Tri- Counties Blood Bank, Inc., as Grantors, hereby grant to the CITY
OF SAN LUIS OBISPO, a Municipal Corporation, as Grantee, the following
easement.for sewer installation and maintenance in the City of San Luis
Obispo, County of San Luis Obispo, State of California, to wit:
PARCEL A
The southerly six (6) feet of Lots 101 and 102 of the Mt. Pleasanton
Addition to the City of San Luis Obispo in the City of San Luis Obispo,
County of San Luis Obispo, State of California, according to the Map
recorded November 7, 1923 in Book 3, Page 34 of Maps in the Office of
the County Recorder of Said County excepting therefrom from said.Lot 102
that portion conveyed-to the State of California by Deed recorded
August 1, 1967 in Book 1443, Page 616 and 619 of Official Records of
Said County Recorder.

That portion of the Southwest quarter of the Northwest quarter of
Section 26 and of the Southeast quarter.of the Northeast quarter of
Section 27, Township 30 South, Range.12 East, Mt. Diablo Base and
Meridian, according to the official plat or plats of the survey of said
lands returned to the General Land Office by the Surveyor General,
described as follows;
BEGINNING at the Southwest corner of Lot 101, Mt. Pleasanton Square
Addition to the City of San Luis Obispo, in the City of San Luis
Obispo, County of San,Luis Obispo, State of',California, according to
a map recorded November 7, 1923 in Book 3, at Page 34 of Maps; thence
North 890 East 91.28 feet, more or less, along the South boundary of
Lots 101 and 102 of said Mt. Pleasanton Square Addition to a point
on the Southwesterly line of the property conveyed to the State of
California, by deed dated June 25, 1941 and recorded July 11, 1941
in Book 303, at Page 55 of Official Records; thence South 35044'30"
East 7.39 feet along said Southwesterly line of property conveyed
to the State of.' California; thence South 89949' West 95.60 feet,
more or less, to a Southerly prolongation of the Westerly lot line
of said Lot 101; thence North along said extension of said lot line
of said Lot 101, 6.00 feet., more or less, to the POINT OF BEGINNING.
PARCEL C
BEGINNING at the Northeasterly corner of the parcel of land conveyed
to Rudolf A. Poe by deed recorded January 26, 1956 in Volume 833,
Page 599 of Official Records, records of said County; thence North
35044'30" West 4.92 feet; thence North 890 East 5.50 feet.; thence from
a tangent that bears South 200.11'56" East Southeasterly along a curve
to the left'with a radius of 540 feet through an angle of 1008'15"
for an arc distance of 10.72 feet; thence South 890 West 2.50 feet,
more or less, to the Southwesterly line of the property conveyed to
the State of California by deed recorded July 11., 1941 in Volume 303,
Page 55 of Official Records, Records of said County; thence along
last said line North 35044'30" West 7.39 feet to the POINT OF BEGINNING.
The total easement containing 0.022 Acres, more or less.

to the CITY OF SAN LUIS OBISPO, a Political Corporation,, is hereby
accepted by the undersigned officer on behalf of the City Council
pursuant to authority conferred by Resolution No. 549 (1959 Series),
recorded May 26, 1959, in Volume 1002., Official Records, Page 292,
San Luis Obispo County, California, and the Grantee consents to
recordation thereof by its duly authorized officer of his agent.

AGREEMENT

This agreement, by and between THE CITY OF SAN LUIS OBISPO, a municipal
corporation, hereinafter called "City ", and Tr; -.o,n ; s Blood Bank
and
Calitornia, hereinafter called "Owners ".
WITNESSETH
WHEREAS there has been called to the City's attention a poor condition
of the sanitary sewerliin the back yards of the properties in the 800 block
of Murray Street; and
WHEREAS, the City has plans to correct the situation by the installation
of new sewer lines with adequate slope and proper standards, and;
WHEREAS, it is necessary to have access to the area of construction.
NOW THEREFORE, the parties hereto mutually agree as follows:
1. Owners agree that the City may, at its sole cost, reconstruct the
.sewerline along the rear of their lots as shown on the plans for
City Project D -24, Murray Sewerline (Santa Rosa - Chorro).
2. The City agrees to pay the full cost for the work including
engineering, surveying, inspection, labor and materials.
3. the City agrees to connect the laterals now connected to the old
sewer main from the subject properties into the new sewer main.
4. The City agrees to restore all landscaping and fencing removed or
damaged by the installation of the sewerline to the original condition.
5. The owner agrees to sign an easement for ten foot wide easement
for construction and maintenance of the new sewer main and agrees
to allow access for-'the expedient construction and maintenance
of the sewerline.

6. The City intends to construct the sewerline in the Spring of 1982,
'however, in the event that the City does not construct this sewerline
for any reason within three years, this agreement shall become.null
and void.

Dear Mr.. Herrera:
As indicated in our telephone conversation of this afternoon, the enclosed
Deed of Easement between the Blood Bank and the City of San Luis Obispo
was inadvertently notarized as "individuals" rather than corporate officers
acknowledging for the corporation.
Also enclosed is the prior signature page for your disposal. The remaining
agreement and maps are on file at the City Clerk's office awaiting the
signatures required and will be reincorporated with the.Deed of Easement
upon its return in the enclosed, self- addressed, postage -paid envelope.
If you should have,any questions with regard to this matter, please feel
