Thursday, February 4, 2021
Special Meeting of the Administrative Review Board
CALL TO ORDER
A Special Meeting of the City of San Luis Obispo Administrative Review Board was called to
order on Thursday, February 4, 2021 at 3:02 p.m. via teleconference, by Chair Conaway.
ROLL CALL
Present: Board Members Joe Benson, Vice Chair Alex Karlin, and Chair Earl Conaway
Absent: None
Staff: Markie Jorgensen, Assistant City Attorney, Kelly White Legal Assistant/Paralegal
APPROVAL OF MINUTES
1. Consideration of Minutes of the Special Administrative Review Board Meeting of
January 20, 2021:
ACTION: UPON MOTION BY BOARD MEMBER BENSON, SECONDED BY VICE
CHAIR KARLIN, CARRIED 3-0-0, the Administrative Review Board approved the Minutes
of the Special Administrative Review Board Meeting of January 20, 2021, as presented.
BUSINESS ITEMS
2. Administrative Citation Appeal: Consider and adopt a resolution entitled, “A Resolution of
the Administrative Review Board of the City of San Luis Obispo, California, denying the
appeal of Shauna Cunningham, on behalf of Kennedy Club Fitness of SLO, LLC, and
upholding Administrative Citation No. 23027.”
Markie Jorgensen, Assistant City Attorney and Advisor to the Board, provided an overview of
the resolution and responded to Board member inquiries.
Public Comment
None.

Jordan Cunningham, Appellant’s Representative, was given an opportunity to pose questions
to Board Counsel and had none. During Board deliberations Mr. Cunningham did request the
payment deadline remain at 30 days.

ACTION: UPON MOTION BY VICE CHAIR KARLIN, SECONDED BY CHAIR
CONAWAY, CARRIED 3-0-0 to adopt Resolution No. ARB-04-21 entitled, “A Resolution
of the Administrative Review Board of the City of San Luis Obispo, California, denying the
appeal of Shauna Cunningham, on behalf of Kennedy Club Fitness of SLO, LLC, and
upholding Administrative Citation No. 23027,” amended as follows:
a. Changing section 6 to read as: “The following submissions were submitted to the
record, including, but not limited to photographs, drawings, and documents:”
b. Correcting the Ordinance number in sections 8.c. and 8.d. to “1692”.
c. Changing section 9 to read as: “The Board found the following information
credible…”
d. Changing section 9.f. to read as: “…and further failed to submit any evidence that
the violation did not occur.”
ADJOURNMENT
The meeting was adjourned at 3:28 p.m. The next Regular Meeting of the Administrative Review
Board is scheduled for Tuesday, February 9, 2021 at 3:00 p.m., via teleconference.
