Dear Vice Mayor,
I wish to introduce myself and speak to you about an upcoming appeal scheduled to be
heard this coming Tuesday at the City Council meeting. As a resident owner in the
affected property, a Mixed Use building located at 1308 Monterey Street, I am Asking

for your help in upholding the July 10, 2019 decision of the Planning Commission and
deny the appeal by Taqueria Santa Cruz for extended hours. The owner/residents of
the building believe the Planning Commissioners decision was fair and should not be
overturned. I have attached a brief history and some pictures for your review.
I would like to meet with you before the Council meeting for 5 minutes at your
convenience to explain a few important points. I am available anytime, including

For years, the Taqueria has had no valid permission to operate after 6:00pm, yet during
this period they continuously operated the restaurant and patio area past 11:00pm at
night causing great stress and negative impact to the residents caused by the intrusive
noise. The loud noise was caused by staff after closing clean up, lingering customers
some who had been drinking and out of compliance rooftop equipment. Keep in mind;
the other two restaurants in the building were closing promptly at 9:00pm. The
commercial restaurant exhaust fan for the Taqueria is located just 11 feet from our
bedroom window and for years it has been on record that the noise level of this fan
exceeds the legal noise limits for a commercial zone, let alone a residential mixed use
zone. For years the Taqueria has dragged their feet to reduce the noise of the fan and
to this date, after official noise testing done on 9/24/2019, they are not in compliance.
Yet they are asking to extend their hours past the zoning limitations on commericial
activities within a mixed use project. The ordinance hours for our Mixed Use Building is
between 8:00am and 6:00pm.
The owner/residents have been patient and compromising and it shows with us being
agreeable to an extremely fair time of a 9:00pm closing for the Taqueria. That is a 3
hour extension for a business that as shown zero effort or respect in working with the
owners of the units of our Mixed Use Building, The Mix at Monterey
A 9:00pm closing time is a very fair closing time within any Mixed Use building. The two
other restaurants are successfully closing at 9:00pm, making sense that all the
restaurants and patios and noise will end at the same time within the building. The
9:00pm closing gives all the restaurants time to close up, customers to exit the building
and exit the parking lot, staff to clean up, trash removed, fan turned off and staff picked
up. While the Taqueria may claim they can close up quickly, this just would not be an
accurate statement as they have shown historically. Closing a restaurant is not like
closing a retail store, no matter how the Taqueria may wish to present it. They need to
close at 9:00pm, to have adequate time before the more severe noise restriction kicks in
at 10:00pm.
Mixed Use Building hours are set for a reason. They are set to ensure that Commercial
uses will not negatively impact residential uses within the project. The Mixed Use
zoning for this building is 8:00am – 6:00pm. Please uphold the planning Commissions
fair and balanced decision of an extension of a 9:00pm closing for the Taqueria Santa
Cruz.

1.4 miles from Monterey location. It is
open until 12:00am (midnight) for
students and community. It is much
closer to Cal Poly campus.
