cannabis companies on the Central Coast.
MOM has also been cultivating cannabis in SLO County since 2010 using organic, sustainable agricultural
practices that align with its core value of responsible stewardship. Well before there were regulations
governing the cannabis industry, MOM committed to using only Organic Materials Review Institute (OMRI)
certified pest control and disease management products and fertilizers. At a time when most retailers
bought from numerous growers who too often used hazardous fungicides, miticides, pesticides, and
petroleum derived fertilizers—almost 100% of the cannabis flowers sold through MOM’s delivery service
were cultivated by MOM, thereby ensuring customer safety and product quality.
Community involvement has been a central part of MOM’s company culture since its founding. From
adopting a two-mile stretch of Highway 1, to sponsoring community workshops and blood drives,
and even hosting a local radio show, MOM has a exemplary track record of responsible community
stewardship. Additionally, Megan and Eric’s commitment to community development has led them to
serve on multiple boards of directors of local non-profit organizations.
The knowledge and experience Megan and Eric accumulated through their entrepreneurial cannabis
projects provides MOM SLO cannabis storefront with a skilled management team that can guaranteed
success. Their extensive commercial cannabis cultivation and retail delivery experience is complemented
their retail storefront experience gained from Megan’s CBD Market--a shop in Morro Bay selling hemp-
derived products.
MOM wants to continue growing our local brand that can help form the foundation of SLO County’s
cannabis industry: MOM is pursuing licenses for 5-acres of outdoor cannabis cultivation in unincorporated
SLO County, a cannabis storefront and delivery service in Morro Bay, and a cannabis storefront in the
City of SLO.
For its SLO cannabis storefront project, MOM has assembled a completely local team, with truly local
funding, which can offer the City of San Luis Obispo a world-class cannabis retail establishment. A solid
track record of tax compliance, community involvement, and environmental stewardship, make MOM
and the City of San Luis Obispo, the perfect match. The details of our proposal are outlined in the
following application and we hope to work alongside the City as we embark on this new venture.

Who We Are
MOM is a highly experienced, 100% local team, with 100% local funding.
Megan Souza is owner of Megan’s Organic Market
in Morro Bay, which opened in 2013 as a Prop.
215 medical marijuana supplier. Megan attended
Shell Beach Elementary, Judkins Middle School,
Arroyo Grande High School, Cuesta College, UC
Santa Cruz, and Cal Poly for grad school. She
holds a Bachelor of Arts degree in philosophy
from UC Santa Cruz.
Megan’s mother owned New Waves vintage
clothing and costume store in downtown Pismo
Beach, her grandmother owned Second Time
Around vintage store in downtown SLO and her
cousin founded (and recently sold) the popular
Sally Loo’s Wholesome Cafe in SLO.
Megan and partner Eric Powers worked double
shifts as servers at local restaurants to fund their
first medium-scale indoor grow in Cayucos starting
in 2010. With the harvest, they supplied a small
collective of local medical patients. Slowly, their
patient list grew and the size of their cultivation
along with it. In 2016, they moved to a farm in Los
Osos so they could expand and grow outdoors.
Their farm is in Clark Valley, with an agreeable
microclimate, rich native soil and a bountiful well.
As their collective grew and they supplied more
and more patients’ medical cannabis needs,
the need for local advocacy for cannabis users
became apparent.
So they hosted educational campaigns and events,
made a free medicine program for patients
in need, and used their large patient base as a
means to scale up the small community service
projects they did in their spare time. They serve
on the boards of several local non-profits. Megan
hosts an educational cannabis+hemp radio
show, they conduct monthly highway cleanups of
their adopted 2-mile stretch of Hwy 1, volunteer
as election poll workers and candidate forum
workers, organize and host blood drives, and
donate to KCBX public radio and other local non-
profits that help the community.

Eric has been a resident of San Luis Obispo County since 1996. He has
five years of local commercial cannabis retail experience and eighty
years of local commercial cannabis cultivation experience. Since 2010,
Eric has cultivated thousands of pounds of cannabis in SLO County,
which was distributed to more than 3,000 registered local patients
through the delivery service he co-founded with Megan Souza, Megan’s
Organic Market.
Along with Megan, Eric also co-owns Red Truck Management LLC, which
possesses a Temporary Cannabis Cultivation License from the California
Department of Food and Agriculture for local outdoor cultivation in Los
Osos. Red Truck Management LLC has also applied for a license for a
3-acre outdoor cultivation site in Shandon, CA.
Eric also serves as treasurer of the Board of Directors for the Morro
Bay Neighborhood Watch Association, and is a passionate advocate for
sustainable agriculture.
Melissa is the fifth generation of her family to be born and raised on the
Central Coast. Her family has been in the real estate and small business
ownership industry since migrating to the area in a covered wagon
during the Gold Rush.
Following in her family’s entrepreneurial spirit, Melissa attended
cosmetology school immediately after graduating from Atascadero
High School. She paired her newly earned cosmetology degree with her
strong work ethic and business savvy, and went on to have a thriving
hairstylist practice for more than 22 years, owning and operating her
own salon for six of those years.
Now living in SLO and raising her daughter with husband Levi, Melissa is
looking forward to taking her entrepreneurial drive and business savvy
and applying it to the emerging cannabis industry in her hometown.
She wants people to understand the opportunities and possibilities that
are associated with this industry, and is ready to see it lose its negative
stigma to become more widely accepted.
Melissa will work in the Operational Division of the dispensary, applying
her experience and skillset to the storefront layout and design, and to
creating a welcoming and positive customer experience.

