CALL TO ORDER A Regular Meeting of the San Luis Obispo City Council was called to order on November 2, 2021 at 5:00 p.m. by Mayor Stewart, with all Members present via teleconference. 2. PLEDGE OF ALLEGIANCE Council Member Shoresman led the Council in the Pledge of Allegiance. 3. STUDY SESSION 3.a PUBLIC SAFETY CENTER PROGRAM AND DESIGN UPDATE (Estimated Time: 90 minutes) Public Works Director Matt Horn and Acting City Engineer Brian Nelson provided an in-depth staff report and responded to Council questions. Look for ways to take advantage of the corner. • Continue to explore whether having a Community Room is the best use of the space and if this is what the community wants. • When doing community outreach make sure to include all stakeholders. Also use the video to show why this is important. • As this moves forward make sure to the design is sustainable. Examples LEED certification, micro grids, battery storage. 4. PRESENTATIONS 4.a CITY MANAGER REPORT City Manager Derek Johnson provided a report on upcoming projects and a status update on COVID-19. 4.b FAMILY COURT AWARENESS MONTH PROCLAMATION Mayor Stewart proclaimed the month of November as "Family Court Awareness Month" and presented a proclamation to Tina Swithin on behalf of One Mom's Journey. 4.c ARBOR DAY PROCLAMATION Mayor Stewart proclaimed November 6, 2021 as "Arbor Day" and presented a proclamation to Greg Cruce on behalf of the City's Urban Forestry Division. 5. Ayes (5): Council Member Marx, Council Member Pease, Council Member Shoresman, Vice Mayor Christianson, and Mayor Stewart CARRIED (5 to 0) 6.a WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES Waive reading of all resolutions and ordinances as appropriate. 6.b MINUTES REVIEW - OCTOBER 19, 2021 COUNCIL MINUTES Approve the minutes of the City Council meeting held on October 19, 2021. 6.c REAFFIRM RESOLUTION NO. 11278 AUTHORIZING CONTINUING TO MEET VIRTUALLY PURSUANT TO ASSEMBLY BILL 361 Reaffirm Resolution No. 11278 (2021 Series) entitled, "A Resolution of the City of San Luis Obispo, California, proclaiming the continued need to meet by teleconference pursuant to Government Code Section 54953(e)." 6.d APPROVE THE SCHEDULE OF CITY COUNCIL MEETINGS FOR 2022 Adopt the proposed 2022 Regular City Council Meeting Schedule with meetings normally held the first and third Tuesday of every month, with the following exceptions: 1. Reschedule the Regular City Council meeting of January 4 to January 11, 2022; and 2. Reschedule the Regular City Council Meeting of November 1, 2022, to November 8, 2022; and 3. Cancel the Regular City Council meetings of August 2, and December 20, 2022. 5 7. PUBLIC HEARING AND BUSINESS ITEMS 7.a ANNUAL PUBLIC HEARING FOR THE TOURISM BUSINESS IMPROVEMENT DISTRICT (Estimated Time: 20 minutes) Deputy City Manager Greg Hermann, Tourism Manager Molly Cano and TBID Chair John Conner, provided an in-depth staff report and responded to Council questions. Conduct a public hearing to receive testimony regarding the City Council’s intention to continue the San Luis Obispo Tourism Business Improvement District and determine whether a legally sufficient protest is made; and 2. Adopt Resolution No. 11286 (2021 Series) entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, declaring the Basis for and the Levy of the Assessment for the San Luis Obispo Tourism Business Improvement District and Affirming the Establishment of the District.” Ayes (5): Council Member Marx, Council Member Pease, Council Member Shoresman, Vice Mayor Christianson, and Mayor Stewart CARRIED (5 to 0) 7.b INTRODUCE AN ORDINANCE AMENDING TITLE 17 (ZONING REGULATIONS) OF THE MUNICIPAL CODE ADDING OBJECTIVE DESIGN STANDARDS CHAPTER 17.69 FOR QUALIFYING RESIDENTIAL PROJECTS (Estimated Time: 60 minutes) Community Development Director Michael Condron and Associate Planner Rachel Cohen provided an in-depth staff report and responded to Council questions. Public Comments: Molly Kern ---End of Public Comment-- 6 Motion By Council Member Pease Second By Vice Mayor Christianson Introduce Ordinance No. 1703 (2021 Series) entitled, "An Ordinance of the City Council of the City of San Luis Obispo, California, amending Title 17 (Zoning Regulations) of the Municipal Code with Objective Design Standards for qualifying residential projects with an exemption from Environmental Review (CEQA)." with the following changes: Page 5 B. Building Details 11. Residential buildings shall include windows that overlook outdoor public or shared spaces. Page 8 F. Landscaping 3. Landscaping areas shall consist of any combination of the following: living trees, groundcover, shrubbery, turf, and related natural features such as rock, stone, or bark chips to adequately cover all designated landscaping areas. 4. Landscaping shall be top-dressed with three (3) inches of mulch. Mulch shall be maintained within planted areas and shall not migrate onto hard surfaces, such as sidewalks, patios, and parking lots. 5. Any trees removed from the residential project site shall be: a. Replaced on-site with a 1:1 replanting with a minimum 15-gallon sized tree. Required street trees may be counted as part of the replacement plantings; or b. Replaced off-site at a 2:1 ratio by: 1) planting trees off-site on private property within the City limits with a minimum 15-gallon sized tree, or 2) planting street trees off-site (only after required street trees for the project site has been satisfied). c. Any street trees planted as a replacement shall be a minimum 24-inch box size. 7 Page 14 C. Bicycle Parking Areas 4. Short-term bicycle tacks shall be up-down peak style racks. Continue to look at the use of corten steel paneling on building in the downtown and when it is appropriate to have parking areas in the front of buildings. Ayes (5): Council Member Marx, Council Member Pease, Council Member Shoresman, Vice Mayor Christianson, and Mayor Stewart CARRIED (5 to 0) 7.c INTRODUCE AN ORDINANCE TO REVISE THE WATER AND WASTEWATER CHAPTERS OF MUNICIPAL CODE TITLE 13, PUBLIC SERVICES (Estimated Time: 30 minutes) Utilities Director Aaron Floyd and Deputy Director of Engineering and Planning Miguel Barcenas provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment--- Motion By Council Member Pease Second By Council Member Marx Introduce Ordinance No. 1704 (2021 Series) entitled, “An Ordinance of the City Council of the City of San Luis Obispo, California, amending Title 13, Sections 13.04, 13.06, 13.07, 13.08, and 13.24 of the San Luis Obispo Municipal Code” with the following changes: SECTION 10: Page 7: F. The use of a hose equipped with a shutoff nozzle for hand watering of mature, established trees will be exempt from irrigation restrictions. 8 SECTION 18: Page 10 Replace competent person with "a person experience in lateral inspection" Ayes (5): Council Member Marx, Council Member Pease, Council Member Shoresman, Vice Mayor Christianson, and Mayor Stewart CARRIED (5 to 0) 8. LIAISON REPORTS AND COMMUNICATIONS Council Member Pease indicated she took mental health course provided by TMHA. Council Member Marx updated Council on IWMA. Mayor Stewart updated the Council on the recent CAPSLO meeting. 9. ADJOURNMENT The meeting was adjourned at 10:30 p.m. The City Council will hold a Special Meeting on November 9, 2021 at 6:00 p.m. via teleconference.
