EASEMENT
THE CITY OF SAN LUIS OBISPO, a municipal corporation of the State of
California,
first party, hereby grants to PACIFIC GAS AND ELECTRIC COMPANY, a California
corporation,
second party, the right from time to time to construct, install, inspect, maintain, replace,
remove, and use facilities of the type hereinafter specified, together with a right of way
therefor, within a strip or parcel of land or along a route as hereinafter set forth, and also
ingress thereto and egress therefrom, over and across the lands situate in the
County of San Luis Obispo State of California, described
as follows:

The parcel of land, situate in Rancho Potrero de San Luis Obispo,
described in the deed from Maria Alberti to The City of San Luis
Obispo, a municipal corporation of the State of California,
dated December 21, 1950 and recorded in Volume 594 of Official
Records at page 71, San Luis Obispo County Records.
Said facilities shall consist of:
Such poles, aerial wires, cables, electrical conductors with associated .
crossarms, braces, transformers, anchors, guy wires and cables, fixtures
and appurtenances, as second party deems necessary located within the strip
of land described as follows:
A strip of land of the uniform width of 10 feet lying 5 feet
on each side of the line which begins at a pole in an existing
line of poles of Pacific Gas and Electric Company within said
lands and runs thence north 21 °15' east 85 feet, more or less,
to a point in the northeasterly boundary line of said lands;
said point of beginning bears north 63 °10' east 86.6 feet distant
from a found 6 inch x 6 inch concrete monument tagged RE 1880
accepted as marking the most westerly corner of said lands.

First party further grants to second party the right to assign to another
public utility as defined in Section 216 of the California Public Utilities
Code the right to install, inspect., maintain, replace, remove and use pole
line facilities within said strip (including ingress thereto and egress
therefrom).

Second party shall also have the right from time to time to trim and to cut down and clear away any and all trees
and brush now or hereafter on said strip or along said line and shall have the further right from time to time to trim
and to cut down and clear away any trees on either side of said strip or of said line which now or hereafter in the
opinion of second party may be a hazard to the facilities installed hereunder by reason of the danger of falling
thereon, provided, however, that all trees which second party is hereby authorized to cut and remove, if valuable
for timber or wood, shall continue to be the property of first party, but all tops, lops and brush shall be burned or
removed by second party.
The provisions hereof shall inure to the benefit of and bind the successors and assigns of the respective
parties hereto.

A RESOLUTION OF THE COUNCIL OF THE CITY Or SAN
LUIS 0BISPO APPROVING AN. AGREEMENT BETWEEN THE
CITY AND PACIFIC GAS & ELECTRIC (PG &E) TO GRANT
PG &E AN EASEMENT ACROSS ITS HYDRO ELECTRIC PLANT
PROPERTY TO PROVIDE ELECTRIC SERVICE TO PROPERTY
OF JAMES FILBIN LOCATED ON STENNER CREEK ROAD
BE IT RESOLVED by the Council of-the City of San Luis Obispo as follows:
SECTION 1. That certain agreement, attached hereto marked. Exhibit "A"
and incorporated herein by reference, between the City of San Luis Obispo and
PACIFIC GAS & ELECTRIC COMPANY
is hereby approved and the Mayor is authorized to execute the same.
SECTION 2. The City Clerk shall furnish a copy of this resolution and
a copy of the executed agreement approved by it to: PACIFIC GAS & ELECTRIC:

SUBJECT: Grant of Easement for P.G.$E. power line connection for
Mr. James Filbin
CAD RECOMMENDATION:
Approve Resolution granting the requested easement
BACKGROUND:
Mr. Filbin owns the property adjacent to the Old mater Treatment Plant across
which there exists an easement covering the existing 12" penstock and another
easement covering the existing "Army Line ". Mr. Filbin plans to build a
residence on.his property, and the P.G.$E. Company, in order to bring. him electrical
service, proposes to cross a 'short piece of City property to make that connection
on an existing power pole. As this easement should pose no problems in our
operations at that site and since Mr. Filbin, in turn, concurs that the installation
of our proposed 20" penstock together with the underground signal cable to be
concurrently installed will both be within the limitations of the existing pipeline
easements, we recommend the granting of the P.G.$E. easement.
FISCAL IMPACT:
None.
CONCURRENCE:"
The City Attorney's office has concurred and has approved the proposed P.G.&E.
easement.
RECOMMENDATION:
It is staff recommendation that this mutually beneficial arrangement be implemented
by the granting of the requested P.G.$E. easement.
