May 11, 1992 MEMORANDUM TO: Pam Voges, City Clerk FROM: rry Kenny, Supervising Civil Engineer SUBJECT "Capitolio Way - Street Widening Deed Please have the attached deed accepted by the Mayor and recorded. It provides for the widening of the southerly half of the street in accordance with the established alignment. It is a require- ment of the Williams Bros. Shopping Center expansion which is being pursued. Although the widening is actually within unincorporated territory, it makes no sense to have this "sliver" of R/W dedicated to the County. This is approved by the County. Staff proposes to annex the new R/W separately, if the Broad Street Annexation doesn't materialize. Please send me a recorded copy. Shopping Center expansion, who indicated the following: 1. Their current plans are to construct an addition to the existing market building, which is not subject to the Co. Planning Commission approvals for the expansion. Presumably, they would have no requirement (under Co. rules) to install the widening improvements with this phase. 2. The property owner (Tri W Enterprises, Inc., Williams family members) and Vons are currently negotiating the details of the expansion, with the expectation to begin work within a couple months. Possible annexation is apparently one of the issues. In any case, they need to begin this phase within 4 months, under the County approval requirements. If for some reason the project doesn't proceed, this deed would allow the City to do minor interim widening to accommodate current traffic, particularly at the intersection with Broad. Widening is inevitable. It also becomes "of record" so that any possible future owners would have the benefit of disclosure of the widening offer. The dedication to the City was determined to be advisable (by joint resolution with County staff) since the existing street is within the City limits. Some years ago, the City annexed certain street rights of way (including Sacramento Way) to clarify which agency had jurisdiction for maintenance and accident /emergency purposes.
