HomeMy WebLinkAbout08-20-2013 b1 appointment to election campaign review committee FROM: Michael Codron, Assistant City Manager Christine Dietrick, City Attorney Prepared By: Sheryll Schroeder, Interim City Clerk SUBJECT: APPOINTMENTS TO ELECTION CAMPAIGN REGULATIONS REVIEW COMMITTEE RECOMMENDATION Appoint at least five citizens to the Election Campaign Regulations Review Committee. DISCUSSION Chapter 2.40 of the City’s Municipal Code establishes election campaign regulations which must be followed by City Council candidates, political action committees, campaign treasurers, and others involved with City elections. Pursuant to Section 2.40.150, “Expiration of provisions: Unless readopted, this chapter shall expire on June 30, 2014.” This section of the Municipal Code requires the City Council to readopt Chapter 2.40 or else the section will expire and not be in effect for the November 2014 General Election. Section 2.40.140 also sets forth general guidelines regarding the appointment of the Council study committee: “At least nine months prior to the expiration of this chapter, the council shall appoint a committee of at least five citizens to study the efficacy of this chapter. The committee shall complete its deliberations and report its findings to the city council on or before January 31, 2014.” Thus, Council must make committee appointments no later than September 30, 2013 and the committee must complete its work and make recommendations to Council prior to January 31, 2014. As a Council appointed committee, the Elections Campaign Regulations Committee will be a Brown Act body subject to the same agenda and open meeting requirements as other City advisory bodies. Past Practice Past practice has been for Council Members to nominate citizens to be appointed to this committee. Council Members were asked to submit names to the City Clerk of potential nominees to serve on the Election Campaign Regulations Committee. The Council Liaison Subcommittee, which has been comprised of the Mayor and Vice Mayor, would then work with the City Clerk to recruit five Meeting Date Item Number Aug. 20, 2013 B1 - 1 Council Agenda Report – Appointments to Election Campaign Regulations Committee Page 2 or more individuals from those nominations. The Subcommittee's recommendations would then be presented to the full Council for consideration and appointment. Past membership of the Election Campaign Regulations Review Committee has included: 2001 2005 2009 Trish Avery Glenna Deane Dovey John Ewan Amy Shore Matt Mackey Ty Griffin Sandi Sigurdson Pierre Rademaker Christine Mulholland John Spatafore Ken Schwartz Pam Voges-Ruggles Chuck Stevenson Dodie Williams Dodie Williams Recommended Committee Members Council Members were asked to submit names of individuals to the City Clerk to assist in identifying potentially interested nominees to serve on the Election Campaign Regulations Committee. The City Clerk confirmed that the individuals identified by Council members, as well as two additional applicants, were interested in serving. Two applicants presented by Mayor Marx expressed they were unable to serve as this time. The following names were submitted as having an interest in serving: Mayor Marx Ty Griffin Allen Settle Dave Romero Pierre Rademacher Vice Mayor Smith Wilda Rosene Council Member Ashbaugh Bob Hanbrom Council Member Carpenter Andrea Devitt Council Member Christianson Jeri Carroll Applications received Kevin Rice William Powers, Jr. A subcommittee of the Mayor and Vice Mayor reviewed the list of potential nominees/applicants and are recommending the following appointments: Allen Settle Former Mayor Ty Griffin Previously served on this Committee, Treasurer for an election committee Wilda Rosene Served as Treasurer for an election committee Andrea Devitt Currently EOPS Counselor and served on Committee on Political Education Jeri Carroll Served as Treasurer for an election committee Staff Support The City Clerk and City Attorney will provide staff support to the committee.