Board Certified Lactation Consultant (IBCLC), offering lactation support and education to new parents, and
teaching educational classes at the Santa Lucia Birth Center.
Lindsey also volunteers with the Central Coast Breastfeeding Coalition. For the past 8 years, through her
work with this organization, she has helped educate other care providers on patient care and best practices,
offered community outreach and education, organized breastmilk donation drives, been an advocate for
and recognized breastfeeding-friendly workplaces, and hosted a monthly post-partum support group for
new moms.
Lindsey will hold educational workshops for the San Luis Obispo dispensary, applying the knowledge and
experience she has gained through her lactation consultant advocacy work to the cannabis industry. She
has seen first-hand how cannabis can be used to treat a variety of malaise; throughout he mother’s cancer
treatment, Lindsey educated herself on how cannabis can supplement traditional pharmaceuticals to treat
insomnia and anxiety. Lindsey’s brother, paralyzed from the waist down as the result of a motorcycle
accident, uses cannabis to minimize his paralysis-induced muscle spasms.
She believes many of the stigmas associated with the cannabis industry can be dispelled through outreach
and education, and looks forward to the opportunity to further serve the community through this new
industry.
Amanda has been a resident of San Luis Obispo County since 2006. She
has two years of local retail cannabis experience.
As a single mother raising three children in SLO County, making ends
meet has often meant juggling three jobs at a time. Equity interest in
MOMSLO INC is a life-changing opportunity for Amanda and her family.
While employed by Megan’s Organic Market, Amanda developed
a passion for helping people manage pain, detox from addictive
prescription medications and reclaim their lives from anxiety and
depression.

Lindsey Law
Lindsey comes from a long line of San Luis Obispo area locals. Her
mother’s family immigrated here and received the first Spanish land
grant in all of California. And most of her family is still local, including
her parents, grandmother, aunts and uncles, cousins, and siblings. So
when it was time for Lindsey to raise her own family, she knew San Luis
Obispo was the place she wanted to settle down.
Now a mother of 4, Lindsey has planted her own family’s roots here in
SLO. She founded and operates her own business as an International

Levi Seligman is one of the principal property
owners behind this application. Levi arrived in
SLO in 1998 to attend Cal Poly, where he earned a
degree in Construction Management. He’s married
to Melissa Seligman and they have a 3-month old
daughter, Blaire Nissa Seligman. He bought his
first property in 1999, and his passion has always
been to work with the land and have the land work
for him. After working for himself for many years,
Levi decided to help people obtain their own land
and joined forces with Acquire Mortgage and
Real Estate Inc., located in SLO. Acquire has the
unique ability to streamline property purchases
by simultaneously handling the financing and
real estate transaction. This ability to complete
everything all under one roof is the main reason
Levi became a partner in Acquire Mortgage. Levi
also owns many SLO County properties including:
Keith Sweeney is one of the principal property
owners behind this application. An immigrant from
Ireland, Keith has been working on commercial
real estate investments and business projects in
the City of SLO for the past decade. Keith attended
technical college in Dublin, Ireland, before moving
to San Francisco and starting in the commercial
property business as a plumbing contractor.
He owned and operated Sweeney Plumbing for
19 years. Keith then relocated to SLO, where
he married and started his family. He and wife,
Lindsey Law, have 4 young children. Keith has
a strong sense of loyalty and takes pride in his
community and the relationships that he builds.
His passion is in creating successful partnerships
and introductions that will ultimately benefit his
family, friends, partners, and the community as
a whole.

Proposed Location
Overview
MOM proposes a medical & adult-use cannabis retail storefront at 300 Higuera St, San Luis
Obispo, CA 93401. The C-R zoned site is located in the SLO City Cannabis Zone: Mid-Higuera
Overlay Area and is therefore land use compliant. The underutilized site is the former home
of the “O’Connor Pet Hospital” and is currently vacant. Levi Seligman, a principal of MOM
SLO LLC has obtained ownership of the property, giving MOM majority control. A complete
overhaul of the property is proposed, including but not limited to:
Complete facade rehabilitation and major interior renovations
Improved parking lot with ample parking
A Net Zero Energy project through solar and energy efficient fixtures
Two electric vehicle car chargers and a bike rack
Dark sky” compliant exterior lighting
Rain water recapture system
Potential for future affordable housing development

MOM ‘s vision for the property is a project that will significantly improve this major coordinator
of the city. It is an upscale, world-class cannabis retail facility that the city can be proud of.
With commitments to Net Zero Energy, electric vehicle chargers, a bike rack, LED lighting (see
Section 5: Lighting Plan for more information), drought tolerant landscaping, and rainwater
recapture, this project is also in alignment with San Luis Obispo’s climate action goals.
The facility plans coupled with MOM’s extensive experience and local roots provide for an
unmatched customer experience that is emblematic of SLO’s high standards.

Experience
Record of Compliant Current & Previous Business Operations
MOM has a substantial previous record of operating a compliant medical cannabis operation.
MOM has no documented history of unresolved local or state level violations relating to
cannabis. Primary principals Megan Souza and Eric Powers operated Megan’s Organic Market
delivery service out of Los Osos/Morro Bay, CA beginning in December of 2013 and continued
through 2018. Additionally, Eric Powers began cultivation operations in San Luis Obispo
County in 2010.
Therefore 100% of the primary principals have operated a local compliant cannabis operation
for 5 or more years. Please see Exhibit G: Evidence of 5 Years Local Cannabis Experience and
Section 1-D: Tax Compliance for verification.
Throughout all of Megan Souza’s and Eric Power’s cannabis operations there have only been
two instances where our compliance has come into question.
The first instance involved a wage dispute with an employee. MOM took a top level
employee on an all-expense-paid snowboarding trip. After the employee quit, the
employee claimed that he expected to be paid for his time on the trip. Although MOM
had told the employee the trip was optional and not paid, MOM found it to be more
cost-effective to settle the dispute for a one-time payment of $575.00 to the former
employee rather than to dispute the claim. See Exhibit K: Caldwell Signed Settlement.
The second instance was a disagreement between Eric Powers/Susan Veley and the
County of San Luis Obispo. The County of San Luis Obispo claimed that Eric Powers and
Susan Veley no longer had the proper permit to cultivate cannabis under the San Luis
Obispo County cannabis Urgency Ordinance. This is because they claimed that Veley
failed to correct a code violation related to a secondary dwelling on the property. Eric
Powers was ultimately permitted to grow cannabis at Veleys property. Eric Powers was
dismissed from the lawsuit and Susan Veley settled to correct the code violations on
the secondary dwelling. Please see Exhibit L: Filed Request for Dismissal. Eric Powers
Megan Souza’s company Red Truck Management LLC currently cutivate cannabis there
today with approval from San Luis Obispo County and a state license for temporary
cannabis cultivation (See section 1-C: State Licenses).

