LOADING ZONES ON DOWNTOWN STREETS
RECOMMENDATION
1. Introduce an ordinance amending Title 10 Vehicles and Traffic Regulations of the Municipal
Code (Attachment A) to allow traffic control signs to be used to designate passenger loading
zone and allow time restrictions for passenger loading zones to be established by Council
resolution; and
2. Adopt a Resolution establishing a pilot program to implement a 12-month passenger loading
and unloading zone between 10:00 p.m. and 3:00 a.m. in Downtown San Luis Obispo on
Higuera Street, both sides, between the blocks of Garden and Broad Streets, and on Chorro
Street in the existing commercial zone in front of Luna Red (Attachment B).
DISCUSSION
Background
In Summer 2017, the Police Department was contacted by several rideshare drivers that
expressed concern with the lack of available parking spaces for dropping off and picking up
passengers in downtown San Luis Obispo; particularly in the late evening. Currently, rideshare
vehicles (common companies include Uber and Lyft as well as City licensed taxi companies)
will stop in the number one and three lanes1 on Marsh Street and Higuera Street to pick-up and
drop-off passengers when convenient parking spaces are not available. Rideshare drivers and
Police staff identified the vehicular and pedestrian safety hazards associated with vehicles
stopping in travel lanes to pick-up and drop-off passengers.
To address this safety issue, on October 2, 2018, staff presented initial recommendations for
Council consideration that included the concept of using commercial and passenger loading
zones in the downtown area as “flex” zones throughout the day wherein both commercial

deliveries as well as passenger loading could occur in both zones. Because managed parking
terminates at 6:00 p.m., these zones become defacto parking areas after 6:00 p.m. and are not
able to be used for any loading or unloading purposes.
Prior to the Council meeting, the City received communication from Downtown SLO expressing
some concern regarding the proposal particularly for the periods after 6:00 p.m. There was
concern that use of the commercial and passenger loading zones after 6:00 p.m. could impact
evening business and patrons who have come to expect these areas as available parking spaces
during this time.
After deliberation, Council approved the flexible use of commercial and passenger loading zones
only for the period up to 6:00 p.m. but did not approve the flexible use after that time. The
Council directed staff to continue to work with Downtown SLO and bring forward an alternative
for the period after 6:00 p.m.
Staff Engagement of the Downtown SLO Parking and Access Committee
Subsequent to the meeting, staff met with the Downtown SLO Parking and Access Committee
on October 11, 2018 to discuss the issue and receive additional feedback. The committee voted
to support a pilot program with all spaces on both sides of the 700 block of Higuera and the
loading zone on the 1000 block of Chorro to be used as ridesharing drop-offs/pick-up zones
during the hours of 10:00 p.m. to 3:00 a.m. Currently, parking is prohibited downtown between
3:00 a.m. and 5:00 a.m. to provide for street sweeping services and that is why the passenger
loading zones will terminate at 3:00 a.m.
Evaluation of Proposed Locations for Pilot Program
1. Higuera Street – Between Garden and Broad Street
Parking Services and Police staff reviewed the 700 block of Higuera between Chorro and Broad
Streets to determine if the entire length was necessary as part of the pilot program. After
analysis, staff concluded that a shorter length of street was more appropriate as a first step in
addressing the issue. Staff recommends that the initial pilot program establish the passenger
loading zones between Garden Street and Broad Street and review the effectiveness as part of the
pilot program. Two disabled parking spaces exist on this block and will be maintained as part of
the pilot program. The duration of the pilot program would be one year.
Both sides of the Higuera Street are being recommended due to late night establishments being
located on both sides of the streets and given the one way nature of this portion of the street, the
need to discourage the current practice of stopping in any of the three travel lanes and/or having
pedestrians run across the street to pick up a cab or rideshare service.
2. Chorro Street – Commercial Zone in Front of Luna Red
The Downtown SLO Parking and Access Committee recommended the 1000 block of Chorro
and more specifically the existing loading zones in front of Luna Red to be used as a rideshare
passenger zone. This curb space already converts to a taxi loading zone between the hours of
10:00 p.m. and 3:00 a.m. The concept was to expand this zone to the new rideshare/taxi zone
provisions and allow both to use this curb space area during this time period. Staff concurs with

