Authorize the City Manager to execute easements and deed agreements for construction and permanent real property acquisition with Union Pacific Railroad associated with the Railroad Safety Trail Taft to Pepper in a total amount not to exceed $132,000 including title and escrow charges in a form subject to approval by the City Attorney. 2. Authorize the City Manager to execute easements and deed agreements for construction and permanent real property acquisition with the owners of the McLaughlin Property associated with the Railroad Safety Trail Taft to Pepper in a total amount not to exceed $89,000 including title and escrow charges in a form subject to approval of the City Attorney. 3. Approve the transfer of $496,000 from Transportation Impact Fee accounts to the Railroad Safety Trail project account (91375) for all other needed property acquisition. 4. Approve the transfer of $2,399,000 from Transportation Impact Fee accounts to the Railroad Safety Trail project account (91375) for construction. DISCUSSION Background The Railroad Safety Trail (RRST) Extension from Taft to Pepper capital improvement project will extend the existing RRST south from Taft Street, on the west side of the California / US 101 overpass. The proposed trail will continue behind the California Highway Patrol (CHP) property to a new bicycle/pedestrian bridge crossing over the Union Pacific Railroad connecting Phillips Lane to Pepper Street. Construction of the RRST project is partially funded by a $3.24 million Active Transportation Grant awarded to the City by Caltrans. These grant funds can only be used for construction activities. Due to the constrained nature of the land surroun ding the RRST alignment, construction of the project will require right-of-way acquisition from three separate property owners: Union Pacific Railroad (UPRR), the State of California Department of General Services (DGS) and the McLaughlin property, an office building adjacent to the Phillips Street cul-de-sac. See Attachment A for the various encroachments required. Note that negotiations continue with one of the property owners (McLaughlin); this analysis will not represent the entire or final Packet Page 138 Item #10 negotiation costs for this project. Union Pacific Railroad Property The RRST project will require temporary occupancy of 18,782 sq. ft. of UPRR right-of-way during construction activities and permanent occupancy a 5,582 sq. ft. of UPRR right-of-way with completion of the project. Projects that require use of UPRR property must go through an extensive process of plan evaluation and property cost appraisal—staff has been coordinating closely with UPRR on these items for several years. UPRR is still in the process of finalizing proposed terms of an agreement for use of this property but has identified an estimated cost for temporary and permanent use of the required UPRR property at approximately $120,000. Staff is requesting authorization to allocate up to $132,000 for this property acquisition to cover right-of-way costs, escrow fees and other related processing costs. Staff is also requesting authorization to allow the Mayor to execute easements and deed agreements for construction and permanent real property acquisition from UPRR in a form subject to approval by the City Attorney. McLaughlin Property Construction of the RRST project will require 8,007 sq. ft. of the McLaughlin Property for temporary construction easements and 759 sq. ft. for permanent easements. Authorization to enter formal negotiations with the McLaughlin property owners was approved at closed-session hearings on July 2, 2019 and March 6, 2018. While final terms of the property acquisition agreement are currently being drafted, at this time staff is requesting authorization for the City Manager to execute final documents with the McLaughlin Property in a total amount not to exceed $89,000 including title and escrow charges in a form subject to approval of the City Attorney. California Department of General Services Property The California DGS is responsible for management of many State-owned properties, such as the CHP headquarters on California Boulevard where 6,651 sq. ft. is required for temporary construction easements and 19,776 sq. ft. is required for permanent easements for the RRST project. The Council provided formal authorization to enter negotiations with DGS at a previous closed session hearing on July 2, 2019. Staff has since agreed to general terms with the DGS for the CHP property easements at a cost not to exceed $275,000 and a formal agreement is awaiting final review by DGS and the City Attorney. This purchase agreement with DGS will be approved under previous City Council authorization. No new Council action is required at this time related to the DGS property acquisition. In total, property acquisition costs related to the RRST project are estimated at $496,000, including a small contingency applied for escrow and property transfer fees. Previous budget items for the RRST Taft to Pepper project did not include funding for right of way acquisition and project funds that currently remain are needed to complete the remaining pre-construction planning, design and permitting work. For this reason, staff requests authorization to transfer $496,000 from the Transportation Impact Fee account to the RRST project account to fund all property acquisition from UPRR, DGS and from McLaughlin. Packet Page 139 Item #10 Policy Context Construction of this RRST segment furthers the adopted 2019-21 Major City Goal: Multi-Modal Transportation - Prioritize implementation of the Bicycle Master Plan, pedestrian safety, and the Short-Range Transit Plan. This project is identified in the RRST Plan, adopted in 2002, the General Plan Circulation Element, and the City’s Bicycle Transportation Plan (BTP), adopted in 2013. Public Engagement This project has been reviewed by the Active Transportation Committee (ATC), Planning Commission and City Council during development of the adopted Bicycle Transportation Plan. This project was also identified in the proposed city-wide transportation and circulation network within the General Plan Circulation Element. Several opportunities for community outreach and engagement were provided during development of these plans. ENVIRONMENTAL REVIEW An initial study of this project was conducted, and a Mitigated Negative Declaration (MND) was filed to the County of San Luis Obispo on May 19, 2017. All construction plans conform to those mitigations found in the MND. It was anticipated that additional funding may be needed for acquisition but at the time the budget was established detailed areas of right-a-way needs were unknown. When the Active Transportation Grant was applied for in 2015, the project was in preliminary design and was based on the best engineer’s estimate at the time. Since the time of grant award, the project scope has been revised based on UPRR and Caltrans design review. In particular, Caltrans has required changes to the 101/California off ramp and other modifications to improve traffic safety. Both the time delay in the project and the scope changes have increased the total project cost. Staff has determined a project shortfall of $2.39 million needed to proceed with construction. See Attachment B for the 100% Engineer’s Estimate for the project. This estimate includes healthy construction contingencies and outside construction management for the project. The RRST project is included in the Citywide Transportation Impact Fee (TIF) program, and staff is requesting the transfer of $2,894,163 in total from the Citywide TIF account to the RRST project account to fund the property acquisition ($496,000) and construction funding shortfall ($2,398,163). The current balance of the Transportation Impact Fee Fund is approximately $9 million. $4.2 million of that balance has been appropriated to Capital Projects in the FY 2019-20 Financial Plan as well as $1.7 Million in Development Agreement Reimbursements, leaving a balance of approximately $3 million, which is sufficient to accommodate this expenditure. Due to the amount of impact fee credits approved for development-constructed infrastructure, it is anticipated that new traffic impact fee revenues will be limited over the course of the current financial plan; therefore further traffic impact fee expenses have either already been identified or will be proposed for debt financing. ALTERNATIVES The City Council may decide not to authorize the completion of the easement agreement. Staff does not recommend this option as it will result in additional project delays and likely forfeiture of the $3.24-million Active Transportation Grant.
