Iii Community Benefit: The applicant shall demonstrate to the satisfaction of the City of its intent to local hiring and community support. Ii] Education Plan: A plan describing the type of cannabis education and prevention efforts that will be provided by the business to the community. Iii Security Plan: A detailed security plan outlining the measures that will be taken to ensure the safety of persons and property on the business site. The security plan must be prepared by a qualified professional. Iii Lighting Plan: A detailed lighting plan showing existing and proposed exterior and Interior lights that will provide adequate security lighting for the business site. Ii] Site and Floor Plans: A dimensioned site plan of the business site, including all buildings, structures, driveways, parking lots, landscape areas and boundaries. Also provide dimensioned fioor plans for each level of each building that makes up the business site, Including the entrances, exits, walls and cultivation areas, If applicable. Ii] Odor Control Plan: A detailed plan describing how the applicant will prevent all odors generated from the cultivation, manufacturing and storage of cannabis from escaping from the buildings on the business site, such that the odor cannot be detected by a reasonable person of normal sensitivity outside the buildings. 1!11 Hazardous Materials Plan: To the extent that the applicant Intends to use any hazardous materials in its operations, the applicant shall provide a hazardous materials management plan that compiles with all federal, state and local requirements for management of such substances. Co mmercial Ca nnabis Bu sines s Pe r mi t Pursuant to SLOMC 17.99.050.A., Native Bliss will not operate or conduct a commercial cannabis activity or Commercial Cannabis Business without first obtaining both the Commercial Cannabis Business Permit from the City pursuant to Chapter 9.10 of this code and a use permit from the City pursuant to this chapter, to conduct the commercial cannabis activity at a specific location. Any permit authorizing commercial cannabis activity pursuant to this chapter will be conditioned upon the holder obtaining and maintaining a City Commercial Cannabis Business Permit and the appropriate state license for the activity. Limitations on City 's Liability Pursuant to SLOMC 9 .10.260, the City will not be liable for issuing, or failing or refusing to issue, suspending, revoking or failing to renew the Commercial Cannabis Business Permit pursuant to this Chapter or otherwise approving or disapproving the operation of any Commercial Cannabis Business pursuant to this Chapter. Pursuant to SLOMC 17.99.050.E.6), Native Bliss will ensure the following prohibitions are enforced at its facility at all times: Prohibition of on-site consumption of cannabis Prohibition of the possession, storage, sale, distribution or consumption of alcoholic beverages on the premises, or the holding of license from the State Division of Alcoholic Beverage Control for the sale of alcoholic beverages, or operating a business that sells alcoholic beverages, on or adjacent to the commercial cannabis activity site. No cannabis products or cannabis accessories will be displayed in windows or visible from the public right-of way or from places accessible to the general public 37 o Prohibition of minors and persons under the age of 21 on the premises, even if accompanied by a parent or guardian. o Outdoor storage of cannabis or cannabis products is prohibited. Inspection and Enforcement Unscheduled Inspection during Business Hours Pursuant to SLOMC 9.10.140 .A., the City Manager or his/her designee and any other City of San Luis Obispo official or inspector charged with enforcing any provisions of this Code, may enter Native Bliss at any time during the hours of operation without notice for the purpose of inspecting Native Bliss for compliance with the provisions of this Code, the terms and conditions of the Commercial Cannabis Business Permit or any other City permit or state license, including inspection of the recordings and records maintained pursuant to this Chapter or the applicable provisions of State law. The right to inspect under this inspection includes the right to copy recordings and records. lntetference with Inspection Pursuant to SLOMC 9 .10.140.B., it is unlawful for any person who owns, operates, manages or is employed by, or has any responsibility over the operation of, Native Bliss, to refuse to allow, or to impede, obstruct, or interfere with, an Inspection by the City, or the City's review or copying of recordings (·including audio and video recordings) and records, or to conceal, destroy, alter or falsify any recordings or records. Obtaining Samples Pursuant to SLOMC 9.10.140.C., the City Manager or his/her designee or any other person charged with enforcing the provisions of this Chapter may enter the location of Native Bliss at any time during the hours of operation and without notice to obtain samples of cannabis and cannabis products to test for law enforcement and/or public safety purposes. Any samples obtained by the City of San Luis Obispo will be logged, recorded, and maintained in accordance with City of San Luis Obispo Police Department standards for evidence. At all other times, the City Manager or his/her designee may enter the location of Native Bliss to obtain samples of cannabis upon reasonable notice, as otherwise authorized by law or pursuant to a warrant. Indemnification, Insurance, Reimbursement, Consent Pursuant to SLOMC 9.10.160, as a condition of approval of the Commercial Cannabis Business Permit Issued pursuant to this Chapter, Native Bliss will, at a minimum: Execute an agreement to protect, indemnify, defend (at its sole cost and expense with counsel approved by City), and hold the City of San Luis Obispo and Its officers, employees, attorneys, representatives, and employees harmless from and against any and all claims, demands, losses, damages, injuries, costs, expenses including attorneys' fees) fines, penalties, or liabilities arising from, related to or associated with: the issuance of the Commercial Cannabis Business Permit or use permit; the permitting or approving the operation of a Commercial Cannabis Activity; the collection of any fees, taxes, or charges from Native Bliss; Native Bliss's or any of its owners', operators', managers', employees, or employees' violation of any federal, state or local laws; the City's suspension, revocation or refusal to renew the Commercial Cannabis Business Permit. o Maintain insurance with standard City coverages and limits, but with additional conditions thereon deemed necessary by the City Attorney. Reimburse the City of San Luis Obispo for any and all costs, expenses, attorney fees, fines, penalties and court costs that the City of San Luis Obispo may be required to pay as a result of any legal challenge related to the City's approval of the Commercial Cannabis Business Permit pursuant to this Chapter or any other City permit or the City of San Luis Obispo's approval of the operation of a Commercial Cannabis Activity. The City of San Luis Obispo may, at its sole discretion, participate at Its own expense in the defense of any such action, but such participation will not relieve the obligations imposed under this Chapter. Consent to unscheduled inspections, production of records and recordings, and obtaining of samp le s of ca nnabis and cannabis products by authorized City officials during normal operating hours as provided in this chapter. Designated M and A Commercial Cannabis Activity Pursu a nt to 16 CCR§ 5032: Native Bliss will conduct all commercial cannabis activity only with other licensees, and as a Retail licensee, with customers in accordance with chapter 3 of this division. City Commercial Cannabis Permit Required Pursuant to SLOMC 9.10.040.A., Native Bli ss will not engage In Commercial Cannabis Activity or have an ownership interest in, operate, or manage, a Commercial Cannabis Business without obtaining and co ntinuously maintaining the Commercial Cannabis Busine ss Permit pursuant to this chapter. 39 Commercial Cannabis Operator Permit a nd St ate Lic ense (s) Required Pursuant to SLOMC 9.10.040.B., Native Bliss will not own, conduct, manage, operate, engage or participate in, work or volunteer at a Commercial Cannabis Activity or Commercial Cannabis Business that does not have a valid Permit issued pursuant to this chapter and other City permits or licenses required by this Code, in addition to the appropriate licenses. required by state law to conduct the Commercial Cannabis Activity. Ho urs of Operation Pursuant to SLOMC 9.10.250.C., Native Bliss's Operating Hours will be, at a maximum: Retail -Storefront. 9AM-8 PM Retail-Non-Storefront (Delivery Services): 6 AM-10 PM. Finished, dried, manicured, cured Cannabis will be sold in .Sg increments. Native Bliss plans to begin with 25-50 medicinal varieties of Cannabis. A Cannabis edible is a THC-infused product that can be consumed by the client. Infusing Cannabis into foods is a long-practiced and very effective method to use Cannabis as medicine. Native Bliss plans to offer several different edible product lines to cater to the various, nutritional, financial and taste needs of clients. Infusing Cannabis Into foods is a long-practiced and very effective method to use Cannabis as medicine. Careful dosing Is Important. Edibles can be used as effectively as smoking or vaporizing. This may include beverages, coffees, pastries, chocolates, and gummies. Edibles can be as effective as smoking or vaping. This type will ensure clients have a variety of consumption methods that suit each person's needs and lifestyle. Our line is designed to provide high levels of cannabinoids and THC in a readily accessible form which provides instant relief for serious conditions. A Cannabis tincture is a cannab is-based extract that is infused with alcohol. Typically, the flowers and trim leaves are used. This product 40 Topicals Dispensing Devices provides easy dosing for clients with rapid absorption. This line is designed to make dose control easy for clients, with rapid absorption and effect. Tinctures can be flavored for better taste. Topicals are ideal for assisting clients who are arthritic or have aching injuries. Topicals have an analgesic and anti-inflammatory effect to reduce or eliminate pain. These will be developed in the forms of sprays or lotions. Customers will be able to purchase the dispensing device associated with the Cannabis product that is purchased. This will include bongs, vape pens, bowls, pipes, and papers. Retail Store Customer Care Plan The following is a description of procedures that Native Bliss and its employees will follow to provide Customer Care. Native Bliss places Customer Care as one of its highest priorities. Members of the retail store team will be trained to follow all of these procedures. The Retail Storefront will be open to dispense to registered customers and patients at the following proposed schedule, pending approval from the City of San Luis Obispo (and to be adjusted to any restrictions mandated by city officials and law enforcement.) Delivery sales will be conducted via telephone orders or online orders, after customers and patients have been verified and registered in person according to state and local regulations. 41 Retail Store Agents Native Bliss's Retail Store Manager, Retail Store Receptionist(s), and Retail Store Agents are hired specifically to provide Customer Care. Other retail store employees may aid in Customer Care. For example, the security team will contribute to overall Customer Care by providing guest safety. The members of the security team are the security manager and the Security Guards. Retail Store Manager The Retail Store Manager is responsible for the Retail Store Receptionist(s) and employees, and will train all receptionists and employees in Customer Care procedures and execute all patient and community education plans. These are not the sole duties of the Retail Store Manager; other responsibilities may be assigned to the Retail Store Manager by the Facility Manager. Retail Store Receptionist The Retail Store Receptionist(s) will be responsible for handling all procedures regarding patients entering and exiting the retail store. This Includes greeting patients, scheduling visits, updating patient, retail store, and state recording systems, scheduling deliveries, and using the point of sale system to dispense products to customers. The duties listed are not exhaustive; additional responsibilities may be assigned by the Retail Store Manager or other members of the management team. Retail Store Agents Retail Store Agents will be responsible for consulting and advising patients on, at a minimum, the patient's medical cannabis recommendation, the products and accessories sold at the retail store, and possible routes of administration. Retail Store Agents will be responsible for checking a patient's recommendation and records to see how much and what kind of product the patient Is permitted and whether they have surpassed or may surpass the purchase and possession limits provided by state law. The duties listed here are not exhaustive; additional responsibilities may be assigned by the Retail Store Manager or other members of the management team. Security Manager The security manager is responsible for the retail store's security needs. Where Customer Care is concerned, the security manager will be responsible for making sure that the facility is a secured place where the customer can 42 obtain medical cannabis without fear. The security manager is also responsible for training all Security Guards in the performance of all security tasks. Security Guards Security guards are responsible for con trolling access to the retail store. They will verify the identity of all persons wishing to enter the retail store and ensure that only authorized Individuals with permitted items are allowed inside. Sec urity Controls Customer Care Procedure s Guest Arrival Obtaining Identification The Security Guards at the retail store w ill be the first line of Customer Care. They will ask all guests to provide identification and be trained to check for fake Identification and registration cards. When obtaining identification, Security Guards will always keep the information away from other emp loyees and visitors. Secur ity guards will refuse entrance to any visitor without valid Identification. Security guards sha ll know which individuals are permitted at the retail store and which are not. If an unauthorized person attempts to enter the retail store, a Security Guard will alert other members of the security team, and, if necessary, local law enforcement. Below is a list of persons authorized to be