RECOMMENDATION
1. Adopt a Resolution entitled “A Resolution of the Council of the City of San Luis Obispo,
California approving an Amendment to the Meadow Park Pedestrian Bridge Replacement
Project and related budgetary appropriations;” (Attachment A);
2. Award a construction contract (Attachment B – Agreement) to R. Burke Corporation in the
amount of $199,164 for the Meadow Park Pedestrian Bridges Replacement Project); and
3. Approve a transfer of $271,164 from the Parks Major Maintenance – Annual Asset
Maintenance Account to the Meadow Park Pedestrian Bridges Replacement project to fund
the project and construction support services.
DISCUSSION
Background
On February 5, 2019 the City Council authorized inviting bids (Attachment C – Council Agenda
Report that Authorized Advertisement) for the Meadow Park Pedestrian Bridges Replacement
Project. Three bids were received and publicly opened on August 15, 2019 (Attachment D – Bid
Results Summary). All the bids were over the Engineer’s Estimate of $190,000. The lowest
bidder is R. Burke Corporation with a bid price of $199,164. Although this bid is higher than the
Engineer’s Estimate, the increase in cost is minor.

have been verified. Staff therefore recommends awarding a construction contract to R. Burke

Previous Council or Advisory Body Action
This project was approved by Council on February 5, 2019 and authorized for advertising.
Policy Context
Per the Council report on February 5, 2019 the project must be awarded by Council if the
construction contract is higher than the Engineer’s Estimate of $190,000.
Public Engagement
Public engagement was done during the initial identification of this project to be included in the
2015-17 Financial Plan.
CONCURRENCE
There is concurrence from the Community Development Department through the review of the
project for building permit issuance. This project also has concurrence from the City Biologist,
Natural Resources Manager, and Public Works Parks Maintenance Program and the Parks and
Recreation Department through their review and approval of the project plans and special
provisions.
ENVIRONMENTAL REVIEW
This project is exempt from environmental review under Section 15302 Class 2 (Replacement or
Reconstruction) of the California Environmental Quality Act (CEQA) Guidelines because the
project proposes to replace the existing pedestrian bridges with structures of a similar size and
use. The project is consistent with the applicable general plan policies as well as with applicable
City Regulation. A Notice of Exemption has been filed through the Community Development
Department.

Fiscal Analysis:
The Meadow Park Pedestrian Bridges Replacement project was originally identified in the 2015-
17 Financial Plan, Appendix F – Capital Improvement Plan, pages 3-221 through 3-228. Budget
was appropriated to the Parks Major Maintenance and Repairs Annual Asset Maintenance
Account with a subset of total funding attributed to this project as follows: the adopted 2016-17
Supplemental Budget designated $130,000 for the construction of the bridges and an additional
$75,000 was added in the 2017-19 Financial Plan.

The current construction cost exceeds the original budget of $205,000, but there is enough
funding in the Parks Major Maintenance – Annual Asset Maintenance Account to cover the
increase in costs due to project deferment of the Sinsheimer Tennis Court Entrance Hardscape
Project. The hardscape project was advertised for bids in May 2019, with an estimated cost of
$66,200. The lowest bid received was slightly under $110,000. This bridge replacement project
is a higher priority than the hardscape replacement and it is therefore recommended to use this
funding. A future request to replenish funding will be brought forward in the appropriate budget
document to address hardscape needs at Sinsheimer. With this amendment, there is $302,997
currently available in this asset maintenance account.

The Parks Major Maintenance account has enough funds to cover the project cost as shown in
the table above. In addition to the construction contract, budget is necessary to support potential
cost increases by contract change order, as well as support services including Materials Testing
and Construction Support to ensure project is constructed to City specifications.
This project has been delayed due to scope changes and staffing vacancies. One of the larger
issues was a separate utility relocation project that had to be completed prior to the replacement
of one of the bridges. Those issues have been resolved and this critical project is ready to move
forward.

RESOLUTION NO. (2019 SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO,
CALIFORNIA APPROVING AN AMENDMENT TO THE MEADOW PARK
PEDESTRIAN BRIDGE REPLACEMENT PROJECT AND RELATED
BUDGETARY APPROPRIATIONS.
WHEREAS, the City’s 2016-17 Financial and Capital Improvement Plan Supplement
designated $130,000 toward the Meadow Park Pedestrian Bridge Replacement project, and;
WHEREAS, the approved 2017-19 Financial and Capital Improvement Plan designated
an additional $75,000 to the project: and
WHEREAS, on February 5, 2019, the Council authorized the invitation for bids and the
lowest bid received for the project was $199,164, bringing the total project budget needed to
$271,164 and requiring additional funding to proceed, and;
WHEREAS, staff identified the Sinsheimer Tennis Court Entrance Hardscape project as
a source for the needed funding as this project was deferred due to insufficient funding, and;
WHEREAS, the Meadow Park Pedestrian Bridge Replacement is a high priority project,
warranting the use of funding from the Sinsheimer Tennis Court Entrance Hardscape project, and:
WHEREAS, staff would request to replenish funding for the Sinsheimer Tennis Court
Entrance Hardscape project when this project is ready to proceed.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of San Luis
Obispo as follows:
SECTION 1. The budget of $66,200 for the Sinsheimer Tennis Court Entrance Hardscape
project will be moved to the Meadow Park Pedestrian Bridge Replacement project as it is a high
priority City project.
SECTION 2. A funding request to replenish the Sinsheimer Tennis Court Entrance
Hardscape project will be brought forward at a future date when the project is ready to proceed.