this recommendation.
Pilot Program
In consultation with Downtown SLO, staff is recommending that the late-night passenger zone
program be a pilot program for twelve months and be evaluated during this period to determine if
it should be made a permanent program. If the pilot program is successful, staff will notify
Council and the allowance for ride share parking will continue until otherwise changed by the
City Council. If the pilot program needs modifications, staff will return to Council and provide
recommended adjustments.
Regulation and enforcement of ride share services such as Uber and Lyft can be challenging
particularly because most drivers act as independent contractors and are responsible for their
own actions. Providing these areas for passenger safety should help provide additional safety.
However, the transition time between when people can park and when the curb area must be kept
clear may be an operational challenge. SLOPD is aware of these challenges and believes
coordinating with the adjacent businesses will help accomplish the desired results.
Staff is recommending internal program review at three-month and six-month periods and make
adjustments if necessary, to achieve program goals. One issue that will be monitored is the start
time of the program, which is recommended to be 10:00 p.m. This start time may be too early to
have a reasonable transition between evening dinner/shopping parkers and late-night patrons.
The Municipal Code allows the Director of Public Works to adjust these hours as necessary.
Implementation of Pilot Program
To assist in compliance and enforcement, Passenger Loading Only regulatory signs will be
necessary to denote where and when the nighttime parking limitations are established. There will
be no modifications to the existing curb markings that establish commercial, passenger or
disabled spaces as they currently exist. Due to the location of the new zones, sensitivity to the
number of signs and their location will be taken. Staff is proposing to initially install Passenger
Loading Only signs that are supplemental to the existing no overnight parking from 3:00 a.m. to
5:00 a.m. signs that exist along Higuera.
The Police Department will monitor the effectiveness of these signs and make recommendations
for modification, if necessary, if compliance is not achieved.

Other questions have been raised about whether making allowances for ride share companies
will otherwise increase Vehicle Miles Traveled (VMT) and thus increase single occupancy
vehicle use and, indirectly, Greenhouse Gases (GHG). The entire parking and transportation
industry are grappling with the challenges of rideshare companies and the impacts on public
transit, future parking demands, congestion, and sustainability. Cities are largely preempted by
the State in terms of regulating ride share companies, and staff recommends that policies related
to any ability to regulate ride share use of City streets be done in the context of the update to the
Downtown Parking and Access Management Plan, which will be completed during the 2019-
2021 Financial Plan.
Criteria for determining success of Pilot Program
The following are some factors to be utilized in determining the progress of the Pilot Program:
1. Eliminated or dramatically reduced illegal and dangerous pickup and drop off activity.
2. Feedback from Police Department
3. Feedback from businesses, users, rideshare companies
4. Feedback from Downtown SLO
5. Percent of utilization of spaces
6. Little conflict during parking transition time (10:00 p.m.)
Policy Context
This recommendation has taken some time to return to Council for consideration. Staff
changeover, particularly the departure of the Parking Manager in November of 2018, caused
many projects to be delayed and this one was tabled until other higher priorities were completed.
Secondly, with the revised recommendation, staff was working on a solution that would
potentially not need Council approval and instead utilize existing authorities already designated
under Title 10 of the Municipal Code. As final review of the recommendations was completed it
was determined that a Council action would be necessary (the ordinance change recommended
as part of this report) and the item placed upon the August agenda.

Title 10 of the Municipal code establishes regulations for vehicles and traffic. Section 10.14.010
establishes the authority of the Director of Public Works to place and maintain traffic control
devices and more specifically where to mark loading zones. This section also states that
passenger loading zones “shall” be established as “indicated by white paint”.
Because of the special nature of the proposed pilot late-night passenger loading program, the use
of white paint on curbs to designate the parking restrictions would be confusing to motorists and
the public. Much of this curb space is used for general parking during the day and white paint
would be confusing pursuant to existing code regulations.
Therefore, staff is recommending an ordinance amendment to establish that passenger loading
zones can be designated by white paint, the installation of traffic control signs that indicate the
hours of operation for the zone or a combination of both.
Additionally, staff is recommending a revision to Section 10.44.040 to revise the title of “White”
zones to “Passenger” zones to reflect the change in Section 10.14.010 above and clarify that
hours of operation can be set by Council resolution.
Public Engagement
Consistent with Council’s October 2018 direction, City staff has worked with Downtown SLO
and other interested individuals in evaluating this pilot program proposal. All public engagement
has been done in accordance with the City’s Public Engagement and Noticing Manual.
The Downtown SLO Access and Parking Committee made recommendations on this issue at its
October 11, 2018 meeting. Because significant time has elapsed since that action, Downtown
SLO has indicated that they will place this recommendation on the Executive Board and the
Parking and Access Committee to review the report in August. Staff will transmit their actions to
the Council prior to the August 20th meeting.
CONCURRENCE
The Police Department has reviewed and supports this recommendation.
ENVIRONMENTAL REVIEW
The recommended action is considered a “project” under the California Environmental Quality
Act (CEQA) Guidelines; however, it is exempt from review per the general rule exemption sec.
15061(B)(3).

All costs associated with this recommendation will be funded by the Parking Fund. As part of the
FY 2019-21 Financial Plan, Council established $25,000 in capital improvement funding to use
for implementing changes to managed parking in the City. This funding will be used to
implement this program. It is anticipated that signs and installation will cost no more than
$5,000. There is sufficient funding in the CIP account to perform these services.
ALTERNATIVES
Alternative 1 – Modify Pilot Program to earlier start time. Council could change the hours of
the proposed passenger loading zones program and start earlier than the 10:00 p.m. time period.
Starting earlier than 10:00 p.m. may affect curb use for evening parkers particularly those who
are dining and may not finish before 10:00 p.m. Staff does not recommend this since the program
is a pilot program and hours can be administratively adjusted depending upon success of the
proposed hours.
Alternative 2 – Modify Pilot Program to later start time. Council could change the hours of
the proposed program and start later than the 10:00 p.m. time period. Starting later than 10:00
p.m. (either 11:00 p.m. or midnight) are possible and could be supported by staff. The downside
of starting later is that drop offs for people arriving in the downtown between 10:00 p.m. and that
later start time could continue to be done in the unsafe manner that is currently b eing observed
today, which is sometimes by double parking in a vehicle lane. If Council opts for this
alternative, staff would implement the revised hours of operation but monitor the early evening
period to determine if these safety issues persist.