on the retail store property: Owners and board members; Management, employees, and interns; Agents of firms contracted to work with the retail sto re; 43 e Other authorized personnel; Law enforcement officers and first responders; Other federal, state, or local government officials, when necessary to perform essential functions or duties; Laboratory employees, who may enter a facility for the sole purpose of identifying and collecting medical or adult use cannabis samples for purposes of conducting laboratory tests; Registered customers' designated caregivers; and Other guests permitted to be at the retail store. Once a Security Guard has checked a guest's identification, the guard will instruct the guest to proceed immediately to the Retail Store Receptionist. The Retail Store Receptionist will use the patient records system to check-in the customer; other guests shall be entered in the visitor log. Visitors All persons who are not employed by or contracted to work for the retail store, or who are not registered customers, will be considered visitors. After a visitor has been permitted entrance to the retail store by a Security Guard, the Retail Store Receptionist will obtain their government-issued identification and make a copy to be saved in the visitor log. The Reta II Store Receptionist will immediately take the Identification from the visitor, make only the required number of photocopies, and then promptly return the identification to the visitor. The receptionist will not put the identification down at any point, will not hand the identification off to anyone else, and will not place copies of the identification anywhere but in the visitor log. The Retail Store Receptionist will be responsible for ensuring that each visitor to the retail store makes a complete entry into the visitor log. A complete entry will contain the name of the visitor, the date and time the visitor entered the retail store, the purpose of the visit, the time when the visitor leaves the retail store, and the visitor's signature. The visitor log will be kept for at least two years and may be made available to state and law enforcement agencies upon reasonable request. When the visitor Jog is complete the Retail Store Receptionist will give a visitor badge to the visitor and instruct the visitor to display the badge prominently on their clothing. The Retail Store Receptionist will then require the visitor to sign an agreement to not disclose any trade secrets or confidential information that the visitor sees while at the retail store, unless disclosure is required by the state or local law enforcement. The Retail Store Receptionist will instruct visitors that they must be escorted throughout the retail store by a retail store agent and that they will be required to leave the retail store if they do not remain with the retail store agent at all times. Once it is determined which agent will escort the visitor around the retail store, the Retail Store Receptionist will assign the visitor to that agent. Once the visit is complete, the visitor will be escorted back to the Retail Store Receptionist, where they will surrender their visitor badge and sign out on the visitor log. There may be occasions when it is impractical to obtain prior permission or to complete the visitor arrival procedures, such as first responders in an emergency. In these instances, after the onset of the emergency, managers will record the name and affiliation of the visitor along with the purpose, date and time of the visit. 44 Managers will monitor the visitor and be responsible for completing a log of the visit, including the time of departure. New Customers When a patient or designated caregiver visits the retail store for the first time, the Retail Store Receptionist will need to create a new patient file. The Retail Store Receptionist will give the new patient or designated caregiver a secured Health Insurance Portability and Accountability Act (HIPAA) compliant tablet on which to input: The patient's name and state registration number; The designated caregiver's name and state registration number (if applicable); The patient's date of birth; The patient or designated caregiver's phone number, e-mail address, and mailing address; The name and phone number of the physician who issued the patient's recommendation; The reason for the patient's visit, including symptoms and a history of their medical condition; A description of the patient's lifestyle, such as eating habits and exercise routines; and An indication as to whether the customer anticipates requesting medical or adult use cannabis delivered to their home in the future. If so, they will answer a series of security questions that will be used to verify their identity when placing future orders for delivery. The Retail Store Receptionist will scan and make a copy of the new customer's government issued identification. For Medical Cannabis patients and caregivers, the Retail Store Receptionist will also scan and make a copy of their: Medical cannabis registration card; and Physician's medical cannabis recommendation. If the patient does not provide a copy of the physician's recommendation, they may have their recommending physician's office fax one to the retail store. Otherwise, the patient will need to leave and return with their recommendation. While creating the new customer file, the Retail Store Receptionist will verify a medical patient's physical recommendation against their recommendation as entered in the state's data network. The Retail Store Receptionist will also check that the recommendation has not expired or become invalid for any reason. Native Bliss will alert the state of each new patient that visits the retail store. For adult use customers, the Retail Store Receptionist will verify if the customer has already bought the state limit for adult use purchases. The Retail Store Receptionist will also need to query the state's data network to determine if the customer has been dispensed cannabis products at any other retail store, and If so, how much and when. Native Bliss is responsible for ensuring that customers who have surpassed legal possession limits are not served, and that no sales are made that may push a customer over the legal possession limit. When the receptionist releases a client to a Retail Store Agent, they'll include updates from the data network and patient record, if relevant. 45 Existing Customers After determining that a patient is an existing patient, the Retail Store Receptionist will give the patient a tablet for them to update their patient file and indicate the reason for their visit. The patient's file will only be accessible by authorized retail store employees. The Retail Store Receptionist will update the patient's record with the new information from the tablet along with information obtained from the data network indicating the patient's registry status and any medical cannabis product dispensed to the patient within the past thirty (30) days. The Retail Store Receptionist will provide these updates to the Retail Store Agent. Customer Consultations Customer consultations will begin at 8 a.m. from Tuesday to Friday and at 10 a.m. on Saturday and Sunday. The Retail Store Receptionist will make sure to follow the schedule of appointments and that all walk-ins are assigned to a specific Retail Store Agent. Customers with appointments will be seen first. Appointments will be made at the beginning of each hour. Walk-ins will be handled between appointments as they arrive. Retail Store Agents Retail Store Agents will be trained on reading patient recommendations and properly dispensing medical cannabis, derived products, and accessories with educational and informational material. Retail Store Agents will attend training classes on how to evaluate medical cannabis regimens and medication-related problems. They will also attend classes on examining patients in a holistic manner, which will allow them to educate patients about lifestyles choices and how they affect treatment regimens. Retail Store Agents will be able to inform the patients on the entirety of the retail store's inventory, as well as advise and educate each patient based on their individual needs. Customer Consultation Rooms The Retail Store Agent will take the customer from the waiting room into a consulting room. While escorting the customer throughout the facility, the Retail Store Agent will ensure that the customer remains within their line of sight. Once In the consultation room, the Retail Store Agent will answer questions and provide information to the customer. The Retail Store Agent will review the patient's recommendation to see what product the physician recommended and how much product the patient may receive within thirty (30) days. The Retail Store Agent will review with the patient the types of medical cannabis and derived products available at the retail store, as well as how to properly dispose of medical cannabis and derived products. They will also discuss signs of illness or dependency from medical cannabis and derived products and answer questions to help the patient select medical cannabis. The Retail Store Agent will instruct the patient on proper administration, and provide both required and optional literature. Providing Products After all of the patient consultation procedures have been followed, the Retail Store Agent will collect the medical cannabis or derived product and bring it to the Retail Store Receptionist for check-out. The Retail Store Agent will also provide the Retail Store Receptionist with updates to the patient file. 46 If a Retail Store Agent is not available, or a customer does not require a consultation, another agent may assist the customer with their purchase and escort them back to the Retail Store Receptionist. However, only Retail Store Agents and managers will be permitted to disp ense medical cannabis and derived products. Customer Departure Before a patient leaves the retail store, the Retail Store Receptionist will verify that the patient file has been wholly updated, including an accurate reflection of the medical cannabis being dispensed. Before handin g over the dispense d item s, the receptionist will also make sure that all appropriate lab els are affixed to the packaging, that the packaging is compliant, and that all necessary additional inserts are included. The Retail Store Receptionist will collect payment for the medica l cannabis . Non -Storefront (Delivery) Operations Plan Pursuant to 16 CCR§ 5415: All deliveries of cannabis goods will be performed by a delivery employee of a retailer. Each delivery employee of a retailer will be at least 21 years of age . All deliveries of cannabis goods will be made in person. A delivery of cannabis goods will not be made through the use of an unmanned vehicle . The process of delivery begins when the delivery employee leaves Native Blis s's licensed premises with the cannabis goods for delivery. The process of delivering ends when the delivery employee returns to Native Bliss's licensed premises after delivering the cannabis goods to the customer{s). During the process of delivery, Native Bliss 's delivery employee may not engage in any activities except for cannabis goods delivery and necessary rest, fuel, or vehicle repair stops. A delivery employee of a retailer will, during deliveries, carry a copy of Native Bliss 's current license, the employee's government-issued identification, and an identification badge provided by the employer pursuant to section 5043 of this division. Native Bliss will maintain an accurate list of Native Bliss 's delivery employees. Prior to providing cannabis goods to a delivery customer, a delivery employee will confirm the age and identity of the customer. Delivery Vehicle Requirements Pursuant to 16 CCR§ 5417: Native Bliss's delivery employee, carrying cannabis goods for delivery, will only travel in an enclosed motor vehicle. Any vehicle used in the delivery of cannabi s goods will be operated by a delivery employee of Native Bliss. Only Native Bliss or an employee of Native Bliss licensee for whom delivery Is being performed will be in the delivery vehicle . 47 While carrying cannabis goods for delivery, Native Bliss's delivery employee will ensure the cannabis goods are not visible to the public. Cannabis goods will be locked in a box, container, or cage that is secured on the inside of the vehicle. For purposes of this section, the inside of the vehicle includes the trunk. Native Bliss's delivery employee will not leave cannabis goods in an unattended motor vehicle unless the motor vehicle is locked and equipped with an active vehicle alarm system. A vehicle used for the delivery of cannabis goods will be outfitted with a dedicated Global Positioning System GPS) device for identifying the geographic location of the delivery vehicle. A dedicated GPS device must be owned by Native Bliss and used for delivery only. The device will be either permanently or temporarily affixed to the delivery vehicle and will remain active and Inside of the delivery vehicle at all times during delivery. At all times, Native Bliss will be able to identify the geographic location of all delivery vehicles that are making deliveries for Native Bliss and will provide that information to the Bureau upon request. Upon request, Native Bliss will provide the Bureau with information regarding any motor vehicle used for the delivery of cannabis goods, including the vehicle's make, model, color, Vehicle Identification Number, license plate number and Department of Motor Vehicles registration information. e Any motor vehicle used by Native Bliss to deliver cannabis goods is subject to inspection by the Bureau. Vehicles used to deliver cannabis goods may be stopped and Inspected by the Bureau at any licensed premises or during delivery. Cannabis Goods Carried During Delivery Pursuant to 16 CCR§ 5418(a), Native Bliss's delivery employee will not carry cannabis goods in the delivery vehicle in excess of $10,000 at any time. The value of cannabis goods will be determined using the current retail price of all cannabis goods carried by, or within the delivery vehicle of, Native Bliss's delivery employee. Pursuant to 16 CCR§ 5418(b), a delivery employee may only carry cannabis goods in the delivery vehicle and may only perform deliveries for one licensed retailer at a time. A delivery employee must depart and return to the same licensed premises before taking possession of any cannabis goods from another licensee to perform deliveries. Pursuant to 16 CCR§ 5418(c), Native Bliss's delivery employee will not leave the licensed premises with cannabis goods without at least one delivery order that has already been received and processed by Native Bliss. Pursuant to 16 CCR§ 5418(d), before leaving the licensed premises, Native Bliss's delivery driver will have a delivery Inventory ledger of all cannabis goods provided to Native Bliss's delivery driver. For each cannabis good, the delivery inventory ledger will include the type of good, the brand, the retail value, the track and trace identifier, and the weight, volume or other accurate measure of the cannabis good. After each customer delivery, the delivery inventory ledger must be updated to reflect the current Inventory in possession of Native Bliss's delivery driver. Pursuant to 16 CCR§ 5418(e), Native Bliss's delivery driver will maintain a log that includes all stops from the time Native Bliss's delivery driver leaves the licensed premises to the time that Native Bliss's delivery driver returns to the licensed premises, and the reason for each stop. The log will be turned in to Native Bliss when Native Bliss's delivery driver returns to the licensed premises. Native Bliss must maintain the log as a commercial cannabis activity record as required by this division. 