Dear Mayor,
Mr. Hernandez currently has a business that was highly successful until his business hours were shortened. This was to
accommodate the residents that live above him since the building had been classified as mixed use ( B-business) and (R-
residential). Prior a noise ordinance that was issued Mr. Hernandez was unaware of the ordinance upon signing his
lease agreement. In order to try to keep his original hours, as stated in his lease agreement, he has changed the exhaust
fans that service his restaurant to try to provide a quieter environment for the tenants below.
Mr. Hernandez has always been a conscientious business owner and provides great service to the to the community
that surrounds him. In Santa Cruz he is very considerate to his neighbors and is compliant with all the state and local
codes. I’m personally vouching for Mr. Hernandez’s character and believe he has explored all avenues to try and reach
an amicable and reasonable solution.
Understanding the position of the tenants, a bit of due diligence on their part could have helped maybe prevent a
situation like this from getting this far. Some examples would have been to have an agreement at time of sale what the
seller might be able to provide to help mitigate the noise issue for the prospective buyer. Also, full disclosure of
business hours to the new tenant as to the restaurant hours(11pm closing) at which time they serve hungry students,
late workers or people who don’t feel like cooking for whatever
reason.
In addition Mr. Hernandez does donate food to schools and non-profits from time to time and is an assest to any
community he decides to establish his business. It is for this reason I am writing this letter in his behalf to support his
