Adopt a resolution entitled “A Resolution of the City of San Luis Obispo Adopting the 2019 Sewer System Management Plan Update” (Attachment A) approving the 2019 Sanitary Sewer Management Plan; and 2. Authorize the City’s Director of Utilities, or designee, to recertify the 2019 Sanitary Sewer Management Plan with the State Water Resources Control Board. DISCUSSION The State Water Resources Control Board (SWRCB) adopted statewide General Waste Discharge Requirements (GWDR) for publicly owned sanitary sewer systems in 2006. The GWDR required the development and implementation of a system-specific local “Sewer System Management Plan” (SSMP) that articulates a comprehensive program for sewer system operation, maintenance, repair and reporting of all Sanitary Sewer Overflows (SSOs) in the statewide spill reporting database. The City is required to comply with these requirements. The SSMP is an effective tool for the on-going management of the City’s wastewater collection system and preventing SSOs. The City Council adopted the City’s original SSMP on May 5, 2009 (Resolution No. 10077) and the State Required five-year update on May 20, 2014 (Resolution No. 10522). The SSMP undergoes an internal audit at a minimum of every two years and requires approval by Council every five years, or when an audit identifies a major change is needed. The 2019 SSMP (Attachment B) was completed by City staff and now requires Council approval. The following revisions are proposed as part of the 2019 SSMP: Packet Pg. 13 Item 5 Section Revision Page # Introduction Table 1, Collection System Components, includes new pipe installations; Table 2, Lift Station Summary, reflects recent CIP upgrades since the 2014 SSMP adoption. 2 and 5 I. Goals No changes. 6 II. Organization Updated designation of legally responsible official (LRO). Table 3, SSMP Implementation Responsibilities, and Figure 3, Organizational Chart, reflects staffing changes in the Utilities and Public Works Departments. 7-10 III. Legal Authority Updated Table 4, Legal Authority from San Luis Obispo Municipal Code and General Plan, to reflect changes that occurred as part of the 2018 update of the General Plan, Water and Wastewater Management Element. 12 IV. Operation & Maintenance All tables were updated to include most recent data available. 14-26 V. Design & Performance Provisions Updated references to the City’s Standard Specifications & Engineering Standards. 27 VI. Overflow Emergency Response Plan Table 14, Annual Stoppages and Sanitary Sewer Overflows, 1999 to 2018, updated to reflect annual Sanitary Sewer Overflows for 2014-2018 and confirmed regulatory agency contacts in Table 15. 30-34 VII. Fats, Oils, & Grease Control Program No changes. 36 VIII. System Evaluation & Capacity Assurance Plan Table 16, Sewer Line Installations 1999-2018, reflects new sewer lines added to new development and sewer lines replaced with CIP. 39-40 IX. Monitoring, Measurement & Program Modifications Updated Table 18, Historic Data on Sanitary Sewer Overflows 2008-2018, to include 2014 through 2018 data on SSO causes and spill volumes per the California Integrated Water Quality System reporting database. 42 X. Program Audits No changes. 44 XI. Communication Program Link to online version of the SSMP was updated. 48 Appendix A. Sample CCTV Report No changes. 50 Appendix B. Wastewater Collection, Capital Improvement Plan Appendix F was updated to include Wastewater Collection projects FY 2017-19 to FY 2022-23. 60 Packet Pg. 14 Item 5 With the support of the City Council, activities and program elements identified in the SSMP ensure the City’s ongoing compliance with State regulations. The next SSMP update is anticipated in 2024. Policy Context The City updates the SSMP to maintain its applicability, consistent with General Plan, Water and Wastewater Management Element, Program B 4.3.4 and other General Plan policies related to the provision of wastewater service as well as to remain compliant with the SWRCB adopted GWDR for publicly owned sanitary sewer systems. Public Outreach The City maintains a copy of the SSMP on the City’s Utilities Department webpages. Outreach and education are also performed through various City programs including the Environmental Compliance (Pretreatment) Program, Capital Improvement Program, and Private Sewer Lateral Program. CONCURRENCES Community Development concurs with the environmental review findings, below. ENVIRONMENTAL REVIEW Adoption of the proposed Resolution is not a "project" under the California Environmental Quality Act (CEQA), because the action does not involve any commitment to a specific project which may result in a potentially significant physical impact on the environment, as contemplated by Title 14, California Code of Regulations, Section 15378. FISCAL IMPACT Budgeted: Yes Budget Year: FY 18-19 Funding Identified: Yes Fiscal Analysis: There is no fiscal impact related to the adoption of the 2019 SSMP. Ongoing costs for the management, operation, and maintenance of the City’s wastewater collection system are identified in the Financial Plan and paid for through sewer rates. During 2018-19, approximately $1.4 million was identified in the City’s Sewer Fund to support the operation of the wastewater collection system and environmental compliance efforts. Capital expenditures toward replacement of aged sewer infrastructure total an additional approximately $1.5 million annually. Packet Pg. 15 Item 5 ALTERNATIVE The City Council could elect not to approve the SSMP at this time and provide direction to staff to make modifications to the SSMP. Staff does not recommend this alternative, as the draft SSMP meets the GWDR requirements and the City must adopt an SSMP every five years to remain in compliance with the GWDR adopted by the SWRCB. Attachments: a - Resolution Adopting the 2019 Sewer System Management Plan Update b - COUNCIL READING FILE- 2019 Draft SSMP Update Packet Pg. 16 Item 5 R ______ RESOLUTION NO. _____ (2019 Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO, CALIFORNIA, ADOPTING THE 2019 SEWER SYSTEM MANAGEMENT PLAN UPDATE WHEREAS, the State Water Resources Control Board adopted Statewide General Waste Discharge Requirements (GWDR) for publicly owned sanitary sewer systems requiring the development and implementation of a system-specific local Sewer System Management Plan (SSMP) that documents a comprehensive program for sewer system operation, maintenanc e and repair; and WHEREAS; the City Council approved the City’s first SSMP at a public meeting on May 5, 2009 (Resolution No. 10077); and WHEREAS; the City Council approved an update to the SSMP at a public meeting on May 20, 2014 (Resolution No. 10522); and WHEREAS; the SSMP shall be updated every five years, must include any significant changes and be approved by the City Council; and WHEREAS; the City has therefore prepared an updated SSMP for public review and a properly noticed public meeting regarding the SSMP update was held by the City Council on May 7, 2019; and WHEREAS, the City of San Luis Obispo did prepare and shall file a recertification after the adoption of the SSMP update with the State Water Resources Control Board. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. The 2019 Sewer System Management Plan for the City of San Luis Obispo consisting of updated text with tables and figures, presented to the Council on May 7, 2019, on file in the City Clerk’s Office, is hereby adopted.