48 I Pursuant to 16 CCR § 5418(f}, prior to arrival at any delivery location, Native Bliss must have received a delivery request from the customer and provided the delivery request receipt to Native Bliss's delivery driver electronically or in hard copy. The delivery request receipt provided to Native Bliss's delivery driver will contain all of the information required in section 5420 of this division, except for the date and time the delivery was made, and the signature of the customer. Pursuant to 16 CCR § 5418(g), immediately upon request by the Bureau or any law enforcement officer, Native Bliss's delivery driver will provide: o All delivery inventory ledgers from the time Native Bliss's delivery driver left the licensed premises up to the time of the request; All delivery request receipts for cannabis goods carried by the driver, in the delivery vehicle, or any deliveries that have already been made to customers; and The log of all stops from the time Native Bliss's delivery driver left the licensed premises up to the time of the request. Pursuant to 16 CCR § 5418(h), if Native Bliss's delivery driver does not have any delivery requests to be performed for a 30-minute period, Native Bliss's delivery driver will not make any additional deliveries and will return to the licensed premises. Required meal breaks will not count toward the 30-mlnute period. Pursuant to 16 CCR§ 5418(1), upon returning to the licensed premises, all undelivered cannabis goods will be returned to inventory and all necessary inventory and track-and-trace records will be updated as appropriate that same day. Cannabis Consumpt ion During De livery Pursuant to 16 CCR§ 5419, Native Bliss's delivery employees will not consume cannabis goods while delivering cannabis goods to customers. Delivery Request Receipt Pursuant to 16 CCR§ 5420, Native Bliss will prepare a hard copy or electronic delivery request receipt for each delivery of cannabis goods. The delivery request receipt will contain the following: The name and address of Native Bliss; The first name and employee number of Native Bliss's delivery employee who delivered the order; The first name and employee number of Native Bliss's employee who prepared the order for delivery; The first name of the customer and Native Bliss-assigned customer number for the person who requested the delivery; The date and time the delivery request was made; The delivery address; A detailed description of all cannabis goods requested for delivery. The description will include the weight, volume, or any other accurate measure of the amount of all cannabis goods requested; 49 The total amount paid for the delivery, including any taxes or fees, the cost of the cannabis goods, and any other charges related to the delivery; and Upon delivery, the date and time the delivery was made, and the handwritten or electronic signature of the customer who received the delivery. At the time of the delivery, the delivery employee of Native Bliss will provide the customer who placed the order with a hard or electronic copy of the delivery request receipt. The delivery employee will retain a hard or electronic copy of the signed delivery request receipt for Native Blis s's record s. Delivery Route Pursuant to 16 CCR§ 5421, while making deliveries of cannabis goods, Native Bliss's delivery employee will only travel from Native Bliss's licensed premises to the delivery address; from one delivery address to another delivery address; or from a delivery address back to Native Bliss's licensed premises. A delivery employee of Native Bliss will not deviate from the delivery path described in this section, except for necessary rest, fuel, or vehicle repair stops, or because road conditions make continued use of the route unsafe, impossible, or impracticable. Signage Plan Dual Permits Posted and Visible Pursuant to SLOMC 9.10.060.A., a copy of Native Bliss's Commercial Cannabis Business Permit issued by the City of San Luis Obispo pursuant to this Chapter, together with a copy of the appropriate state licenses. for the Commercial Cannabis Activity being conducted, will be posted and readily visible to the public at all times, at each location where Commercial Cannabis Activity occurs. Production of Originals for Inspection Pursuant to SLOMC 9.10.060.B., Native Bliss will produce for inspection and copying, upon request of a City inspector, code enforcement officer, or City police officer during normal operating hours, the original of the current and valid City of San Luis Obispo Commercial Cannabis Business Permit and the appropriate, current and valid licenses. of the State of California for the Commercial Cannabis Activities. or Commercial Cannabis Business.es. being conducted. Staffing Plan Native Bliss has a comprehensive staffing plan in place to guide recruitment, hiring, training and managing its employees. Highlights of the plan feature : Precise definition of responsibilities Clearly understood chains of authority Well-paid, well-qualified, well-trained personnel Professional recruiting practices Thorough training of new hires 50 Native Bliss' recruiting efforts w ill be primarily directed at candidates with the following qualifications: Health-related educational/professional backgrounds Inte rest and aptitude for the healing arts Spotless criminal records Experience in restricted access venues Native Bliss' staffing protocols detail the processes the Chief Executive Officer (CEO) and Chief Operating Officer COO) will USf:! to manage Native Bliss' human resources needs, and to provide customer or patient accessibility in compliance with state law and Department regulations. The COO is assigned the responsibility for maintaining and updating the staffing policies, which will ensure th at Native Bliss has sufficient staff possessing the correct sk ill-se t s and experience needed to ens ure the success of all operations. The staffing plan will be updated at least annua lly. Hiring and Buying Locally As a criti ca l component of its commitment to San Lui s Ob ispo's residents and businesses, Native Bliss is comm itted to hiring 90 percent or more of its empl oyees and managers from the San Luis Obispo County workforce. Native Bliss will al so purchase at least 80 percent of its suppli es and equ ipment from businesses within 90 m il es of the facility. Social Equity In add ition, Native Bliss will implement an ave rage pay rate for entry and mid-level positions of at least 40% more than the median local income for similar positions in other mainstream businesses, and that base wages for empl oyees exceed the minimum wage by at least $3.00/hour. Labor Peace Agreement Once Native Bli ss has hired 20 or more non-management emp loyees, it will enter into a labor peace agreement with a bona fide labor organization. Other items discovered through the reference check process may be considered when making a hiring decision includ ing, but not limited to: A history of theft, acts o f violence, or negligence; Unverifiable resume or application statements; Negative reference checks or inability to obtain a positive reference from any former employers; 55 I Lack of stability in work history or residence; Employment with any independent l aboratory providing services for the operation or physician's office providing Cannabis patient certifications. Background Screen;ng We will perform background checks on all employees, volunteers, principals, directors, and board members. We will also perform background checks on any contractors or vendors who regularly work within the facility or will be employed there for an extended time. Copies of any public records obtained through the background check process will be provided to the individual concerned . To ensure transparency, the entire background checking process will be conducted by a third-party. We will not employ anyone who has been convicted of a felony except for the purposes of the MMICP as an excluded felony offense." Also, we elect not to engage any contractors or vendors who would have access on a regular basis or for an extended time to restricted areas of our facility if they have been convicted of any excluded felony offenses. 1. Employee Badges Native Bliss will provide all agents with security badges that must be worn at all times while engaging in Commercial cannabis Activity. The employee badge will include the following: 1. The licensee's "doing business as" and license number 2. The employee's first name 3. The employee number uniquely assigned to the employee for identification purposes 4. A co lor photograph of the employee that is at least 1 inch in width and 1.5 inches in height 5. Badges must be laminated or plastic coated 57 New Employee Onboarding Once a decision has been made to hire a candidate, the employee must pass a background check and drug test. The below checklist should be used to onboard a new employee. 1. Pass a background check 2. Pass a drug test 3. Fill out our li abil ity waiver 4 . Complete the Employment Contract 5. The GM will review the uniform policy and provides two uniform shirts in appropriate size for employee Employee Training It is the policy at Native Bliss that the better informed our employees are, the better they can answer questions and teach our clients the value of the products we carry. To ensu re all employees enter the training on the same page, Native Bliss utilizes the following items to standardize training: 1. New Hire Training 2. Formalized Staff Training 3. One on One Training 4. Se lf-Directed Training 5. Peer to Peer Training Employees will be tested on training content and must pass the test by their third attempt in order to remain employed. All staff will also go through periodic refresher seminars, as well as new training on any policy updates or changes In procedure. Security and emergency response training is only part of the comprehensive training required for all employees. In developing our official safety and security policies, we will consult with local law enforcement. We will also work with local police to develop effective ongoing employee training seminars and practices. Especially in developing our policies and training procedures on crime prevention and security threat response, we will seek the involvement of local law enforcement. Security and Emergency Response Ongoing education Is recommended , and employees will be encouraged attend courses regularly to pursue the highest levels of employee qualifications. Employee Safety And Training Plan As a steward of healthy living, Native Bliss is committed to serving customers, protecting employees, and meeting the public health needs of its community as it dispenses safe and effective medical and adult use cannabis. Native Bliss will exceed statutory and regulatory requirements, as well as any BCC guidance, on safety and sanitation through procedural assurance of strict sanitary policies and processes; holistic, site-wide appraisal of operational cleanliness; and applying detailed Standard Operating Procedures (SOPs) for daily sanitation compliance and best practices of related protection procedures. Training Native Bliss will ensure that its facility is a safe and sanitary place for customers to visit and employees to work at all times. Prior to commencing duties as an employee, team members will be given an Initial five hours of training on monitoring and controlling sanitation standards and policies, Including daily, weekly, monthly, and semiannual procedures, to ensure ongoing safety and sanitary conditions, as supplemented by ongoing training 59 as needed. This training will include critical, ongoing tasks to ensure Native Bliss maintains a high level of attention to site sanitation and safety on a continuous basis. Monitoring, recording, and reporting of daily tasks will ensure the consistency of cleanliness and safety at Native Bliss. Sanitation Proper sanitation is necessary for maintaining a healthy and compliant facility. Additionally, Native Bliss will maintain Its facility in a sanitary condition to limit the potential for contamination or adulteration of the medical and adult use cannabis stored In or dispensed at the facility. Dispensary Sanitation Training and Maintenance Strategy By structurally building staff SOPs around sanitation concerns, Native Bliss can ensure high levels of cleanliness are maintained without interrupting or derailing other operational processes. Native Bliss intends to achieve this high level of site sanitation by ensuring all operations and employees adhere to the Contamination Prevention policies; additionally, Native Bliss will issue a highly detailed and exacting set of SOPs that ensure cleaning procedures are carried out in a timely and consistent manner. Contamination Prevention Native Bliss stands behind the quality and efficacy of every single one of the medical and adult use cannabis products Native Bliss will be dispensing to Native Bliss customers and caregivers. As such, Native Bliss must ensure that nothing about Native Bliss facility could possibly contribute to the contamination or adulteration of any product Native Bliss sells. To ensure that, Native Bliss is putting In place the following guidelines to be followed at all times by employees and managers. In the event a contamination does occur, either discovered on-site or by a customer, the Native Bliss team will Immediately Inform the BCC, the supplying G/P, and any other necessary parties. Cleaning Procedures Native Bliss will follow a series of standardized safety and sanitation protocols, which will be evaluated and updated on a regular basis. All cleaning shall be properly documented by the responsible employee, with the date and time recorded along with any relevant notes. All products for sale that can support the rapid growth of undesirable microorganisms shall be held in a manner that prevents the growth of microorganisms or other blo-contaminants. This includes, but Is not limited to, refrigeration at proper temperatures, shielding from direct light, and preventing exposure to air. Additionally Native Bliss will institute a burnishing program to prolong the life of the floor, as well as maintaining Its appearance at all times of the year. Daily Cleaning Procedures To carry out these goals, Native Bliss will implement the following deaning procedures: 1. Visually inspect all areas for any types of debris or paper and for evidence of pests, including droppings. 