As a Realtor I am generally opposed to any "point of sale" requirements. I understand why this is coming forward as I have been involved with the public outreach that was done by your utilities department. I believe there were five meetings with the local Realtors in an effort to educate the utilities department as well as educating the Realtors that this was on the way and how can it be made better. The interaction between all of us was both educational and greatly appreciated. A few concerns or items that may need clarification are, on packet page #164 under item #8 the inspection is required upon change of ownership of real property. If you go to packet page #173 2.a. there is (as I read it) any "common interest development" is basically excluded until 2030. So, common interest includes but is not limited, to a condominium, mobile/modular home, commercial condo, planned development home etc... so these are really not a part of the required inspection, correct ? They are sort of exempt ? Back to packet page 164, making the assumption that this will just be negotiated between the buyer and seller may seem like an easy process on the surface but I'm not so sure its just that easy. Is there monitoring of private sales? Who is telling a non represented seller/buyer this needs to be done ? Please keep in mind we deal on agreed time limits for almost anything in a real estate purchase agreement. We also have appraisal concerns (appraisers generally get a copy of the purchase agreement), lender concerns, timing to get someone out to inspect within those time frames previously agreed to etc... I would probably bet that most escrows are scheduled to close in 30 days or less, so its just another challenge to deal with. I think the rebates offered are a real good incentive to at least get some of the laterals replaced. The offset program can be a real asset to those three areas described as your big problem areas for some people to get this done basically for free. I really want to thank, Dave, Jennifer and Jeremy for their time and conversations as I believe this is a better ordinance for that time spent. Over time we may all be better off to not be cleaning so much "clean" water and maybe save a few bucks as well. Steve Delmartini 1
