Thank you for the email. I’ll ask that our City Clerk have this included in the Council Correspondence for the 6/18 meeting. In the staff report we are
compiling a summary of the comments we have received thru the public outreach with any accommodations we have been able to make or an
explanation of why we cant. The staff report should be published early next week.

Subject: Avila Ranch Mitigation Fees
Jake Hudson,
The Roland S. Ball Trust expended $886,640 for construction of the paved 2013 portion of Earthwood Lane and 3/4ths of Suburban Road adjacent to the Ball
Trust properties.
The planned industrial commercial development of the Tract 2943 became economically unfeasible after the annexation and rezoning from industrial to
residential of the land South of Earthwood Lane Tract 2943. Due to this dramatic change of circumstances, Phase 2 of Tract 2943 will probably not be developed
before 2025.
Since the City of SLO has proposed that 75% of the expense of the extension of Earthwood Lane through Phase 2 of Tract 2943 as a primary access to the Avila
Ranch should be borne by the Avila Ranch development, the Ball Trust should be entitled to a credit against the Mitigation Fees for Future Development of lots
on Phase 2 of Tract 2943 in an amount equal to 75% of the amount expended for the existing paved 2013 portion of Earthwood Lane.
The Ball Trust was required to install gutters, curbs, the landscape buffer, and sidewalks along the 2013 portion of Earthwood Lane.
The Avila Ranch development should be required to install gutters, curbs, a landscape buffer, and sidewalks along the extension of Earthwood Lane through
Phase 2 of Tract 2943. Allowing construction of this portion of Earthwood Lane without providing sidewalks would create serious safety and liability hazards,
especially in light of the planned dense residential development adjacent to the northerly boundary of the Avila Ranch adjacent to Earthwood Lane.
The gutters, curbs, landscape buffer, and sidewalks along the extension of Earthwood Lane through Phase 2 of Tract 2943 should be constructed in conformity to
the plan for lots within Phase 2 of Tract 2943, specifically, 4 driveways on each side of Earthwood Lane to provide a common driveway for each pair of proposed
lots.
Utility installations under the 2013 portion of Earthwood Lane should be extended through the extension of Earthwood Lane through Phase 2 of Tract 2943.
Utility installations under the extension of Earthwood Lane through Phase 2 of Tract 2943 should be constructed in a manner which will allow connection of the
utilities to the lots within Phase 2 of Tract 2943 with minimal excavation of Earthwood Lane.
The term of the Mitigation Fee enforcement should commence on the date that the extension of Earthwood Lane through Phase 2 of Tract 2943 is paved.
(Waiting for a later date, such as final inspection or completion of some aspect of the Avila Ranch, is not fair since those dates are subject to anticipated
manipulation by the developer.)
Who will be responsible for planting, maintenance, and irrigation of the landscape buffer pending future development?
The City of SLO and the developer persist in trampling upon the interests of the Ball Trust in the process of extending a collector street through this property.
The beneficiaries of the Ball Trust, as long time residents and business leaders in our community, are livid.