2. Remove these items and dispose of them properly. 3. Vacuum up any dirt or debris that cannot be removed by hand. 60 4. s. 6. 7. 8. If there are any spots or stains on the carpets, floors, walls, furniture, or baseboards, immediately clean in an appropriate manner, then follow up with a portable spotter to remove the spot or stain and the chemical. Empty trash cans and replace garbage bags in all areas. Clean the trash can and surrounding area if necessary. Check pest traps for pests and remove as necessary, disposing of the remains in a sanitary manner sealed in separate trash bags and disposing in the dumpster. At no time will pest 9. remains be allowed to be dumped inside the building. 10. Ensure products for sale and/or for disposal are being stored in the proper manner according to their types and to all applicable rules, regulations, and laws. Weekly Cleaning Procedures 1. Dust all surfaces, including desks, filing cabinets, walls, and shelves. 11. Wipe down desks, telephones, calculators, and computer keyboards thoroughly using a disinfectant spray that has been sprayed on a microfiber cloth or a disinfecting wipe. 12. Wipe down heating vents, ledges, door jambs and window sills at any easily reachable level. 13. Dust mop all tiled or hard-surface floors, and sweep debris into dustpan for disposal. 14. Wet mop all hard-floor surfaces following step-by-step instructions. 15. Vacuum all carpeted floors, starting with the mats and runners. 16. Discard all expired food from employee break rooms. Monthly Cleaning Procedures 1. Clean wall-mounted units such as paper towel dispensers with a disinfectant spray or wipe, paying special attention to all fixtures and items in the restroom, while following established cleaning procedures. 17. Wipe down all vertical surfaces in the area with an all-purpose cleaner. 18. Spray buff all hard-surface floors. The spray procedures will be used with a low-speed floor buffer. The burnishing procedures will be best utilized with a high-speed burnisher. If hard-surface floors are particularly dirty, initially scrub floors with a low-speed buffer. 19. Polish tables, chairs, and any other wooden objects using furniture polish or wood cleaner to maintain a professional appearance. 20. Dust or vacuum all vents, overhead circular fans, and behind hard-to-reach areas like tables and desks. Clean all windows with a glass cleaner to remove all marks and fingerprints. Semiannual Cleaning Procedures 1. Strip and recoat any hard-surface floors to remove scuff marks and any imperfections in the finish. 61 2. Spray buff or burnish the floor immediately to make the finish "pop" as much as possible. 3. Extraction clean all carpeting, runners, mats, and upholstery, following the carpet extractor instructions. For any heavily soiled areas, or traffic pattern areas, follow carpet scrubbing bonnet instructions. Site Sanitation In addition to Native Bliss training and staff maintenance strategies with respect to keeping the cleanest Retail Store possible, Native Bliss will take a firm approach to standardized methods for site cleanliness in general; various staff actions will be orchestrated to achieve efficient waste removal and adequate cleaning of the site's physical surfaces, and to ensure Native Bliss's entire operation remain free from infestation by insects, rodents, birds and pests. Waste Removal Litter and waste are to be properly and regularly removed from Native Bliss, so waste does not constitute a source of contamination nor attract or harbor pests, per and . There shall be a sufficient number of trash receptacles throughout Native Bliss, with no less than one receptacle in each room, placed in such a manner to provide easy access while preventing them from obstructing walkways or creating a safety hazard. Each trash receptacle will be of sufficient size to serve the needs of the room, with larger cans in more heavily used rooms and smaller cans in less-used rooms. At all times trash cans will have liners in them and will be emptied and relined at the end of each workday and at any time during hours of operation when the receptacle is full or nearly full, or when the nature of the refuse is such that it requires immediate disposal to the on-site dumpster on the exterior of the building. To minimize spillage, odor, and contamination, all receptacles shall be constructed to prevent leaks and will be equipped with solid, tight-fitting covers that can be operated in a hands-free manner .. Native Bliss will not keep corrugated cardboard in the same area as medical and adult use cannabis products. If corrugated cardboard waste is kept in the facility at all, it will be kept off the floor, and it will be broken down and disposed of immediately to prevent dust, insects, pests, bacteria, mold, etc. All sweepings, solid or liquid wastes, refuse, and garbage shall be removed in such a manner as to avoid creating a menace to health and as often as necessary or appropriate to maintain the place of employment in a sanitary condition, per. Upon returning from disposing of refuse in the dumpster, the employee is required to wash their hands with soap and water prior to resuming other duties. Native Bliss will ensure the proper method of PHI disposal in compliance with the Health Insurance Portability and Accountability Act (HIPPA). Examples of proper disposal methods may include, but are not limited to: For PHI in paper records, shredding, burning, pulping, or pulverizing the records so PHI is rendered essentially unreadable, indecipherable, and otherwise cannot be reconstructed; Maintaining labeled prescription bottles and other items containing PHI in opaque bags in a secure area and using a disposal vendor as a business associate to pick up and shred or otherwise destroy the items containing PHI; and For PHI on electronic media, clearing (using software or hardware products designed to overwrite media with non-sensitive data), purging (degaussing or exposing the media to a strong magnetic field to disrupt the 62 recorded magnetic domains), or destroying the media (disintegration, pulverization, melting, incinerating, or shredding). Floors, Walls, and Ceilings The fioors, walls, and ceilings in every room of Native Bliss will be constructed in such a manner that they can be adequately cleaned and kept in good repair. The fiooring of Native Bliss will be slip-resistant, with a wear layer made of mineral aggregate with saturated glass-fiber backing underneath. This type of fiooring will not only minimize safety issues such as slippage, but, given the insolubility and stain-resisting properties of the material, it will make cleanup easy to complete as liquids, stains, and litter are easy to spot and cannot be absorbed, Where appropriate, there will be floor runners made of corrugated vinyl along high-traffic routes to further minimize the possibility of slippage. Such precautions will keep Native Bliss clean and will keep the rate of staff accidents low. Pest Protection Procedures Native Bliss will design and execute a pest protection plan that provides adequate protection against pests using integrated pest management practices and techniques that identify and manage pest problems. Implementation of said strategies include, but are not limited to, regular inspections of Native Bliss, the use of non-chemical means of prevention and removal of pests whenever possible, such as baited traps, keeping all areas of Native Bliss clean and sanitary at all times, regular removal of trash and other debris, and sealing cracks, crevices, and other potential means of ingress into the building against pests. Employee Sanitation and Hygiene Per, and in accordance with (relating to restrictions on food handlers) of the California Code, all Native Bliss employees shall be expected to at all times maintain proper personal hygiene and sanitary standards for their person while on the premises for any reason. All persons working in direct contact with medical and adult use cannabis or medical and adult use cannabis products shall maintain adequate personal cleanliness, which includes washing hands thoroughly prior to beginning work as well as at any other time when the hands may have become soiled or contaminated (), ensuring clothing Is suitably clean, and showering or bathing prior to reporting for duty. Hand-Washing and Lavatory Facilities Native Bliss will have an adequate number of hand-washing and lavatory facilities, convenient for their regular use by employees and customers and furnished with running water at a suitable temperature. Hand-washing facilities will be located in all bathrooms, employee break rooms, and any other locations regular hand-washing is needed; these areas will be supplied with effective, non-toxic sanitizing cleansers and sanitary towels or suitable hand drying devices. The toilet facilities will be provided with adequate consumables, readily accessible, and maintained in sanitary condition and good repair. Furthermore, Native Bliss shall at all times comply with California's laws, rules, and regulations regarding retail operations and the cleanliness and safety thereof. Native Bliss shall submit to and fully cooperate with all regular or unannounced inspections by any designated agency of California or the local authority. Going beyond that, Native Bliss shall conduct their own regular and unannounced health and safety audits and inspections by contracting with an outside firm which can provide such a service, and similarly conduct a separate pest control audit. Native Bliss shall fully implement the recommendations and requirements of each such audit. 63 Mandato1y Sanitation and Safety Supplies At all times, Native Bliss will have on each premises sufficient tools and products to ensure that safety and sanitation procedures can be properly carried out by employees. These tools will be properly labeled, locked, and stored in closets compliant with all applicable laws and regulations per and which are dedicated to such tools, away from other products to prevent diversion and cross-contamination. Cleaning Tools A janitorial cart, two mops, two mop buckets, one large push broom, two regular-sized brooms, two dustpans, one duster, one wall-mounted broom holder, one carpet vacuum cleaner, one wet-dry vacuum, one floor machine, one handheld dust vacuum, one toilet bowl scrubber, four empty refillable spray bottles, four "Caution Wet Floor" signs in both English and Spanish, one pack of reusable rubber gloves, wall-mounted hand sanitizer dispensers in each bathroom and In the employee break room, wall-mounted paper towel dispensers in the employee break room, wall-mounted automatic hand dryers in each bathroom, wall-mounted hand soap dispensers in each bathroom and the employee break room, two snow shovels, one salt spreader, one hands-free waste disposal bin of sufficient and appropriate size in every room of the facility, one hands-free recycling bin in the employee break room, and pest traps and deterrents, including ultrasonic sound emitters to deter mice and rats. Cleaning Supplies Trash bags (both for regular waste and large, heavy-duty bags), commercial-grade, all-purpose cleaner and deodorizer in gallon bottle size, one spray bottles of glass cleaner, one gallon-sized bottle of glass cleaner refill, one bottle of toilet disinfectant and cleaner, one bottle of liquid drain opener, two bottles of spray disinfectant, hand soap bottles and refill bottles, hand sanitizer refills, two hand sanitizer bottles to be kept at separate locations in the main retail area, toilet paper, tissue paper, paper towels for both the wall-mounted dispensers and for general cleaning purposes, terry cloths, all-purpose microfiber cloths, one bottle of dishwashing liquid, one pack of scrubbing sponges, one box of scouring pads, three bottles of disinfectant wipes, one bottle of air freshener, one bottle of wood cleaner or polish, one bottle of compressed gas office hardware cleaner, one bottle of metal polish, four bags of deicing salts (during the winter months only), and one bottle of insect killer. Above are non-exhaustive lists of tools and supplies to be kept at Native Bliss' facility at all times. Developing needs shall be continuously evaluated by Native Bliss managers, and it shall be the responsibility of the general manager to ensure that all cleaning tools and supplies are in stock and kept in good working order. Should a cleaning supply run low or a sanitary tool need replacing, the manager will place an order with Native Bliss supplier, prior to running out of that supply or exhausting the use of that tool. The cleaning supplies purchased by the Native Bliss team will be of the lowest toxicity possible to complete the task and be environmentally friendly when possible to purchase such a product. For instance, work surfaces will be sanitized with isopropyl alcohol. Toxic Cleaning Compounds While the Native Bliss team will strive to minimize the use and purchase of toxic cleaning compounds, should the need arise to use such products, toxic cleaning compounds, sanitizing employees, and other chemicals shall be identified, held, stored, and disposed of in a manner that protects against contamination of medical and adult 64 use cannabis and medical and adult use cannabis products. Such handling will always be done in a manner that is in accordance with any applicable local, state, or federal laws, rules, regulations, or ordinances. These compounds will be stored in monitored, secured spaces such as a locked closet away from medical and adult use cannabis products and the retail floor; such toxic products will only be accessed when necessary. Employees who use any such products are required to wash their hands with soap and water immediately after use. Safety Plan and Protocols Americans with Disabilities Act (ADA) Access Philosophy Native Bliss is focused on improving the quality of life of Native Bliss customers by providing safe access to effective medicine. This approach extends to Native Bliss's facility design philosophy, which emphasizes ADA access as a matter