Dear Applicant:
The Planning Commission, at its meeting of May 20, 1997, approved a use permit to allow a
wireless telecommunications facility at 0 Higuera Street based on the findings, and subject to the
conditions listed in the attached Resolution No. 5197-97.
The decision of the Commission is final unless appealed to the City Council within ten working
days of the action. The appeal period will expire at 5:00 p.m. on Tuesday, May 27, 1997. An
appeal may be filed with the City Clerk by any person aggrieved by a decision of the
Commission.
The Planning Commission's approval expires after three years if construction has not started,
unless the Commission designated a different time period. On request, the Community
Development Director may grant renewals for successive periods of not more than one year each.

RESOLUTION NO. 5197-97
WHEREAS, the Planning Commission of the City of San Luis Obispo did conduct a
public hearing in the Council Chamber, City Hall, 990 Palm Street, San Luis Obispo, California,
on May 14, 1997, pursuant to a proceeding instituted under application U 152-96, GTE
MOBILNET, applicant.
PLANNING COMMISSION USE PERMIT REVIEWED:
U 152-96 - a request to allow a wireless telecommunication facility on a hillside and
review of a Negative Declaration of Environmental Impact.
DESCRIPTION:

WHEREAS, said commission as a result of its inspections, investigations, and studies
made by itself, and in behalf of testimonies offered at said hearing has established existence of the
following circumstances:
1. As conditioned, the proposed use will not adversely affect the health, safety and welfare of
persons living or working at the site or in the vicinity.

2. As conditioned, the proposed use is appropriate at the proposed location and will be
compatible with surrounding land uses.
3. The proposed use conforms to the general plan, specifically hillside protection policies in the
Land Use and Open Space Elements, and meets zoning ordinance requirements for wireless
telecommunications antennas.
4. Mitigation measures provided in the adopted initial study ER 152-96 adequately address
potential environmental impacts of the project. The Planning Commission has reviewed and
considered the information contained in the attached addendum in its consideration of the
Mitigated Negative Declaration ER 152-96 and Use Permit U 152-96, and finds that the
preparation of a subsequent Negative Declaration is not necessary because:
• the proposed additions and changes are minor;
• the changes are consistent with City goals to consolidate telecommunication facilities and
equipment on hillside locations; and
• the proposal will help to further mitigate aesthetic and visual concerns with such
installations.
NOW, THEREFORE, BE IT RESOLVED that the application U 152-96 be approved
subject to the following to conditions:
1. The approval of Use Permit U 152-96 allows GTE Wireless to proceed with its individual
facility plans, as well as approves a master concept for future carriers to locate on the
graded area for cell sites that is confined by retaining walls and screened with rock and
earth berms. Future carriers that show installations that are consistent with the master
plan may submit applications for an administrative, rather than Planning Commission use
permit. These installations will also require minor or incidental architectural review.
2. The applicant shall utilize the existing Cellular One monopole, rather than installing a
separate monopole. The maximum height of the monopole shall be 60 feet.
3. To ensure that the access road remains passable and that road grading is minimized, the
applicant shall submit a road maintenance agreement for review and recordation to the
satisfaction of the Fire Chief and Community Development Director prior to issuance of a
grading and building permit.
4. To ensure there will be no radio interference with existing on -site radios, the cellular
transceiver facility shall be designed consistent with independent analysis of building plans
prior to building permit issuance to the satisfaction of the Fire Chief. Once installed, the

new facility shall be tested by an independent consultant prior to commencing the cellular
transceiver use to the satisfaction of the Fire Chief. It shall be the responsibility of the
applicant to finance such analysis.
5. The use permit shall be subject to immediate revocation in the event the cellular
transceiver facility results in radio interference with municipal radio operations necessary
for field work and emergency response coordination. The applicant shall be responsible
for the cost of identifying the source of interference in the event GTE Wireless' equipment
or operating procedures are identified as the probable cause of interference.
6. The applicant shall submit an agreement for review and recordation granting the City the
right to access GTE Wireless' site and inspect equipment upon request and outlining an
action plan for correcting radio interference that may occur subsequent to installation of
the cellular transceiver facility to the satisfaction of the Fire Chief.
7. Consistent with recommendations outlined in the Botanical Study prepared for this project
by V.L. Holland in June 1996, a botanist approved by the City shall monitor all grading
and construction to ensure that impacts to the Calochortus obispoensis are minimized.
8. A radio frequency radiation hazard management program shall be developed by the
applicant to the satisfaction of the Fire Chief and the Community Development Director,
and shall include a baseline radio frequency field measurement prior to construction,
regular measurements thereafter in and around such facility, and posting measurement
results in a place visible to anyone visiting the site.
9. Levels of radio frequency radiation shall not exceed applicable Federal Communication
Commission's (FCC's) radio frequency emission guidelines.
The foregoing resolution was approved by the Planning Commission of the City of San Luis
Obispo upon the following roll call vote:
