City of SLO; AVOIDING FURTHER DELAY DAMAGES OF $333.00 PER DAY (MINIMUM)

Pursuant to the California Public Records Act, based upon statements in Mr.
Guzman's email below, I am requesting copies of the following document concerning the following:
1. All records of inspections, reports, notes, documents, field
observations, corrections, concerning Encroachment Permit, Right of Way, ENCR‐5556‐2019, November 1, 2019,
concerning the installation of a one inch water service lateral to serve a one inch meter; D‐Call engineering Inc., Garrett
Loughran, including any final inspection, location of water meter box, location and length of connecting water service
pipes and valves.
2. All records of inspections, employee time records, reports,
notes, documents, field observations, corrections, concerning Encroachment
Permit, Right of Way, ENCR‐0780‐2020, April 24, 2020,
concerning the installation of curbs, gutters, sidewalks, parking meters,
street light base, water and utility meters, etc.
3. All records of inspections, reports, employee time records,
notes, documents, field observations, corrections, concerning Encroachment
Permit ENCR‐0780‐ 2020, with regard to the following facts:
Anchor Bolts for the decorative street light fixture have been Inspected by Ben Marquart San Luis Obispo City
Public Work Inspector Ben Marquart, who also provided to the contractor on site and used a template
for bolt pattern for the from a
previous install before concrete was installed for
the new mission style sidewalks on the frontage of 679 Monterey St. and the
installation is exactly per that bolt pattern. The current
installation reflects the direction and templates provided by Mr. Marquart to the contractor on the site.
4. All documents, communications, records, reports, notes,
conversations, communications between any and all city employees,
contractors, agents, managers, engineers, supervisors,
inspectors regarding 679 Monterey St. and 677 Monterey St., Encroachment
EnCR‐0780‐2020, not previously copied to William S. Walter.
5. All documents, communications, records, reports, notes,
conversations, communications between any and all city employees,
contractors, agents, managers, engineers, supervisors,
inspectors regarding 679 Monterey St. and 677 Monterey St., Foundation
Repair Permit BLDG 1143‐2018, 679 Monterey St., not previously
copied to William S. Walter.

6. All documents, communications, records, reports, notes,
conversations, communications between any and all city employees,
contractors, agents, managers, engineers, supervisors,
inspectors regarding 679 Monterey St., Arch‐1236‐2017, not previously copied to William S. Walter.
I am sorry, Mr. Christian, to put this burden upon you but the City Council Protest hearing is pending and this
information is relevant to having a fair hearing.

1. Have you informed the supplier that you approve the
purchase, which is what I understand they want?
2. When did you inspect the bolts and inform the contractor?
3. What records reflect your inspection, including dates?
4. Have you communicated this to Stephen Williams (he is not
copied on your email), and if not, why not?
The delays continue on your watch until the manufacturer is informed and the contractor is informed.

City Engineering Standard Specification Section 5‐1.23 require the submittal of equipment information that is not
specified by standards. In this case, the equipment being ordered is specified by Engineering Standard 7915.
Submittal, review and approval of this equipment is not required by the City prior to purchase since it is provided in
great detail in Engineering Standard 7915. Any delays identified in your email below are not the responsibility of the
City.
The submittal is approved but before you order your light fixture please confirm that your bolt pattern will work with
field work done to date. The bolt pattern in your submittal is a hard 12" meanwhile Engineering Standard
7915 requires 12" to 15" and your bolts have already been installed.

Greetings Mr. Horn,
We look forward to the response so that the decorative light can be manufactured and the time of 12 weeks to
manufacture it can commence and unreasonable further delays and costs to me (minimum of $333.33 per day) avoided.
Under protest, I have already paid for the fixture. As I understand it, something direct in writing is required from the
City itself, for reasons unknown to me except that this is a municipal public works function.
Is there a history of problems with the manufacturing of these lights for the City of San Luis Obispo?

We are still waiting for the City's approval for the decorative light fixture.
Eddie indicates that a sign‐off on the attachment is required.
I have (under protest) already paid for the decorative light fixture and the
12 week lead time to manufacture it cannot commence until someone with authority at the City complies with the
manufacturers request for a "sign off" from the City.
Please coordinate with Eddie and provide him with the written approval as required by Lumec.

Continuing under protest with my doing your public works functions at great time and annoyance, the Lumec factory
wants the City of San Luis Obispo to sign‐off on these specifications prior to building it.

Please respond to this by copying Eddie Jensen who has worked very hard to make sure that the City's decorative light
fixture which I am purchasing under protest is the correct item.
Apparently, we cannot purchase this item without the City's approval.