of priority. Native Bliss will provide reasonable accommodations to customers and caregivers to ensure safe access to the facility. From physical modifications to Native Bliss to digital modifications to Native Bliss information systems, Native Bliss is committed to providing safe, comfortable, and dignified access. Safety Training Well trained employees are integral to a safe and secure facility. Safety training includes instruction on Personal Protective Equipment (PPE), Occupational Safety and Health Administration (OSHA) training for medical professionals, and OSHA hazardous materials training. If an employee will use any devices such as ladders, dollies, pallet jacks, or forklifts, the employee will be certified for such use. Safety training also includes emergency response training for manufactured and natural disasters. Specific emergency training will be provided for a medical emergency, fire, or chemical spill. Employees will be trained for threatening events such as armed robbery, invasion, burglary, or any other criminal incident. All employees will also be instructed in basic self-defense training and will be encouraged to take additional self-defense classes. Personal Protective Equipment Personal Protective Equipment (PPE) for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained In a sanitary and reliable condition wherever it Is necessary, per. Native Bliss will provide training to each employee who is required to use PPE, per and its subsections. Each such employee will be trained In at least the following Information and skills: When PPE is necessary; What PPE Is necessary; How to properly put on, take off, adjust, and wear PPE; 65 Instruction for speci fic pers onal protective equipment employees will use regularly, including protective g loves during applicable work duties; The limitations of the PPE ; and The proper care, ma intenance, use ful life, and disposa l of the PPE. Emp loyees w ill demonstrate an understanding of the training and the ability to use PPE properly before being all owed to perform work req uiring the use of PPE. If an emp loyee who ha s already been trained does not have the understanding and sk ills descri bed above, the emp loyee will be retrained. OSHA Compliance OSHA re co mmends tra i ni ng for severa l fi elds, but because the medica l cannabis industry Is a young industry, certain stan dards and training have not yet been ou tlined . However, Native Bliss will make sure that all employees receive all rel eva nt OSHA training. Initiall y, Native Bliss managers will attend Introduction to OSHA for Small Bu sinesses, Introduction to Safety and Hea lth Management, and Recordkeeping Rule Seminar. Within the first 60 days of employment, Retail Store Agents will take part in the OSHA Evacuation and Emergency Planning course. Between 60 and 120 days of employment, employees w ill t ake the OSHA St andards for General Industry and OSHA Hazardous M aterials courses. Waste Management Plan Non -Cannabis Solid Waste Non-hazardous non-cannabis so lid waste will be stored in bins or dumpsters for regu lar weekly pickup by a local waste management compa ny. Example s of non-hazardous non-cannab is waste include food and general waste from break rooms and restrooms a nd recyclable waste, such as plastics, paper, and meta ls. Non-Cannabis Liquid Waste Native Bl iss does not antici pate any non-haz ardous non-ca nnabis liqu id w as te requiring a specific disposa l procedure. Should Native Bli ss devel op a need for liquid waste disposal , a policy will be Im pl ement ed that co mplies with the require ment s for disc harge into surface water, grou ndwa t er, and sewers. Cannabis Waste Pursua nt to 16 CCR§ SOSS(a), Native Bliss will not se ll cannab is waste . Pursua nt to 16 CCR§ SOSS(b ), Native Blis s will comply with all applicable wa st e managemen t laws Including, but not limited to, Divi sion 30 of the Public Resources Code. Pursua nt to 16 CCR§ SOSS(c), Native Bliss will dispose of cannab is waste in a secured waste recep t acle or in a secured area o n t he license d premises . Fo r th e purposes of this section, "secure waste receptacle" or "secured area" m ea n s that physica l access to the recept ac le or area is restricted to Native Bliss and it s employees and the local agency, or waste h auler fra nchised or contracted by a local agency. Public access to the designated receptacle or area Is prohibited. 66 Pursuant to 16 CCR§ 5055(d), if Native Bliss is composting cannabis waste on the licensed premises, Native Bliss will do so in compliance with title 14, California Code of Regulations, chapter 3.1 (commencing with Section 17850). Pursuant to 16 CCR§ 5055(e), if a local agency, or waste hauler permitted by a local agency, is being used to collect and process cannabis waste, Native Bliss will do all the following: Provide the Bureau with the following information for the local agency, or waste hauler franchised or contracted by a local agency, who will collect and process Native Bliss's cannabis waste; e Name of local agency providing waste hauling services, if applicable; Native Bliss name of the local agency franchised or contracted or permitted waste hauler, if applicable; Native Bliss business address; and Name of the primary contact person at the company and contact person's phone number. Obtain documentation from the entity hauling the waste that indicates the date and time of each collection of cannabis waste at the licensed premises; and Obtain a copy of the certified weight ticket or other documentation prepared by the entity hauling the waste confirming receipt of the cannabis waste at one, or more, of the following solid waste facilities: A manned, fully permitted solid waste landfill or transformation facility; A manned, fully permitted composting facility or manned composting operation; A manned, fully permitted in-vessel digestion facility or manned in-vessel digestion operation; A manned, fully permitted transfer/processing facility or manned transfer/processing operation; or A manned, fully permitted chip and grind facility or manned chip and grind operation. Pursuant to 16 CCR§ 5055(f), if Native Bliss is self-hauling cannabis waste to one, or more, of the solid waste facilities in subsection (e)(3) of this section, Native Bliss will obtain for each delivery of cannabis waste by Native Bliss a copy of a certified weight ticket or receipt documenting delivery from the solid waste facility. Only Native Bliss or its employees may transport self-hauled cannabis waste. Quality Assurance Plan Company Name] is committed to providing the highest quality products to its customers and patients. To ensure this commitment, Native Bliss will hire a Quality Assurance Director and an Inventory Manager. These managers, along with other Retail Agents selected to join the Native Bliss's Product Evaluation Committee, will be responsible for receiving, verifying, storing, returns, recalls, transportation, packaging, labeling, and inventory control of Cannabis at Native Bliss. Additional Retail Agents will be assigned product evaluation duties as needed. 67 In addition, the Evaluation Committee will periodically review procedures for efficiency and efficacy and make adjustments as necessary. Any deviation from standard operating procedures will be recorded in the variance log, accompanied by an appropriate explanation. Quality Assurance Director The Quality Assurance Director will be hired by the Facility Manager with approval from Native Bliss management. The Quality Assurance Director will be responsible for: Ensuring that the products sold at Native Bliss are of the quality and quantity that they are purported to be; Receiving all products shipped to Native Bliss; Inspecting the products, packaging, labeling, weight, and any other aspects of a shipment to verify quality; All decisions on which product is accepted and which is returned or destroyed; All testing and re-testing of products; Sampling received materials for potential future adverse event and recall purposes; Placing all products in storage; Ensuring that no product is stored in an unsafe or unsanitary manner; Inspecting, sanitizing, and calibrating any equipment, including scales, used with Cannabis; Maintenance of all product quality logs for cleaning, sanitizing, calibration, and other quality assurance measures; and Ensuring all edible products are labeled clearly and unambiguously as Cannabis and are presented in packaging that is not appealing to children. The duties listed here are not exhaustive; the Facility Manager may assign other responsibilities to the Quality Assurance Director. Receiving Products 68 Verification of Shipping Manifest The shipment should exactly reflect the shipping manifest; any discrepancies in the shipment will be noted on the shipping manifest. In the event of a discrepancy, the Quality Assurance Director will notify the originating facility. Only after the shipping manifest has been verified as correct will he or she perform an inspection to ensure the quality, purity, and identification of each product In the shipment. If the shipment contains Cannabis, a detailed inspection of the products, packaging, labeling, and testing results must be conducted before the shipment may be accepted. The packaging should be legally compliant and uncompromised. Any dents, tears, cracks, or other damage to the packaging may be grounds to reject the product; the Quality Assurance Director will determine if the product is compromised. Eval u ation of Received Prod ucts Each shipment of products containing Cannabis received from a Cannabis cultivation or manufacturing establishment will be inspected by the Evaluation Committee to verify that it meets all state requirements and Native Bliss best practices, prior to being stored for sale to a customer or patient. The Evaluation Committee will inspect all products, packaging, written notices and labels affixed to packaged products to make sure they contain all legally required information. If any components are deficient the product will be accepted but placed into quarantine until the Quality Assurance Director obtains the information from the shipper. The Quality Assurance Director must check labels for testing Information. If a product arrives without testing information, it shall be placed into quarantine until the Quality Assurance Director can obtain the testing results for the product. The Evaluation Committee shall verify that all information is included for all receivables, and if it is not, they shall reject the shipment, print labels containing the missing information according to labellng procedures, or place the packages In quarantine for further investigation at the direction of the Quality Assurance Director. Native Bliss shall maintain a designated area for packaging. As packaging and labeling designs change, the Quality Assurance Director will insert updated mock-ups into the standard operating procedures in order to assist Product Evaluation Retail Agents with Inspection procedures. Additional brochures or pamphlets may be given to customers and patients to provide information about routes of administration, product advisories, upcoming classes, and other topics of customer or patient interest. Upon request, Native Bliss will provide customers and patients with a pamphlet for any product. Pamphlets shall Include, at a minimum: specifications, proper administration, and instructions for disposal. This information will be available on Native Bliss website, printed In pamphlets available at Native Bliss, and provided over the phone to those who request deliveries, in addition to hard copies given with delivery. All Retail Agents must offer additional Information and product Inserts when dispensing Cannabis, but customers and patients are not required to accept it so long as the dispensed product meets all packaging and labe ling requirements. Product Information and Inserts In addition to all information required on packaging, the Evaluation Committee will ensure that any additional Information required by state law Is provided to the customer or patient with each transaction. Additional information may be included as a product insert, and may include any of the following warnings: 69 I This product may have intoxicating effects and may be habit forming. Smoking is hazardous to your health;" There may be health risks associated with consumption of this product;" For use only by the person named on the label of the dispensed product. l<eep out of the reach of children;" Products containing cannabis can impair concentration, coordination, and judgm ent. Do not operate a vehicle or machinery under the Influence of this drug;" and/or Cau tion : When eaten or swa llowed, the intoxicating effect s of this drug may be delayed by 2 or more hours." Acce pted Pr od ucts If the Quality Assurance Director believes the quality of the product is still intact, he or she may accept the product and have it tested to ensure quality. The product will be placed in quarantine until the retest results are con firmed. If the product passe s testing, Native Bliss may repackage it. If the product fails testing, the product will remain in quaranti ne until it can be properly disposed of. Products accepted at Native Bliss will be Immediately placed into secured storage by the Quality Assurance Director. Products conditionally accepted will be placed into quarantine until the necessary I nformation about the product is obtained; then they can be accepted and placed into secured storage. All other products will either be rejected and returned to the shipper or placed In quarantine to await disposal. Rejected Products All products that are rejected by the Evaluation Committee will be disposed of in full compliance with California state and local regulations for cannabis waste. Waste Storage and Quarantin e Medical Cannabis waste shall at no time be stored anywhere outside of the secured Cannabis waste disposal area. Products requiring disposal may be contam inated, returned, damaged, or in a condition that could adversely affect the quality of other Cannabis. Cannabis products that are placed in secured quarantine are products whose quality is unknown, and they may pose a similar threat to the quality of other Cannab is. As products in secured quarantine may still be approved or rejected, it is necessary to segregate them to prevent potentia l contamination. Having designated areas for Cannabis storage also means that at no lime will a Reta il Agent sell a product that has not been tested and approved. ·see the Waste Management Pian for more Information. Inventory Control Plan Pursuant to SLOMC 17.99.050.E.3), Native Bliss's facility will be sited and/or operated In a manner that prevents cannabis odors from being detected offsite. Commercial cannabis activities will not create offensive or excess ive odors, dust, heat, noise, light, glare, smoke, traffic, or hazards due to the use or storage of materials, processes, products or wastes, or other unreasonable impacts to people of normal sensitivity living, working or lawfully present in the vicinity of the commercial facility. 