WHEREAS, the City recognizes the need to accommodate ride share vehicles and taxicabs
in the downtown area by allowing passenger vehicles the ability to load and unload passengers in
loading zones without being subject to citation; and
WHEREAS, passenger loading and unloading in the downtown can be problematic and
potentially hazardous for drivers and passengers during the late-night period when there is little
turnover of curb spaces for loading purposes and no designated passenger unloading zones; and
WHEREAS, the City recognizes the need to discourage passenger loading and unloading
in vehicular travel lanes and that loading from adjacent curbs is preferable; and
WHEREAS, Title 10 of the Municipal Code already establishes the authority of the Public
Works Director to establish passenger loading zones in the central traffic district by place and time
however those passenger zones are to be indicated by white paint; and
WHEREAS, Late night passenger loading activities need to have specific areas designated
for the loading and unloading of passengers, particularly those using ride share vehicles or taxicabs
and that a blanket white curb installation would be confusing to motorists and the public; and
WHEREAS, the use of signs to denote the limits and time restrictions for passenger
loading zones may be preferable to white paint in certain circumstances; and
WHEREAS, the California Vehicle Code and State Manual on Uniform Traffic Control
Devices allow for loading zones to be established by signage, painting or a combination of both.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo
as follows:
SECTION 1. Section 10.44.010 of the San Luis Obispo Municipal Code, entitled Loading
Zones – Marking - Authority, is hereby amended to read as follows:
10.44.010 Loading zones—Marking—Authority.
A. The public works director or their designee(s) is authorized to determine and to mark loading
zones and passenger loading zones as follows:
1. At any place in the central traffic district or any business district;
2. Elsewhere in front of the entrance to any place of business or in front of any hall or place
used for the purpose of public assembly.
B. Loading zones shall be indicated by yellow paint upon the top and side of all curbs in the
zones.

C. Passenger loading zones shall be:
1. Iindicated by white paint upon the top and side of all curbs in the zones.; or
2. Traffic control signs indicating Hours of operation and use times as set by resolution or

SECTION 2. Section 10.44.040 of the San Luis Obispo Municipal Code, entitled White
Zones – Time restrictions for loading and unloading, is hereby amended to read as follows:
10.44.040 WhitePassenger zones—Time restrictions for loading and unloading.
A. No person shall stop, stand or park any vehicle in any passenger loading zone for any purpose
other than the loading or unloading of passengers for such time as is specified in this section or by
resolution of the Council.
B. Permission herein granted to stop or park for purposes of loading or unloading passengers
shall include the loading or unloading of personal baggage and shall not extend beyond the time
necessary therefor and in no event for more than ten minutes and during such time the vehicle may
be left unoccupied to accommodate the use.
SECTION 3. If any subdivision, paragraph, sentence, clause, or phrase of this ordinance
is, for any reason, held to be invalid or unenforceable by a court of competent jurisdiction, such
invalidity or unenforceability shall not affect the validity or enforcement of the remaining portions
of this ordinance, or any other provisions of the City’s rules and regulations. It is the City’s express
intent that each remaining portion would have been adopted irrespective of the fact that any one
or more subdivisions, paragraphs, sentences, clauses, or phrases be declared invalid or
unenforceable.
SECTION 4. A summary of this ordinance, together with the names of Council members
voting for and against, shall be published at least five (5) days prior to its final passage, in The
New Times, a newspaper published and circulated in this City. This ordinance shall go into effect
at the expiration of thirty (30) days after its final passage.

Background

1. Higuera Street, both sides, between Garden and Broad Streets and
2. Chorro Street in the existing commercial zone in front of Luna Red.
SECTION 2. Pursuant to Municipal Code Section 10.44.010, authorizes the Director
of Public Works to install necessary signs, markings and other traffic control devises to
establish the passenger zones as established in this resolution and to make any and all
necessary adjustments to program times to achieve desired results.

Revised Recommendation
1.Introduce an ordinance amending Title 10 Vehicles and Traffic Regulations
of the Municipal Code (Attachment A) to allow traffic control signs to be
used to designate passenger loading zone and allow time restrictions for
passenger loading zones to be established by Council resolution; and
2.Adopt a Resolution and revised language establishing a pilot program to
implement a 12-month passenger loading and unloading zone between
11 :00 p.m. and 3:00 a.m. in Downtown San Luis Obispo on Higuera Street,
both sides, between the blocks of Garden and Broad Streets, and on
Chorro Street in the existing commercial zone in front of Luna Red
(Attachment B).