Operation Details
Proposed Hours of Operation
MOM’s proposed hours of operation for retail sales are the hours of 10AM and 8PM. MOM will
limit deliveries of inventory to the storefront to normal operating hours.
MOM will be closed on some major holidays so employees may have the opportunity to be
with their friends and family.
Target Market
MOM has a successful history of targeting the 55 and over demographic, first-time users,
medical users, and women. Our wholesome branding and diverse selection of high CBD
products has attracted cannabis users who appreciate cannabis more for its medical benefits
than its psychoactive effects. This is the fastest growing segment of the market and is a major
focus of the retail operation. MOM will continue its mission of Making Cannabis Wholesome
in its San Luis Obispo storefront.
Employee Compensation and Benefits
MOM has always created jobs that have paid more than minimum wage. Historically, our
starting pay has been at least $15/hour for all positions.
MOM hereby commits to create an average pay rate for entry and mid-level positions of at least
40% more than the median local income for similar positions in other mainstream businesses.
MOM also commits to providing a base wage of employees that exceeds the minimum wage
by at least $4.00/hr ($15/hour). MOM will also allow a “labor peace agreement” at 20 or more
non-management employees.
MOM will also offer full-time employees benefits including health insurance and a 401k. To
help the city achieve its multi-model transportation goals, MOM will also offer employees a
Commuter Tax Benefit account.

Product Quality Standards & Packaging Requirements
Products sold by MOM will be properly labeled to ensure consumers are informed about what
they are purchasing and to prevent unintended use. MOM will ensure all products meet the
guidelines provided by the California Department of Public Health (See Exhibit I: Labeling
Requirements Manufactures Cannabis Products) and the requirements of Division 10 of the
Business and Professions Code (See Exhibit J: Chapter 12 Packaging and Labeling).
MOM has a reputation for sourcing the highest quality products in the industry. Please see
section 1-H: Products and Services for proposed products. MOM’s officers and managers
have gained experience with sourcing and purchasing wholesale cannabis products when they
operated as a Prop 215 delivery service. This experience will ensure that we will offer only the

MOM is committed to making sure adult-use cannabis is not diverted to minors. No person
under 21 years of age will be given access to the premises at 300 Higuera St, San Luis Obispo,
CA 93401, to ensure this all customers must present a valid form of government issued ID
as well all customers must sign up as a MOM Member. An account will be created for each
customer. There will be signage in the Entrance Vestibule that states that it is against the law
to provide adult use cannabis to persons under the age of 21. MOM will refuse sale and entry
to any customer that is known to have provided adult use cannabis to persons under the age
of 21, these persons will be designated in our cannabis compliance platform Proteus420.
MOM reserves the right to refuse sale to anyone suspected of supplying or intending to supply
adult-use cannabis to persons under the age of 21, these persons will be designated in our
cannabis compliance platform Proteus420.
MOM is committed to providing resources and knowledge to prevent unpleasant or

MOM has always offered “low-dose” or “micro-dose” cannabis products as an option. MOM will
continue to provide low or micro-dose options for its retail 300 Higuera St, San Luis Obispo, CA
93401. Products that we anticipate to carry in this category include Kiva Mints which offer only
2.5mg of THC per mint and high-CBD-low-THC flower strains such as “Remedy” or “Harlequin”,
as well as high-CBD-low-THC edibles. Please see section 1-H: Products and Services for a
complete list of our proposed products.
Cannabis use disorder (CUD), also known as cannabis addiction or marijuana addiction, is
defined in the fifth revision of the Diagnostic and Statistical Manual of Mental Disorders
DSM-5) and ICD-10 published by World Health Organization as the continued use of cannabis
despite clinically significant impairment, ranging from mild to severe. MOM will offer to first
time customers to help customers control their cannabis use through a voluntary tracking
program where customers can select weekly quotas for the maximum amount of MG of
THC and the maximum amount of cannabis flower. To achieve this, MOM will make a note
of the customer’s determined maximums on the customers account, a MOM employee will
then be able to review the previous seven days of receipts to determine if that customer has
reached their maximum. Please see Exhibit E: Public Messaging for our pamphlet on Cannabis
Use Disorder and Cautions including the risk of cannabis use for the development of the

adolescent brain.
MOM will ensure that all advertising, branding, and products will only target adult audiences
21+). Prior to any advertising or marketing from the licensee involving direct, individualized
communication or dialogue, MOM will use age affirmation to verify that the recipient is 21
years of age or older. All visual media will be clearly labelled as for 21 years of age and over. All
packaging of product will be compliant with state and local requirements and will be properly

using cartoons, images popularly used to advertise to children, imitating candy labeling, and

