Thursday, January 7, 2021
Special Meeting of the Administrative Review Board
CALL TO ORDER
A Special Meeting of the San Luis Obispo Administrative Review Board was called to order on
Thursday, January 7, 2021 at 1:00 p.m. via teleconference, by Chair Conaway.
ROLL CALL
Present: Board Members Joe Benson, Vice Chair Alex Karlin, and Chair Earl Conaway
Absent: None
Staff: Markie Jorgensen, Assistant City Attorney, Mark Amberg, Assistant City Attorney,
Kelly White Legal Assistant/Paralegal and City Clerk Teresa Purrington
APPROVAL OF MINUTES
1. Consideration of Minutes of the Regular Administrative Review Board Meeting of
November 12, 2019:
ACTION: UPON MOTION BY VICE CHAIR KARLIN, SECONDED BY BOARD
MEMBER BENSON, CARRIED 3-0-0, the Administrative Review Board approved the
Minutes of the Regular Administrative Review Board Meeting of November 12, 2019, as
presented.
BUSINESS ITEMS
2. Administrative Citation Appeal: Review and decide on the appeal submitted by attorney
Shauna Cunningham on behalf of Kennedy Club Fitness for Community Development
Department issued Administrative Citation #23027.
Member Benson, Vice Chair Karlin, and Chair Conaway reported having no Ex Parte
Communications.
Vice Chair Karlin indicated he was a member of Kennedy Club Fitness in the past. Member
Benson indicated his current employer has a few connections with the Appellant
Representative Shauna Cunningham, including that she was previously employed by his
employer, Carmel & Naccasha LLP but that he has not met Ms. Cunningham or worked on
any matters she was assigned when employed there; that Jordan Cunningham has made
informal referrals of potential new clients to Member Benson’s employer but that he has not

met Mr. Cunningham or worked on any of the referred matters; that Matthew Kennedy has
made informal referrals of potential new clients to Member Benson’s employer but that he
has not met Mr. Kennedy or worked on any of the referred matters; and that he was previously
a client of Appellant as his child took swim lessons there.
Code Enforcement Officer, John Mezzapesa, and Assistant City Attorney, Mark Amberg,
provided a presentation and responded to Board member inquiries.
Jordan Cunningham, Appellant’s Representative, provided an overview of the appeal and
responded to Board member inquiries.

ACTION: UPON MOTION BY VICE CHAIR KARLIN, SECONDED BY CHAIR
CONAWAY, CARRIED 2-1 (WITH MEMBER BENSON VOTING NO) to continue the
item to the January 20, 2021 Administrative Review Board meeting to allow for additional
information to be provided to the Board by the Appellant’s Representative and staff.
ADJOURNMENT
The meeting was adjourned at 3:15 p.m. The next Special Meeting of the Administrative Review
Board meeting is scheduled for Wednesday, January 20, 2021 at 12:30 p.m., via teleconference.
