That date is six months rom the date of the shower pan inspection for the Cottage, which started the current delays. 542 On December 4, 2020, Molly Brown signed and approved the Inspection Record for the Fire Sprinkler Trim & Test. On March 8, 2021, Torn Fitzgerald signed and approved the Inspection Record for Underfloor Insulation. The City's on-line records do not reflect the signed inspection records posted on -site. In addition to the Covid-19 extensions, it's my understanding that each inspection extended the expiration of the permit for six months, so that the permit will not expire until September S, 2021. If this is not the case, then we are requesting an extension of the permit due to delays caused by the mistaken issuance of a Correction Notice for the Cottage permit. Thank you. Hello Mr. Sadowski, It has been six months of very costly delays for us because of the repeated statements that there was no inspection of the stair replacement pads for 679 Monterey St. Sadly, our friend and general contractor unexpectedly passed away in the past weeks making project completion even more difficult. Our contractor was ready to commence the work on both the Cottage deck and the replacement stairs for Bello House, which was delayed by the Correction Notice. �.. We have been disturbed by the City's repeated suggestion that the work was not inspected, since that a a very serious allegation against Stephen Williams that he completed work without inspections and pians. This is why I researched how to contact the City Inspector who signed the Inspection Records. We now know that the City's statements about the lack of inspection and having consistent plans (City stamped Site Plan) were both untrue. The Primary City Inspector, Paula Frojae, who approved the foundations for both the Cottage and the Bello House stairs while reviewing both sets of approved plans, has sent us the attached email verifying her signatures on the Inspection Records for 679 Monterey St. (while als❑ signing the Card for the Cottage foundation on the same date) as follows her email to my husband on March 4, 2021, in the attached email chain: "Hi Bill, those are my signatures, the three (Pb on 8/27 and I made a note I saw the stair wall so that's your proof for the stair stringer pads. They were inspected and approved by me. I never signed a permit on the front page if the work was not fully ready to be covered up. If there were questions I would not sign the front, but make notes on the back. I remember looking at this work and the plans. If you need me to testify to this I win. Please feel free to use this email." 544 It is my hope that the City can now correct the serious errors in issuing the Correction Notice dated September 22, 2020 and that you will promptly reply so that we may now proceed forward to complete replacement stairs for Bello and be able to enjoy and make use of our property. I would like to continue" making great progress" to resolve this situation even without you working directly with Bruce Elster_ I believe he completed all the requests you made for the stair plans. 1 think that there are two items which are not being communicated clearly. 1. There is confusion about your statement that the "verification of the footings that have already been installed without inspection from the City." A scan of the Inspection Record was provided to you months ago, and confirms Stephen Williams statements to you that the footings had been inspected and the inspections noted on the Inspection Record. 2. In your email you stated that we did not have stamped City approval for the stairs. We did and do have stamped City approval dated August 14, 2019 and provided a copy of the revised Cottage site 546 plan which deleted the Bello deck because the deck conflicted with PG&E meter locations required for the Cottage. It shows the two replacement stairs without building the deck . These plans were approved and duplicate copies were available in two locations on -site before the City Inspector came out on August 15,2019 and August 27, 2019. He/She signed the inspection Record on that date. I am attaching another copy of the signed Inspection Record for you. Per the City website, once the Inspector approves the work we can go forward with our project. We did not proceed without approval. It seems reasonable that any Correction Notice would have been given to us at that time, not over a year later after relations with the City have become very difficult. We notified you of these approved plans ❑n October 27, 2020 but I don't recall any acknowledgment from you concerning receipt of the copy of the file stamped plans. The two disputed items as I see it are: (1) Was there a stamped and revised issued permit? -Yes, on August 14, 2019_(2) Were the Forms, Excavation, Reinforcement, Rebar, Rough Grading/Pad Certification signed off on by the City Inspector? Yes, on August 15, 2019 and August 27, 2019. We have full confidence that Stephen Williams fulfilled his obligation of calling for the inspection of the pad, rebar, footings, and believe him when he says the Inspection Record was signed off and the work approved before he poured concrete. Before involving Mr. Williams further we want to make sure that everyone is working from the same set of facts. I look forward to resolving this and getting the replacement stairs built. As you may be aware, I was doing my best to help by working with your design professionals directly, and was making great progress towards resolution. At your request, I am ceasing correspondence with your design professionals and sending the information to you for distribution to your architect and/ or engineer. To summarize previous communications, there are two matters to resolve with the City's Building Department as it relates to the changes to the rear deck. Those include plan revision approval, and verification of the footings that have already been installed without inspection from the City. I will list the necessary steps below for each of these matters, and expand on previous direction given in efforts to provide a complete and clear path forward. These steps are consistently applied in all projects where we encounter plan revisions and/ or work that may have progressed without City approval Plan Revision: 0 547 I. Provide a completed copy of the City's revision form, as previously requested, describing the changes being proposed. A copy of this form can be found here. 2. The updated architectural plans prepared by design professional Thom Brajkovich shall be signed by Mr. Brajkovich. 