7Q I Inventory Control System Pursuant to SLOMC 9.10.130.C., Native Bliss will maintain an inventory control and reporting system that accurately documents the present location, amounts, and descriptions of all cannabis and cannabis products for all stages of the growing and production or manufacturing, laboratory testing and distribution processes until sold or distributed. Native Bliss will maintain records of all sales or transfers of cannabis and cannabis products. Storage of Inventory In accordance with 16 CCR § 5033, Native Bliss will not store cannabis goods outdoors. separate employee break rooms, changing facilities, and bathrooms from all storage areas. separately license each location where cannabis goods are stored Sig n ificant Discrepancy in Invent ory Pursuant to 16 CCR § 5034, Native Bliss will comply with these requirements to determine significant discrepancies in inventory: A significant discrepancy in inventory means a difference in actual inventory compared to records pertaining to inventory of at least $5,000 or 2 percent of the average monthly sales of Native Bliss, whichever is less. For the purposes of this section, average monthly sales will be calculated by taking a per month average of the total sales for the previous 6 months. If Native Bliss has not been in operation for at least 6 months, only the months in which Native Bliss was operating will be used In determining average monthly sales. For the purposes of this section, Native Bliss's acquisition price will be used to determine the value of cannabis goods in Native Bliss's inventory. Track and Trace System Pursuant to 16 CCR § 5048: Native Bliss will create and maintain an active and functional account within the track and trace system prior to engaging In any commercial cannabis activity, including the purchase, sale, test, packaging, transfer, transport, return, destruction, or disposal, of any cannabis goods. Native Bliss will designate one individual owner as the track and trace system account manager. The account manager may authorize additional owners or employees as track and trace system users and will ensure that each user is trained on the track and trace system prior to its access or use. The account manager will attend and successfully complete all required track and trace system training, including any orientation and continuing education. If the account manager did not complete the required track and trace system training prior to receiving their annual license, the account manager will sign up for and complete state mandated training, as prescribed by the Bureau, within five business days of license issuance. f The account manager and each user will be assigned a unique log-on, consisting of a username and password. The account manager or each user accessing the track and trace system will only do so under his or her assigned log-on, and will not use or access a log-on of any other individual. No account manager or user will share or transfer his or her log-on, username, or password, to be used by any other individual for any reason. The account manager will maintain a complete, accurate, and up-to-date list of all track and trace system users, consisting of their full names and usernames. Native Bliss will monitor all compliance notifications from the track and trace system, and timely resolve the issues detailed in the compliance notification. Native Bliss will keep a record, independent of the track and trace system, of all compliance notifications received from the track and trace system, and how and when compliance was achieved. If Native Bliss is unable to resolve a compliance notification within three business days of receiving the notification, Native Bliss will notify the Bureau immediately. Native Bliss is accountable for all actions its owners or employees take while logged into or using the track and trace system, or otherwise while conducting track and trace activities. Track and Trace Reporting In accordance with 16 CCR§ 5049(a), Native Bliss will record in the track and trace system all commercial cannabis activity, including: G Packaging of cannabis goods . Sale of cannabis goods . Transportation of cannabis goods to Native Bliss . Receipt of cannabis goods . Return of cannabis goods, Destruction and disposal of cannabis goods . Laboratory testing and results . Any other activity as required pursuant to this division, or by any other licensing authority. Unless otherwise specified, all transactions must be entered into the track and trace system within 24 hours of occurrence. Native Bliss will only enter and record complete and accurate information into the track and trace system, and will correct any known errors entered into the track and trace system immediately upon discovery. Pursuant to 16 CCR§ 5049(b), the following information will be recorded for each activity entered in the track and trace system: Name and type of the cannabis goods. 72 Unique identifier of the cannabis goods. Amount of the cannabis goods, by weight or count. Date and time of the activity or transaction. Name and license number of other licensees involved in the activity or transaction. Trace and Trace Requirements During Transport In accordance with 16 CCR§ 5049(b)(6)(A), if the cannabis goods are being transported, Native Bliss will transport pursuant to a shipping manifest generated through the track and trace system, that includes items (1) through (5) of this subsection, as well as: The name, license number, and premises address of the originating licensee. The name, license number, and premises address of Native Bliss transporting the cannabis goods. The name, license number, and premises address of the destination licensee receiving the cannabis goods into inventory or storage. e The date and time of departure from the licensed premises and approximate date and time of departure from each subsequent licensed premises, if any. Arrival date and estimated time of arrival at each licensed premises. Driver license number of the personnel transporting the cannabis goods, and the make, model, and license plate number of the vehicle used for transport. Pursuant to 16 CCR§ 5049(b)(6)(B), upon pick-up or receipt of cannabis goods for transport, storage, or inventory, Native Bliss will ensure that the cannabis goods received are as described in the shipping manifest, and will record acceptance and acknowledgment of the cannabis goods in the track and trace system. In accordance with 16 CCR§ 5049(b)(6)(C), If there are any discrepancies between the type or quantity specified in the shipping manifest and the type or quantity received by Native Bliss, Native Bliss will record and document the discrepancy in the track and trace system and in any relevant business record. Trace and Trace Requirements During Destruction or Disposal of Cannabis Pursuant to 16 CCR§ 5049(b)(7), if cannabis goods are being destroyed or disposed of, Native Bliss will record in the track and trace system the following additional information: o The name of the employee performing the destruction or disposal. The reason for destruction or disposal. The name of the entity being used to collect and process cannabis waste, pursuant to section 5055 of this division. Trace and Trace Requirements for Additional Adjustments In accordance with 16 CCR§ 5049(b)(8), Native Bliss will record a description for any adjustments made in the track and trace system, including, but not limited to; 73 Spoilage or fouling of the cannabis goods. Any event resulting in exposure or compromise of the cannabis goods. e Any other information as required pursuant to this division, or by any other applicable licensing authorities. Loss ofAccess Pursuant to 16 CCR§ SOSO, Native Bliss will If at any point Native Bliss loses access to the track and trace system for any reason, Native Bliss will prepare and maintain comprehensive records detailing all commercial cannabis activities that were conducted during the loss of access. The licensee will both document and notify the Bureau immediately: When access to the system is lost; When access to the system is restored; and The cause for the loss of access. Once access is restored, all commercial cannabis activity that occurred during the loss of access will be entered into the track and trace system within three business days of access being restored. Native Bliss will not transport, transfer or deliver any cannabis goods until such time as access is restored and all information recorded in the track and trace system. Track and Trace System Reconciliation In accordance with 16 CCR§ 5051(a), in addition to other inventory reconciliation requirements under this division, Native Bliss will reconcile the physical inventory of cannabis goods at the licensed premises with the records in the track and trace database at least once every 14 days. Pursuant to 16 CCR§ 5051{b), if Native Bliss finds a discrepancy between its physical inventory and the track and trace system database, Native Bliss will conduct an audit, and notify the Bureau of any reportable activity pursuant to section 5036. Recordkeeping Plan Cit;y Access to Records Pursuant to SLOMC 9.10.130.A., subject to the Health Insurance Portability and Accountability Act .HIPAA. regulations, Native Bliss will allow City of San Luis Obispo officials to have access to Native Bliss's books, records, accounts, and any and all data relevant to its permitted activities for the purpose of conducting an audit, examination or inspection. Books, records, accounts, and any and all relevant data will be produced no later than twenty-four (24) hours after receipt of the City's request or within a reasonable time as authorized in writing by the City. Annual Audit Pursuant to SLOMC 9.10.130.B., Native Bliss will file with the City Manager or his/her designee an audit of its financial operations for the previous fiscal year, complete and certified by an independent certified public accountant in accordance with generally accepted auditing and accounting principles. 74 o The audit will include but not be li mited to a discussion, an alysis, and verification of each of the records required to be maintained pursuant to this Chapter. c The Information contained in the audit will be made available in standard el ectronic format which will be compatibl e with programs and software used by the City, and which ca n easily be Imported into either Excel, access or any other contemporary software designated by the City Manager. Employee Registry Pursuant to SLOMC 9.10 .130.D., Native Bliss will maintain a current register of the names and the contact information (including the name, address, and telephone number) of all employees currently employed by Native Blis s and will disclose such register to any City of San Luis Obispo officia l upon request. Reporting and Tracking ofProduct and ofGross Sales Pursuant to SLOMC 9.10.130.E., Native Bliss will have in p lace a point-of -sale tracking system to track and to report on all aspects of its Commercia l Cannabis Activity including, but not limited to, su ch matters as cannabis tracking, inventory data, and gross sales (by weight and by sale) and will ensure that such information is compatible with the City's record-keeping systems. The system will have the capability to produce historica l transactional data for review by the City of San Lui s Obispo. All information provided to the City pursuant to this sub-Chapter will be confidentia l and will not be disclosed, except as may otherwise be required under law. Maintenance of Records Pursuant to SLOMC 9 .10.130.F., all records required by this Chapter will be maintained by Native Bliss for a period of not less than seven (7) years and will otherwise keep accurate records of all Commercial Cannab is Business activity and provide such records for inspection consistent with this Code or any ru le. Record Retention Pursuant to 16 CCR§ 5037, Native Bliss will kee p and maintain the following records related to commercial cannabis activity for at lea st seven years: Financial records incl udi ng, but not limited to, bank statements, sa le s invoices, receipts, tax records, and all records required by the California Department of Tax and Fee Administration (formerly Board of Equalization) under title 18, California Code of Regulations, sections 1698 and 4901. Personnel records, including each employee's full name, social security or individual t axpayer Identification number, date employment begins, and date of termination of employment If applicable. Training records including, but not limited to, the content of the training provided and the names of the employees that received the training. Contracts with other licensees regarding commercia l cannabis activity. Permits, licenses, and other local authorizations to conduct Native Bliss's commercial cannabis activity. Security records, except for surveillance recordings required pursuant to section 5044 of this division. Records relating to the composting or destruction of cannabis goods. 