CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION Significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Section 54956.9: No. of potential cases: One. A point has been reached where, in the opinion of the legislative body of the local agency on the advice of its legal counsel, based on existing facts and circumstances, there is a significant exposure to litigation against the local agency. The existing facts and circumstances exposing the City to litigation include the following: In a letter dated February 14, 2019, attorney for the International Association of Firefighters, Local 3523 requested a tolling agreement related to what was described as FLSA regular rate miscalculations by the City. In an email exchange that followed receipt of the letter, the attorney clarified the position of Local 3523 and submitted a Public Records Act Request for information related to employee health benefit payments. Copies of the original letter, email exchange, and records request are on file with the City Clerk’s office. CITY FARM 5 YEAR REPORT AND PRESENTATION (MARX – 5 MINUTES) Steven Marx, Executive Director and President of Central Coast Grown, will present the City Farm 5-year Report. 2. C-SPAN CITIES TOUR (JOHNSON – 5 MINUTES) Representatives from C-SPAN will present their San Luis Obispo Weekend "tour" plan. PUBLIC COMMENT PERIOD FOR ITEMS NOT ON THE AGENDA (not to exceed 15 minutes total) The Council welcomes your input. You may address the Council by completing a speaker slip and giving it to the City Clerk prior to the meeting. At this time, you may address the Council on items that are not on the agenda. Time limit is three minutes. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Code sec. 54954.2). Staff may be asked to follow up on such items. CONSENT AGENDA Matters appearing on the Consent Calendar are expected to be non-controversial and will be acted upon at one time. A member of the public may request the Council to pull an item for discussion. Pulled items shall be heard at the close of the Consent Agenda unless a majority of the Council chooses another time. WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES (PURRINGTON) Recommendation: Waive reading of all resolutions and ordinances as appropriate. 4. REVIEW MINUTES OF THE FEBRUARY 19, 2019 CITY COUNCIL MEETING (PURRINGTON) Recommendation: Approve the minutes of the City Council meeting held on February 19, 2019. 5. PUBLIC HEARING - SECOND READING TO ADOPT AN ORDINANCE AMENDING THE AIRPORT AREA SPECIFIC PLAN AND THE CITY'S GENERAL PLAN TO RE-ZONE PROPERTY TO ALLOW FOR A MIXED-USE PROJECT (CODRON / COHEN) Recommendation: Adopt an Ordinance entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, rezoning property at 650 Tank Farm Road from Business Park (BP-SP) and Medium-Density Residential (R-2-SP) to Service Commercial (C-S-SP) and making associated amendments to the Airport Area Specific Plan to be consistent with the 650 Tank Farm Mixed-Use Project Conceptual Development Plan and with the General Plan as amended.” 6. LOW CARBON TRANSIT OPERATIONS PROGRAM GRANT APPLICATION(S) (GRIGSBY / ANGUIANO) Recommendation Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, authorizing the City Manager or their designee, to file, execute and fulfill any related low carbon transportation operations program grant applications, certifications, assurances, forms, agreements, and associated documents on behalf of the City” for transit capital projects. 7. TERRACE HILL PIPELINE AND PRESSURE REGULATING VALVE REHABILITATION PROJECT, SPECIFICATION NO. 91425 (GRIGSBY / KLOEPPER) Recommendation: Approve the project plans and special provisions, authorize staff to advertise for bids, and authorize the City Manager to award the construction contract for the bid total if the lowest responsible bid is within the Engineer’s Estimate of $420,000. SOUTH HILLS RADIO SITE UPGRADES PROJECT, SPECIFICATION NO. 91584 (GRIGSBY / KLOEPPER) Recommendation:   Approve the project plans and specifications, authorize staff to advertise for bids, and authorize the City Manager to award the construction contract for the bid total if the lowest responsible bid is within the publicly disclosed funding amount of $650,000.  