Subject: Tree Committee 5/20/2019 item 6 Brown Act Violation PLEASE POST
If the Committee proceeds to take any action on the “Old Business: Tree Ordinance“ item 6 you may be in violation of
the Brown Act.
This item appeared on February 25, 2019 where the agenda packet included draft revisions. The minutes of that meeting
indicate “Matt Horn , City representative, made a presentation and responded to Committee inquiries and discussion.”
Public comment at the March 25, 2019 TC meeting questioned the lack of information provided in those minutes, to
which staff responded that the intent was for reliance upon the audio recordings as to additional information. There is
no inclusion of the audio recording of the February 25th TC meeting in the City Clerk Public Access. There was also
inquiry as to the provision of amendments or revisions to the draft ordinance in light of the TC 2/25 meeting which the
TC on 3/25 indicated had not been received.
The Tree Ordinance is included on the current agenda and no materials are included in the agenda packet. The absence
of the audio recording of the 2/25/19 meeting, and lack of information in the minutes from that meeting renders the
public unable to ascertain the intent of the TC in agendizing this matter. Perhaps it is set for the TC to make a demand
for receipt of the revised draft ordinance and continue to a date once received so that open government and public
participation may be effectively accomplished.
