Subject: Objection to Stairways and roof decks of the project.
Dear Commissioners
I have had a variety of emails with staff and we are at an impasse as to what is allowed over the 35’
height limit in this zone. Please consider the follow:
Point #1.
Please see my previous letter dated September 23, 2010 where I site code section 17.58.030, which
gives the developer some leeway “to more effectively accommodate the residential component of a
mixed-use project”. I argue that he does not need the extra height to accommodate the residential
component.
Point #2
Section 17.70.080.c.2 Addresses projections but does not include stairways.
Point #3
Is the most important point………. Section 17.70.150-Roof Uses. The section specifically sites “exterior
stairways for access to roof decks shall not exceed the maximum allowable height for the structure”
I would have to conclude that the stairways for access to roof decks would be in violation to the zoning
code.
