SUBJECT: Item#14 Condition of Approval#3 Correction
Correction Needed to Condition of Approval Item #3 and Reach Code.
It has come to staff s attention that Condition of Approval #3, regarding Energy Reach Code
Compliance, discussed in the Agenda Report for Item#14, and included in the Draft Resolution is
a prior draft and does not accurately reflect the final staff recommended language to address
sustainability. The staff report discussion on "Reach Code" compliance also requires further
clarification since the recommended condition of approval requires the submittal of a Carbon
Reduction Plan (CRP) if building permits are submitted prior to the effective date of the 2019
California Building Code and adoption of the City of San Luis Obispo "Reach Code". Plans
submitted prior to adoption of the codes will require the CRP as discussed in the condition of
approval. The corrected condition language is below:
3. Building permits submitted after the effective date of the 2019 California Building Code
(CCR Title 24, Part 6) and City of San Luis Obispo"Reach Code"will be subject to the
applicable code. If a building permit application is submitted prior to the effective date
of the 2019 California Building Code and City of San Luis Obispo "Reach Code", at
time of the first building permit application, a Carbon Reduction Plan (CRP) outlining
specific project components and analysis with considerations of the 2019 California
Building Code to achieve the amount of greenhouse gas emissions savings for new
construction shall be submitted and approved by the Community Development Director.
The CRP shall include, at a minimum, the following:
a. An agreement to implement the CRP measures to the satisfaction of the Director
prior to issuance of building permit.
b. The project shall minimize onsite fossil fuel consumption to the greatest extent
feasible (e.g., all-electric suite appliances and building systems). Should the
applicant only be able to identify a fossil fuel-based appliance or system, the
CRP must include a justification for why an electric alternative is not feasible.
c. The project shall minimize transportation related greenhouse gas emissions
through program- related measures (e.g., active transportation connectivity,
private van transportation for residents, showering/changing facilities, transit
passes for employees and residents, etc.).
d. The project shall minimize onsite energy consumption to the lowest feasible
level through compliance with the 2019 California Building Code. The CRP

must include a justification for why the proj ect is not able to achieve additional
reductions.
e. All new buildings shall be constructed to be "solar ready", including, but not
limited to, conduit runs, sufficient electrical panel space and designated circuits
labeled as "Reserved for Solar Energy System."