Instructions for E-Filing Form 940
Employer’s Annual Federal Unemployment (FUTA) Tax Return
File Form 940 annually to report your annual FUTA tax.
Important: Be sure you have made all your state unemployment tax payments before
you e-file the 940. Check the Pay Taxes screen and pay any necessary tax. Then return
to e-file the 940.
To file Form 940:
1. Review the account and employee information on the completed form.
If any account information has changed, such as your business name or address,
click the Setup link in the top navigation bar and make the change. Return to
e-file Form 940. Be sure you also submit Form 8822, Change of Address, to the
IRS. (Link to the form from the Help/Resources page or Help Index.)
2. On the main screen, click Send.
3. Click Archive to confirm that this is the version of the form that you have filed.
You can view this form later by clicking “View Archived Forms” on the Annual
Forms page.
If you want to file by paper this time:
1. Click Setup and then Electronic Services.
2. At the Payment & Filing page, under “Will you file forms electronically when
possible,” check No.
3. Click Continue.
4. Return to Taxes&Forms/Quarterly Forms to print your Form 940 and complete
your filing on paper.
Your E-Filing setup is not affected. Next time you want to file electronically, just return to

by the EDD. Don’t worry, you can send your payment to any of the EDD’s addresses

Products & Services
Under no circumstances will any person under 21 years of age be allowed on the premises of
MOM dispensary. Products will not be visible through windows or by any other means from
outside of the dispensary. All of MOM’s advertising will be targeted to adult audience over
21 years old.
MOM commits to providing Retail Medical Cannabis products to consumers. MOM began
as a Prop 215 Medical cannabis collective and MOM’s offerings have always geared toward
the needs of medical patients. MOM will continue providing products that serve the medical
needs of its customers by maintaining shelf space for products such as transdermal patches,
topical salves, sublingual sprays, capsules, and tinctures.
In addition to retail medical cannabis products, MOM will also provide retail adult-use
cannabis products to consumers. Many adult-use cannabis consumers are medical users who
choose not to get their medical cannabis license. Other adult-use consumers use cannabis as
part of a workout routine, sleep routine, or social activity. MOM will carry products for all of
these different consumer needs.
The fastest growing category of both medical or adult-use consumers is first-time users.
MOM will carry products designed for first-time users such as low-dose THC products,
CBD:THC combination products, and ingestibles such as edibles and sublinguals. MOM will
also provide education to first-time users on proper dosing, driving under the influence,
cannabis use disorder, keeping cannabis away from kids and pets, cannabis and pregnancy,
etc.
Products
High CBD
MOM’s brand was crafted to appeal to seniors and new cannabis users. Because of this,
we’ve always maintained and will continue to maintain a large offering of high-CBD products.
High-CBD products are more approachable to seniors and new cannabis users who want the
benefits of cannabis without the psychoactivity of THC. High-CBD products will remain an
integral part of MOM’s offerings.
Low-Dose THC
Low-dose THC products are the best choice for new cannabis users who have yet to establish
their THC tolerance level as well as those who want the benefits of THC without the negative
effects of too much psychoactivity. Low-dose THC products include edibles starting at 1 mg
THC per serving as well as tinctures, dissolving strips, and sprays that allow consumers to
adjust and control dosage according to their needs.

Flower
MOM is committed to sourcing local products and that starts with our in-house organic
flower cultivated on SLO County farms. MOM has submitted applications for 5-acres of
cannabis cultivation within the County. MOM also has relationships with dozens of other
local cultivators.
Concentrates
Concentrates are an important form of cannabis medicine and MOM will carry a wide
selection. Concentrates are a top choice for patients dealing with severe pain, seizures,
muscle spasms, panic attacks, and opiate withdrawal as well as for patients who have a high
tolerance for CBD or THC. MOM will provide instruction on safe-use of cannabis concentrates
as well as display educational signage warning about the extremely high potency of cannabis
concentrates.
Vape Products
Vaping may be a less harmful alternative to traditional ways of smoking cannabis and is
a popular mode of ingestion for new cannabis users. MOM will carry a wide selection of
vaporizer cartridges and accompanying batteries. MOM is committed to selling vaporizer
products without potentially harmful additives like PEG. MOM will provide educational
materials about vaping including safe and effective use as well as the need to limit use to
designated smoking areas only.
Edibles
A strong selection of ingestible inventory will be devoted to low-dose and micro-dose
edibles as these products most appeal to MOM’s clientele. No edibles resembling candy or
will be sold. Strict State regulations control types of edibles allowable, dosage, packaging,
labeling and more. Educational pamphlets about proper dosing for cannabis edibles will be
offered to new users.
Other Ingestibles
Cannabis ingestibles come in many forms and MOM will carry a wide array including:
tinctures, dissolving strips, oral sprays, capsules, cooking oils, etc. MOM will encourage non-
smoking modes of consumption such as these as they reduce consumers risk of diseases
associated with smoking.
Plants
MOM will sell clones and seeds of the cannabis plant. An informational sheet with local
regulations on personal cultivation will be included with every purchase of clones and seeds.
When purchased, all clones and seeds will be placed in opaque exit packaging as required
by State regulations.
Gear
MOM will carry accessories such as books about cannabis, branded merchandise like t-shirts
and stickers, and gear related to cannabis consumption such as vaporizer batteries, desktop
vaporizers, water pipes, etc..

