For parking structures, the Zoning Regulations (Section 17.86.200, Parking as a Primary Use) states, “Where parking as a primary use is permitted in compliance with Table 2-1: Uses Allowed by Zone … discretionary permit approval may include deviations from otherwise applicable development standards.” This can include overall building height, including stairwells and other building features. This is the code provision that has allowed for the other parking structures downtown to be taller than 50 feet, as well. Also for your reference, CAR Packet Page 114, Paragraph 3 discusses allowance for “deviations to development standards” such as height as being allowed for parking structures. With respect to mechanical equipment, the City’s Zoning Regulations Section 17.70.080(C)2 states “Projections.
