Mayor Harmon and Council Members,
I am writing in support of the decision taken by the Planning Commission and the ARC regarding 1121
Montalban, and I urge you to reject the appeal of the applicant and to uphold condition 3.
It is not the first time that I witness the kind of deception used by developers when they want to have
four bedrooms but do not want to provide the right amount of parking. Therefore they claim their
apartments have two bedrooms until the staff and the council give their approval, then, presto, two turn
into four as if by magic. It first happened on Taft, where the city made the owner remove the partitions
not once but twice and then appears to have given up. It then happened at 22 Chorro, where the pretend
2 bedrooms are now advertised as 4 bedrooms right under the nose of the city staff, it will happen at 790
Foothill where the same design has been approved, and it will happen again at Montalban if you turn
your back to the wisdom of your own commissioners.
A bedroom is a bedroom is a bedroom whether its walls are movable or not. Two bedrooms are two
bedrooms, and four bedrooms are four bedrooms. They are not interchangeable. If convenience makes
them appear as two bedrooms one day, and four the next, it’s not magic, it’s deception. The staff ought to
know this, but perhaps they don’t care. However one would think they would get tired of being treated
like fools by developers time and again, unless, of course, a darker reason motivates them. It’s not up to
me to figure it out, but I do believe it is up to you, the Council, because you owe honesty and
responsibility to the residents. Therefore, please decide whether these are two or four bedrooms. If they
are two, follow the recommendation of the commissions and reject the appeal. If they are four, demand
that more parking be provided. Thank you.
