HomeMy WebLinkAboutR-11356 authorizing Grant Applications for Department of Alcoholic Beverage Control-Office of Traffic Safety for programs focusing on Underage DrinkingR 11356 RESOLUTION NO. 11356 (2022 SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO, CALIFORNIA, AUTHORIZING GRANT APPLICATIONS FOR FUNDING PROVIDED THROUGH THE DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL – OFFICE OF TRAFFIC SAFETY THROUGH THE NATIONAL HIGHWAY TRAFFIC SAFETY ADMINISTRATION TO INCREASE EDUCATION AND ENFORCEMENT PROGRAMS FOCUSING ON UNDERAGE DRINKING AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL RELATED GRANT DOCUMENTS WHEREAS, the San Luis Obispo Police Department (the “Police Department”) through the City of San Luis Obispo desires to undertake programs to increase education and enforcement to deter underage drinking; and WHEREAS, the Police Department submitted a grant through the Department of Alcoholic Beverage Control (ABC), sponsored by the Office of Traffic Safety (OTS), through the National Highway Traffic Safety Administration (NHTSA), in September 2022 to conduct education and enforcement activities to deter underage drinking; and WHEREAS, on August 2, 2022, the Police Department was notified of the ABC- OTS Local Enforcement Grant opportunity in an award amount not to exceed $50,000. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. The Chief of Police or his designee is hereby authorized to submit grant applications consistent with program requirements to pursue a grant administered by ABC-OTS, including the Police Department's September 2022 application. SECTION 2. The City Manager of the City of San Luis Obispo is authorized to execute all grant related documents, including the State of California Standard Agreement, any extensions or amendments thereof, and any subsequent contract with the State in relation to the ABC-OTS Local Enforcement grant administered by ABC. SECTION 3. Authorize Finance Director to make the necessary budget adjustments upon the award of the grant. SECTION 4. The City agrees that any liability arising out of the performance of this contract, including civil court actions for damages, shall be the responsibility of the grant recipient and the authorizing agency and acknowledges that the State of California and ABC disclaim responsibility for any such liability. Grant funds received hereunder shall not be used to supplant expenditures controlled by this body. SECTION 6. This award is not subject to local hiring freezes.
