acknowledged LEE JAMES WALTERS, an unmarried man, and THOMAS R.

2.FOR VALUABLE CONSIDERATION, receipt of which is hereby
acknowledged MARTIN POLIN and SUSAN POLIN, husband and wife, hereby
remise, release and forever quitclaim to LEE JAMES WALTERS, an
unmarried man, and THOMAS R. PATTERSON and TERI PATTERSON, husband
and wife; a non-exclusive easement in, over and across that certain
parcel in the City of San Luis Obispo, County of San Luis Obispo,
State of California, described as follows:
The wouthwesterly two feet of the northwesterly.one hundred
feet of lot 13;in Block 13'of the Central.Addition to the City of
San Luis Obispo, California, the said lot being -San Luis Obispo
County assessor's parcel number 01- 233 -13. "
3. It is understood that MARTIN POLIN etum, herein known as-
second parties, are exchanging the said two foot wide easement and
the land they own between the side lines of the said lot 12
extended south - easterly, with WALTERS and PATTERSON etux, herein
known as first parties, for the above described 14' wide easement
herein deeded to them. The said land to be so deeded shall be
deeded by quitclaim deed in an instrument separate from this
instrument.
4. The map of the said two easements attached hereto and
11' +initialed by the parties, forming a common driveway, is hereby
.made a part hereof. The easements are not necessarily drawn to

scale.
5. The two above described non - exclusive easements are for
ingress and egress for vehicular and foot traffic of all lawful
kinds in a common driveway, including the right to back up and
turn and do all things necessary or convenient to parking vehicles
adjoining, or beyond, the said easements and bringing vehicles.to
and from Marsh. Street in San Luis Obispo, California. If the
property between the rear of the Polin lot and San Luis Creek is
added to the Polin lot, or has the same owners, the acquired
property may also be served by the said common driveway and
easements.
6, Each party will pay his own real property taxes, and
assessments as if no easements had been given or exchanged.
7. The property owners, first parties and second parties,
after the initial blacktopping, will be jointly responsible for the
improvement and maintenance of all parts of the common- access
driveway sixteen feet wide and one hundred feet long, beginning at
Marsh Street; provided, however, when the paving.is first done,
first parties shall pay for the fourteen foot by one hundred foot
strip on their property and second parties shall pay for the two
foot by one hundred foot strip on their property. The parties are
jointly responsible for the said improvement.insofar as the City
of San Luis Obispo is concerned, anything that may appear herein
to the contrary, notwithstanding.
8. All parking on.the commonly used.portions.of the driveway
is prohibited.
9. Any affected property owner may avail himself of the
vehicle.removing authority granted private property owners in Section
22658 of the California Vehicle Code when any vehicle is parked in
the common - access driveway so as to impede, restrict, or prevent
entry or access to a parcel or the parcels served thereby;
10. The property.owners agree to hold the city harmless from
all claims of damages or liability arising from any action to tow
away vehicles pursuant to item nine:- _immediately above.-

11. If the easement or covenant is abandoned or dissolved, each
lot previously served by the common- access driveway shall be
provided with standard access as required by the city regulations.
In witness whereof, the parties have executed these quitclaim
deeds and easement agreements one u.ly`_24 - ; 1980.