Labeling and Packaging
MOM will abide by all State regulations with regard to labeling and packaging and will
ensure that all products sold in its dispensary conform to State regulations for labeling and
packaging. Please see Exhibit I: Labeling Requirements Manufactured Cannabis Products,
and Exhibit J: Chapter 12 Packaging and Labeling. In accordance with State regulation, all
retail products sold by MOM will leave the dispensary in opaque exit bag.
Quality Control
MOM has many operating procedures in place to ensure the highest quality of products

What is Legal for Adult Use?
It is legal for adults 21 or older to possess, consume and cultivate cannabis in California. Sale of cannabis from
licensed retail outlets will become legal January 1, 2018. If you are 18 or older, you can use cannabis if you have
a current qualifying physician’s recommendation or a valid county-issued medical marijuana identification
card. The new law, known as the Medicinal and Adult-Use Cannabis Regulation and Safety Act,1 includes
information about where you can use cannabis, how much you can possess, and the penalties for illegal use.
Here are a few things you should know.
Buying, Selling, and Giving
If you are 21 or older, you can buy and possess up to
one ounce (28.5 grams) of cannabis and up to eight
grams of concentrated cannabis (separated resin,
whether crude or purified, obtained
from cannabis).2
You can only buy cannabis at retail outlets
licensed by the California Bureau of
Cannabis Control.3
Although you can legally possess cannabis,
it is illegal for you to sell it without a license.4
You can give up to one ounce (28.5 grams)
of cannabis and up to eight grams of
concentrated cannabis to a person 21 or
older, but you cannot receive money or any
form of compensation.5
Where You Can Use
You can use cannabis on private property.
You cannot use, smoke, eat, or vape cannabis in
public places. Property owners and landlords can
ban the use and possession of cannabis on
their properties.6,7
You cannot use cannabis within 1,000 feet of a
school, day care center, or youth center while
children are present.8
Even though it is legal in California, you cannot use
or possess cannabis on federal lands like national
parks, even if the park is in California.9
Drivers and Passengers
If you are under the influence of cannabis while
operating a car, boat, or other vehicle, a law
enforcement officer can pull you over and conduct
a sobriety test.10

Information Initiative
Having an open container of cannabis in a vehicle
while driving or riding in the passenger seat is
against the law. If you have cannabis in a vehicle,
it must be in an approved sealed package or
container. Otherwise, it must be kept in the trunk
of the vehicle.11
Keep it in California. It is illegal to take your
cannabis across state lines, even if you are
traveling to another state where cannabis is legal.12
Growing and Processing
If you are 21 or older, you can plant, cultivate,
harvest, dry, and process up to six cannabis plants
in your private residence or on the grounds of
your residence.13
If you are growing cannabis, the plants must be in a
locked space that is not visible to the public. Cities
and counties may prohibit the outdoor cultivation
of cannabis.
It is against the law for you to use a volatile solvent
for the manufacture of concentrated cannabis for
your own personal use.14
Other Laws
Even though it is legal in California, employers
have the right to prohibit the use of cannabis by
their employees. Know your workplace
cannabis policies.15
Cities and counties may have stricter laws than the
state about cannabis use. Know your local
cannabis laws.16
There are several penalties for violating cannabis
law including fines, jail time, community service,
and drug education.

Water Efficiency Plan
MOM SLO will have minimal water usage limited to a single restroom and landscape
irrigation. Water usage for landscaping shall be derived from a small rainwater
capture system whenever possible, reducing demand on the city water supply.
All restroom fixtures shall be water conserving low-flow fixtures including the faucet and toilet.
The toilet will also be equipped with a “dual flush” to further conserve water. The faucet shall be
equipped with a timed motion sensor to reduce water usage. Fixtures will meet or exceed the
requirements in the California Green Building Standards Code.
Low-Flow Fixtures
All landscaping will consist of drought tolerant plants that require little to no watering. Any
required watering will be delivered through a drip irrigation system. The drip irrigation system
will be connected to a rainwater capture system as described below. MOM will maintain all
landscaping in good condition.
Drought Tolerant Landscaping
MOM will install a small (approximately 150 gallon) rainwater capture system to supply the drip
irrigation system. The rainwater capture system will collect water flowing from the building’s
gutters. MOM expects that with the drought tolerant landscaping the rainwater capture system
will be sufficient to supply a majority, if not all, of the water supply required for the drip irrigation
system.

MOM will monitor water usage on a consistent basis to identify any potential leaks or issues
that lead to higher than expected water consumption. Any irregularities will be identified and
rectified within 72 hours.

Relative to cannabis cultivation and cannabis manufacturing, cannabis retail
operations produce a minimal amount of odor. This is because the cannabis products
to be retailed arrive at the premises already sealed and packaged.
MOM shall ensure that no odor can be detected on the exterior or interior of the facility or any
neighboring properties. MOM will install an air filtration and treatment system that creates
negative pressure, ensuring that air does not escape the facility without first passing through
the filtration system. Additionally, the dual door entrance vestibule provides an additional layer
of protection.
No Detectable Odor
The air filtration system will be a dynamic
activated carbon matrix duct system that
is capable of removing odor, bacteria and
other potentially harmful substances. The air
filtration system creates negative pressure in
the building and also regulates the temperature
and humidity of the facility. A proposed model

is Dynamic V8 which has been proven to achieve indoor air quality that is 90% cleaner than
the outdoor air surrounding the facility, and has highly efficient odor removal capabilities. This
proposed system is highly energy efficient and has been used successfully in LEED certified

mechanical engineer during the building permit/land use phase of the project.
For cannabis flower samples, patients prefer
to be able to smell the product; to provide for
this while minimizing odor inside the facility
we will use Sensory Pod™ from Bud Bar
Displays. These pods offer a closable area of
small holes so that the cannabis product can
share its aroma. All Sensory Pods™ from Bud
Bar Displays will remain closed when not
actively being smelled.

and fixtures, and “back-lighting” for product displays. All lights will be connected to a
centrally controlled system that ensures consistent illumination during operating hours.

