DISCUSSION In 2018, National Oceanic and Atmospheric Administration (NOAA) staff informed the City that the Calle Joaquin Siphon and Lift Station Replacement project must include the removal of the existing sewer siphon from within the San Luis Obispo Creek channel. Sewer siphons are common in wastewater collection systems to convey wastewater under creek channels. The siphon removal was not proposed by the City as part of the original project concept as Natural Resources staff believed it provided habitat value in its current location, and its removal would result in additional creek disturbance as well as lengthen project construction. With this new requirement, staff revisited the project to review whether other feasible opportunities exist to eliminate the existing siphon, install the replacement with horizontal directional drilling, and avoid disturbance to the creek environment. The original project also involved the removal of the invasive plant, Arundo within the creek channel; the City still views, this component as highly desirable. This work is enabled by the excavation activities conducted for the installation of the new siphon. The City's engineering consultant, AECOM, provided a proposal for the additional design services for the removal of the existing siphon, provided here with the proposed contract amendment (Attachment A). The NOAA requirement to remove the existing siphon from the creek channel requires the City to update the project's CEQA document. Terra Verde Environmental Consulting (Terra Verde), who is working on project permitting, has provided the attached proposal (Attachment B) to accomplish this additional work. Packet Pg. 43 Item 10 Staff continues to work with Hamner Jewell & Associates (HJA) to negotiate w ith property owners related to easement acquisition for the siting of the lift station and siphon installation work, including temporary and permanent easements. Due to lengthy dialog necessary to sort through siting issues associated with the new lift station, this work has extended beyond the original scope of HJA’s contract. HJA provided a proposal (Attachment C) to complete the process. Staff is also recommending the City Council authorize use of project funding for additional environmental permitting a nd property acquisition services. Both Terra Verde and HJA are on-call consultants under contract with the City. The project budget has a current balance of $2,579,973.94 to accommodate the contract amendment with AECOM and additional services from Terra Verde and HJA, which total $225,402. AECOM will update the project’s Opinion of Probable Construction Cost to identify the necessary design and construction cost change in the upcoming 2019 -21 Financial Plan. The City entered into a contract with AECOM in 2011 for two lift station replacement projects - the Laguna and Calle Joaquin lift stations and the Calle Joaquin force main. The City’s contract with AECOM has been amended previously to accommodate various changes in the original project’s scope and construct ion schedule including: • Separating the Laguna and Calle Joaquin lift stations for construction, • Adding construction phase support for the Laguna lift station project, • Separating the project’s force main construction from the siphon and Calle Joaquin lift station replacement, and • To add scope to the project for modifications to the alignment of the 101 crossing and add landscape plans and specifications for the area surrounding the lift station. The project’s design, easement acquisition, and environmental permitting process has been challenging due to the existing siphon’s location and crossing of Highway 101. The City hired HJA to assist with property acquisition for the project in 2015 and Terra Verde to assist with environmental permitting in 2013. The City Council approved a Mitigated Negative Declaration of Environmental Impact for the Calle Joaquin Lift Station and Siphon Project in 2016 (Resolution 10718). Packet Pg. 44 Item 10 At this time, the construction documents for the project are close to 100 percent complete. Environmental permitting is required from a number of environmental agencies including U.S. Fish and Wildlife Service, California Department of Fish and Wildlife, Regional Water Quality Control Board, Army Corps of Engineers, and NOAA. Previous Council or Advisory Body Actions The City Council approved a Mitigated Negative Declaration of Environmental Impact for the Calle Joaquin Lift Station and Siphon Project in 2016 (Resolution 10718). The NOAA requirement to remove the existing siphon from the Creek cha nnel requires the City to update the project’s CEQA document. Staff proposes to work with Terra Verde to update the project’s CEQA document and other environmental permitting for the project. Policy Context On April 21, 2009, the City Council adopted the City’s first Sewer System Management Plan (SSMP). The SSMP documents a comprehensive program for sewer system operation, maintenance and repair as required by the State Water Resources Control Board’s Statewide General Waste Discharge Requirements. On May 20, 2014, the City Council approved Resolution 10522 to update the SSMP. Public Engagement The Calle Joaquin