IMPROVEMENTS UPON REQUEST OF CITY

WHEREAS, the undersigned own certain real property commonly known as 4325 South
Higuera Street, and
WHEREAS, the undersigned have requested and been granted a temporary exception by
the City Public Works Director from the requirement of installing certain public improvements
on said property conditioned upon execution of a covenant by the property owner agreeing to
install said improvements at such time in the future as the city may request same.
NOW THEREFORE, in consideration of the granting of permission to temporarily defer
installation of certain public improvements consisting of: standard frontage improvements
(curbs, gutters, sidewalks and street trees), the undersigned owner(s) of property hereinafter
described hereby covenant with the City of San Luis Obispo to install all of said public
improvements without cost to City upon upon 120 days written notice from the City of San Luis
Obispo requesting that said improvements be installed.
Said property is located in the city of San Luis Obispo, County of San Luis Obispo, Sate
of California, and is described as follows:

This covenant shall run with the land and shall be binding upon the undersigned
owner(s), their heirs, executors, administrators, and assigns..

Township 31 South, Range 12 East, M.D.B. & M., filed for record in Book I at Page 53
of Record of Surveys, San Luis Obispo County Records, more particularly described in
the following documents;
One parcel being conveyed from Matthew Vear and wife, to Pacific Gas and Electric
Company, by grant deed dated May 26, 1954, as filed for record in Volume 759 at Page
363 of Official records in the office of the Recorder for San Luis Obispo County;
Another parcel being conveyed from John J. Azevedo and Etelvira S. Azevedo, husband
and wife, and Joseph T. Arsenio and Amy L. Arsenio, husband and wife, to Pacific Gas
and Electric Company, by grant deed dated June 7, 1954, as filed for record in Volume