I. INTRODUCTION
This emergency plan in meant to be in compliance with OSHA 29 CFR 1910.120(q).
An emergency response plan shall be developed and implemented to handle anticipated emergencies prior to the
commencement of emergency response operations. The plan shall be in writing and available for inspection and
copying by employees, their representatives and OSHA personnel.”
This plan shall be reviewed and updated anytime there are any changes in the plan. If there are no changes, the
plan will be reviewed on an annual basis.
The core of the MOM’s Hazardous Materials Response Plan is prevention. MOM pledges to use the safest and least
harmful materials possible for its operations. MOM pledges to limit the amount of Hazardous Materials stored on
site. Because of these practices, and the small scale of business operations, a Hazardous Materials contamination
event is unlikely to occur on this site as a result of MOM operations.
II. PRE-EMERGENCY PLANNING & COORDINATION WITH OUTSIDE PARTIES
Cal Fire/San Luis Obispo County Fire Department will maintain a file of all reports concerning the presence of haz-
ardous materials at various locations within the Fire District. The San Luis Obispo County Emergency Operations
Plan contains listings of hazardous materials regulated under Sara Title III, and the designated facility coordinators
for those locations. This plan also contains emergency assistance telephone numbers for outside agencies.
III. PERSONNEL ROLES, LINES OF AUTHORITY, TRAINING AND COMMUNICATIONS
When a Hazardous Materials Incident has been identified, the appropriate Fire Service agency will be immediately
notified.
In the event that MOM personnel must temporarily take charge of an incident, Incident Command will be trans-
ferred to a Fire Service Officer, Environmental Officer, or other appropriate agency as soon as is practical.
Personnel will confine their activities to those described herein, and will not engage in activities outside of the
scope of their training.
The policy for MOM personnel when confronted with a hazardous materials incident is to:
Attempt to safely assess hazards that are present in the situation whenever possible, keeping in mind the personal
safety of department personnel, as well as the safety of others who may be present.
Immediately report the situation to the dispatcher and request that the local Fire Department and Police agency
be notified.
Implement traffic and crowd control procedures when necessary.
Carry out an evacuation of the immediate area if the situation is too critical to await emergency services person-
nel.
The Chief of the San Luis Obispo County Fire Department, or in their absence, the ranking Fire Officer, shall serve
as incident commander for hazardous materials emergencies provided they have Incident Command Training
or, unless relieved of command by the Local Chief Executive under a declared state of emergency. Control of the
incident scene will be passed to other agencies as appropriate when the immediate threat to life and property has
ceased, and the San Luis Obispo County Fire Department has returned to service.

Firefighters responding to a hazardous materials emergency will perform their routine emergency response
duties, and perform only those specialized hazardous materials response functions for which they have received
training as prescribed by OSHA regulations. See appendix – C for member training requirements.
Scene Management
The incident commander will be designated at the time of the incident and will implement the aspects of the inci-
dent command system listed below:
1. A command post shall be established.
2. The command post shall be located upwind at a safe distance from the incident. This distance shall be determined by
the nature of the incident, including type of hazardous material, quantity involved, and weather conditions.
3. All appropriate personnel shall be advised of the command location, and communications shall be maintained between
Incident Command and personnel.
4. A Safety Officer shall be appointed.
IV. EMERGENCY RECOGNITION AND PREVENTION
Incident Classification
Criteria for Level I: (Controlled Emergency Condition)
Incident that can be controlled by the primary first response agencies of a local jurisdiction, San Luis Obispo County Fire
Department.
Single jurisdiction and limited agency involvement.
Does not require evacuation, except for the structure or affected facility.
Confined geographic area.
No immediate threat to life, health, or property.
Involves material of known properties.
Criteria for Level II: (Limited Emergency Condition)
Potential threat to life, health, or property.
Expanded geographic scope.
Limited evacuation of nearby residents or facilities.
Involvement of two or three jurisdictions.
Limited participation or mutual aid from agencies that do not routinely respond to emergency incidents in the area.
Specialists or technical team called to the scene (i.e. DEC HazMat Spill Team.)
Combined emergency operations such as firefighting and evacuation, or containment and emergency medical care.
Level II trained firefighters may assist in the handling of such incidents. Determination of appropriate assistance shall
be made in concert with the incident commander and available fire personnel.

Serious hazard or severe threat to life, health, and property.
Large geographic impact.
Major community evacuation.
Multi-jurisdictional involvement.
State and Federal involvement.
Specialists and technical teams deployed.

Multiple emergency operations.
Level II trained firefighters may assist in the handling of such incidents. Determination of appropriate assistance shall
be made in concert with the incident commander and available fire personnel.
V. SAFE DISTANCES AND PLACES OF REFUGE
Safe distances will be determined by the On-Scene Incident Commander if the hazardous materials incident is a
transportation incident or at a fixed site facility other than those listed.
In the event that large numbers of individuals must be evacuated notification will be made to the American Red
Cross.
VI. SITE SECURITY AND CONTROL
The Incident Commander will assign a site security and control officer, until authorities can take control.
VII. EVACUATION ROUTES AND PROCEDURES
In the event that the evacuation of residents of the area surrounding the emergency scene is necessary, the evacu-
ation order will be issued by the Incident Commander.
Notification to the public as appropriate.
Evacuation routes shall be selected to avoid exposure to the hazardous material.
In the event that large numbers of individuals must be evacuated, notification will be made to the American Red
Cross and the additional guidelines set forth under the San Luis Obispo County Emergency Operations Plan.