3. Provide a minimum of "3- printed sets of the revised plans (architectural and structural) to the City for review and approval. Plan sheet size shall be standard 24 x 36 inch format. 4. Once the review of the updated plans has been completed, an invoice will be provided to you for the additional staff time necessary to evaluate the changes in project scope. 5. After the plan review fees are paid, the City will stamp the plans approved and issue two sets back to you, and retain one set for our records. Foundation Verifications' L Provide excavations adjacent to deck footings in order to verify total footing depths. 2. Provide a rebar scan by a licensed special inspection agency for these footings. The report shall specify size, quantity, and spacing of the reinforcing bar located in the scan. 1 Submit rebar scan report findings to the engineer of record and City Building Department. 4. The engineer of record shall review the rebar scan report and provide a written statement either accepting the findings, or identify corrective actions needed to be considered acceptable with the project's engineering design specifications. 5. The engineer's written statement shall be submitted to the City's Building Department for review. We have filed a damages claim with the City including these delays for false and careless allegations and violations of 42 USC Section 1983. Similar three month delays by a local government have been held by the Supreme Court (unanimously) to be compensable. I have already communicated that to the City Manager and the Planning Director, who are the legally culpable parties unless others are shown to actively participate in the retaliatory scheme. This has been a de facto "stop work" order and is malicious and discriminatory. I urge you to resolve all of these issues immediately- our damages claim against the City is $10,000 to $20,000 per month. Please limit your communications to me directly before you continue to consume unnecessary civil engineering fees which exceed the cost of one of the stairways! Per the City website, once the Inspector approves the work we can go forward with our project. We did not proceed without approval. It seems reasonable that any Correction Notice would have been given to us at that time, not — over a year later after relations with the City have become very difficult. We notified you of these approved plans on October 27, 2020 but I don't recall any acknowledgment from you concerning receipt of the copy of the file stamped plans. The two disputed items as I see it are: (1) Was there a stamped and revised issued permit? -Yes, on August 14, 2019.(2) Were the Forms, Excavation, Reinforcement, Rebar, Rough Grading/Pad Certification signed off on by the City Inspector? Yes, on August 15, 2019 and August 27, 2019. We have full confidence that Stephen Williams fulfilled his obligation of calling for the inspection of the pad, rebar, footings, and believe him when he says the Inspection Record was signed off and the work approved before he poured concrete. Before involving Mr. Williams further we want to make sure that everyone is working from the same set of facts. I look forward to resolving this and getting the replacement stairs built. As you may be aware, I was doing my best to help by worsting with your design professionals directly, and was making great progress towards resolution. At your request, I am ceasing correspondence with your design professionals and sending the information to you for distribution to your architect and/ or engineer. To summarize previous communications, there are two matters to resolve with the City's Building Department as it relates to the changes to the rear deck. Those include plan revision approval, and verification of the footings that have already been installed without inspection from the City. I will list the necessary steps below for each of these matters, and expand on previous direction given in efforts to provide a complete and clear path forward. These steps are consistently applied in all projects where we encounter plan revisions and/ or work that may have progressed without City approval. Plan Revision: 555 3. Provide a completed copy of the City's revision form, as previously requested, describing the changes being proposed. A copy of this form can be found here. 2. The updated architectural plans prepared by design professional Thom Brajkovich shall be signed by Mr. Brajkovich. 3. Provide a minimum of "3A printed sets of the revised plans (architectural and structural) to the City for review and approval. Plan sheet size shall be standard 24 x 35 inch format. 4. Once the review of the updated plans has been completed, an invoice will be provided to you for the additional staff time necessary to evaluate the changes in project scope. S. After the plan review fees are paid, the City will stamp the plans approved and issue two sets back to you, and retain one set for our records. Foundation Verifications: 1. Provide excavations adjacent to deck footings in order to verify total footing depths. 2. Provide a rebar scan by a licensed special inspection agency for these footings. The report shall specify size, quantity, and spacing of the reinforcing bar located in the scan. 3. Submit rebar scan report findings to the engineer of record and City Building Department. 4. The engineer of record shall review the rebar scan report and provide a written statement either accepting the findings, or identify corrective actions needed to be considered acceptable with the project's engineering design specifications. 5. The engineer's written statement shall be submitted to the City's Building Department for review. We have filed a damages claim with the City including these delays for false and careless allegations and violations of 42 USC Section 1983. Similar three month delays by a local government have been held by the Supreme Court (unanimously) to be compensable. I have already communicated that to the City Manager and the Planning Director, who are the legally culpable parties unless others are shown to actively participate in the retaliatory scheme. This has been a de facto "stop work" order and is malicious and discriminatory. I urge you to resolve all of these issues immediately — our damages claim against the City is $10,000 to $20,000 per month.
