I object on the following grounds: City Code 16.20.110 specifies eligibility for developer reimbursement and it states two criteria that must be met for a reimbursement to be possible. 1. Condition #1 —Adjacent to the development. 4080 Horizon Lane is NOT �c�"�s�� to the development— It is only near. 2. Condition #2 — Improvements are of greater size or capacity than that required for the development of the property. At the 5/28/19 meeting at RRM, Jake Hudson made it clear that all improvements to the roadway are required to support the traffic levels of Avila Ranch alone. Therefore, they are not of greater size and capacity than already required. Putting in sidewalks, curbs, and gutters may satisfy a City desire, but in no way are they necessary for Avila Ranch access of roadway capacity. They should be left for when each property improves and as they are not necessary, either the developer or City must pay if they are to be done now. If they are done later when each property develops, then there is no issue of who bears the appropriate cost for Avila Ranch to have the roadway capacity. Horizon Lane is required to have the other half of the road put in. This may someday benefit John Wallace as his side of Horizon Lane has not been built, but 4080 Horizon Lane is behind the finish part (minus curbs and gutters) of Horizon Lane and, therefore, is no more eligible to be included in this special T.I.F. than the other properties on our side of Horizon Lane. In conclusion: 1) We are not adjacent to and we do not benefit from any extra roadway capacity being put in by Avila Ranch development. 2) Increasing the traffic on Horizon Lane 100 fold is a serious cost/disadvantage that the City Planning staff has curiously forgotten to quantify or include in their analysis. Additional traffic is a big negative —Where is it in the staff analysis? Bearing the cost of additional traffic is bad enough without being required to pay for it! 3) The improvements to Suburban Road do not increase roadway capacity and are not of greater size than already exists. The City's desire to have these improvements put in ahead of the appropriate time is noted, but a desire for unnecessary roadway edge improvements does not meet the requirements of City Code 16.20.110 in any way as they have no effect on the traffic, only on roadside niceties. The proposed premature improvements on Suburban Road are neither of greater size nor do they increase roadway capacity, so they do not fall under City Code 16.20.110. 4) None of the proposPd Avila Ranch improvements DIRECTLY benefit 4080 Horizon Lane in any manner. Overall, they represent a detriment and a cost, not a benefit.
