CALL TO ORDER A Regular Meeting of the San Luis Obispo Planning Commission was called to order on February 14, 2024 at 6:00 p.m. in the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo, by Chair Munoz-Morris. 2. CONSENT 3.a CONSIDERATION OF MINUTES - JANUARY 24, 2024 PLANNING COMMISSION MINUTES Motion By Commissioner Jorgensen Second By Commissioner Houghton To approve the Planning Commission Minutes of January 24, 2024. Ayes (4): Commissioner Houghton, Commissioner Jorgensen, Commissioner Tolle, and Chair Munoz-Morris (one vacant seat) Abstained (1): Vice Chair Cooley (abstentions count as a “yes” vote) Absent (1): Commissioner Kahn CARRIED (5 to 0) 2 4. PUBLIC HEARING 4.a 4240 AND 4280 EARTHWOOD LN, 165 CESSNA CT (ARCH-0197-2023) REVIEW OF THE MULTI-FAMILY HIGH DENSITY RESIDENTIAL (R-4) COMPONENT IN PHASE 3 OF THE AVILA RANCH DEVELOPMENT PLAN Contract Planner John Rickenbach and Associate Planner Callie Taylor presented the staff report and responded to Commission inquiries. Applicant representatives, Emily Ewer with Oasis Associates and Murray Duncan, the Project Architect, provided a brief overview of the project and responded to questions raised. Chair Munoz-Morris opened the Public Hearing Public Comment: None --End of Public Comment-- Chair Munoz-Morris closed Public Comment Motion By Commissioner Jorgensen Second By Vice Chair Cooley Adopt the Draft Resolution approving the proposed site design and layout for the R-4 component of the Avila Ranch Project to be developed within Phase 3 of the Avila Ranch Development Plan (ADRP), including a density bonus to increase the unit count of the R-4 component from 125 to 145 units, which includes 59 affordable units, and Addendum #2 to the ARDP Final EIR, and incorporating the recommendations of the Architectural Review Commission, including a fence height exception, sign exception, and a parking exception, based on findings and subject to the Conditions of Approval, with the following modification to Condition #16 to ensure consistency with the Affordable Housing Agreement: 16. The affordable housing units shall be constructed in proportion to and concurrently with the construction of the market rate units in the Avila Ranch Development Plan, as described in Section 5 of the Avila Ranch Phase 3 Affordable Housing Agreement. In the event the affordable housing developer fails to construct the 59 inclusionary affordable units on Lot 186 (Sendero), the obligation to provide the affordable units remains the responsibility of Avila Ranch to complete, as required by the Avila Ranch Development Agreement and subject to the satisfaction of the Community Development Director. 3 "A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF SAN LUIS OBISPO APPROVING SITE DESIGN AND LAYOUT FOR 145 RESIDENTIAL UNITS WITH A DENSITY BONUS, INCLUDING A TOTAL OF 59 AFFORDABLE UNITS WITHIN THE R-4 COMPONENT OF THE AVILA RANCH PROJECT TO BE DEVELOPED WITHIN PHASE 3 OF THE DEVELOPMENT PLAN, INCLUDING A FENCE HEIGHT EXCEPTION, SIGN EXCEPTION, PARKING EXCEPTION, AND FINDING THE PROJECT CONSISTENT WITH THE AVILA RANCH DEVELOPMENT PLAN AND AIRPORT AREA SPECIFIC PLAN, AND CERTIFIED 2017 FINAL ENVIRONMENTAL IMPACT REPORT FOR AVILA RANCH AND TWO FEIR ADDENDUMS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA); AS REPRESENTED IN THE AGENDA REPORT AND ATTACHMENTS DATED FEBRUARY 14, 2024, FOR THE PROJECT LOCATED AT 4240 AND 4280 EARTHWOOD LANE AND 165 CESSNA COURT (ARCH-0197-2023)" Ayes (5): Commissioner Houghton, Commissioner Jorgensen, Commissioner Tolle, Vice Chair Cooley, and Chair Munoz-Morris (one vacant seat) Absent (1): Commissioner Kahn CARRIED (5 to 0) 5. COMMENT AND DISCUSSION 5.a STAFF UPDATES AND AGENDA FORECAST Deputy Community Development Director Tyler Corey provided the following update of upcoming projects: • The February 28th Planning Commission meeting will be cancelled due to lack of items. • On March 13th, staff will present the General Plan Annual Report. • Currently, there are no items scheduled for the March 27th meeting. If necessary, a cancellation notice will be published one week in advance of the meeting date. Commissioner Jorgensen requested an update on the development project known as San Luis Square, located at 590 Marsh Street, which staff will provide at the March 13th meeting. Commissioner Houghton requested an update on "The Link" Project. 4 Commissioner Tolley requested an update on the Rotating Safe Parking Program. Deputy City Clerk Megan Wilbanks provided the following update on the Annual Advisory Body Recruitment: • This year, a total of 71 applicants applied for 21 positions across 14 advisory bodies. Comparatively, last year we only had 48 applicants for 34 positions. • The Planning Commission interviews are scheduled for February 26th. There are 2 positions open on the Planning Commission, with 6 applicants. Note, Commissioner Ringer recently resigned from her term. • Recommendations will go before the City Council for approval on March 19th. 6. ADJOURNMENT The meeting was adjourned at 7:22 p.m. The next Regular Meeting of the Planning Commission is scheduled for March 13, 2024 at 6:00 p.m. in the Council Chambers at City Hall, 990 Palm Street, San Luis Obispo.