VIII. DECONTAMINATION
Decontamination procedures at a hazardous materials incident shall be the responsibility of the incident com-
mander (officer in charge) or an individual so appointed. Decontamination shall be conducted for all personnel,
their personal protective equipment, apparatus and any equipment other than disposable items. The disposable
items will be handled through a third party certified in their respective field and general accepted public health
practices.
The decontamination stations and process should be confined. Steps for dry decontamination (not using water)

are outlined in Plan 1. Steps for wet decontamination are outlined in Plan 2. See Appendix – F for Decontamina-

IX. EMERGENCY MEDICAL TREATMENT AND FIRST-AID
A minimum of one ambulance shall be at the scene of a hazardous materials emergency. Available medical per-
sonnel shall include at least one EMT.
In the event that emergency response personnel require first aid to exposure to hazardous materials, such treat-
ment will follow standard medical protocols and information from Material Safety Data Sheets.
In the event that emergency personnel receive treatment at a hospital, information on the nature of the hazard-
ous material involved will be provided to hospital personnel.
X. EMERGENCY ALERTING AND RESPONSE PROCEDURES
First responders will follow basic chemical identification procedures as per training such as checking for:

Wind direction
Presence of fire, spilled liquids, or vapor leaks.
Verbal information
Shipping documents
Reference materials or agencies
XI. CRITIQUE OF RESPONSE AND FOLLOW-UP
A post incident critique will be held as soon as is practical to evaluate the response to the incident. This post

dations with regard to additional planning, training and/or equipment. No media representation will be allowed at
the critique.
XII. PPE AND EMERGENCY EQUIPMENT
Personal protective equipment shall meet at a minimum; the criteria contained in 29 CFR 1910.156(e) when worn
while performing fire fighting operations beyond the incipient stage for any incident.

Where can you legally smoke or consume cannabis? Short answer: Not in public.
To stay within the law, you’ll need to consume cannabis on private property. You cannot
consume, smoke, eat, or vape cannabis in public places (Health & Safety Code § 11362.3). Do
not use cannabis while in a vehicle.
In the city of San Luis Obispo, no person shall cause secondhand smoke to unreasonably
interfere with the reasonable use and enjoyment of another person’s private residence. Smoking
cannabis where tobacco is prohibited is also illegal. In general, it is best to only use cannabis in
the comfort of a private residence.
No consuming cannabis while driving or riding in a car!
Another California law that went into effect January 1st, 2018 which bans lighting up or snacking
on any cannabis products while driving or riding as a passenger in a car. That includes cannabis
edibles. The new law also regulates how and where consumers can store cannabis while in a
car, similar to the state's open alcohol container rules. "It has to be sealed in a container. The
seal cannot be broken. And if it is in an open container, it would have to be locked away in a
place like the trunk," (California Highway Patrol Sgt. Oscar Chavez).
Violations of that new law are considered infractions and punishable by a $70 fine.
Chavez says officers are trained to detect impaired drivers, whether the impairment is due to
alcohol or cannabis. He said the same guidance applies to all drivers — if it’s not safe to drive,
don’t get behind the wheel. The same DUI penalties also apply to both sets of drivers.
How long after ingesting cannabis am I allowed to drive? Short answer is: It depends…
You are free to hit the road once you are no longer impaired. It is illegal to drive under the
influence of any substance, cannabis included. Unlike the .08 blood alcohol content
measurement, there is no established threshold for THC (chemical compound in cannabis
responsible for a euphoric high) levels in California that would automatically result in a DUI or
not result in a DUI. There is NO “legal limit” for cannabis, any amount of cannabis impairment
may result in a DUI.

The California Office of Traffic Safety, or OTS, warns that even small doses of THC can slow a
driver’s reaction time and the ability to make decisions. According to OTS, cannabis effects are
strongest within the first hour of consumption and those who drive within that time period may
double their risk of collision. OTS says impairment may take over four hours to subside - but
that is just an estimate and should not be used as a blanket rule. In order to be certain that you
are no longer impaired before operating a vehicle, Megan’s Organic Market recommends
waiting 12 hours after consuming cannabis.
Can my landlord ban cannabis? Short answer is: Yes.
Property owners and landlords may ban the use and possession of cannabis on their properties,
according to the California Department of Health.
Can you get fired for having cannabis in your system? Short answer is: Yes.
It depends on your employer. There is no state law that protects employees from termination for
using cannabis. A 2008 Supreme Court decision ruled that employers are entitled to fire
employees who fail a drug screening for cannabis, regardless of state law. It’s up to individual
employers to continue to test for cannabis or decide to remove it from the common 5-drug panel
that also tests for cocaine, PCP, opiates and amphetamines. Prop 64 has specific language
empowering employers to tailor their drug policy according to their wishes. Employers that
contract with the federal government may see a prohibition of use as well, since those
employers will defer to federal law that still classifies cannabis as an illegal drug.
Can I take cannabis with me on a plane? Or when I travel? Short answer is: No.
It is not legal to transport cannabis of any amount by plane, even if it’s medicinal. That includes
trips within state borders and to other states that have legalized cannabis. The Transportation
Security Administration, or TSA, defers to federal law, which still classifies cannabis as a
Schedule I illegal drug. This one is pretty cut and dry - if you attempt to fly with cannabis, you
are breaking the law.
The state agency outlined two other restrictions:
You cannot consume or possess cannabis on federal lands such as national parks, even
if the park is in California.
It is illegal to take cannabis across state lines, even if you are traveling to another state
where cannabis is legal.
Do I need a California Doctor’s Recommendation to buy cannabis from Megan’s Organic
Market at 280 Higuera St, San Luis Obispo, CA 93401?
No. The City of San Luis Obispo allows for sales of cannabis to anyone over the age of
21.
Do I need a California ID and a California doctor’s recommendation for medical cannabis
to purchase medical cannabis? Short answer is: CA ID no, Dr’s Rec yes.
You’ll need a valid government-issued ID, but it can be from any state, according to a
spokesman for the California Bureau of Cannabis Control. Options include a driver’s license, a
military ID with a person’s picture and date of birth, or a passport issued either by the U.S. or by
other countries.
However, you will need a verifiable and current doctor’s recommendation for medical cannabis
from a doctor in California in order to purchase medical cannabis.

