CITY OF SAN LUIS OBISPO, a public body of the State of California,
first party, hereby grants to PACIFIC GAS AND ELECTRIC COMPANY, a California
corporation,
second party, the right from time to time to construct, install, inspect,
maintain, .replace, remove and use electrical facilities of the type here-
inafter specified, together with a right of way therefor, within a strip or
parcel of land or along a route as.hereinafter set forth, and also ingress
thereto and egress therefrom, over and across the lands situate in 'the City of
San Luis Obispo, County of San Luis Obispo, State of California, described as
follows:

The strip of land of the uniform width of 50 feet described and
designated Parcel 1 in the Final Order of Condemnation dated
March 5, 1954 and recorded in Volume 748 of Official Records at
page 17,2, San Luis Obispo County Records.
Said electrical facilities shall consist of:
Such underground conduits.,, pipes, manholes, service boxes, wires, cables, and
electrical conductors;,abovegiound marker posts, risers, and service
pedestals; underground and aboveground '-switches, fuses, terminals, and
transformers with associated . concrete pads; and fixtures and appurtenances
necessary.to,any and all thereof, as second,party deems necessary located
within said lands.
In the event any�df the facilities installed hereunder interfere with future
operations of first party on said lands second party shall, within 90 days
after receiving written notice from first party so to do, at second party's
own cost and expense, remove and relocate in a location mutually agreed
upon on lands owned by first party such of said facilities so interfering;
provided, however, that first party at the same time grant to second party all
rights second party may deem necessary to effect said relocation.

RESOLUTION NO.5772 (1985 SERIES)
A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS
OBISPO GRANTING AN EASEMENT TO PACIFIC GAS & ELECTRIC COMPANY
BE IT RESOLVED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. That certain document granting an easement to
P.G. &E., attached hereto marked Exhibit A, and incorporated herein by
reference, is hereby approved, and the Mayor is authorized to execute
the same.
SECTION 2. The City Clerk shall transmit one copy to P.G. &E.
On motion of Councilman Dunin , seconded by Councilman Griffin
and on the following roll call vote:
AYES: Councilmembers Dunin, Griffin, Dovey and Vice -Mayor Settle
NOES: None
ABSENT: Mayor Billig
the foregoing Resolution was passed and adopted this 20th_ day of

At its meeting of August 20, 1985, the San Luis Obispo City Council took
action to adopt Resolution No. 5772 (attached) which granted an easement
to your company for a power transmission line traversing city property at
Laguna Lake Park.
Please forward a recorded copy of the easement to this office when it is
completed.

Modification of P.G. &E. Easement Traversing Laguna Lake Park
CAD RECOMMENDATION:
Adopt Resolution Authorizing Mayor to Sign P.G. &E. Easement
at Laguna Lake Park
BACKGROUND:
In 1954, P.G. &E. acquired an easement for a power transmission line
to traverse City property at Laguna Lake Park. In order to better
serve the western part of San Luis Obispo, and to provide service to
the new San Luis Obispo Mall, P.G. &E. now finds it necessary to
obtain underground easement rights along the transmission line
easement
The City Attorney's office and the Public Works Department have been
negotiating with P.G. &E. for some months and have arrived at an
easement document which is mutually acceptable. City staff has not
requested compensation from P.G. &E., but has required that P.G. &E.
relocate underground facilities at its cost if these facilities
interfere with future operations of the City.
FISCAL IMPACT
None.
RECOMMENDATION
Adopt Resolution authorizing Mayor to sign P.G. &E
Lake Park.

Per your conversation of April 16 with Mrs. Claire Mastin, Pacific Gas and
Electric Company is attempting to improve electric service reliability to the
western part of San Luis Obispo, as well as provide service to the new San
Luis Obispo Mall. The proposed facilities would be installed underground
within the existing transmission line easement on Laguna Lake Park. In order
to do this, we would need to acquire an underground easement from the City of
San Luis Obisp.o.- The exact location of the easement across City'property is
shown colored in red on the attached map.
Please review the attached document and, if it meets with your approval, have
the signature page of the copy marked "PG &E Co. Copy" signed by the
appropriate City official(s), have all signatures notarized using the attached
jurat, and return the signed document in the envelope provided. The copy
