Code Sections 6250-6270 and Penal Code section 832.7, which was passed as part of SB1421 (2018). Under Penal Code section 832.7, "peace officer or custodial officer personnel records and records maintained by any state or local agency shall not be confidential and shall be made available for public inspection pursuant to the California Public Records Act...." Orozco (67256) Rouse (unknown) This request includes, but is not limited to, records or reports of: 9 An incident involving the discharge of a firearm at a person by a peace officer. • An incident in which the use of force by a peace officer resulted in death or great body injury. An incident in which a sustained finding was made by any law enforcement agency or oversight agency that a peace officer engaged in sexual assault involving a member of public. a An incident in which a sustained finding was made by any law enforcement agency or oversight agency of dishonesty by a peace officer directly relating to the reporting, investigation, or prosecution of a crime, or directly relating to the reporting of, or investigation of misconduct by, another peace officer or custodial officer, including, but not limited to, any sustained of perjury, false statements, filing false reports, destruction, falsifying, or concealing of evidence. A response to this request shall be made within 10 days. (Gov. Code section 6253.) Any refusal to this request must be justified in writing. (Gov. Code, section 6255.) This request may be enforced through injunctive relief or a court writ of mandate, and awarding of attorney's fees. (Gov. Code, sections 6258,6259.)
