Abe Lincoln - Human Relations Commission; to complete an unexpired term through March 31, 2021; 2. Kari Applegate - Parks and Recreations Commission; to complete an unexpired term through March 31, 2023, and 3. Kristin Battaglia - Tourism Business Improvement District Board; to complete an unexpired term through March 31, 2023. You may address the Council by completing a speaker slip and giving it to the City Clerk prior to the meeting. At this time, you may address the Council on items that are not on the agenda. Time limit is three minutes. State law does not allow the Council to discuss or take action on issues not on the agenda, except that members of the Council or staff may briefly respond to statements made or questions posed by persons exercising their public testimony rights (Gov. Code sec. 54954.2). Staff may be asked to follow up on such items. CONSENT AGENDA Matters appearing on the Consent Calendar are expected to be non-controversial and will be acted upon at one time. A member of the public may request the Council to pull an item for discussion. Pulled items shall be heard at the close of the Consent Agenda unless a majority of the Council chooses another time. The public may comment on any and all items on the Consent Agenda within the three-minute time limit. 6. WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES (PURRINGTON) Recommendation: Waive reading of all resolutions and ordinances as appropriate. 7. MINUTES OF MAY 7, 2019 (PURRINGTON) Recommendation: Approve the Minutes of the City Council meeting of May 7, 2019. 8. ALLOW FOR ALTERNATE FORMS OF IDENTIFICATION OR A DEPOSIT TO BE USED FOR ESTABLISHMENT OF UTILITY ACCOUNTS (FLOYD / BOERMAN) Recommendation: Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, rescinding and replacing Resolution No. 10904 (2018 series) to establish a reconnection fee and refundable deposit requirements.” San Luis Obispo City Council Agenda May 21, 2019 Page 4 9. MICROSOFT OFFICE 365 RENEWAL (HERMANN / GUARDADO) Recommendation: Approve contract renewals, authorize waiver of formal bids through a cooperative agreement, and authorize the City Manager to approve related Purchase Order requisitions for Microsoft Office 365 Government Plan subscription licenses through the 2019-21 Financial Plan. 10. 2018/19 SENATE BILL 1 (SB1) STATE OF GOOD REPAIR TRANSIT GRANT APPLICATION (GRIGSBY / ANGUIANO) Recommendation: Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, authorizing the execution of the certifications and assurances for the California State of Good Repair Program” and authorize the City Manager to enter into a Sole Source Agreement with Genfare for new fareboxes. 11. WATER ENERGY EFFICIENCY PROJECT – CALIFORNIA INFRASTRUCTURE AND ECONOMIC DEVELOPMENT BANK (IBANK) FUNDING RESOLUTION (FLOYD / METZ) Recommendation: Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, authorizing the submission of the application to the California Infrastructure and Economic Development Bank (IBank) for financing the Water Energy Efficiency Project, authorizing the incurring of an obligation payable to IBank for the financing of the Water Energy Efficiency Project if IBank approves said application, Declaration of Official Intent to reimburse certain expenditures from proceeds of obligation, and approving certain other matters in connection therewith,” and authorize the Director of Utilities to execute the financial assistance application for the Water Energy Efficiency Project. 12. REVIEW OF A MILLS ACT HISTORICAL PROPERTY CONTR ACT FOR THE MONDAY CLUB – 1815 MONTEREY STREET (CODRON / OETZELL) Recommendation: Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, approving a Historic Property Preservation Agreement between the City and the owner of The Monday Club at 1815 Monterey Street (Application No. HIST 2034- 2019).” San Luis Obispo City Council Agenda May 21, 2019 Page 5 13. ADVERTISE THE FOOTHILL PIPE BURST PROJECT, SPECIFICATION NO. 91640 (GRIGSBY / RODRIGUEZ) Recommendation: 1. Approve the project plans and specifications for the Foothill Pipe Burst Project, Specification Number 91640; and 2. Authorize staff to advertise the Project for bids; and 3. Authorize the City Manager to award the construction contract if the lowest responsible bid is within the Engineer’s Estimate of $220,000; and 4. Approve the transfer of $150,000 from the I/I Reduction Funds (91739) account to the project account. 14. CLIMATE ACTION PLAN CONTRACT AMENDMENT (HILL / READ) Recommendation: Approve a contract amendment with Raimi + Associates in the amount of $55,000 for a total contract amount of $149,993. PUBLIC HEARING AND BUSINESS ITEMS 15. PUBLIC HEARING –AMEND THE LAND USE DESIGNATION OF THE NORTH- WEST CORNER OF TANK FARM AND BROAD (3985 BROAD ST, 660 TANK FARM RD) – NOTICED AS A CONTINUED ITEM FROM THE MAY 7, 2019 CITY COUNCIL MEETING (CODRON / LEVEILLE) This item has been continued to a date uncertain. MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SAN LUIS OBISPO, THE COUNTY OF SAN LUIS OBISPO, AND 1144 HIGUERA INVESTMENTS LLC FOR A POTENTIAL PUBLIC-PRIVATE PARKING STRUCTURE IN THE UPPER DOWNTOWN (GRIGSBY / BOCHUM – 45 MINUTES) Recommendation: 1. Authorize the City Manager to execute a Memorandum of Understanding between the City of San Luis Obispo, County of San Luis Obispo, and 1144 Higuera Investments, LLC; and 2. Approve a new capital project “Higuera Parking Structure” and direct the Public Works Department to engage in design-build project delivery (Phase 1) with the County and allocate $90,000 in matching funds to the County for Phase I activities; and 3. Authorize the City Manager, or his designee, to negotiate final terms for a Ground Option Lease and Final Lease Option for the project and return to Council with final recommendations for consideration; and 4. Authorize the Public Works Director to exercise, if necessary, any termination clauses in the MOU. LIAISON REPORTS AND COMMUNICATIONS (Not to exceed 15 minutes) Council Members report on conferences or other City activities. At this time, any Council Member or the City Manager may ask a question for clarification, make an announcement, or report briefly on his or her activities. In addition, subject to Council Policies and Procedures, they may provide a reference to staff or other resources for factual information, request staff to report back to the Council at a subsequent meeting concerning any matter, or take action to direct staff to place a matter of business on a future agenda.
