AGREEMENT
THIS AGREEMENT, executed this 5th day of December 31
1978 by and between Bocce Ball Associates, hereinafter called Grantors,
and the CITY OF SAN LUIS OBISPO.
1. Grantors shall convey to the City 371 square feet
'(0.0085 acres), more or less, lying along Johnson
Avenue as shown on the attached sketch.
2. In consideration of the deed to the property for
street widening_, City agrees to remove existing
driveway ramp, sidewalk, curb and gutter and to
construct sidewalk, curb and gutter at the new line..
3. City, w l provide all necessary engineering, relocate
utilities and drainage improvements as necessary,
and;'p'ave out the street to the new gutter.

SITUATION
'An agreement and grant deed were accepted by the Council on 11/8/78 per
Resolution No. 3711. However, grantors had transferred said property from
Kuden and Ready to Bocce Ball Associates.
STAFF POSITION
Recommend acceptance of these revised documents and rescind Resolution No. 3711
(1978) as per attached new Resolution.

SUBJECT: Johnson Avenue Street Widening Agreement & Grant Deed (Kuden & Ready)
SITUATION
Property owners offer to grant the city necessary right -of -way to accommodate
street widening provided the city installs the new improvements.
STAFF POSITION
Recommend approval of -.agreement, acceptance of deed and instuct city clerk
to record the deed.
In accordance with past policy and city codes, staff prepared the attached
agreement and grant deed in order to further widen a section of Johnson Avenue
(northeasterly side) between Marsh Street and Pacific Street. This widening
is in conformance with the current widening between Marsh and Higuera and the
widening in front of Ready Realty.at the corner. of Marsh & Johnson some years
ago. Although there is no adopted plan line along this reach of Johnson Avenue
it is recommended that the widening be done to accommodate the traffic.
The widening (see attached sketch) does not extend all the way to Pacific Street
due to the fact that 2 large acacia trees would need to be removed. Furthermore,
one of the property owners has verbally agreed to the future dedication of the
remainder of his frontage. However, he felt the widening was a sensitive issue
with regards to the neighborhood and would rather prolong the rest of the work
to a time when the changes at the site become more accepted. The work to be done
under this agreement would simply facilitate the turns into their parking lot
and /or right turns onto Marsh Street.