Siphon and Lift Station Replacement project is identified as a priority project in Financial Plan Capital Improvement Plan. The project is funded by the City’s Sewer Fund. When the project proceeds to construction, updates will be provided on the City’s Public Works Department website at: www.slocity.org/government/department-directory/public-works/construction-and-traffic-updates CONCURRENCES Co mmunity Development concurs with the environmental review findings. ENVIRONMENTAL REVIEW An Initial Study and Mitigated Negative Declaration was prepared by Sage Institute for the project in accordance with the California Environmental Quality Act and approved on April 9, 2016. The NOAA requirement to remove the existing siphon from the Creek channel requires the City to update the project’s CEQA document, as described above. Annual staffing, maintenance, equipment, and energy cost for the Calle Joaquin Lift Station is estimated at $15,000 annually. This cost is not expected to increase with the replacement of the lift station. ALTERNATIVE Elect not to approve the contract amendment. The City Council may elect not to approve the contract amendments at this time. Council may select this alternative if it believes the lift station and siphon replacement should be deferred. Staff does not recommend this alternative due to the age of the lift station and the opinion of NOAA. WITNESSETH: WHEREAS, on November 15, 2011 the City entered into an Agreement with Contractor for Engineering Design Services per Specification No. 91133 and WHEREAS, the City desires to amend the scope of services to include additional Engineering Design Services and Contractor has submitted a proposal for this purpose that is acceptable to the City. SCOPE OF WORK This Scope Amendment includes the following tasks: TASK GROUP 1: Project Management and Coordination Task 1.1: Project Meetings AECOM will attend three (3) progress and coordination meetings during the final design of the project. Additional meetings for other tasks are included in their respective task. Task 1.2: Project Management AECOM will provide additional project management and coordination with the City’s Project Manager. Task 1.3: CEQA and Permitting Support AECOM will provide additional CEQA and Permitting coordination with the City and their subconsultant. TASK GROUP 2: Siphon Removal and Restoration Task 2.1: Existing Siphon Removal and Creek Restoration Design In order to comply with a request from the National Marine Fisheries Service (NMFS), AECOM will provide plans, specifications, and opinion of probable cost (OPC) to remove the existing siphon from Packet Pg. 48 Item 10 2 the channel of San Luis Obispo Creek and restore the channel. The design is based on the following parameters from the City:  Removal of an approximately 15-20 foot section of the existing sewer pipeline and concrete encasement from the center of the channel;  Installation of a water diversion to isolate the instream work area including dewatering;  Construction of a roughened channel. For NMFS review purposes, separate set of bid documents will be prepared for Task 2.1. Subtasks include the following:  Channel Design o Background Review, Hydrologic Data Collection o Site Reconnaissance, Sampling and Analysis o Determine Design Flows, Criteria and Constraints o Hydraulic Modeling (Existing and Iterative Design) o Fish Passage Assessment and Design o Grade Control, Channel Substrate and/or Bank Design o Material Balance Iterations  Revegetation Design o Planting plan, details, and schedule o Irrigation plan, details and schedule o Planting preparation plan o Seeding and mulching plan o Willow pole cuttings installation plan o Container plant and tree seed installation plan o Plant establishment plan (1-Year) o Long term maintenance and monitoring plan (Year 2-5) o Propagule collection plan Deliverables:  60% Submittal consisting of the following (7 hard copies): o Draft half-size (11” x 17”) drawings o Draft technical specifications o Draft opinion of probable construction costs (OPC)  90% Submittal consisting of the following (7 hard copies) o Revised half-size (11” x 17”) drawings o Revised technical specifications o Revised OPC Once the design documents are approved by the NMFS, the design will be incorporated into Project’s final design documents as part of Task 3.2. Packet Pg. 49 Item 10 3 TASK GROUP 3: Finalize 100% Design Documents for Bid Task 3.1: Develop Recommended Sequence of Construction AECOM will conduct two meetings with City staff and the City’s construction inspector (Filippin Engineering) to determine a recommended sequence of construction for the project. The meetings will allow all parties to evaluate the various permit schedule requirements alongside standard construction practices and continued sewer service requirements to determine the optimum timing for bidding, construction, and duration of the project. The conclusions from these meetings will be summarized in an email and incorporated into the Project specifications as part of Task 3.2. Deliverables:  Recommended Sequence of Construction email Task 3.2: Finalize Design Documents for Bid AECOM will finalize the 100% Design Documents for bid including the