75 Documentation for data or information entered into the track and trace system. All other documents prepared or executed by an owner or his emp loyees or assignees in connection with the licensed commercia l cannabis business. The Bureau may make any examination of th e books and records of any lice nsee as it deems necessary to perform its duties under the Act. Records will be kept in a manner that allows the records to be produced for the Bureau at the licensed premises in either hard copy or electronic form, whichever the Bureau requests. Native Bliss may contract with a third party to provide custodia l or management services of the records. Such a contract will not relieve Native Bliss of Native Bliss's responsibilities und er this section. Community Benefits & Relations Plan A plan describing who Is designated as be ing respons ib le for outreach and communi cation with the surrounding commun ity, i ncl u ding t h e neighborhood and bus i nesses, and how the des ignec can be contacted . Ongoing Commitment to Medical Cannabis Native Bliss is committed to always providing :retail medical cannabis to qualifying patients. In coordination with the City of San Luis Obispo, Native Bliss will strive to provide significan t support to qualifying patients and their caregivers. Volunteerism and Charitable Donations Native Bliss will institute an Employee Service Program encouraging staff to volunteer time towards achieving Native Bliss's goals for the local community. Beginning with the local partners descr ibed above, Native Bliss will have employees join existing volunteer efforts and, if none exist, lead the effort to create volunteer opportunities that garner employees' enthusiasm. If a local Business or Corporate Volunteer Council already exists, Native Bliss will seek to join it. Using feedback from and working with other existing local organizations, Native Bliss will establish clear goals and communicate them to staff. Native Bliss also hopes to support causes that its staff is passionate about. Annually, as part of the budget process, staff will be asked to submit proposals for support of organizations, events or entities to Community Relations Liaison. Along with the CFO, CEO and others involved In the budget process, our Liaison will select programs to be supported throughout the fiscal year. To encourage participation, any employee who submits a proposal will be entered into a drawing for a prize. Selection of a proposal will be based on whether it fits into Native Bliss's established goals, feasibility, and accessibility. Native Bliss will also expand its philanthropic efforts and actively pursuing new relationships with additional nonprofit organizations, veterans' groups, homeless she lters, food pantries, and a variety of other community service groups and organizations. Veteran Support Initiatives Anecdotal research shows that cannabis provides relief to veterans suffering from a variety of physical and mental symptoms, particularly post-traumatic stress disorder (PT SD ). The United States' Veterans Affairs (VA) Office estimates that up to 30% of veterans experience PTSD at some point, compared with only 8 percent of civilians. Federal barriers to research have made clinical studies on cannabis and PTSD difficult, but one study found that people suffering from PTSD have lower levels of anandamide, an endogenous cannabinoid that triggers the same brain receptors as cannabis. To increase awareness of San Luis Obispo's cannabis program among veteran s, Native Bliss will seek a partnership with a loca l veterans' service organization to hold educational discussions that include: Patient recommendation and MMCIP card application process; Strategies other veterans have used to participate in state-approved cannabis programs with minimal risk to VA benefits; and National advocacy efforts to allow veterans to access cannabis with no risk to VA benefits. The focus of veteran education forums will be creating a community among veterans, allowing them to learn from each other's experiences, and answering questions about the state and federal cannabis policies. Veteran Education Forums will be led by Native Bliss's Community Relations Liaison. Families and K-12 Schools Parents and schools face particular challenges educating teens and preteens on the facts about cannabis. Adolescents may misinterpret the legalization of cannabis as unofficial endorsement of the widespread recreational use of cannabis on school campuses, even though this is strictly prohibited by law. There may be parents and educators who feel the legalization of cannabis has made their jobs harder. Native Bliss will partner with area schools to create ongoing educational programs, given the importance of protecting children and securing the rights of patients to access cannabis. Native Bliss believes in reaching out to families , l<-12 schools, educators, and the community to build goodwill and allay fears. Demonstrating positive impacts may face some of the following challenges: Adolescents constitute a vulnerable population that must be protected; Emotions run high whenever families feel the health and safety of their children may be at risk; Educational materials for students must be age-appropriate and approved by parents and sc hool officials; and 77 Educational materials for parents must ad dress thei r concerns about diversion. Our plan of action for families and l<-12 schools includ es: Community Outreach: Native Bliss will e ngage parents and educa tors with surveys and on line forums to identify areas of interest and co ncern . It will also assess their level of understa ndi ng and perceptions of cannabis. We will ex tend invitations for co llaborative dialogu e and will maintain an open-door policy encouraging tran spa r ency in o ur products, quality and safe ty co ntrol procedures, and anti-d ivers io n tactics. We will emphasize the benefits of specific cannab is products, including the treatment of disorders that sometimes occur in ado lescent populations. We will kee p families and schools updated with pertinent r esearch and other re levant information . Developing Educational Materials: Native Bli ss will partn er with ed uca tors to create appropriate educational materials for teachers, parents and studen t s. Supporting Local Youth: Native Bliss will donate time and reso urces to local organizations that serve youth in a variety of ways. Native Bliss will co mpensa t e employees for a fixed number of days spent volunteering with se rvice o rg aniza tions, from coaching so cce r to sitting on sc ho larship co m mittees and judging science fairs. Commercial Cannabis Develo pment Standards Pursuant to SLOMC 17 .99.050.E.4), Native Bliss's commercial cannabis operations will be concealed from public view at all times and there will be no exterior evidence of cannabis or cannabis products occurring at the property, visible with normal unaided vision from any public place, or the public right-of way. Commercial manufacturing of cannabis or cannabis products will be shielded to confine light and glare to the interior of the structure. Pursuant to SLOMC 17.99.050.E.S), Native Bliss's facility will include adequate measures that address enforcement priorities for commercial cannabis activities including restricting access to the public and to minors and ensuring that cannabis and cannabis products are only obtained from and supplied to other permitted licensed sources within the State and not distributed out of State. Pursuant to SLOMC 17.99.050.E.6), Native Bliss will ensure the following prohibitions are enforced at its facility at all times: Prohibition of on-site consumption of cannabis Prohibition of the possession, storage, sale, distribution or consumption of alcoholic beverages on the premises, or the holding of license from the State Division of Alcoholic Beverage Control for the sale of alcoholic beverages, or operating a business that sells alcoholic beverages, on or adjacent to the commercial cannabis activity site. No cannabis products or cannabis accessories will be displayed in windows or visible from the public right-of way or from places accessible to the general public Prohibition of minors and persons under the age of 21 on the premises, even if accompanied by a parent or guardian. Outdoor storage of cannabis or cannabis products is prohibited. 110 Community Education Plan A pl an d esc r i bin g the type of ca nn ab is edu ca tion and prevention effo rts that w il l b e provided by the business to the co mmunity. Retail Store Agents will be charged with educating customers and careg ive rs on the cannabis products and accessories available at Native Bliss. Retail Store Agents will escort the customer and/or caregiver to a consultation room where they will advise on the current status of the customer's recommendation, including inquiring as to the effectiveness of previously administered cannabis and providing advice on what other cannabis, products, and routes of administration may be best for the customer. Retail Store Agents wil l also use these sessions to educate customers on lifestyles choices and how they affect treatment regimens. In addition to customer consultations, employees wlll also provide education duri ng free public classes on cannabis, its uses, and administration. These classes may be he ld off-site in order to accommodate more interested persons without impacting Native Bliss security. If a class is held off-s ite, no cannabis will be present. In order to promote customer communication and education, Native Bliss will keep an up to date webs ite. All employees shall be familiar with website content including: Descriptions of available products; Descriptions of services; News and information; Contact information; Retai l Store Agent appointment booking; Information on classes offered by Native Bliss to the public; Answers to frequently asked questions, including how to become a registered customer; an d Recall status reports, in the event of a reca ll. Community Information Sessions Dispensary information sessions will be scheduled the first Monday evening of every month. These sess ions w ill allow the public, subject to visitation policies, to visit Native Bliss and speak with managers, employees and owners. Each session will feature a predetermined topic of discussion. The number of vis itors at each session w ill be limited to between t en and 30 people, depending on what Native Bliss can reasonabl y and safely accommodate. No cannabis or accessories will be sold during these sessions. Diversion Prevention Dive rsion Is possible both internally and externally, and It is Native Bliss's responsibility to minimize the potential for its occurrence and take the necessary steps to be able to proactively identify when and where it happens . Once product is dispensed, It is the customer's responsibility to ensure product is on ly used by the intended person to whom It was dispensed. As such, Native Bliss will educate every customer and have them acknowledge 111 that it is a crime for the product to be used, sold, or transferred to any customer other than to whom It was dispensed. Both internal and external diversion prevention requires strong adherence to inventory management and security standard operating procedures ("SOP"s), as well as effective physical and electronic systems to monitor, detect, and deter any attempts to divert cannabis in any form, from its regulated and secure chain of custody. Native Bliss's internal inventory and security procedures along with their integration with the physical and electronic tracking, monitoring, and deterrence systems are detailed in the Inventory Management and Security sections of this application. This section will focus on demonstrating Native Bliss's understanding and integration of all regulations relating to ensuring the proper identification, dispensing, recording, and tracking of cannabis products to customers and caregivers, as well as the detection and notification requirements to the BCC and local law enforcement. Dive r s ion Prevention Training Native Bliss's Security Director will work closely with both the Retail Store Manager and the Inventory Control Manager to administer and over~ee diversion prevention and training operations at the Native Bliss Retail Store . All training Retail Store Agents receive will ultimately help them to keep cannabis products safe from theft or diversion. Access control training will help Retail Store Agents keep unpermitted individuals from entering secured or restricted areas of the facility. Training on when and how to alert management or local law enforcement for assistance with authorized or unauthorized visitors will help ensure a strong support system in preventing theft and diversion. Thorough surveillance -focused security training for the security team will decrease opportunities for people to steal or divert product from the Retail Store premises. Specifically training employees to verify a customer's proper identification ensures cannabis is dispensed to those with valid registration. These training procedures, along with others, will help the Retail Store prevent theft and diversion . Electronic Infrastructure Diversion Too ls Lawful Transactions The Retail Store Manager will be responsible for all sales transactions taking place inside the Native Bliss Retail Store. The Retail Store Manager must ensure all Retail Store Agents working in the facility are properly trained on 112 all operating procedures. Native Bliss will ensure that no unlawful sales transactions are permitted or tolerated in accordance with state and local regulations. Where possible, engineered controls will be established to ensure it is Impossible to dispense cannabis to non-registered customers or caregivers by using the Point of Sale System in conjunction with the [Inventory Control System]'s record keeping. Native Bliss will display a minimum sample of each product offered for sale in locked cases, behind the counter, and they will be inaccessible to customers. Employees of Native Bliss may refuse to dispense to a customer or personal caregiver if, in the opinion of the employee, the customer or the public could be placed at risk. In any instance of denial, Native Bliss will immediately notify the BCC and register the refusal in [Inventory Control System]. When the customer is called into the point of sale area, they will confirm their identity with their government issued ID. Prior to the completion of the transaction, the Native Bliss employee conducting the transaction will prepare a receipt of the transaction, and file the receipt information with the BCC using the [Inventory Control System]. Native Bliss will provide a copy of the receipt to the customer 01· the caregiver, unless the customer or the caregiver declines the receipt. The receipt will include; The name, address, and any permit number assigned to Native Bliss by the BCC; The name and address of the customer and, if applicable, the customer's caregiver; The date the cannabis was dispensed; Any requirement or limitation noted by the practitioner on the customer's certification as to the form of cannabis that the customer should use; and e The form and the quantity of cannabis dispensed. Native Bliss will store all cannabis products or waste in the process of distribution, transfer, or analysis in such a way as to prevent diversion, theft, or loss. Native Bliss staff will return product or waste to its secure location immediately after completion of the process or at the end of the scheduled business day. In order to ensure cannabis is securely stored and avoid any threat of loss and diversion, Native Bliss will: Not procure or maintain cannabis inventory in excess of the quantity required for normal, efficient operation; Keep all approved safes, vaults, or other equipment or areas used for the storage of cannabis securely locked or protected from entry, except for the actual time required to remove or replace cannabis; Keep all locks and security eq'uipment in good working order; Not allow keys to be left in the locks, or stored or placed in a location accessible to persons other than specifically authorized personnel; Store all cannabis products in a safe, vault, or secured room to prevent diversion, theft, or loss; Maintain all cannabis product in a secure area or location within the Retail Store accessible only to specifically authorized personnel, which will include only the minimum number of employees essential for efficient operation; 113 Not allow other security measures, such as combination numbers, passwords, or electronic or biometric security systems, to be accessible to persons other than specifically authorized personnel; and e l<eep Native Bliss securely locked and protected from unauthorized entry at all times. Any additional safeguards required by the BCC regarding special security issues, such as an unexpected, large stock of cannabis, exposed handling or unusual vulnerability to diversion, theft or loss, will be complied with immediately. If a loss, theft, or diversion of cannabis has occurred from the Retail Store, the Retail Store Manager or the Director of Human Relations will notify the BCC and local law enforcement immediately, who may require additional safeguards to ensure the security of the cannabis. If a reduction in the amount of cannabis in the Retail Store Inventory is due to suspected criminal activity, the Retail Store Agent in charge will immediately report the reduction to the BCC and local law enforcement. No Retail Store employees and/or security policies will prohibit members of the BCC, local law enforcement or other federal, state, local government officials, or persons authorized by the BCC from entering any area of Native Bliss Retail Store to perform their governmental duties. Promoting Responsible Use Native Bliss will promote responsible use of cannabis through a variety of messaging options: 1. Retail Store Agents will place informational inserts in exit packaging, including information on cannabis use disorder and the effect of cannabis use on the development of the adolescent brain. 