HomeMy WebLinkAbout8377-8380® C� RESOLUTION NO. 838�1994 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO MAKING AN APPOINTMENT TO FILL THE OFFICE OF COUNCIL MEMBER OF THE CITY OF SAN LUIS OBISPO, TO FILL THE VACANCY CREATED BY THE ELECTION OF ALLEN K. SETTLE AS MAYOR WHEREAS, Allen K. Settle was duly elected to the Office of Council Member of the City of San Luis Obispo at the November 1992 regular municipal election, with a term to expire December 1, 1996; and WHEREAS, Allen K Settle was duly elected to the Office of Mayor of the City of San Luis Obispo at the November 1994 regular municipal election, and has therefore resigned as Council Member; and WHEREAS, qualified electors have. been nominated to this Council for appointment to the Office of Council Member to fill the vacancy created by Allen K Settle's election as Mayor, for the balance of the unexpired term, which is December 1, 1996, under the terms of City of San Luis Obispo Charter Section 406; and WHEREAS, this Council has considered and reviewed the applicants; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. The Council hereby appoints Kathy smith to the office of Council Member of the City of San Luis Obispo, to fill the vacancy created by Allen Settle's election as Mayor, for the remainder of Allen K Settle's unexpired term, to wit, until noon, December 1, 1996. SECTION 2. This appointment December 13, 1994 shall become effective on R -8380 Council On motion of Mayor Settle , seconded by Member Williams , and on the following roll call vote: AYES: Mayor Settle, Council Members Williams, Roalman, and Vice Mayor Romero NOES: None ABSENT: None The foregoing Resolution was passed and adopted this 13th day of -December, 1994. I 'Clerk Didne R. &Tadwell APPROVED AS TO FORM: �� /i' • rlo$ensen (`G `a\ RESOLUTION NO. 8379 (1994 SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LUIS OBISPO DECLARING THE RESULTS OF THE GENERAL ELECTION HELD TUESDAY, NOVEMBER 8, 1994 WHEREAS, a General Municipal Election was held in the City of San Luis Obispo on the 8th day of November 1994, which. election was duly held and conducted in the manner provided by the Charter of the City of San Luis Obispo, and as provided by law for the purpose of voting for the election of a Mayor and two Council Members. WHEREAS, under the provisions of City Council resolution No. 8305 (1994 Series), the Board of Supervisors was authorized to perform the official canvass of the November 8, 1994 General Municipal Election pursuant to the election laws of the State of California; and, WHEREAS, a statement of the results of said election has been duly entered by the City Clerk in the official records of the City. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of San Luis Obispo that: SECTION 1. The whole number of votes cast in said election within the City of San Luis Obispo was' 16,947. SECTION 2. The names of the persons voted for, the office for which each person was voted for, and the number of votes given at each precinct to each person, are shown by the tabulation of votes marked Exhibit "A" attached hereto, and by this reference incorporated as though fully set forth. SECTION 3. ALLEN K. SETTLE, the candidate receiving the highest number of votes cast at said election for the Office of Mayor, is hereby declared elected to such office: for the term prescribed in the City Charter. SECTION 4. BILL ROALMAN AND DODIE WILLIAMS, the two candidates receiving the highest number of votes cast at said election for the Office of City Council Member, are and each of them is hereby declared elected to such office for the term prescribed by the City Charter. The City Clerk is hereby directed to sign and deliver to each of said Allen K Settle, Bill Roalman and Dodie Williams, a certificate of election certifying to his /her election to his /her respective office, as hereinbefore set forth. C RESOLUTION NO. 8378 (1994 SERIES) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO AUTHORIZING A CONTRIBUTION OF UP TO $29000 TO THE CENTRAL COAST CHAPTER OF THE AMERICAN INSTITUTE OF ARCHITECTS FOR THE "DESIGN CHARETTE FOR SAN LUIS OBISPO GATEWAYS" COMMUNITY PROJECT. WHEREAS, the Central Coast. Chapter of the American Institute of Architects ( "Chapter ") has proposed , a design " charette" or study to evaluate and make design recommendations on a major gateway to the City, namely the Los Osos Valley Road corridor south of Madonna Road; and WHEREAS, the City's General Plan policies encourage the aesthetic enhancement of major City gateways, and the City Council has identified Los Osos Valley Road between Madonna Road and State Highway 101 as an important gateway corridor in need of such a study and to defray costs; and WHEREAS, in consideration of the professional services offered for this community project, the Chapter has requested a donation of up to $2,000 from the City to support the study; and WHEREAS, Section 805 of the City Charter authorizes the City to contribute public funds to economic, promotional, environmental, cultural, or other agencies whose operations are unrelated to those of the City but who contribute largely to the City's quality of life; and WHEREAS, this City Council has considered the Chapter's requests and desires to contribute up to $2,000 for the purposes 'requested, based on the findings herein described; NOW THEREFORE BE IT RESOLVED by the Council of the City of San Luis Obispo as follows: SECTION 1. Findings. The Council finds that the requested $2,000 donation is justified because: L, The Chapter will provide professional design services through .a "Design Charette for San Luis Obispo Gateways ", generally as described in the attached letter from the Chapter, in consideration for said donation; and 2. The proposed Design Charette will enhance the City's quality of life by providing recommendations for actions to improve the appearance, function and safety of a major street corridor and entryway to the City; and 3. Said donation is an appropriate and reasonable use of public funds since; a) the value of the professional design services will exceed the requested donation; and b) this is the most appropriate and timely manner to allocate funds to support this community project. k- 8318 Council Resolution No. 8378 (1994 Series) Page 2 SECTION 2. CAO Authorization. The City Administrative Officer is hereby authorized to donate up to $2,000 to the Central Coast Chapter of the American Institute of Architects in connection with the proposed "Design Charette for San Luis Obispo Gateways" on a 1 :1 matching grant basis. Said funds are to be used to offset actual study costs and costs of preparing a useful work product for the Community. None ABSENT: None the foregoing Resolution was sed and adopted this 6th day of December, 1994. j� Mayor Allen Settle ATTEST: , i e Gladwell, Citl lerk APPROVED: Attachment: ■ Gateway Design Charette Proposal AIL.: gateway, apt. ✓�t,j �vv �C6 C 0 RESOLUTION NO. 8377 (1994 Series) A RESOLUTION OF THE COUNCIL OF THE CITY OF SAN LUIS OBISPO SUSPENDING RESOLUTIONS No. 8252 (SECTIONS 3.3.4 AND 3.3.5 OF THE MANUAL TITLED "COUNCIL POLICIES AND PROCEDURES ") AND RESOLUTION No. 4423 WHEREAS, the Council wishes to adopt alternate procedural rules for the appointment of the current Council vacancy to allow for a more flexible appointment process than that contained in Resolutions 8252 and 4423; a NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Luis Obispo hereby suspends Resolution No. 8252 (sections 3.3.4 and 3.3.5 of the manual titled, "Council Policies and Procedures ") and Resolution No. 4423 during.the period required to conduct an appointment process for the current Council vacancy; and BE IT RESOLVED by the City Council of the City of San Luis obispo that the following alternative procedure shall be substituted for Resolutions No. 8252 and 4423 during the period required to conduct an appointment process for the current Council vacancy: 1. Any citizen wishing to serve on the Council should be present at the Council meeting to verify that they would be willing to "serve, if appointed, and they are a resident of the City of San Luis Obispo and a registered voter.. 2. Each candidate will be given five minutes to make a presentation to Council. 3. Candidates are encouraged to. submit a written statement of 200 words or less by Monday, December 5th.