plans, specifications, and OPC. This task includes the following subtasks:  Incorporate approved siphon removal and creek restoration design documents developed in Task 2;  Revise specifications to include the sequence of construction developed in Task 3.1;  Update design documents based on final permit requirements from all agencies;  Update design documents based on final agreement with Motel 6;  Reduce the size of the Highway 101 crossing casing to 24-inch diameter and revise the construction method;  Due to the delays in design, review specifications to identify changes in manufacturer product lines, design standards, and environmental laws that effect the specifications. Update specifications as necessary;  Incorporate recommended revisions based on the survey consultant review of the project survey;  Incorporate recommended revisions based on the geotechnical engineering consultant review of the project geotechnical report;  Conduct a constructability review of the design documents;  Final QA/QC of the design documents. Packet Pg. 50 Item 10 4 Deliverables:  Final Submittal consisting of the following (7 hard copies and electronic copy in PDF format) o Final half-size (11” x 17”) drawings o Final technical specifications o Final OPC Additional Engineering Services If requested by City, AECOM will provide the following additional services, beyond the services included in our Scope of Work, on a time and materials basis based on the current rate schedule: A. Attendance to additional meetings beyond those specifically identified. B. Planning, analysis or design of additional or alternative facilities, including facilities offsite from the proposed project site. C. Services associated with prequalification of contractors other than as specifically defined herein. D. Any additional project-related services not specifically included in Scope of Work. Client Furnished Services The following services or information will be provided by City or its consultants: A. Information for inclusion in the cost opinion and/or bid item descriptions on project components not being prepared by AECOM. B. Copies of all relevant reports, studies, drawings, correspondence, and other relevant project information or data. We have assumed that the City will provide all relevant planning information identifying existing and future design flows for the lift station. Schedule The preliminary schedule for this scope of work assumes a notice-to-proceed (NTP) date of December 21, 2018 and bidding for the project to commence June 28, 2019. Budget AECOM’s budget for the scope items described above is $175,827, and will not be exceeded unless additional authorization is requested and granted by the City in writing. AECOM’s fee and costs will be invoiced on a Time and Materials basis. These services will be provided according to the terms and conditions defined in the Agreement between the City and AECOM for Design Services for the Calle Joaquin and Laguna Lift Station Replacement project, dated November 15, 2011. City of San Luis Obispo  879 Morro Street  San Luis Obispo, CA 93401      RE: Calle Joaquin Lift Station Replacement Project – Continued Permitting Assistance    Dear Ms. Metz,    Per your request, Terra Verde Environmental Consulting, LLC (Terra Verde) has prepared the  following scope of work and cost estimate to provide continued permitting assistance for the  City of San Luis Obispo (City) Calle Joaquin Lift Station Project (project). Due to recent feedback  received from the National Marine Fisheries Service (NMFS), the project is currently going  through design modifications to include the removal of the existing siphon that was originally  planned to be abandoned in place and installation of a roughened channel for grade control.  The City has determined that there will not likely be enough time to install and switch the new  sewer line into service and remove the existing sewer during a single construction season. As  such, it expected that the proposed project will require two consecutive seasons to complete  with installation of the new sewer line in Year 1 (Phase 1) and removal of the existing line and  installation of the roughened channel in Year 2 (Phase 2).    Terra Verde has been asked to support the approval of the revised project description and  acquisition of the final agency permits for the revised project (Phase 1 and 2). This scope of  work entails the following tasks:    Task 1 – Project Description Addendum and Agency Submittals (Phase 2)  Task 2 – CEQA Documentation/Prepare Subsequent Mitigated Negative Declaration  Task 3 – Revise Habitat Restoration Plan  Task 4 – Biological Resources Assessment Memorandum  Task 5 – Permit Tracking and follow‐up Support  Packet Pg. 55 Item 10 2 Task 1 – Project Description Addendum (Phase 2)  Under this task, Terra Verde would update the current project description to include the  pipeline abandonment and roughened channel component (Phase 2) and submit the project  updates to the regulatory agencies. This would include the following:   Update graphics showing the revised work area.   Support final project description development that includes details on area of  disturbance, volumes of material, type of material, stockpile locations, updated  impact calculations, etc.   