PRESENTATION - MAYOR'S AWARD FOR COMMUNITY SERVICE - LAGUNA MIDDLE SCHOOL STUDENTS (HARMON – 5 MINUTES) 2. PRESENTATION - BIKE TO SCHOOL DAY (MAY 8TH) / BIKE TO WORK DAY (MAY 17TH) – SLOCOG/RIDESHARE (SLOCOG REPRESENTATIVE WILLIAMSON – 5 MINUTES) PUBLIC COMMENT PERIOD FOR ITEMS NOT ON THE AGENDA (not to exceed 15 minutes total) The Council welcomes your input. You may address the Council by completing a speaker slip and giving it to the City Clerk prior to the meeting. At this time, you may address the Council on items that are not on the agenda. Time limit is three minutes. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Code sec. 54954.2). Staff may be asked to follow up on such items. A member of the public may request the Council to pull an item for discussion. Pulled items shall be heard at the close of the Consent Agenda unless a majority of the Council chooses another time. The public may comment on any and all items on the Consent Agenda within the three-minute time limit. 3. WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES (PURRINGTON) Recommendation: Waive reading of all resolutions and ordinances as appropriate. 4. REVIEW MINUTES FROM THE APRIL 16, 2019 CITY COUNCIL MEETING (PURRINGTON) Approve the minutes from the City Council meeting held on April 16, 2019. 5. 2019 SEWER SYSTEM MANAGEMENT PLAN UPDATE, ADOPTION, AND RECERTIFICATION (FLOYD / HIX / GEARHART) Recommendation: Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, adopting the 2019 Sewer System Management Plan Update,” and authorize the City Utilities Director, or designee, to recertify the 2019 Sanitary Sewer Management Plan with the State Water Resources Control Board. 6. CONTRACT AWARD FOR ANHOLM NEIGHBORHOOD GREENWAY PHASE 1A FOOTHILL CROSSING (GRIGSBY / SCHWARTZ) Recommendation: Award a contract to Lee Wilson Electric Company, Inc. in the amount of $296,549.75 for the Anholm Neighborhood Greenway Phase 1A—Foothill Crossing Project, and approve the reallocation of funds from the Bicycle Transportation Plan Implementation account, the Concrete Streets & Accessibility Improvements 2016 account, and the Traffic Safety and Operations account in order to fully fund the project costs. 7. ON-LINE ELECTRONIC TRANSACTION FEE (CODRON / HAGEN) Recommendation: Approve an electronic transaction fee of $0.10 per transaction on fees associated with online Community Development Department Payments. CONTRACT FOR STREETS AND SIDEWALK MAINTENANCE 2019 (GRIGSBY / NEMETH) Recommendation: Approve the Special Provisions for Job Order Contract for Streets and Sidewalk Maintenance 2019, Specification No. 1000043, authorize staff to advertise for bids, and authorize the City Manager to award the contract to the lowest responsible bidder. 9. APPROVAL OF CONTRACT AMENDMENTS FOR PHASE 4 AND 5 OF THE WATER RESOURCE RECOVERY FACILITY PROJECT (FLOYD / HIX) Recommendation: 1. Approve a contract amendment with CH2M Hill Engineers (Jacobs), for engineering services during construction of the Water Resource Recovery Facility Project, for an amount not to exceed $5,142,138; and 2. Approve a contract amendment with Water Systems Consulting Inc. for program management and labor compliance of Phase 4 and 5 of the Water Resource Recovery Facility Project for an amount not to exceed $2,620,938. 10. AUTHORIZE DESIGNATED STAFF TO WAIVE ADMINISTRATIVE FINES RESULTING FROM CODE ENFORCEMENT ACTION (CODRON / COCINA) Recommendation: Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, establishing a tiered system authorizing staff to waive administrative fines resulting from code enforcement action.” 11. HOUSING AUTHORITY REQUEST TO EXECUTE A LEASE RIDER AGREEMENT FOR CITY-OWNED PROPERTY AT 1090 AND 1092 ORCUTT ROAD, AND 1105 LAUREL LANE (CODRON / VERESCHAGIN) Recommendation: Authorize the City Manager to execute a Lease Rider Agreement as required by the California Tax Credit Allocation Committee for City-owned property on Orcutt Road and Laurel Lane, titled Laurel Creek Apartments, with SLO 55, L.P. of the Housing Authority of the City of San Luis Obispo. AUTHORIZE APPLICATION FOR SB 2 PLANNING GRANTS PROGRAM FUNDS (CODRON / FOWLER / VERESCHAGIN) Recommendation: Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, authorizing application for, and receipt of, SB 2 Planning Grants Program Funds.” PUBLIC HEARING AND BUSINESS ITEMS 13. POLICE DEPARTMENT 2017/2018 COMPARISON AND UPDATE (CANTRELL / SMITH – 60 MINUTES) Receive and file the 2018 Police Department crime report. 14. ADOPT AN ORDINANCE AMENDING THE CONTRACT BETWEEN THE CITY AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEE’S RETIREMENT SYSTEM (IRONS / ROLTGEN – 10 MINUTES) Recommendation: Adopt an Ordinance entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, authorizing an amendment to the contract between the City Council of the City of San Luis Obispo, California and the Board of Administration of the California Public Employees’ Retirement System.” San Luis Obispo City Council Agenda May 7, 2019 Page 5 15. PUBLIC HEARING – INTRODUCE AN ORDINANCE TO AMEND THE LAND USE DESIGNATION OF THE NORTH-WEST CORNER OF TANK FARM AND BROAD (3985 BROAD ST, 660 TANK FARM RD) (CODRON / LEVEILLE – 45 MINUTES) Recommendation: 1. Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, approving the General Plan Amendment, Airport Area Specific Plan Amendment, Vesting Tentative Tract Map 3115, Creek Setback Exception, and architectural design review to allow the phased development of an assisted living facility and commercial development including a mitigated negative declaration of environmental review as represented in the City Council agenda report and attachments dated May 7, 2019 (660 Tank Farm Road, 3985 Broad Street; EID-1484-2018, SPEC- 1482-2018, SBVD-1483-2018, ARCH-1486-2018);” and, 2. Introduce an Ordinance entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, rezoning property at 660 Tank Farm Road from Business Park (BP-SP) to Community Commercial with Special Focus Overlay (CC-SP-SF) and amending the Airport Area Specific Plan zoning for 660 Tank Farm Road and 3985 Broad Street to Community Commercial with Special Focus area (C-C-SP-SF) and making associated amendments to the Airport Area Specific Plan To be consistent with the proposed northwest corner assisted living and commercial-retail project, and with the General Plan as amended.” LIAISON REPORTS AND COMMUNICATIONS (Not to exceed 15 minutes) Council Members report on conferences or other City activities. At this time, any Council Member or the City Manager may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council Policies and Procedures, they may provide a reference to staff or other resources for factual information, request staff to report back to the Council at a subsequent meeting concerning any matter, or take action to direct staff to place a matter of business on a future agenda.