AGREEMENT
THIS AGREEMENT, made on this , by and between the City of
San Luis Obispo, a municipal corporation and charter city, San Luis Obispo County,
California (hereinafter called the Owner) and R. Burke Corporation (hereinafter called the
Contractor).
WITNESSETH:
That the Owner and the Contractor for the consideration stated herein agree as follows:
ARTICLE 1, SCOPE OF WORK: The Contractor shall perform everything required to be
performed, shall provide and furnish all of the labor, materials, necessary tools,
expendable equipment, and all utility and transportation services required to complete all
the work of construction of

in strict compliance with the plans and specifications therefor, including any and all
Addenda, adopted by the Owner, in strict compliance with the Contract Documents

and said work performed and completed under the direction and supervision and subject
to the approval of the Owner or its authorized representatives.
ARTICLE II, CONTRACT PRICE: The Owner shall pay the Contractor as full

Payments are to be made to the Contractor in compliance with and subject to the provisions
embodied in the documents made a part of this Contract.
Should any dispute arise respecting the true value of any work omitted, or of any extra work
which the Contractor may be required to do, or respecting the size of any payment to the
Contractor, during the performance of this Contract, said dispute shall be decided by the
Owner and its decision shall be final, and conclusive.

ARTICLE IV INDEMNIFICATION: The Contractor shall indemnify, defend with legal
counsel approved by City, and hold harmless City, its officers, officials, employees and
volunteers from and against all liability, loss, damage, expense, cost (including without
limitation reasonable legal counsel fees, expert fees and all other costs and fees of
litigation) of every nature arising out of or in connection with the Contractor’s negligence,
recklessness or willful misconduct in the performance of work hereunder or its failure to
comply with any of its obligations contained in this Agreement, except such loss or damage
which is caused by the sole or active negligence or willful misconduct of the City. Should
conflict of interest principles preclude a single legal counsel from representing both the City
and the Contractor, or should the City otherwise find the Contractor’s legal counsel
unacceptable, then the Contractor shall reimburse the City its costs of defense, including
without limitation reasonable legal counsel fees, expert fees and all other costs and fees of
litigation. The Contractor shall promptly pay any final judgment rendered against the City
(and its officers, officials, employees and volunteers) with respect to claims determined by
a trier of fact to have been the result of the Contractor’s negligent, reckless or wrongful
performance. It is expressly understood and agreed that the foregoing provisions are
intended to be as broad and inclusive as is permitted by the law of the State of California
and will survive termination of this Agreement.
The Contractor obligations under this section apply regardless of whether such claim,
charge, damage, demand, action, proceeding, loss, stop notice, cost, expense, judgment,
civil fine or penalty, or liability was caused in part or contributed to by an Indemnitee.
However, without affecting the rights of the City under any provision of this agreement, the
Contractor shall not be required to indemnify and hold harmless the City for liability
attributable to the active negligence of AGENCY, provided such active negligence is
determined by agreement between the parties or by the findings of a court of competent
jurisdiction. In instances where the City is shown to have been actively negligent and where
the City’s active negligence accounts for only a percentage of the liability involved, the
obligation of the Contractor will be for that entire portion or percentage of liability not
attributable to the active negligence of the City.
ARTICLE V. It is further expressly agreed by and between the parties hereto that should
there be any conflict between the terms of this instrument and the bid of said Contractor,
then this instrument shall control and nothing herein shall be considered as an acceptance
of the said terms of said bid conflicting herewith.

Meadow Park Pedestrian Bridges Replacement project, Specification Number 1000017;
2. Authorize staff to advertise for bids; and
3. Authorize the City Manager to award the construction contract for the Bid Total if the lowest
responsible bid is within the Engineer’s Estimate of $190,000.
DISCUSSION
Background
Beginning with the 15-17 Financial Plan, the City Council has reviewed and approved a new
Annual Asset Maintenance project called ‘Parks Major Maintenance’. This new program has
enabled the City to identify and repair deteriorating structures in citywide parks. The pedestrian
bridges in Meadow Park were one of several specific projects identified in this Capital
Improvement Project.
The two pedestrian bridges at Meadow Park were identified in the 2015-17 Financial Plan as
deteriorating and in need of replacement. One of the pedestrian bridges links the parking lot to
the community building and playground, and the other bridge connects the pathway from King
Street to Corrida Avenue. Both bridges can no longer be properly repaired and are in need of full
replacement.
During design it was identified that a PG&E electrical line was attached to the underside of the
bridge at King Street. Due to the specific nature of the work required to relocate the PG&E line,
a separate project was created to bid this scope of work independently of the pedestrian bridge
project. This project is currently underway and will be completed in the first quarter of 2019.
The Bridge Replacement project will follow the PG&E line relocation work and will install two
new prefabricated and slightly longer bridges in the same locations as the existing bridges. The
bridges are specified to be weathered steel with a concrete deck that will comply with current
accessibility requirements.
