabis product will will rendered unusable and disposed of as required by State and local regulations through a licensed waste management company. Energy Efficiency Plan Energy efficiency LabTested SLO LLC will implement best management practices to ensure a minimized carbon footprint. By using LEED certified LED lights in the place of high consumption fluorescent light fixtures as well as the use of LEED and Energy Star certified appliances Lab Tested SLO will greatly reduce its energy consumption.