Review the updated Phase 2 site plans and provide technical support (once available  from project engineer; assumed later date).   Submit the project description update and amendments to the regulatory agencies  for review/comment.    Task 2 – Prepare CEQA Documentation  Terra Verde will be responsible for preparing the updated CEQA documentation for the project.  For the purposes of this scope of work, we have assumed that the appropriate CEQA document  will be a subsequent Initial Study and Mitigated Negative Declaration (IS/MND). The  subsequent IS/MND will include the requested project description revisions related to facility  improvements, construction methods, sequencing, and schedule. The evaluation of  environmental impacts will utilize the technical information included in the original IS/MND  prepared for the Calle Joaquin Siphon and Lift Station Replacement (October 7, 2015), to the  extent feasible. The environmental baseline will be updated, as appropriate, based on the  Biological Resources Assessment Memorandum (refer to Task 4) and existing baseline data  available from the City (e.g., traffic, water and wastewater capacities, etc.). The IS/MND will be  prepared using the City standard format. This task also includes time to draft the required  public notices.    Task 3 – Revise Habitat Restoration Plan  Terra Verde will update and revise the Habitat Restoration Plan (HRP) to include details on the  roughened channel component as well as the temporary erosion control measures and Best  Management Practices that will be necessary to temporarily stabilize the site between phases.  We have assumed one round of review by the City prior to submittal to the regulatory agencies  for review as part of Task 1 (above).    Task 4 – Biological Resources Assessment Memorandum  Terra Verde will review the existing Biological Resources Assessment prepared by Sage Institute  (May 2015) to ensure that the biological resources impact analysis adequately addresses the  revised project components. This will include a desktop analysis of the California Department of  Fish and Wildlife California Natural Diversity Database for any recent sensitive biological  Packet Pg. 56 Item 10 3 resources occurrences as well as a brief inspection of the proposed roughened channel area  and an immediate buffer area. The findings will be included in a summary memorandum which  will supplement the subsequent IS/MND in Task 2 above.    Task 5 – Permit Tracking and Follow‐up Support  After submittal of the updated project materials (Task 1), Terra Verde will continue to work  with the City and the regulatory agencies to meet the City’s construction schedule. This  communication will be maintained throughout the project permitting process. These  communications include providing agencies with information from other resource agencies  involved in the project including the updated CEQA documentation for further permit  processing and approval. This is assumed to include follow‐up correspondence with the  regulatory agencies (e.g., email, phone calls, etc.), additional site visits, and possibly additional  project team meetings. This task does not include conducting additional resource surveys or  development of technical reports or plans.    Cost Estimate  The total not‐to‐exceed amount of this work is estimated to be $23,975.00 and includes a 15%  contingency to account for unforeseen support tasks to complete the permit process. Any  changes to this scope or cost estimate will be approved in advance by the City prior to out of  scope work occurring.    Assumptions:     Task 1 includes up to one (1) additional meeting with the project team.   Phase 1 will be completed as originally proposed (i.e., trenching). If HDD is proposed, a  separate scope of work will need to be prepared to support consultation with agencies  on substantial project changes and determine permitting requirements.    The City and/or Engineer will provide details on area of disturbance, volumes of  material, type of material, and stockpile locations.    The City will provide engineering specifications and drawings for use in final permits, as  necessary.   All draft deliverables will be provided to the City in electronic format, unless otherwise  requested   Task 2 includes up to two (2) meetings with the City planner.   No additional technical documents, other than those which already exist (or are  proposed under the tasks above and are included in this scope of work), will be required  for the IS/MND.  Packet Pg. 57 Item 10 4  The City will provide a list of names and addresses to be used for noticing the Draft  IS/MND.   Task 5 assumes one additional site visit with agency staff, as necessary, to discuss the  Phase 2 design component (i.e., roughened channel).   The City will provide checks for all additional permit application fees.   Assumes the U.S. Army Corps of Engineers will concur with proposed draft PD.   Assumes Regional Water Quality Control Board will accept responses for Phase 1.   Assumes the existing California Department of Fish and Wildlife Streambed Alteration  Agreement can be amended to include Phase 2.