9. FY 2019-20 GRANT APPLICATION FOR OFFICE OF TRAFFIC SAFETY GRANT PROGRAM (CANTRELL / ELLSWORTH) Recommendation: 1. Authorize the Police Department to submit a grant application to the Office of Traffic Safety for a FY 2019-20 Selective Traffic Enforcement Program (STEP) not to exceed $125,000. 2. If the grant is awarded, authorize the Chief of Police to execute all grant related documents and authorize the Finance Director to make the necessary budget adjustments upon the award of the grant. 10. CALLE JOAQUIN LIFT STATION REPLACEMENT, SPEC. NO. 91118, CONTRACT AMENDMENTS (FLOYD / HIX / METZ) Recommendation: 1. Approve and authorize the Mayor to execute a contract amendment with AECOM for $175,827 for engineering design services for the Calle Joaquin Siphon and Lift Station Replacement, Spec. No. 91118; and 2. Authorize use of project funding for additional environmental permitting services by Terra Verde Environmental Consulting and property acquisition services by Hamner Jewell & Associates for the Calle Joaquin Siphon and Lift Station Replacement. BUDGET REALLOCATION FOR THE POLICE DEPARTMENT REPLACEMENT PROJECT AND SINSHEIMER TENNIS COURT LIGHTING PROJECT (GRIGSBY / NELSON) Recommendation: Citizens’ Revenue Enhancement Oversight Commission Recommendations (REOC): 1. Authorize the reallocation of Local Revenue Measure funds for the Police Station Replacement Project; and 2. Approve the following budget transfers: a. $104,000 to the Police Station Replacement Project, Specification No. 91365, from Police Department Space Improvements & Carpet Replacement Project, Specification No. 91557; and b. $20,000 to the Major Facilities Replacement Account, Specification No. 91250, from the Police Department Space Improvements & Carpet Replacement Project, Specification No. 91557; and Staff Recommendation: 1. Authorize Staff to implement the above REOC recommendations; and, 2. Authorize the deferment and return $165,000 of unspent funds of the Parkland Funded 2017-19 Sinsheimer Park Tennis Court Lighting Project and direct staff to include discussions of this project concurrent with the update of the Parks and Recreation Element and Master Plan Update. PUBLIC HEARING AND BUSINESS ITEMS 12. RESOLUTION OF INTENTION AND AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES’ RETIREMENT SYSTEM TO PROVIDE SECTION 20516 (COST SHARING) (IRONS / SUTTER – 10 MINUTES) Recommendation: Adopt a resolution of intention entitled “Resolution of Intention to approve an amendment to contract between the Board of Administration California Public Employees' Retirement System and the City Council of the City of San Luis Obispo;” and Introduce an Ordinance entitled “An Ordinance of the City Council of the City of San Luis Obispo, California, authorizing an amendment to the contract between the City Council of the City of San Luis Obispo, California and the Board of Administration of the California Public Employees’ Retirement System” approving an amendment to the contract between the Board of Administration of the California Public Employees’ Retirement System (CalPERS) and the City of San Luis Obispo. San Luis Obispo City Council Agenda March 5, 2019 Page 6 13. 2019 LEGISLATIVE PLATFORM (SECOND REVIEW) (DIETRICK – 30 MINUTES) Recommendation: Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, establishing the City Legislative Action Platform for 2019 and appointing the Council Member and staff person to act as liaison between the City of San Luis Obispo and the League of California Cities.” STUDY SESSION ITEMS 14. CAL POLY REGIONAL WATER SUPPLY ALTERNATIVES AND SHORT-TERM WATER AGREEMENTS (FLOYD / METZ – 60 MINUTES) Recommendation: Receive an update on Cal Poly regional water supply alternatives and provide direction on whether existing policy should be broadened to include both non-potable and recycled water supplies. LIAISON REPORTS AND COMMUNICATIONS (Not to exceed 15 minutes) Council Members report on conferences or other City activities. At this time, any Council Member or the City Manager may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council Policies and Procedures, they may provide a reference to staff or other resources for factual information, request staff to report back to the Council at a subsequent meeting concerning any matter, or take action to direct staff to place a matter of business on a future agenda. (Gov.
