NO. 91563 RECOMMENDATION 1. Award a contract (Attachment A – Draft Agreement) to Wright Construction Engineering Corp. in the amount of $138,790 for Pickleball Courts (Specification No. 91563); and 2. Approve a transfer of $36,436.48 from the Parkland Fund Undesignated Capital Account to this project (Specification no. 91563); and 3. Approve a transfer of $10,353.52 from the Capital Outlay Fund Undesignated Capital Account to this project (Specification no. 91563). DISCUSSION Background The Pickleball Courts project originally began advertising for bid at the end of February 2019 with a bid opening date of March 28, 2019. No bids were received during the first bidding period. The project was re-advertised, and staff did additional outreach to local contractors to notify them that the project was advertising again. Bids were opened on May 2, 2019. Two bids were received, and both were over the Engineer’s estimate of $98,000. The lowest bidder is Wright Construction Engineering Corp. with a bid price of $138,790. This increase in cost may be attributed to the overall increase in construction activity and high demand for contractor work. See Attachment B for the Bid Results Summary. Engineer’s Estimate Wright Construction Newton Construction $98,000 $138,790 $150,900 The Contractor’s references, license and registration with the Department of Industrial Relations have been verified. Staff therefore recommends awarding a construction contract to Wright Construction Engineering Corp. Packet Pg 185 Item 8 Previous Council or Advisory Body Action This project was identified in the 2017-19 Financial Plans that were approved by Council. Council authorized advertisement of this project on February 5, 2019 and provided $60,000 of additional funding from the Parkland Development Fund. Policy Context Per the recommendation of the previous approved Council Agenda Report (Attachment C – Council Agenda Report to Advertise) to authorize additional allocation from the Parkland Development Fund, the Council must approve award of the project if the lowest responsible bidder is over the engineer’s estimate. Public Engagement Public Engagement for this project was done during the initial identification as part of the 2015- 17 Financial Plan. Additionally, Public Works and Parks and Recreation staff worked with the local pickleball advocates throughout design to provide the best possible use of the existing space. All feedback was reviewed and taken into consideration in the final design which balances the constraints of the space, codes, and varied inputs by the users. Staff have presented a complete design which has balanced practically, public input and cost. There are differences of opinion on how the court could be laid out and this represents the most practical and achievable design for all users. CONCURRENCE There is concurrence from the Community Development Department and Parks and Recreation Department through the review of the project plans and special provisions. ENVIRONMENTAL REVIEW The project is categorically exempt from environmental review under Section 15301 Class 1 (Existing Facilities) of the California Environmental Quality Act (CEQA) Guidelines because the project proposes minor changes to existing park facilities. The project is consistent with the applicable general plan policies as well as with applicable City Regulations. A Notice of Exemption has been filed through the Community Development Department. Council originally approved a project budget of $60,000 from the Parkland Development Fund. The project was estimated at $98,000 for construction, so staff requested an additional $60,000 from the Parkland Development Fund to supplement the estimate cost for construction. This request was approved by Council on February 5, 2019 (Attachment C). The table below shows a summary of total project cost and current funding appropriation for the Pickleball Courts project. Staff has identified Undesignated Capital accounts that may be utilized to supplement project funding and award the contract with enough contingency to complete the work. These include the Parkland Development Fund Undesignated Capital Account (501.9501.71501), which has a current has a balance of $36,436.48, and the Capital Outlay Fund Undesignated Capital Account (401.9501.71501), which has a current balance of $94,946. Staff is recommending City Council approve a budget transfer of the available funding in order to complete the project. Current and proposed funding is identified in the following table. ALTERNATIVES The City Council could choose to deny approval to award. This is not recommended since the Pickleball Courts project was identified in the 2017-19 Financial Plan as being responsive to emerging recreational needs.
