RE: Public Records Act Requests regarding the Sub fire
Dear Mr. Hanson
I am responding to your Public Records Act requests received by the City of San Luis
Obispo on January 24, 2018 pertaining to the Sub fire.
1. (PRR18028) requests: "Please provide the 911 calls for the sub fire on
12/26/2015. Ms. Rapp has informed us that the records are retained for 2 years,
As auto -delete has only been 24 days back-ups should be available"
• Despite your assertion in this request, our auto -deleted tiles are not in fact
retained for any period of time beyond the date of deletion. The date of
deletion means the records are deleted. 1 have no audio to provide you for
the Sub fire.
2. (PRR18027) requests: "Please provide audio of the Sub fire on 12/26/15
between SLOFD command and firefighters with SLO dispatch".
• The response to this similar request is the same as to #1 above. Any
additional requests for any audio from the Sub fire are not necessary as we
do not have any audio to provide.
3. (PRR18024) requests: "Please provide the names and details of 911 callers on
12/26/15 pertaining to the Sub Fire."
• As the 911 calls have been deleted, we have no way to obtain this information
beyond the fact that the call lists The Sub as the original caller. In addition,
complainant information has widely been recognized as exempt under the
PRA pursuant to Government Code section 6255. See City of San Jose vs.
Superior Court (1999, case Cal.app.41h 1008).

California Government Code Section 6253 (c). Each agency, upon a request for a copy of records, shall, within 10 days from receipt of the request determine whether
the request, in whole or in pan, seeks copies of disclosable public records in the possession of the agency and shall promptly notify the person making the request of
the determination and the reasons therefore. In unusual circumstances, the time limit prescribed in this section may be extended by written notice by the head of the
agency or his or her designee to the person making the request, setting forth the reasons for the extension and the date on which a determination is expected to be
dispatched. No notice shall specify a date that would result in on extension for more than 34 days.'

As used in this section, "unusual circumstances" means, but only to the extent reasonably necessary to the proper processing of the particular request: 1jThe need to
search for and collect the requested records from field facilities or other establishments that are separate from the office processing the request. 2) The need to search
for, collect and appropriately examine a voluminous amount of separate and distinct records which are demanded in a single request. 3jThe need for consultation,
which shall be conducted with all practicable speed, with another agency having substantial interest in the determination of the request or among two or more
components of the agency having substantial subject matter interest therein.
