HomeMy WebLinkAbout2110 Broad 1986 Use Pmt A128-83SAN LUIS OBISPO CITY PLANNING COMMISSION RESOLUTION NO. 3048-86 WHEREAS, the Planning Commission of the City of San Luis Obispo did conduct a public hearing in the City Council Chambers of the San Luis Obispo City Hall, San Luis Obispo, California on August 13, 1986, pursuant to a proceeding instituted under application No. A128-83 by Jules Rogoff, applicant. USE PERMIT REVIEWED: To allow a drive -through carwash. PROPERTY DESCRIPTION: On file in the office of Community Development, City Hall. GENERAL LOCATION: 2110 Broad Street GENERAL PLAN LAND USE ELEMENT: Service-Commercial/light industrial PRESENT ZONE: C-S WHEREAS, said commission as a result of its inspections, investigations and studies made by itself, and in behalf and of testimonies offered at said hearing, has established existence of the following circumstance: 1. The proposed project will not be detrimental to the health, safety, or welfare of persons living or working at or near the site because: A. Noise of operations may be reduced to levels which are acceptable for commercial zones, considering proposed types, location, and screening of mechanical equipment, and the proposed installation of noise blocking walls and the ambient traffic noise in the area. Traffic congestion and hazards may be minimized by the proposed one-way circulation traffic pattern and by-pass lane, and with minor changes to striping on Santa Barbara Street. NOW, THEREFORE, BE IT RESOLVED that application No. A128-83 be approved subject to the following conditions: 1. Use permit shall take effect after rezoning of the property from C-N to C-S becomes effective. 2. Applicant shall install a solid, 6-foot high masonry wall along the northern property line, extending from about 24 feet east of the Broad Street property line to about 85 feet east of the Broad Street property line, to the approval of the Community Development Department staff. 3. Wash water shall be reclaimed in an essentially close system with back -flow protection to prevent contamination of domestic water, to the satisfaction of the Chief Building official. 4. The fraction of wash water which must be separated or periodically drained to the sanitary sewer system shall comply with Section 7501 of the Municipal Code, as determined by the Public Works Department: A sand trap shall be provided as required by the Uniform Plumbing Code, Section 708, and Municipal Code Section 7501.3.E. 5. Applicant shall compensate the city for the cost of the following items, which are to be completed prior to operation of the carwash: A. Red curbing of the parking space on Santa Barbara Street, northwest of the project exit driveway. B. Extension of lane separation striping northwest of the Broad Street intersection, to the approval of the Police Department Traffic Safety Division, and the Public Works Department. 6. Proposed by-pass lane to the north of the building shall have a minimum clear width of 10 feet, and shall be kept clear of vehicles and other obstructions during operating hours. Resolution No. 3048-86 Use Permit A128-83 Page 3 7. Applicant shall provide at least three parking spaces for the proposed use. Two of the required parking spaces must be located on -site, and the remaining space may be located on -site or off -site within 300 feet of the carwash site. If the space is off -site, the applicant shall submit evidence of securing such space prior to issuance of building permits for the carwash and the applicant shall notify the Community Development Director in writing of the expiration or termination of any agreement securing the required off -site parking. 8. Hours of operation shall be limited to 7 a.m. to 9 p.m. Monday through Sunday. 9. Site shall be maintained in a clean and orderly manner, with proper receptacles for litter and replacement of dead or dying plants, as necessary. 10. Use permit shall be reviewed by the Community Development Director upon receipt of any reasonable written complaint. At the review hearing, the use permit may be extended, revoked, or modified, and conditions added or deleted. 11. Traffic directional signing and/or other traffic control devices shall be installed at driveway exit from site onto Santa Barbara Street to control vehicles entering the site at this driveway, to the approval of the Community Development Department staff. 12. The carwash shall be operated in a manner to prevent waiting vehicles from obstructing the Broad Street sidewalk or travel lanes. The foregoing resolution was adopted by the Planning Commission of the City of San Luis Obispo, upon the motion of Commr. Gerety, seconded by Commr. Kourakis, and upon the following roll call vote: AYES: Gerety, Kourakis, Crotser, Duerk, Reiss, Schmidt, Dettmer NOES: None ABSENT: None Michael Multari, Secretary Planning Commission DATED: August 13, 1986