Do I have to get a Medical Marijuana State ID Card? Short answer is: No, but there are
benefits.
Patients are not required to get a Medical Marijuana ID card, but a state card can provide an
extra measure of protection against arrest. Patients and caregivers can obtain state ID cards
through the health departments of the county where they live. The state ID card system has
safeguards to protect patient privacy. Police and employers cannot track down patients through
the registry.
Patients with a state ID card are exempt from sales tax in dispensaries under the new state law
AUMA). They are still subject to other taxes under AUMA.
Do I need to be a U.S. citizen? Short answer is: No, but there are risks.
If you are not a U.S. citizen, think about whether you should carry your medical cannabis
recommendation with you. Reports are that ICE is asking if people have their cards and/or use
medical cannabis, and using that as grounds for deportation or grounds that they are in violation
of the Federal Controlled Substances Act. This means permanent residents, visa holders, and
those who are not naturalized nor are natural born citizens should be wary.
Can the federal government charge cannabis customers with a crime? Short answer is:
Yes.
Cannabis remains illegal under federal law. The Trump administration has taken a more
aggressive stance on enforcement. And cannabis dispensaries do collect customer information
that could potentially be seized by federal agents and prosecutors. The likelihood of that
happening, however, is very, very small, according to reputable cannabis policy experts. The
assumption is, federal authorities would focus on large suppliers, not individual consumers who
make small purchases.
Can I own or buy a gun if I use medical cannabis? Short answer is: No.
The Federal Bureau of Alcohol Tobacco and Firearms sent warning letters to gun dealers in
2011 warning them they could not sell to known medical cannabis users. When buying a gun,
you may be asked whether you are a user of illegal drugs and/or medical cannabis.
Answering yes makes you ineligible to purchase; falsely answering no is in principle punishable
as perjury.
Can I sell cannabis? Short answer is: No.
Any person or entity engaging in cannabis sales must obtain a license from the Bureau of
Cannabis Control.
How much cannabis can I possess or purchase? Short answer is: Either 1 ounce of
flower for adults or as much as is allowed by your doctor.
The amount of cannabis a patient can possess is determined by the patient’s physician. The
state regulations limit a patient’s possession to eight ounces of dried cannabis flower and 6
mature plants or 12 immature plants unless a valid physician’s recommendation contains a
different amount than the limits listed. This is because the average patient does not consume
more than eight ounces of dried cannabis flower in a year. If your medical needs require you to
possess more than the limit currently listed on your doctor’s recommendation for medical
cannabis, you must contact your physician to adjust your limits. Under no circumstance will

and the patient’s physician.
Can I cultivate my own cannabis? Short answer is: Maybe.
Municipal and local laws governing personal cultivation vary significantly. If you live in the
unincorporated areas of San Luis Obispo County, you can grow up to six plants (within a 100
square-feet area) inside a personal residence without a land use permit.
The ordinance for personal cultivation in the City of San Luis Obispo is as follows:

Personal Cultivation Limited
A. Maximum Six Plants Outdoors Per Parcel. It shall be unlawful for any person to
plant,cultivate, harvest, dry, process, maintain, possess or store outdoors, more than six (6) live
cannabis plants on any parcel containing one or more private residences. This limitation on
outdoor personal cannabis activities applies per parcel, regardless of the number of residents in
each private residence, and regardless of the number of residences on the parcel. This
limitation applies to cannabis live plants for either adult recreational use or medicinal purposes.
Outdoor personal cultivation shall comply with applicable provisions of chapter 17.99 of this
Code.
Maximum Six Plants Per Private Residence, Indoors and Outdoors/ It shall be unlawful
for the cumulative total of cannabis plants per private residence, indoors and outdoors,
to exceed six (6) cannabis live plants, regardless of number of persons residing in the
private residence. This limitation applies to cannabis live plants for either adult
recreational use or medicinal purposes. Any live cannabis plants grown indoors shall
comply with applicable provisions of Chapter 17.99 of this Code.
No Outdoor Cultivation on Parcel without Private Residence. It shall be unlawful for any
person to plant, cultivate, harvest, dry, process, maintain, possess or store any cannabis
live plants outdoors on a parcel that does not have a private residence used for
residential dwelling purposes by the person cultivating the cannabis live plants.
Neighborhood Impacts of Personal Cultivation. There shall be no exterior evidence of
cannabis cultivation occurring at the property visible by normal unaided vision from a
public place or the public right-of-way and any outdoor cultivation shall comply with
provisions of Chapter 17.99.040 of this code. Personal cultivation of cannabis, for
recreational adult use or for medicinal purposes, shall not create odors, dust, heat,
noise,light, glare smoke or other impacts to people of normal sensitivity living, working or
lawfully present in the vicinity of the personal cultivation site. Impacts that cross the
nearest property line of any other parcel, beyond that parcel on which the personal
cultivation is conducted, or that are visible or noticeable with normal unaided vision, from
a public place or the public right of way, or from any separately owned, leased or
controlled private residence or business on the same parcel as the private residence
responsible for the personal cultivation, are unlawful.
No Hazardous Personal Cultivation. Personal cultivation, harvesting, drying, or
processing of cannabis, for recreational adult use or medicinal purposes, that uses or
stores hazardous or toxic chemicals or materials, creates hazardous or toxic products or
wastes, or uses volatile processes or other methods or substances that pose a
significant risk to public health or safety, is prohibited and unlawful.