21. Native Bliss' website will include this same content, regarding cannabis use disorder and the effect of cannabis use on the development of the adolescent brain 22. Native Bliss will offer lower dose THC product options, and train Retail Store Agents to educate customers on these options. 23. Native Bliss will integrate a program that allows customers to track their use via self-determined quotas, and access their usage statistics, Native Bliss' website. Advertising and Marketing In accordance with 16 CCR § 5040, Native Bliss will comply with the following requirements regarding placement of advertising: Any advertising or marketing placed in broadcast, cable, radio, print, and digital communications: Shall only be displayed where at least 71.6 percent of the audience is reasonably expected to be 21 years of age or older, as determined by reliable up-to-date audience composition data; and Shall not use any depictions or Images of minors under 18 years of age. 114 o Upon req uest, Native Bliss wi ll provide to the Bureau audie nce composition data as required in subsection a) of th is section for adve r tis in g or marketing pl aced by Native Bli ss. This information will be provided to the Bureau within the time speci fi ed by the Burea u. If th e Bureau determines th at aud ience co mposition data for advertising or marketing provided by Native Bliss does not comply with the requireme nts of subsection (a) of this section, or Native Bliss fails to provide aud ience composition data to the Bureau within th e time specified by the Bureau, Native Bliss wil l remove the advertis ing o r marketing placement in question. Restricting Advertis ing to Adu lts In accord ance with CCR § 5041, Native Bliss will comp ly with the fo llowing requirements: Prior to any advertising or marketing from Native Bli ss involving direct, individualized comm unication o r dialogue, Native Bliss will use age affirmation t o verify that the recipient is 21 years of age or older. Subject to approval by the San Luis Obispo Planning Department and the San Luis Obispo Police Department, Native Bliss will maintain a minimum exterior lighting standard of 1.5-foot candles across all perimeters, access points and parking spaces associated with the licensed premises. Lighting will be white LED lighting with a heat index between 27001<-42001<, a color rendering index of at least 70 and a light loss factor of at least .95. Where foyers exist, or awnings are installed on the structure, fixtures will be installed as necessary to provide for a minimum lighting standard of 1.5-foot candles beneath the awning or within the foyer. Additional lighting will be added as deemed necessary. Outdoor Lighting Policy It is the policy of Native Bliss to maintain outdoor lighting procedures to ensure compliance with Chapter 17.99.050 and 17.70.100 of the San Luis Obispo Municipal Codes, City Ordinance No. 1647, and all governing agencies and to dispense cannabis and cannabis products in a safe, compliant manner. Purpos e To provide safe, compliant daily operating procedures for Native Bliss, a retail dispensary. Scope This procedure applies specifically to the lighting projected from the exterior of the premise both during hours of operation and while the premise Is closed. Procedure 1. Outdoor lighting will activate at a time consistent with the activation of the City of San Luis Obispo street lights and all wall-mounted lights shall not exceed a height of fifteen feet, measured from the adjacent grade to the bottom of the fixture. 2. The lighting will be bright enough to ensure that security may effectively suppress any nuisance that could result from loitering or other interactions involving the retail storefront as well as curtail and reverse any degradation of the nighttime visual environment and the night sky. 3. Native Bliss will ensure that the storefront sign for the business will not consist of upward Illumination, be properly lit, visible, and legible so that a person hard of seeing may effectively read it. 4. The readable lighting will simultaneously consist of a proper amount of lumens in which it is neither obtrusive nor obstructive to the effective function of the neighboring businesses and traffic. 5. Outdoor lighting that is necessary for security will consist of motion sensor lights as well as timed lights that will activate at a time consistent with the activation of the City of San Luis Obispo street lights. 6. Any outdoor lighting of the parking area and/or loading area or outdoor lighting for aforementioned security shall not exceed a maintained value of ten foot-candles, when measured at finished grade. With water becoming increasingly scarce in a particularly dry area, Native Bliss understands that water is a precious resource in San Luis Obispo, and fully respects the necessity of a water efficiency plan as required in the application under the SLO city ordinance 17.99.050 Commercial Cannabis Businesses. Native Bliss will practice water conservation and efficient management to help reduce operating costs, meet drought allotments, mitigate economic losses, and extend water supplies. Native Bliss understands that a well-planned water management procedure often is accompanied by savings of energy, wastewater treatment, and toxic disposal. By developing a water conservation program, Native Bliss can implement long-term savings and can reduce expenses and sustain the viability of the business. Native Bliss plans on using recycled water on-site. Matching the quality of water by the quality of use. Use treated municipal and industrial wastewater instead of potable supplies for landscape Irrigation, dust control, and cooling water. Native Bliss plans on using water efficient equipment and devices on-site, including but not limited to: -Water efficient toilets and urinals; -Dishwashers; -Refrigerators -lcemakers; -All other water use equipment Native Bliss will assign a conservation specialist to implement programs and monitor usage to Identify waste and where areas can be more efficient. Native Bliss and the conservation specialist will Identify and evaluate specific water management alternatives for improved water use efficiency: Understand why and how water is used in the various processes and equipment in the facility. l<now the different thermal and chemical requirements of these water uses. Compliance with the regulations of water conservation to particular Basins. Identify conservation measures that will reduce water use while sustaining production. Loss of production will adversely impact business and the community. Conserve water and energy together, particularly when the energy is heat. Recycling warm water saves energy. Reduce wastewater and toxic waste disposal. Efficient water management will decrease wastewater volume and require fewer chemicals that may produce toxic by-products. When considered together, conservation becomes more cost-effective. Anticipate increased utility rates for water and wastewater service. Native Bliss will maintain water and wastewater utilities for projections of future rates. Encourage water and wastewater utilities to provide rebates and other financial assistance to offset part of the initial cost of implementing conservation measures. Use the site audit analysis and water conservation plan to justify requests for reductions in wastewater charges. The audit can also document water requirements needed for future production increases. 156 ~ e Realize cost reductions due to improved water use efficiency. After the initial payback period, soundly conceived and implemented conservation measures will save money throughout the life of the measure. The savings will increase as utility rates for water, energy, and wastewater discharge rise. As fees and utility rates increase, businesses implementing conservation measures will have a competitive advantage over firms that ignore conservation opportunities o Teach water conservation awareness. Post signs throughout the facility to create an awareness of water conservation and put information on website. Native Bliss will utilize water audits to lead cost-effective water efficiency measure. Native Bliss will gather all utility records, plumbing diagrams, alternate water supply sources, a preliminary list of water using equipment and processes. Native Bliss and conservation specialist will conduct quarterly walk-through surveys. Keeping a record of: 1. Hours of operation of each water-using process or piece of equipment. 2. Water flow and quality regarding temperature, pH, TDS, and organic loading. 3. Measure the amount of water use. 1 Odor Control P lan Odor Control Plan : A detai led plan describing how t he appl icant will prevent all odors generated from the cultivation, manufacturi ng and storage of cannabis from escaping from the buildings on the business site, such t ha t the odo r cannot be detected by a reasonab le person of no r mal sensitivity outside t he bui l dings . Pursuant to SLOMC 17.99.050.E.3), Native Bliss's facility will be sited and/or operated in a manner that prevents cannabis odors from being detected offsite. Commercial cannabis activities will not create offensive or excessive odors, dust, heat, noise, light, glare, smoke, traffic, or hazards due to the use or storage of materials, processes, products or wastes, or other unreasonable impacts to people of normal sensitivity living, working or la wfu lly present In the vicinity of the comme rcial facility. Native Bliss will have an air treatment syste~ that ensures offsite odors will not result from i ts operations. This requirement at a minimum means that Native Bliss will be designed to provide sufficient odor absorbing ventilation and exhaust systems so that any odor generated in side the location of Native Bliss is not detected outside the building, on adjacent properties or public rights-of-way, or within any other unit located within the same building as Native Bliss, if the use only occupies a portion of a building. We will take measures to eliminate any cannabis odor that may potentially emanate from the retail store to mitigate disturbances to local business residents. Ventilated air from the retail store will pass through HEPA filters with UV-light sanitation. Any air that is expelled from the building will be filtered again through HEPA and charcoal filters to ensure clean, odor-free air. Odors will be mitigated by activated carbon filters integrated into the exhaust, ventilation, and HVAC systems. Activated carbo n is charcoal treated with oxygen, which generates pores between the carbon atoms, creating a highly absorbent material that captures odorous, gaseous, and liquid contaminates. The building will also be negatively pressured, preventing odor escape. The Safety Coordinator will conduct the initial review of Native Bliss' build ing an d des ig n pla ns, and as con struction Is completed, will leverage Ca l/OSHA's Hazard Assessment Checkli st, to identify all potentia l hazards, and how the company will mitigate them. Thi s assessment, along with Cal/OSHA's Cal/OSHA's llPP Se lf-Assess m ent Checkl ist. will facilitate the creation of Native Bliss' Injury and Illnes s Prev ention (llP) Program. A written llP is required which is r equired for all employers In the State of California. Additional measures serve to establish procedures for injury cl ai m s and policies re lated to workers' compensation an d benefit s provided. 159 i Hazard Communication Policy Native Bliss is committed to the prevention of hazardous material and chemical incidents that could result in injury and/or illness to any employee. Native Bliss will spare no effort in providing a safe and healthful work environment for employees and all levels of supervision will be accountable for the safety of those employees under their direction. The Occupational Safety and Health Administration's (OSHA) Hazard Communication standard (29 CFR 1910.1200) is based on the simple concept that employees have both a need and a "right to know" the identities and hazards of any chemicals they work with during the course of their employment. Employees also need to know what protective measures are available to prevent chemical exposures and how to avoid adverse health effects. The following constitutes Native Bliss' written Hazard Communication program. Native Bliss will meet the requirements of OSHA's Hazard Communication standard as follows: Container Labeling It is the policy of Native Bliss that no container will be released for use unless it has a complete label. Managers will ensure that secondary containers, such as spray bottles, have complete labels. Either (1) a copy of the original manufacturer's label will be made and placed on the secondary container, or (2) the minimal information bulleted above will be placed on the container in permanent ink.
